In 1233 a certain R. Joseph bar Moses of Würzburg commissioned an illuminated copy of Rashi's Bible commentary, now in Munich. After the text was finished, the task of illuminating was put into the hands of a Christian painter, apparently a man named Heinrich, who kept a lay workshop in Würzburg . Three years later a giant Bible, now in Milan, was commissioned perhaps by the same patron, but not necessarily in the same city . It, too, was illuminated; (...) this time, however, it cannot be excluded that the paintings were made by Jewish artists. Both manuscripts are richly decorated with narrative scenes involving human figures. In the following decades it became more and more customary for wealthy Jews of Germany and northern France to have their Bibles, prayer books, and other texts adorned with figural miniatures. Yet there is no evidence that during the Middle Ages human figures were painted in any form in a Jewish context before the 1230s. A few textual references from the twelfth century indicate wall paintings and stained-glass windows in synagogues with images of animals and dragons, but none have survived. Some decades after the first illuminated books made their appearance, the most outstanding authority on religious law of his time, R. Meir ben Barukh of Rothenburg , was asked his opinion of this phenomenon. R. Meir was worried, as his reply shows, but not for reasons of religious law; his concern was that images in painted books would distract believers from their pious concentration during prayer. Du point de vue méthodologique et épistémologique, la vision occupe une place privilégiée dans les œuvres de Galien de Pergame, ce qui explique les tentatives répétées de ce dernier pour en expliquer le fonctionnement. En partie grâce à la dissection et à la vivisection pratiquées sur des animaux de différentes espèces, il développa une connaissance détaillée de l’anatomie de l’œil, du nerf optique, du cerveau, des muscles oculaires et du système vasculaire cérébral et oculaire. Il utilisa avec habileté cet impressionnant (...) savoir anatomique pour élaborer une explication détaillée de la physiologie de la vision. Pour expliquer comment voient les êtres humains, il fit également appel à l’optique mathématique, notamment à l’optique euclidienne. Cependant, en dépit d’efforts remarquables pour intégrer anatomie, physiologie et mathématiques dans une unique théorie cohérente de la vision, une analyse plus attentive montre que son explication de la vision n’est pas exempte de lacunes non négligeables, de difficultés non résolues et de tensions internes. Cette contribution apporte des éclaircissements sur le rôle du médecin et psychanalyste Heinrich Meng dans les réseaux de l’Institut de recherche sociale, en particulier sur sa perspective hygiéniste en santé mentale. Directeur adjoint de l’Institut de psychanalyse de Francfort au côté de Karl Landauer, Meng fut le porteur d’un programme de réformes sociales et de prévention appelé Psychohygiene, une conception de l’hygiène mentale adossée à la psychanalyse. Ce cadre de référence explique pourquoi et comment Meng a surtout été force (...) de propositions en prophylaxie plutôt qu’en théorie, à l’unisson avec les pédagogues et les associations engagées dans la prévention en santé mentale. Même si Meng fut l’éditeur de nombreux ouvrages de psychanalyse appliquée aux institutions sociales, il est resté en marge de la Théorie critique, à la fois à l’écart des sciences sociales et en dehors des premiers cercles de l’institut en exil. Patient portals are poised to transform health communication by empowering patients with rapid access to their own health data. The 21st Century Cures Act is a US federal law that, among other provisions, prevents health entities from engaging in practices that disrupt the exchange of electronic health information—a measure that may increase the usage of patient health portals. Caregiver access to patient portals, however, may lead to breaches in patient privacy and confidentiality if not managed properly through proxy accounts. We (...) present an ethical framework that guides policy and clinical workflow development for healthcare institutions to support the best use of patient portals. Caregivers are vital members of the care team and should be supported through novel forms of health information technology (IT). Patients, however, may not want all information to be shared with their proxies so healthcare institutions must support the development and use of separate proxy accounts as opposed to using the patient’s own account as well provide controls for limiting the scope of information displayed in the proxy accounts. Lastly, as socioeconomic barriers to adoption of health IT persist, healthcare providers must work to ensure multiple streams of patient communication, to prevent further propagating health inequities. Faith has been shown to serve a protective role in the mental health of African Americans and European Americans. However, little research has examined whether any association exists in Asian Americans. Using the National Latino and Asian American Study dataset, we examined the effect of religious attendance on the mental health of Asian Americans in the United States. The present study focused on Chinese Americans because they are the largest Asian American group. The results revealed that almost 80% of the (...) respondents were foreign-born and that their English proficiency had a positive association with their self-rated mental health. Being male correlated significantly to higher levels of mental health self-rating. After controlling for known predictive variables, such as demographics, cultural and immigration variables, more frequent religious attendance significantly predicted higher self-rating of mental health. These findings suggest that faith may have a unique protective role in Chinese Americans’ mental health. (shrink)

Abstract:Electronic health records (EHRs) offer significant advantages over paper charts, such as ease of portability, facilitated communication, and a decreased risk of medical errors; however, important ethical concerns related to patient confidentiality remain. Although legal protections have been implemented, in practice, EHRs may be still prone to breaches that threaten patient privacy. Potential safeguards are essential, and have been implemented especially in sensitive areas such as mental illness, substance abuse, and sexual health. Features of one institutional model are described that (...) may illustrate the efforts to both ensure adequate transparency and ensure patient confidentiality. Trust and the therapeutic alliance are critical to the provider–patient relationship and quality healthcare services. All of the benefits of an EHR are only possible if patients retain confidence in the security and accuracy of their medical records. (shrink)

The model for capacity assessment in the United States and much of the Western world relies upon the demonstration of four skills including the ability to communicate a clear, consistent choice. Yet such assessments often occur at only one moment in time, which may result in the patient expressing a choice to the evaluator that is highly inconsistent with the patient’s underlying values and goals, especially if a short-term factor (such as frustration with the hospital staff) distorts the patient’s preferences (...) momentarily. These challenges are particularly concerning in cases, which arise frequently in hospital settings, in which patients demand immediate self-discharge, often during off-hours, while faced with life-threatening risks. This paper examines the distinctive elements that shape such cases and explores their ethical implications, ultimately offering a model for such situations that can be operationalized. (shrink)

Because the number of organs available for transplantation does not meet the needs of potential recipients, some have proposed that a potentially effective way to increase registration is to offer a self‐benefit incentive that grants a 'preferred status' or some degree of prioritization to those who register as potential donors, in case they might need organs. This proposal has elicited an ethical debate on the appropriateness of such a benefit in the context of a life‐saving medical procedure. In this paper (...) we review arguments and ethical concerns raised by scholars, and studies of views of members of the public regarding the prioritization incentive system. We also report on our study of the views of those involved in organ transplant and of other medical professionals in Israel, as over half a decade ago Israel implemented a prioritization incentive system. Bioethicists propose that key stakeholders' views can provide additional arguments and perspectives on controversial issues. Proponents justify the prioritization incentive drawing mainly on arguments related to its potential effectiveness, reciprocity and fairness. Opponents point to the fact that registering is not binding and not an actual donation, and raise concerns regarding equity, autonomy and gaming the system. Ethical concerns raised by the practitioners in the study were examined in light of scholars' arguments and actual registration and donation data. Practitioners involved in transplantation raised ethical concerns corresponding to those raised by scholars as well as additional concerns. They also challenged proponents' assumptions regarding the utility of the incentive system from their own experience and argued that proponents obscure the meaning of reciprocity. (shrink)

This conflict can be interpreted in both religious and nonreligious ways. However, some intellectuals have identified a common thread parallel to the theological axis. The research study determines the role of existential philosophy in the contemporary religious beliefs. They have interpreted this contradiction as the conflict between our current selves and aspirations. Recognizing our animality and the role that such creatures play in the world is a requirement of our rational side. You may guarantee a well-attended eulogy by eating well, (...) exercising, not being a burden, helping out where you can, raising the next generation, and leaving the area essentially as you found it when it's time to leave. We must deal with this since it is who we are and what we are at our core. However, to be human means to be unhappy with this chilly, conventional assessment. As human beings, we possess the capacity to make decisions that influence our potential. Our destiny is not predetermined and that we can use our willpower to slightly warm the universe's unbreakable laws so that we can bend and shape them into the things we want. In the end, the cosmos prevails, yet we try to become rather than just exist during our brief existence. In the ongoing struggle against finitude, we strive for transcendence. The general framework has secular and strong religious proponents, and this view has been widely referred to as existentialist. (shrink)

In this paper it is suggested to generalize our understanding of general (structural) proof theory and to consider it as a general theory of two kinds of derivations, namely proofs and dual proofs. The proposal is substantiated by (i) considerations on assertion, denial, and bi-lateralism, (ii) remarks on compositionality in proof-theoretic semantics, and (iii) comments on falsification and co-implication. The main formal result of the paper is a normal form theorem for the natural deduction proof system N2Int of the bi-intuitionistic (...) logic 2Int. The proof makes use of the faithful embedding of 2Int into intuitionistic logic with respect to validity and shows that conversions of dual proofs can be sidestepped. (shrink)

Liver transplantation offers a lifesaving treatment for patients suffering from end-stage liver failure, but not all candidates in the United States are eligible owing to center-specific criteria. When a patient is rejected at a transplantation center for medical, surgical, or psychosocial issues, they are often referred to other centers. We focus on this practice of reevaluation at a second center when the candidate was rejected for psychosocial reasons. We review the criteria used by health professionals to determine psychosocial eligibility and (...) present three case examples from a large teaching hospital that demonstrate this phenomenon in practice. The cases illustrate the conflicts among autonomy, beneficence, nonmaleficence, and justice. We present arguments for and against this practice and provide concrete solutions as a path forward. The level of impairment shown by the 1.3 million residents of nursing homes in the United States varies significantly, and this raises considerable challenges for how to address the sexual and romantic interests and needs of these diverse individuals. Unfortunately, bright-line rules and a onesize- fits-all approach are often taken when addressing these challenges. This article proposes a novel taxonomy for classifying the potential sexual and romantic relationships of cognitively impaired nursing home residents that includes relationships between unmarried residents, relationships (...) between residents and their own spouses, and adulterous relationships. We explore the ethical and logistical challenges distinctive to each category of relationship. (shrink)

ABSTRACT The EU’s activation of Article 7 procedures against Hungary and Poland signals that it is beginning to take seriously the illiberal turn in Central Europe. However, the likelihood that the EU can restrain populist and illiberal tendencies in Hungary and Poland in the near future is slim. Despite the efficacy of the EU and other international organizations in promoting liberalism in these countries in the past, similar efforts are hobbled by a lack of political will and by significant bureaucratic (...) hurdles. The impetus to protect the liberal institutions and practices developed after the collapse of communism must come from the combined efforts of additional external actors and, most of all, by strong pressure from below. Russia's war against Ukraine has had devastating human consequences and destabilizing geopolitical effects. This roundtable takes up three critical debates in connection with the conflict: Ukraine's potential accession to the European Union; the role of Ukrainian nationalism in advancing democratization; and the degree of human rights accountability, not just for Russia, but also for Ukraine. In addition to challenging conventional wisdom on each of these issues, the contributors to this roundtable make a second, critically important intervention. Each essay explores the (...) problem of concealed political and normative commitments within much of the research on Russia's war against Ukraine by unearthing biases intrinsic to particular conceptualizations. The collection also questions the perceived separation between “interests” and “values” that permeates policy analysis. This roundtable further draws attention to the ethical problems that scholars and policymakers bring to policy debates through the occlusion of their preexisting political commitments. It argues for greater transparency around and awareness of the ways in which values, not just evidence, inform research findings and policy positions. (shrink)

Plus précisément, il s’agit d’une critique de l’ « architectonique” de la différenciation discussionnelle, menée à propos du rapport entre principe de discussion, principe moral, principe du droit et principe démocratique. Mon point de vue résulte de la position de l’éthique de la discussion comme discipline de base de la philosophie pratique, dans la perspective d’une fondation pragmatique-transcendantale ultime. Une « architectonique » alternative (...) de la différenciation discussionnelle du point de vue de l’éthique de la discussion est proposée.The following essay takes a critical stand to Habermas’ book Faktizität und Geltung of 1992 ; more precisely expressed : my stance is critical with regard to Habermas’ new « architectonics » of discourse-differentiation concerning the relationship between « discourse-principle », « principle of morality », « principle of law », and « principle of democracy ». My critique represents the view of a « transcendentalpragmatic ultimate foundation of discourse-ethics » . An alternative « architectonics » of discourse differentiation in the sense of discourse-ethics is suggested. (shrink)

Most reasonable people acknowledge that Karl Helge Hampus Hellekant has committed a grave moral offense: the 33-year-old Swede, also known as Karl Svensson, was convicted of killing trade unionist Björn Söderberg in 1999 at the behest of the Swedish neo-Nazi movement. What is not so clear is whether Hellekant, who is currently free on parole, should be permitted to become a physician. The former extremist was admitted to the medical school at Stockholm’s Karolinska Institute in 2007, but later expelled—following considerable (...) public debate—after school officials discovered that he was temporarily unable to verify his academic records. Sweden’s most prestigious medical school, Uppsala, subsequently confirmed these records and matricatulated him in 2008. (shrink)
