This paper aims, firstly, to bridge debates on human rights and Transnational Corporations within practical philosophy and those within the business and human rights literature and, secondly, to determine the extent to which human rights duties can be assigned to TNCs. To justifiably assign human rights duties to TNCs, it is argued that these duties need to be grounded in moral theory. Through assessment of two approaches from practical philosophy, it is argued that positive duties cannot be assigned to TNCs (...) because their bindingness cannot be grounded in moral theory. A positive argument is introduced to interpret TNCs’ human rights duties as corresponding to virtues rather than rights. Though such duties are indeterminate regarding what constitutes adequate performance, they can be made more determinate through legal instruments outside of positive human rights law. An approach is introduced exemplifying how such approaches can achieve the end of TNCs compliance with human rights norms. (shrink)

Charles Avison's Essay on Musical Expression, first published in 1752, is a major contribution to the debate on musical aesthetics which developed in the course of the 18th century. Considered by Charles Burney as the first essay devoted to 'musical criticism' proper, it established the primary importance of 'expression' and reconsidered the relative importance of harmony and melody. Immediately after its publication it was followed by William Hayes's Remarks (1753), to which Avison himself retorted in his Reply. Taken together these (...) three texts offer a fascinating insight into the debate that raged in the 18th century between the promoters of the so-called 'ancient music' (such as Hayes) and the more 'modern' musicians. Beyond matters of taste, what was at stake in Avison's theoretical contribution was the assertion that the individual's response to music ultimately mattered more than the dry rules established by professional musicians. Avison also wrote several prefaces to the published editions of his own musical compositions. This volume reprints these prefaces and advertisements together with his Essay to provide an interesting view of eighteenth-century conceptions of composition and performance, and a complete survey of Avison's theory of music. Dr Hay is Honorary Senior Research Fellow at the University of Aberdeen. A zoologist by profession, his research has been guided by the hypothesis that religious or spiritual awareness is biologically natural to the human species and has been selected for in the process of organic evolution because it has survival value. Although naturalistic, this hypothesis is not intended to be reductionist with regard to religion. Nevertheless it does imply that all people, including those who have no religious belief, have (...) a spiritual life. Sin-talk, though politically incorrect, is indispensable. Placing human life under the ‘hermeneutic of sin’ means acknowledging that one ought to aim flawlessly at God, and that one can fail in this endeavor. None of this can be appreciated within the contemporary post-Christian, mindset, which has attempted to reduce religion to morality and culture. In such a secular context, the guilt-feelings connected with the recognition of sin are considered to be harmful; the eternal benefit of a repentance is disregarded. Nevertheless, spirituality (...) appears to have therapeutic benefits. Therefore attempts are made to re-locate within healthcare a religion shorn of its transcendent claims, so as then to harvest the benefits of a spirituality ‘saved from sin’. This reduction of religiosity to its therapeutic function is nourished by a post-modern constructivist construal of religion. This article critically examines the dis-ingenuity marring such recasting, as well as the incoherence of related attempts to reduce transcendence to solidarity, and to re-shape the significance of religious rituals. This introduction supplies further bearing points for the conceptual map, which the introduction to the previous issue on European bioethics (2008/1) had provided for sorting out the various dimension in which the essays collected in these issues resemble and differ from each other. Special attention is devoted to communication, as diverse Christianities attend to different purposes, problems, and opportunities for normatively engaging (persuading, influencing, ruling, opposing, and converting) their surrounding secularized cultures. These differences reflect incompatible ways of conceiving Christ's acts (...) of healing, as these provide a model for His disciples' bioethics. These differences also reflect diversely rationalist and noetic epistemologies. The subtext concerns the haunting question about the enduring sustainability of a specifically Christian bioethics in Europe. As Schotsmans opts for a Roman Catholicism that is not recognized as such by his Magisterium, as Muller transforms Protestantism into a religiously nonhostile laicity, as Messer and Silva da Barbosa hope for the prophetic impact of communal “cities on the hill,” and as the Orthodox pursue the conversion of Western Europe in Greek, Russian, and Rumanian, ongoing Divine miracles present the most realistic hope. This is a book about the harms of oppression, and about addressing these harms using the resources of liberalism and Kantianism. Its central thesis is that people who are oppressed are bound by the duty of self-respect to resist their own oppression. In it, I defend certain core ideals of the liberal tradition—specifically, the fundamental importance of autonomy and rationality, the intrinsic and inalienable dignity of the individual, and the duty of self-respect—making the case that these ideals are pivotal in (...) both understanding and counteracting oppression. I argue that if we take these ideals seriously then it follows that people who are oppressed have an obligation to themselves to resist their own oppression. (shrink)

This paper presents a cognitive model of the planning process. The model generalizes the theoretical architecture of the Hearsay‐ll system. Thus, it assumes that planning comprises the activities of a variety of cognitive “specialists.” Each specialist can suggest certain kinds of decisions for incorporation into the plan in progress. These include decisions about: (a) how to approach the planning problem; (b) what knowledge bears on the problem; (c) what kinds of actions to try to plan; (d) what specific actions to (...) plan; and (e) how to allocate cognitive resources during planning. Within each of these categories, different specialists suggest decisions at different levels of abstraction. The activities of the various specialists are not coordinated in any systematic way. Instead, the specialists operate opportunistically, suggesting decisions whenever promising opportunities arise. The paper presents a detailed account of the model and illustrates its assumptions with a “thinking aloud” protocol. It also describes the performance of a computer simulation of the model. The paper contrasts the proposed model with successive refinement models and attempts to resolve apparent differences between the two points of view. (shrink)

A set of questions that can help citizens determine the trustworthiness of information available to them emerges from the discussion.

It is true for many disciplines within the humanities that there are numerous excellent works that introduce the beginner to the basic building blocks of the discipline, and also many advanced studies for the accomplished scholar, but few works that help the student get from the beginning stage to the advanced level. That has certainly been true of the discipline of Sanskrit. Once a student has devoted a couple of years to working through one of the excellent introductions to the (...) language by Ashok Aklujkar, Michael Coulson, Madhav Deshpande, Robert Goldman, or Walter Maurer, there have been hardly any intermediate texts to help the student systematically progress to more advanced levels. Now, however, with the publication of Scholastic Sanskrit, an important step has been taken toward filling that lacuna. This book assumes that the student has learned enough about Sanskrit grammar and syntax to be ready to begin plunging into the vast corpus comprising the many genres of Sanskrit literature. It is built on the conviction that even a student at the early stages of exploring Sanskrit literature can benefit from the work of traditional commentators; it is also built on the observation that until now there have not been reliable guides to help the student make intelligent use of Sanskrit commentaries. Chow illustrates the important role played by significance testing in the evaluation of research findings. Statistics and the goals of research should be treated as both interrelated and separate parts of the research evaluation process – a message that will benefit all who read Chow's book. The arguments are especially pertinent to the debate over the relative merits of confidence intervals and significance tests.

Welfare internalism holds that "for any intrinsic good φ for a person p, it must be the case that φ 'fits' p, resonates with p, fails to alienate p, and so forth." This "resonance constraint" is often employed in arguments against objectivist theories of well-being. Many philosophers argue that, because objectivist theories ground a person's good in sources other than that person's subjective attitudes, such theories fail to satisfy the resonance constraint. And because welfare internalism and the resonance constraint seem (...) so plausible—at least to these philosophers—they therefore reject objectivist theories. A person's welfare or well-being is, they claim, subjective. I push back against such arguments. I argue that many objectivist theories can (and do) adopt the resonance constraint. Looking to a historical example—Thomas Aquinas—I argue that an objectivist can put forward a theory of value that preserves an affective/motivational link between a person and his good, without sacrificing the objectivity of value. I therefore claim that the argument from internalism, when waged against objectivist theories of well-being, generally fails. Moreover, I argue that this sort of internalist-objectivism can explain things that subjectivism cannot; for example, why we claim that φ is good for p despite p 's beliefs and actions suggesting the opposite, or why valuing is important for humans in the first place. In short, certain objective approaches to welfare—such as Thomas Aquinas'—are more plausible than their subjective counterparts. (shrink)

This paper synthesizes a wide range of literature from sociolinguistics and cognitive psychology, to argue for a central role for the “word” as a vehicle of language variation and change. Three crucially interlinked strands of research are reviewed—the role of context in associative learning, the word-level storage of phonetic and contextual detail, and the phonetic consequences of skewed distributions of words across different contexts. I argue that the human capacity for associative learning, combined with attention to fine-phonetic detail at the (...) level of the word, plays a significant role in predicting a range of subtle but systematically robust observed socioindexical patterns in speech production and perception. In Words Are Weapons, Philippe-Joseph Salazar has produced a work that's garnered international acclaim. Winning the Prix Bristol des Lumières in 2015 and earning rave reviews, the book is one of the first, perhaps only, robust treatments of ISIS's rhetoric with an eye toward its persuasive efforts. For these reasons, the book is vitally important as we approach turning the corner into a second decade of Western-led terror wars that created the conditions under which ISIS formed. Salazar deserves serious credit (...) for this contribution; it is undoubtedly a text that should appear in every library throughout the world.For these reasons, I struggle with this book. A comprehensive introduction to the theory of knowledge, this work explores what it is to be a rational, sentient human being.

Few ethics committees were in place when the New Jersey Supreme Court announced its ruling on the Quinlan case in 1976. Today, the vast majority of hospitals have formed ethics committees and their use in nursing homes and other healthcare facilities is growing. Given the increasing commitment to the use of ethics committees and their increasing influence on healthcare decision making, the careful evaluation of committee performance should be a high priority. Yet to date ethics committees appear to have undergone (...) relatively little scrutiny. While professional articles on ethics committees do appear and at least one journal sets aside a regular section for the discussion of “Ethics Committees at Work” articles to date have primarily been limited to essays, philosophical inquiries, reports, case studies, and, occasionally, surveys. The use of more structured research methodologies has been lacking. As a result, it is not yet clear, for example, what characteristics describe the best functioning ethics committee. Indeed, what constitutes best functioning lacks careful definition as well. Committee impact on medical decision making and patient outcomes, while discussed, has not been systematically measured and analyzed. (shrink)

Every month some one pronounces that science must be rejected if we are to preserve a belief in human freedom, or that only by a faith in freedom that flies in the face of logic and the principle of causality can democracy be justified. Equally often other authors insist that the increase of knowledge in the science of human behavior makes plain the irrelevance and sentimentality of pious talk about free and rational choice. This introduction discusses the various respects in which the turn to psychotherapy and psychology in pastoral counseling touches on issues of bioethics (as the content of such counseling) and medical morality (insofar as the spiritual dimension addressed in pastoral care impacts the medical condition of those cared for, and the various kinds of psychotherapy relate to the therapy offered by medicine). A short characterization of each essay contained in this issue of Christian Bioethics highlights the major subjects on which these (...) essays agree and disagree. These subjects concern the significance of psychotherapy and psychology for (1) reaching out to parishioners who are estranged from the church, (2) criticizing religion as a whole, and (3) remedying certain distortions for which pastoral care and counseling have been criticized in some Christianities. Problems that arise from the incompatibilities between different sorts of theological and psychological accounts of human flourishing and their suggested solutions are considered. The introduction, then, concludes by briefly discussing the different understandings of tradition and church that inform the various post- and extra-Enlightenment positions adopted by the authors. Belgium's policy of not permitting Catholic hospitals to refuse euthanasia services rests on ethical presuppositions concerning the secular justification of political power which reveal the paradoxical character of European liberalism: In endorsing freedom as a value (rather than as a side constraint), liberalism prioritizes first-order intentions, thus discouraging lasting moral commitments and the authority of moral communities in supporting such commitments. The state itself is thus transformed into a moral community of its own. Alternative policies (such as an explicit moral (...) diversification of public healthcare or the greater tolerance for Christian institutions in the Netherlands) are shown to be incompatible with Europe's liberal concern with securing social and material freedom resources, as well as the concern with equality of opportunity, as embodied in the European Union's anti-discrimination labor law. The essay's argument for the preferability of a libertarian solution closes with the challenge that only if the provision of public healthcare can be shown to be rationally indispensable for a morally justified polity, could the exposed incoherence of modern European liberalism be generously discounted. We critically review key lines of evidence and theoretical argument relevant to Machery's These include interactions between different kinds of concept representations, unified approaches to explaining contextual effects on concept retrieval, and a critique of empirical dissociations as evidence for concept heterogeneity. We suggest there are good grounds for retaining the concept construct in human cognition.

Can proposing a policy of equal access to health care be justified on Christian grounds? The notion of a “Christian justification” with regard to Christians' political activity is explored in relation to the New Testament texts. The less demanding policy of granting “rights to (basic) health care,” the meaning of Jesus' healing activities, early Christian welfare schemes, and Christian grounds for the ascription of “rights” are each discussed. As a result, with some stretching of the neighbor-love and missionary imperatives it (...) is proposed that a basic health care policy can be legitimized. With regard to equal access to health care, however, all attempts to derive an equalizing imperative from the spiritual “equality among humans” or by way of the “love your neighbor as yourself” imperative are shown to fail. Particular attention is given to whether “attending to the least of my brothers' needs” obliges Christians to satisfy those needs optimally, as well as to the personal involvement aspect of the love-commandment in its simultaneously spiritual and temporal orientations. The elegists sang of the new developments of the archaic period, above all the rise of the polis. They wrote first-person poetry (...) celebrating their own individuality; most modern anthologies open emblematically with Archilochus's... They invoked the phraseology of epic only to reject its values: Homer's aristocratic warriors retreated in disarray before the bandy-legged general of the mercenary Archilochus. The arrival of the citizen soldier was reflected in Tyrtaeus and Callinus, whose exhortations hoplites chanted as they marched into battle. Solon was a little harder to accommodate in this picture: an odd hybrid of Jeremiah and Polonius, rising to occasional grandeur, but weak on logic and organization. Still, his praise of Eunomia helped bridge the gap between Homeric naiveté and the abstract thinking of the fifth century. And of course there was that law code...This explanatory model reflects the Geistesgeschichte approach of Bruno Snell, Hermann Fränkel, and Werner Jaeger, and it has been notably tenacious. But as a tool for explaining elegy (and lyric generally) it has come to seem pretty dated. Archilochus's "I" was problematized as early as 1964 in K. J. Dover's contribution to the Fondation Hardt Archiloque volume. But it was in the 1980s that the ice really started to break up. In an influential article (JHS 106 [1986] 13-35), [End Page 427] Ewen Bowie stressed the symposium's centrality as the performative context for elegy, thus making conservative aristocrats the genre's primary consumers (so much for the citizen soldier and the rising middle class!). The rise of "cultural poetics" left archaic society—and its poets—looking much less familiar. Finally, the conventional relationship between elegy and epic was being reexamined. Many supposed Homeric allusions melted away under closer examination (notably in Robert Fowler's The Nature of Early Greek Lyric [Toronto, 1987]). Recent scholarship has proposed dramatically later dates for the stabilization of the Homeric poems, calling into question their priority to lyric even in a chronological sense. The old picture of elegy as an archaic response to a monolithic "epic" has given way to theories of an ongoing and dynamic dialogue between (and within) both genres.These trends are reflected in Elizabeth Irwin's study of Solon, a revised version of her 1999 Cambridge dissertation. It also reflects renewed interest in the poet, appearing soon after commentaries by Maria Noussia (2001) and Christoph Mülke (2002) and almost simultaneously with a collective volume edited by Josine Blok and André Lardinois (Solon of Athens: New Historical and Philological Approaches [Leiden, 2006]), to which Irwin has contributed. Along with Solon, Irwin focuses on Callinus and Tyrtaeus, and one of her stated goals is "to help us unlearn what we think we know about this poetry and its historical significance" (18).The book is divided into three parts. In part 1 ("The Politics of Exhortation") Irwin examines the tradition of martial exhortation represented by Tyrtaeus and Callinus. The conventional view had these poets discarding Homer's individualistic front-fighters in favor of the new citizen-armies of the polis— is now a civic virtue. But as Irwin observes, "fighting for one's fatherland" is not alien to Iliadic values. For her, the similarities between martial elegy and epic outweigh any differences. As she notes, the evocation of future warfare in sympotic elegy mirrors a corresponding appeal to past feasting in the exhortations of the Iliad. Martial elegy provides (or sees itself as providing) an off-duty complement to Homeric warriors' battlefield vaunts—the sort of thing Sarpedon might have directed to Glaucus back in Lycia while the slave-boys were refilling the goblets. Such Iliadic self-fashioning constructs its sympotic audience not simply as heroic, but specifically as a heroic elite. While martial elegy may pay lip service to the polis, its center of gravity is elsewhere. Thus Tyrtaeus fragment 11W can conclude with patronizing advice to the... (shrink)
