To sum up on forms and rightness. No one wants poetry to be like filling out a form, though plenty of poems look dismally like it. The forms were there to be wrestled with mightily, because they silently and emptily, till one filled them up with the thing said, stood for the recalcitrant outside and other that knows nothing of the human will. The mindless rigidity in principle of the verse patterns suggestively compounded with the sinewy nature of the speaking (...) voice that flowed in continuous energy through the marked-off graph of foot and line and strophe. Together they might be taken to stand for two powers of the mind that ought to work with and against one another to the same effect: the streamy nature of association, said Coleridge, that thinking curbs and rudders. Ezra Pound's commandment to the poet, to compose in the sequence of the musical phrase, not in the sequence of the metronome, is a good warning against monotonous cadences; but taken literally it invites the reply that Beethoven did both. For art is a place where you make choices, sometimes difficult ones that require you decide not between good and bad but between this good and that: very often it is between the beauty of a line and the sense of the whole thing. Age discrimination, particularly in the context of performance evaluation decisions, has been a source of major concern and litigation for organizations in the past, and indications are that this area will pose serious challenges in the future. The present study attempted to delve more deeply into the process by which manifest age discrimination operates in the performance evaluation process. A conceptualization was proposed and tested which suggested that age-related influences on performance ratings operate through interpersonal distance and political influence of (...) subordinates. An examination of how, in literature, silence and veiling are related to moral significance. The paper emphasizes Walter Benjamin’s essay on Goethe’s Elective Affiniites and Nathaniel Hawthorne’s “The Minister’s Black Veil” and poses the question of how the literary can possess moral meaning or effect when, as in these two works, silence and veiling appear as a means of refusing or denying intention. Benjamin’s and Hawthorne’s different critiques of the symbol are presented as the central issue around which the possibility (...) of moral meaning is decided as an intentionless act. Benjamin’s preservation of the moral is interpreted as the cause of the paradoxical and contradictory sources of the expressionless and its critical violence as well as the veiling and secrecy he identifies as forming the true work of art. Against this account, Hawthorne’s story is read as the refusal of any preceding secret as the basis of a moral claim and thus as the defining category of the work of art. (shrink)

A special report of The Hastings Center and the Association of American Medical Colleges addressed the ethical oversight of learning health systems, which seek to combine high‐quality patient care with routine data collection aimed at improving patient outcomes. The report contained two position papers, authored by a number of distinguished bioethicists, and several commentaries. The position papers urged two changes. First, they urged a rethinking of our approach to the regulation of human subjects research, so as to make it easier (...) in the future for learning health systems to function well. Second, they argued that the rethinking required dispensing with a strict distinction between research and therapy, which has been a major tenet of bioethics since the Belmont Report, which explicated basic ethical principles governing human subjects research. We fully support the objectives of the authors, and we agree that the learning health system is an important advance that serves patients well. Unnecessary regulatory burden ought not impede this progress. We disagree, however, that the best way to bring about these needed changes in the regulatory environment is to reject the basic distinction between research and treatment. Unfortunately, we find the arguments in favor of that strategy to be, in places, reminiscent of what we take to be basic conceptual errors that hampered the ethical understanding of human subjects research prior to adoption of the Belmont Report. To see why one need not reject the research‐treatment distinction in order to promote learning health systems, we first investigate in some detail the arguments offered for eliminating the distinction. We next turn to an issue not addressed by those authors, namely, the relationship between the physician or investigator and the patient or subject, to illustrate why the distinction is important and what is lost if it is jettisoned. In 1945–46, representatives of the U.S. government made similar discoveries in both Germany and Japan, unearthing evidence of unethical experiments on human beings that could be viewed as war crimes. The outcomes in the two defeated nations, however, were strikingly different. In Germany, the United States, influenced by the Canadian physician John Thompson, played a key role in bringing Nazi physicians to trial and publicizing their misdeeds. In Japan, the United States played an equally key role in concealing information about (...) the biological warfare experiments and in securing immunity from prosecution for the perpetrators. The greater force of appeals to national security and wartime exigency help to explain these different outcomes. (shrink)

The Toronto experience suggests that there may be several general lessons for academic health sciences complexes to learn from the Olivieri/Apotex affair regarding the ethics, independence, and integrity of clinical research sponsored by for profit enterprises. From a local perspective, the OAA occurred when there already was a focus on the complex and changing relationships among the University of Toronto, its medical school, the fully affiliated teaching hospitals, and off campus faculty because of intertwined interests and responsibilities. The OAA became (...) a catalyst that accelerated various systemic reforms, particularly concerning academic/industry relations. In this article, the evolving governance framework for the Toronto academic health sciences complex is reviewed and these policy and process reforms discussed. These reforms have created collaborative activity among research ethics boards and contract research offices of the partner institutions, and allowed the joint university/hospital ethics centre to play a role in governance and policy, while respecting the missions and mandates of the involved institutions. Although few of the policies are dramatically innovative, what is arguably novel is the elaboration of an overarching governance framework that aims to move ethics to a central focus in the academic complex. Time alone will tell how sustainable and effective these changes are. (shrink)

In recent years, a number of groups have begun to argue that pension funds have an obligation to invest their capital in socially responsible ways. The concept of social investing of pension funds is examined with regard to legal requirements, determination of social objectives, measurement of perfornance, and financial effects. This analysis concludes that, while the problems of social investing are relatively well-defined, the benefits are nebulous. This paper discusses the Principle of Normative Invariance: ‘An action’s moral status does not depend on whether or not it is performed.’ I show the importance of this principle for arguments regarding actualism and other variations on the person-affecting restriction, discuss and rebut arguments in favor of the principle, and then discuss five counterexamples to it. I conclude that the principle as it stands is false; and that if it is modified to avoid the counterexamples, it is gutted of any (...) interest or power. (shrink)

Proposals for a universal basic income have reemerged in public discourse for a variety of reasons. Marx’s critique of exploitation suggests two apparently opposed positions on a basic income. On the one hand, a basic income funded from taxes on labor would appear to be exploitative of workers. On the other hand, a basic income liberates everyone from the vulnerable condition in which one is forced to sell one’s labor in order to survive, and so seems to be one way (...) of abolishing exploitation at its root. This paper will develop a conception of exploitation that resolves the conflict in favor of basic income. The conception of exploitation is grounded in a liberal egalitarian conception of justice rather than in Marx’s labor theory of value or an exclusive focus on the worker-capitalist relation. This position is not premised on an acceptance of the basic institutions of capitalism, but rather is a standpoint from which to evaluate them. It is not necessary to downsize our ideas of freedom and equality. But it is less obvious than it appeared in classic Marxist formulations that socialism is necessary for social justice. To quote the title of a famous article, there could be a ‘capitalist road to communism’, if a substantial basic income is feasible in a capitalist society. (shrink)

No prior knowledge of logic is necessary; readers need only an acquaintance with high school mathematics. The author emphasizes understanding, rather than technique, and focuses on such topics as the historical reasons (...) for the formation of Aristotelian logic, the rise of mathematical logic after more than 2,000 years of traditional logic, the nature of the formal axiomatic method and the reasons for its use, and the main results of metatheory and their philosophic import. Agnes's brakes fail. Should she continue straight into the busy intersection or should she swerve into the field? Add to the story, what Agnes does not and cannot know, that continuing into the intersection will cause no harm, whereas swerving into the apparently empty field will cause a death. I evaluate arguments for the claim that she should enter the intersection, i.e. for objectivism about right and wrong; and arguments for the claim that she should swerve, i.e. for subjectivism about (...) right and wrong, and conclude that subjectivism is more plausible. I also consider the view that ‘ought’ and ‘wrong’ are systematically ambiguous, that she subjectively ought to swerve and that she objectively ought to enter the intersection. I argue that most versions of this suggestion are unworkable, and that even the best version is less plausible than pure subjectivism. (shrink)

In any probabilistic theory, we say that a bipartite state ω on a composite system AB steers its marginal state ω B if, for any decomposition of ω B as a mixture ω B =∑ i p i β i of states β i on B, there exists an observable {a i } on A such that the conditional states $\omega_{B|a_{i}}$ are exactly the states β i . This is always so for pure bipartite states in quantum mechanics, a fact (...) first observed by Schrödinger in 1935. Here, we show that, for weakly self-dual state spaces (those isomorphic, but perhaps not canonically isomorphic, to their dual spaces), the assumption that every state of a system A is steered by some bipartite state of a composite AA consisting of two copies of A, amounts to the homogeneity of the state cone. If the state space is actually self-dual, and not just weakly so, this implies (via the Koecher-Vinberg Theorem) that it is the self-adjoint part of a formally real Jordan algebra, and hence, quite close to being quantum mechanical. Over the past three decades, research on the social dimensions of emotions has grown exponentially, particularly in the area of “emotion management.” In this project, we will attempt to add to this body of research by studying the social aspects of labeling or “instantiating” feelings. The data for the project come from televised red-carpet interviews conducted with celebrities immediately prior to awards ceremonies. By focusing on the generic aspects of the emotional claims-making put forth by interviewers and interviewees, we demonstrate (...) how the labeling of emotions is an interpretive, interactive task. This paper takes as its starting point the phenomenon of young lawyers in ethical crisis. The teaching of ethics in the classroom and the ethos and environment of the law firm have created dissonance: knowing what it is right to do but being unable to do it. In examining this phenomenon, we develop the idea of commitment as a source of duty, loyalty, and courage that enables someone to accept and overcome reluctance to act ethically. Our conceptual framework combines two (...) models: Fineman’s radical view that vulnerability is universal, but ameliorated by the assets available to the individual, and Rest’s four component model that provides a taxonomy of precursors for ethical action and resilience. We consider how the structures and the relationships between law schools, regulators and law firms, acting in combination, support or degrade ethical resilience and development of a commitment to ethical action. We close by considering how changes to the structure planned by one regulator in England and Wales deplete the assets available to the young lawyer and thereby the profession. (shrink)
