This article describes in candour, the journey of a novice researcher deciding which methodological approach to apply to her doctoral research. Eager to commence fieldwork, she considers five options: ethnography, phenomenology, biography, grounded theory, and case study. Upon discovering however, that none of the described alternatives satisfactorily fits with her envisaged mode of research, she embarks on an unplanned journey into more creative possibilities and solutions. It is a process that requires critical analysis both of methodological options and the self, (...) culminating in a mixed yet considered combination of phenomenology, grounded theory, and feminist research approaches. The journey ultimately proves to be a lesson for the student, not only in terms of research design but also how such decisions are inextricably linked with individual passions, fears, insecurities, and values. The recent decision of the House of Lords in Stack v. Dowden appears, at first sight, to endorse a new approach to the jointly owned family home. However, upon closer inspection, this proves to be something of an illusion: the new approach is remarkably similar to the traditional resulting trust in that it attaches more weight to financial payments than to other contributions. A further problem is that the disjunction between the reasoning of the judges and the actual result makes (...) it a difficult decision to apply to future cases. This case-note will consider the legal and social issues raised by the case and will argue that it has the potential to disadvantage women who do not make an equal financial contribution to the purchase of the home. Global policy transfer has become increasingly popular in recent years, and one recent example of such policy transfer is the England–China Teacher Exchange, which was initiated in 2014 with the explicit aim of raising attainment in maths in English primary schools by trialling concepts used in Shanghai schools, Shanghai rising to the top of the PISA rankings in 2009. However, as this paper will argue this is an overly simplistic attempt to transfer a policy between two wholly different contexts, the (...) lack of success of the policy seen in the very limited impact on student attainment in the participating schools. Whilst such policy transfer has increasingly taken place in the context of isomorphism and global pressures to adopt policy from high performing education systems, it is argued that policy needs to be explicitly reconsidered in terms of the local context it is being imported into if it is to be embedded in an effective manner, as well as rooted firmly in research. It is also argued that the England–China Teacher Exchange reflects a broader ideological focus in coalition government policy on the marketisation of education alongside the PISA rankings, rather any wider consideration of how this particular policy would drive up standards. In Ghaidan v. Godin-Mendoza [2004] U.K.H.L. 30, the U.K. House of Lords upheld the right of a man to succeed to the tenancy of his deceased same-sex partner as if he had been the husband or wife of the deceased. This note examines the five judgements delivered by the court and considers the implications of the decision. It argues that, within the context of family law, Mendoza was a welcome decision but an evolutionary dead-end. The case signals a more promising (...) approach to the development of human rights, but the appropriate use and scope of s.3 of the Human Rights Act 1998 remain somewhat unclear. (shrink)

I defend the normativity of meaning against recent objections by arguing for a new interpretation of the ‘ought’ relevant to meaning. Both critics and defenders of the normativity thesis have understood statements about how an expression ought to be used as either prescriptive or semantic. I propose an alternative view of the ‘ought’ as conveying the primitively normative attitudes speakers must adopt towards their uses if they are to use the expression with understanding.

Behavioral ethics research has focused predominantly on how the attributes of individuals influence their ethicality. Relatively neglected has been how macro-level factors such as the behavior of firms influence members’ ethicality. Researchers have noted specifically that we know little about how a firm’s CSR influences members’ behaviors. We seek to better merge these literatures and gain a deeper understanding of the role macro-level influences have on manager’s ethicality. Based on agency theory and social identity theory, we hypothesize that a company’s (...) commitment to CSR shifts managers’ focus away from self-interests toward the interests of the firm, bolstering resistance to temptation. We propose this occurs through self-categorization and collective identification processes. We conduct a 2 × 2 factorial experiment in which managers make expense decisions for a company with commitment to CSR either present or absent, and temptation either present or absent. Results indicate that under temptation, managers make decisions consistent with self-interest. More importantly, we find when commitment to CSR is present, managers are more likely to make ethical decisions in the presence of temptation. Overall, this research highlights the interactive role of two key contextual factors—temptation and firm CSR commitment—in influencing managers’ ethical decisions. While limited research has highlighted the positive effects that a firm’s CSR has on its employees’ attitudes, the current results demonstrate CSR’s effects on ethical behavior and imply that through conducting and communicating its CSR efforts internally, firms can in part limit the deleterious effects of temptation on managers’ decisions. Given its non-invasive nature, there is increasing interest in the use of transcutaneous vagus nerve stimulation across basic, translational and clinical research. Contemporaneously, tVNS can be achieved by stimulating either the auricular branch or the cervical bundle of the vagus nerve, referred to as transcutaneous auricular vagus nerve stimulation and transcutaneous cervical VNS, respectively. In order to advance the field in a systematic manner, studies using these technologies need to adequately report sufficient methodological detail to enable comparison of results between (...) studies, replication of studies, as well as enhancing study participant safety. We systematically reviewed the existing tVNS literature to evaluate current reporting practices. Based on this review, and consensus among participating authors, we propose a set of minimal reporting items to guide future tVNS studies. The suggested items address specific technical aspects of the device and stimulation parameters. We also cover general recommendations including inclusion and exclusion criteria for participants, outcome parameters and the detailed reporting of side effects. Furthermore, we review strategies used to identify the optimal stimulation parameters for a given research setting and summarize ongoing developments in animal research with potential implications for the application of tVNS in humans. Finally, we discuss the potential of tVNS in future research as well as the associated challenges across several disciplines in research and clinical practice. (shrink)

After 100+ years of studying syllogistic reasoning, what have we learned? Well, Riesterer and colleagues suggest that we have learned to throw away most of the data! If that seems like a bad idea to you then, be assured, that the authors agree with you. The sad fact is that the conclusion of “No Valid Conclusion” (NVC) is one of the most frequently selected responses in syllogistic reasoning but these “majority data” have been ignored by most researchers. Antimicrobial resistance is one of the greatest public health crises of our time. The natural biological process that causes microbes to become resistant to antimicrobial drugs presents a complex social challenge requiring more effective and sustainable management of the global antimicrobial commons—the common pool of effective antimicrobials. This special issue of Health Care Analysis explores the potential of two legal approaches—one long-term and one short-term—for managing the antimicrobial commons. The authors argue in favor of the “nonconciliation” (or “steadfast”) position concerning the problem of peer disagreement. Throughout the paper they place heavy emphasis on matters of phenomenology—on how things seem epistemically with respect to the net import of one’s available evidence vis-à-vis the disputed claim p, and on how such phenomenology is affected by the awareness that an interlocutor whom one initially regards as an epistemic peer disagrees with oneself about p. Central to the argument is a nested goal/sub-goal (...) hierarchy that the authors claim is inherent to the structure of epistemically responsible belief-formation: pursuing true beliefs by pursuing beliefs that are objectively likely given one’s total available evidence; pursuing this sub-goal by pursuing beliefs that are likely true (given that evidence) relative to one’s own deep epistemic sensibility; and pursuing this sub-sub-goal by forming beliefs in accordance with one’s own all-in, ultima facie, epistemic seemings. Interest in the intersection between bilingualism and cognitive control and accessibility to neuroimaging methods have resulted in numerous studies with a variety of interpretations of the bilingual cognitive advantage. Neurocomputational Emergentism (or Neuroemergentism for short) is a new framework for understanding this relationship between bilingualism and cognitive control. This framework considers Emergence, in which two small elements are recombined in an interactive manner, yielding a non-linear effect. Added to this is the notion that Emergence can be captured in neural systems (...) using computationally inspired models. This review poses that bilingualism and cognitive control, as examined through the Neuroemergentist framework, are interwoven through development and involve the non-linear growth of cognitive processing encompassing brain areas that combine and recombine, in symbiotic and parasitic ways, in order to handle more complex types of processing. The models that have sought to explain the neural substrates of bilingual cognitive differences will be discussed with a reinterpretation of the entire bilingual cognitive advantage within a Neuroemergentist framework incorporating its neural bases. It will conclude by discussing how this new Neuroemergentist approach alters our view of the effects of language experience on cognitive control. Avenues to move beyond the simple notion of a bilingual advantage or lack thereof will be proposed. (shrink)

Technologic advances mean automated, wearable cameras are now feasible for investigating health behaviors in a public health context. This paper attempts to identify and discuss the ethical implications of such research, in relation to existing guidelines for ethical research in traditional visual methodologies. Research using automated, wearable cameras can be very intrusive, generating unprecedented levels of image data, some of it potentially unflattering or unwanted. Participants and third parties they encounter may feel uncomfortable or that their privacy has been affected (...) negatively. This paper attempts to formalize the protection of all according to best ethical principles through the development of an ethical framework. Respect for autonomy, through appropriate approaches to informed consent and adequate privacy and confidentiality controls, allows for ethical research, which has the potential to confer substantial benefits on the field of health behavior research. Recent advances in stem cell research suggest that in the future it may be possible to create eggs and sperm from human stem cells through a process that we term in vitro gametogenesis (IVG). IVG would allow treatment of some currently untreatable forms of infertility. It may also allow same-sex couples to have genetically-related children. For example, cells taken from one man could potentially be used to create an egg, which could then be fertilised using naturally produced sperm from another (...) man to create a genetically-related child with half of its DNA from each of the men. In this chapter, we consider whether this technology could justifiably be denied to same-sex couples if it were made available as a fertility treatment to different-sex couples. The aim of this study was to investigate if children’s early responsiveness toward social partners is developmentally related to their growing concept of self, as reflected in their mirror self-recognition (MSR) and delayed self-recognition (DSR). Thus, a longitudinal study assessed infants’ responsiveness (e.g., smiling, gaze) toward social partners during the still-face (SF) task and a social imitation game and related it to their emerging MSR and DSR. Thereby, children were tested at regular time points from 9 months to 4 years (...) of age. Results revealed significant predictive relations between children’s responsiveness toward a social partner in the SF task at 9 months and their MSR at 24 months. Further, interindividual differences in children’s awareness of and responsiveness toward being imitated in a social imitation game at 12 months proved to be the strongest predictor of children’s DSR at 4 years, while some additional variance was explained by MSR at 24 months and verbal intelligence. Overall, findings suggest a developmental link between children’s early awareness of and responsiveness toward the social world and their later ability to form a concept of self. (shrink)

Seeing the entwinement of social and epistemic challenges through COVID, we discuss the perils of simplistic appeals to ‘follow the science’. A hardened scientism risks excarbating social conflict and fueling conspiracy beliefs. Instead, we see an opportunity to devise more inclusive medical knowledge practices through endorsing experiential knowledge alongside traditional evidence types.

Methods Young healthy heterosexual couples underwent sleep-lab-based polysomnography of two sleeping arrangements: individual sleep and co-sleep. Individual and dyadic sleep parameters (i.e., synchronization of sleep stages) were collected. The latter were assessed using cross-recurrence quantification analysis. Additionally, subjective sleep quality, relationship characteristics, and chronotype were monitored. Data were analyzed comparing co-sleep vs. individual sleep. Interaction effects of the sleeping arrangement with gender, chronotype, or relationship characteristics were moreover tested. Results As compared to sleeping individually, co-sleeping was associated with about 10% (...) more REM sleep, less fragmented REM sleep (p = 0.008), longer undisturbed REM fragments (p = 0.0006), and more limb movements (p = 0.007). None of the other sleep stages was significantly altered. Social support interacted with sleeping arrangement in a way that individuals with suboptimal social support showed the biggest impact of the sleeping arrangement on REM sleep. Sleep architectures were more synchronized between partners during co-sleep (p = 0.005) even if wake phases were excluded (p = 0.022). Moreover, sleep architectures are significantly coupled across a lag of ± 5min. Depth of relationship represented an additional significant main effect regarding synchronization, reflecting a positive association between the two. Neither REM sleep nor synchronization was influenced by gender, chronotype, or other relationship characteristics. Conclusion Depending on the sleeping arrangement, couple's sleep architecture and synchronization show alterations that are modified by relationship characteristics. We discuss that these alterations could be part of a self-enhancing feedback loop of REM sleep and sociality and a mechanism through which sociality prevents mental illness. (shrink)

The essence of the correspondence between Arendt and Scholem can be said to lie in three things. Above all it provides an intimate account of how two great intellectuals try to come to terms with being both German and Jewish, and how to think about Germany before, during, and after the Holocaust. They also debate the issue of what it means to be Jewish in the post-Holocaust world whether in New York or in Jerusalem. Finally, the specter of Benjamin haunts (...) the work and in a sense the letters are as much about Benjamin as the other two questions since his life and tragic death epitomize them both. Arendt and Scholem's letters on these weighty questions are lightened by more routine exchanges: on travel itineraries, lunch or dinner parties where important people were present, and so forth. These daily details are woven throughout the correspondence and provide vivid biographical information about Arendt and Scholem that is unavailable in any other source. (shrink)

This paper elucidates and rationalizes the ethical governance system for healthcare AI research, as outlined in the ‘Research Ethics Guidelines for AI Researchers in Healthcare’ published by the South Korean government in August 2023. In developing the guidelines, a four-phase clinical trial process was expanded to six stages for healthcare AI research: preliminary ethics review (stage 1); creating datasets (stage 2); model development (stage 3); training, validation, and evaluation (stage 4); application (stage 5); and post-deployment monitoring (stage 6). Researchers identified (...) similarities between clinical trials and healthcare AI research, particularly in research subjects, management and regulations, and application of research results. In the step-by-step articulation of ethical requirements, this similarity benefits from a reliable and flexible use of existing research ethics governance resources, research management, and regulatory functions. In contrast to clinical trials, this procedural approach to healthcare AI research governance effectively highlights the distinct characteristics of healthcare AI research in research and development process, evaluation of results, and modifiability of findings. The model exhibits limitations, primarily in its reliance on self-regulation and lack of clear delineation of responsibilities. While formulated through multidisciplinary deliberations, its application in the research field remains untested. To overcome the limitations, the researchers’ ongoing efforts for educating AI researchers and public and the revision of the guidelines are expected to contribute to establish an ethical research governance framework for healthcare AI research in the South Korean context in the future. This article explores the use of walking interviews as a research method. In spite of a wave of interest in methods which take interviewing out of the "safe," stationary environment, there has been limited work critically examining the techniques for undertaking such work. Curiously for a method which takes an explicitly spatial approach, few projects have attempted to rigorously connect what participants say with where they say it. The article reviews three case studies where the authors have used different techniques, (...) including GPS, for locating the interview in space. The article concludes by arguing that researchers considering using walking interviews need to think carefully about what kinds of data they wish to generate when deciding which approach to adopt.
