The out?dated intentionalistic assumptions manifest in Habermas's Theory of Communicative Action undermine a solution to the problem of order in action theory beyond utilitarianism. An analysis of his intersubjectivistic conception, which is based on the theory of the speech?act, shows that the incompleteness of Habermas's linguistic turn is due to his attempt to revive the older Critical Theory's concept of critique. The claims for a scientifically well?founded revival of a universal concept of reason ? which are asserted in this concept (...) ? invalidate the intersubjectivistic paradigm in action theory and therefore obstruct the way to a de?individualized formulation of the theory of social contract that avoids the paradox of utilitarian models. A new approach to Hume's problem of induction that justifies the optimality of induction at the level of meta-induction. Hume's problem of justifying induction has been among epistemology's greatest challenges for centuries. In this book, Gerhard Schurz proposes a new approach to Hume's problem. Acknowledging the force of Hume's arguments against the possibility of a noncircular justification of the reliability of induction, Schurz demonstrates instead the possibility of a noncircular justification of the optimality of induction, or, more precisely, of (...) meta-induction (the application of induction to competing prediction models). Drawing on discoveries in computational learning theory, Schurz demonstrates that a regret-based learning strategy, attractivity-weighted meta-induction, is predictively optimal in all possible worlds among all prediction methods accessible to the epistemic agent. Moreover, the a priori justification of meta-induction generates a noncircular a posteriori justification of object induction. Taken together, these two results provide a noncircular solution to Hume's problem. Schurz discusses the philosophical debate on the problem of induction, addressing all major attempts at a solution to Hume's problem and describing their shortcomings; presents a series of theorems, accompanied by a description of computer simulations illustrating the content of these theorems (with proofs presented in a mathematical appendix); and defends, refines, and applies core insights regarding the optimality of meta-induction, explaining applications in neighboring disciplines including forecasting sciences, cognitive science, social epistemology, and generalized evolution theory. Finally, Schurz generalizes the method of optimality-based justification to a new strategy of justification in epistemology, arguing that optimality justifications can avoid the problems of justificatory circularity and regress. This article suggests a ‘best alternative' justification of induction (in the sense of Reichenbach) which is based on meta-induction . The meta-inductivist applies the principle of induction to all competing prediction methods which are accessible to her. It is demonstrated, and illustrated by computer simulations, that there exist meta-inductivistic prediction strategies whose success is approximately optimal among all accessible prediction methods in arbitrary possible worlds, and which dominate the success of every noninductive prediction strategy. The proposed justification of meta-induction is (...) mathematically analytical. Konstruktivistische Positionen gehen davon aus, dass unsere Wörter und Sätze nie die Dinge an sich bezeichnen, sondern dies immer aus einer bestimmten Perspektive tun. Einer ‚Wirklichkeit an sich‘ nachzujagen, ist zwecklos, als wichtig gilt das Aufzeigen der Perspektiven. Nicht selten geschieht das (...) in aufklärerischer Absicht, wenn etwa Formulierungen wie die von der „Größe eines Volkes“, der „historischen Bestimmung einer Nation“ oder der „Natur des Geschlechts“ kritisch hinterfragt werden. Diesen Versuchen, die Wirklichkeit als interessengeleitet konstruierte auszuweisen, wird mit dem Argument begegnet, der Akt der Aufklärung diene letztlich nur dazu, die jeweils eigene Position als die ‚eigentlich richtige‘ durchzusetzen. This paper grapples with two objections against Max Weber’s methodology that arise because Weber borrows some ideas from Heinrich Rickert’s neo-Kantian philosophical system. The first objection (“the contradiction argument”) is raised by Julius J. Schaaf who disagrees with Weber’s claim that historical objects are constituted through retrospectively and hypothetically applied selections of value relations and that we can understand these objects. Weber’s idea that the relating ideal type constructions are also non-arbitrary—i.e., not merely subjective—and can be rectified, Schaaf maintains, contradicts (...) his own characterization of historical objects and reality. The second objection (“the incom¬patibility argument”) was made by Gerhard Wagner and Heinz Zipprian. It focuses on the conception of objective possibility. According to this, counter¬factual chains of historical events are contrived to figure out the relevant set of causes by which a certain event can be said to necessarily occur. The critics claim that it is only based on the ontological assumption of a preexisting real object that this thought-experiment can operate. That is, the pre-emptive assumption of realism is indis¬pensable for explaining the historical individual. To refute these two objections, I clarify some foundational notions and ideas of Weber’s methodology. (shrink)

Edited by Perry Schmidt-Leukel with Gerhard Koberlin and Thomas Josef Gotz, OSB. St. Ottilien: EOS-Verlag, 2001. 179 pp. The papers collected here represent a significant step forward in European scholarship on Buddhist-Christian relations. As Perry Schmidt-Leukel remarks in his helpful introduction, they are an experiment in correlating auto-interpretation and hetero-interpretation, introspection and extrospection.Each of the (...) first three sections—on China/Japan, Southeast Asia, and Europe—begins with a historical study. Iso Kern clears up some misconceptions about the Jesuits' approach to mission work in China, stating that they did in fact preach Jesus crucified (37) and the doctrine of Atonement (41) in the face of a grave danger that Christianity would simply be absorbed into Buddhism (33). Whereas Buddhism had no specifically religious clash with the state, Christianity did, and this was eventually sealed by martyrdom in both China and Japan. Introducing part 2, Heinz Murmel gives a sober reassessment of the vehement controversies between a certain segment of Buddhism and a certain type of Christianity in Ceylon. Only the high-caste highland nikayas were protected by the British (63); the more popular, rural Buddhists of the lowlands felt excluded and threatened and gave rise to what became known as "Protestant Buddhism." The "great debates" between bitterly anti-Christian monks and Protestant clergymen were not as important as the records may suggest, and even the fiery Anagarika Dharmapala later disclosed that he felt great devotion to Jesus. Finally, Frank Usarski reviews the heated debates between ill-informed Christians and overaggressive Buddhist converts such as Karl B. Seidenstucker as Buddhism established itself in Germany in the early decades of the twentieth century. The History of Religions school seemed to suggest that Christianity was culturally inferior to Buddhism, which was allegedly proved by Christian attitudes to [End Page 178] vegetarianism and the general anti-intellectualism of Christianity. Christianity was inauthentic, derivative, "Buddhism in Jewish garments" (120).Yet even Seidenstucker, the renegade Protestant, converted to Catholicism toward the end of his life.Each historical contribution is followed by an essay on the contemporary situation in the three regions, and these vary greatly in substance. Shizuteru Ueda offers a profound meditation on the significance of Keiji Nishitani for Buddhist approaches to Christianity. If Nietzsche posed the fundamental question of "life without why " (44-45), the thought of Meister Eckhart contains the answer (curiously, Ueda insists that this answer must be European, because Europe "determines the world" [47]). The "ground" on which we stand, interpreted as Nishida's "place (basho) of nothingness," is "ground-less." This is not nihilism but the overcoming of nihilism by nihilism, the shûnyatâ of shûnyatâ (46). Jesus as the Christ is the God/man and therefore the mediator, the absolute in history (53). He occupies the "place" (basho) of infinite openness, unconditioned ultimacy (55). He is thus unique, but not universal: the ultimate "for me" is not necessary "for the whole of mankind" (56). The actual encounter between Buddhist and Christian absolutes takes place in silence.Santikaro Bhikkhu, the friend and translator of Buddhadâsa Bhikkhu in the last eight years of his life, tells how his mentor gradually overcame his initial suspicion ofChristianity, perhaps because he was not confronted with colonial oppression as Dharmapala was in Ceylon. Distinguishing between "people language" and " dhamma language," he eventually arrived at a certain equivalence between the Christian God and Buddhist dhamma understood as a nonpersonal, nondual transcendent that is nevertheless not outside nature (85, 90). What Jesus the Teacher of Wisdom offers in the Sermon on the Mount, if practiced, is sufficient for salvation (93). In the perspective of dhamma language, however, the God of Christian convention is conditioned, and Jesus as Son of God cannot be unique. Though inconclusive and sometimes obscure because of Buddhadâsa's indifferent grasp of English, this is surely an astonishing journey for one who tried to understand each tradition, including his own, from the sources. Bislang wurde Walter Benjamins Werk nicht auf Staatlichkeit hin gelesen, weist es doch weder eine Staatstheorie noch deren explizite Kritik auf. Mit Problemen moderner Staatlichkeit beschaftigte sich Benjamin zeitlebens uber die kulturelle Sphare, und sein politisches Denken motivierte sich wesentlich aus Beobachtungen an Alltagsdingen und Konsumgutern sowie der Auseinandersetzung mit neuen (...) kunstlerischen Verfahren und Technologien. The paper tries to contribute to the discussion of the following problem: Nearly every government acts as if it has a natural right to collect taxes – if necessary by force. How legitimate is such an act of expropriation? To find an acceptable solution, three different theories of property are discussed – eventually favouring the Kantian approach. Subsequently, possible vindications of taxation are presented: (1) control of conduct, (2) financing public institutions, (3) reduction of social differences. All three justifications turn (...) out to be de ficient. What remains is John St. Mill's almost forgotten theory; he sees taxes as a sacrifice and, on this account, pleads for a proportional taxation. (shrink)

La théorie de l’organisme social était une approche foncièrement et largement répandue au début du 20ème siècle, qui était acceptée par de nombreuses orientations théoriques dans la sociologie et l’économie. L’approche de Rudolf Steiner s’y rapportant est bien connue. La théorie de Gerhard Stolzmann ne l’est pas autant. Ce dernier était un représentant de ce qu’on appelle le « mouvement des droits sociaux de l’économie politique » et au plan philosophique, il défendait le néo-kantisme (école de Marburg, de l’Allemagne (...) du sud-ouest). Stolzmann a connu et cité les écrits de Steiner sur l’organisme social, comme on peut le prouver. Dans cet essai, on va mettre au jour les communautés et tendances dans le concept de l’organisme social chez Stolzmann et Steiner. Tous deux ont mis en exergue l’importance du spirituel et en conséquence de la sphère du droit, pour la société et l’économie dans leur théorie. Mais Steiner eut essentiellement une amorce plus pratique. Son concept d’organisme social est plus une proposition de réforme pour l’économie et la société, alors que Stolzmann fait ressortir la signification théorique générale toujours valable de sa théorie. The first challenge is taken up by Hume in the Dialogues ConcerningNatural Religion, and the second (...) in hisNatural History ofReligion. In this paper I will try to show that there is a third fundamental problem discussed by Hume with regard to religion, namely its relationship to and influence on morality. Although he never wrote on this topic in as systematic a way as on the above-mentioned two questions inparticular, I am convinced that his thoughts about it were not just casual. The passages in Hume relevant to this third central question about religion are to be found in "Of Superstition and Enthusiasm," in Essays Moral, Political, and Literary; in section 11 ofAn Enquiry Concerning Human Understanding; in Appendix 4 and "A Dialogue," in An Enquiry Concerning the Principles ofMorals; in the History ofEngland; in Part XII of the Dialogues Concerning Natural Religion ; and, in particular, in the Natural History ofReligion. Why Hume never wrote about the relationship between religion and morality in a more systematic way is not entirely clear. He may have decided not to provoke the orthodox any further than he already had. That Hume changed the title ofsection 11 ofhis first Enquiry from the original "Of the Practical Consequences of Natural Religion" to the rather non-committal "Of a Particular Providence and of a Future State" may support this conjecture. Before going into more detail as to Hume's view on the relationship between religion and morality, I want to make a few remarks about Hume's opinion of religion in general. Hume made a distinction between one 'true' and two forms of 'false' religion. His most explicit description of true religion is to be found in a preface to the second volume of his History ofEngland: Volume XV Number 2 277 GERHARD STREMINGER Theproper Office ofReligion, Hume wrote in terms which have a Quakerish flavour, is to reform Men's Lives, to purify their Hearts, to inforce all moralDuties, & to secure Obedience to the Laws & civil Magistrate. While it pursues these useful Purposes, its Operations, tho' infinitely valuable, are secret & silent; andseldom come under the Cognizance ofHistory... The Idea ofan Infinite Mind, the Author ofthe Universe seems... to require a Worship absolutely pure, simple, unadorned; without Rites, Institutions, Ceremonies; even without Temples, Priests, or verbal Prayer & Supplication. This preface, however, was not printed in the words quoted above. Instead it was reduced by Hume to a footnote at the end of the second volume of his History of England in a shortened and toned-down version. Even this footnote was removed in later editions ofthe History ofEngland. But in the Dialogues Hume repeated his idea of the effect of true religion on morality almost verbatim: The proper office of religion is to regulate the heart of men, humanize their conduct, infuse the spirit oftemperance, order, and obedience; and as its operation is silent, and only enforces the motives of mortality and justice, it is in danger of being overlooked, and confounded with these other motives. This form ofreligion, however, although without anypernicious consequences with regard to society (D 223), is extremely rare. Religion, as it has commonly been found in the world (D 223), is a threat to morality. The corruptions of true religion, namely superstition and enthusiasm, are the popular forms of religious worship. Whenever Hume talks about religion without qualifications, he has this false religion in mind. Coming back to my original thesis, Hume, I think, sees three main negative influences of false religion: (1) The clergy has an interest in setting bounds to human knowledge; (2) The God offalse religion is no moral authority; (3) False religion corrupts the natural moral sentiments and promotes an 'artificial, affected' life. Over many years, Jung had often used the medium of letters to communicate his ideas to others and to clarify the interpretation of his work, quite apart from answering people who approached him with genuine problems of their own and simply corresponding with friends and colleagues. Zusammenfassung In Deutschland verlangt das Transplantationsgesetz die Zuteilung von postmortal gespendeten Organen nach den Kriterien der Dringlichkeit und der Erfolgsaussicht. Der herrschenden Auffassung zufolge darf die Erfolgsaussicht hierbei jedoch lediglich den Charakter einer Minimalnutzenschwelle annehmen. Eine darüber hinausgehende Gewichtung von Erfolgsaussichten soll zudem nicht mit der Lebenswertindifferenzkonzeption des Bundesverfassungsgerichts zu vereinbaren sein, die aus dem Gleichheitsgrundsatz sowie aus der Menschenwürde abgeleitet wird. Gerhard Dannecker argumentiert, diese im juristischen Schrifttum überwiegend vertretene Auffassung sei weniger zwingend, als es auf den ersten (...) Blick scheinen mag. Seiner Auffassung zufolge lässt sich aus der Lebensschutzgarantie in Artikel 2 der Verfassung eine Pflicht ableiten, die vorhandenen Ressourcen möglichst effektiv einzusetzen. Zwar dürfe Effizienz hier tatsächlich nicht bedeuten, dass die Funktionsdauer der vorhandenen Organe über das Gesamtkollektiv aller Patienten hinweg utilitaristisch zu maximieren sei - eine Pflicht zur Rettung einer möglichst großen Anzahl an Menschen lässt sich ihres Erachtens jedoch durchaus rechtfertigen. Oft wird nur jenes anerkannt, was "wissenschaftlich beweisbar" ist. Ein solches Vorurteil vergisst, dass es auch andere Wirklichkeiten gibt. Ist unsere Welt ein Blick durch ein Kaleidoskop? Wie kann es sein, dass man eine mehr oder minder große Auswahl panoramenhafter Wirklichkeiten vor sich hat? Ist es möglich, solche Wirklichkeiten zu verlassen und in andere überzuwechseln? Anhand konkreter Beispiele wird dieser Wirklichkeits-Pluralismus beleuchtet. Das erste Beispiel, ein astronomisches, zeigt in aller Ausführlichkeit, auf welche Weise Wirklichkeit entstehen kann. Dann ist von anderen (...) naturwissenschaftlichen Wirklichkeiten die Rede, vom Licht und von der Farbe sowie von einer fremden heilkundlichen Wirklichkeit. Ein zentrales Anliegen von Gerhard Fasching ist ein Denken, welches in einen Wirklichkeitspluralismus mündet. Unser monokulturelles Wirklichkeitsverständnis hat nämlich schon viele Wirklichkeiten unserer eigenen Kultur und fremder Kulturen missachtet und dadurch verloren. Unser humanistisches Weltbild benötigt also ein breiteres Fundament. Das Buch findet zu einem überraschenden Ergebnis: Man selbst gehört nicht zur Wirklichkeit, sondern man steht stets außerhalb jeder Wirklichkeit. GERHARD FASCHING.
