Over the past twenty-five years, thirty-seven states and the US Congress have passed mental health and substance use disorder (MH/SUD) parity laws to secure nondiscriminatory insurance coverage for MH/SUD services in the private health insurance market and through certain public insurance programs. However, in the intervening years, litigation has been brought by numerous parties alleging violations of insurance parity. We examine the critical issues underlying these legal challenges as a framework for understanding the areas in which parity enforcement is lacking, (...) as well as ongoing areas of ambiguity in the interpretation of these laws. We identified all private litigation involving federal and state parity laws and extracted themes from a final sample of thirty-seven lawsuits. The primary substantive topics at issue include the scope of services guaranteed by parity laws, coverage of certain habilitative therapies such as applied behavioral analysis for autism spectrum disorders, credentialing standards for MH/SUD providers, determinations regarding the medical necessity of MH/SUD services, and the application of nonquantitative treatment limitations under the 2008 federal parity law. Ongoing efforts to achieve nondiscriminatory insurance coverage for MH/SUDs should attend to the major issues subject to private legal action as important areas for facilitating and monitoring insurer compliance. This essay examines neoconservative criticisms of equity planning, and the challenges against the right of government to regulate local development and land use. The specific concern of this essay is how, or if, local development administrators (equity planners), should use their discretionary powers to ensure that city officials and private developers promote and protect the interests of urban residents, particularly the poor and disadvantaged. The essay begins by discussing the alleged conflict said to exist between needy urban residents and the (...) more secure urban taxpayers. The contrary views of equity planners are then reviewed, and the tensions within the neoconservative arguments are exposed and critiqued. Finally, the dispute between equity planners and neoconservatives is further explored by examining the dispute over the voucher system to address the problem of equal educational opportunity in urban communities. No word is more central to the contemporary political imagination and action than ‘resistance'. In its various manifestations - from the armed guerrilla to Gandhian mass pacifist protest, from Wikileaks and the Arab Spring to the global eruption and violent repression of the Occupy movement - concepts of resistance are becoming ubiquitous and urgent. Among both the defenders and adversaries of orthodox Trinitarian dogma, the so-called “kenosis hymn” of Philippians 2 was of the utmost importance, whether in refuting opponents’ teachings or articulating one’s own. While historical theologians have extensively investigated its place in the works of Sts. Hilary and Augustine—each the leading Latin pro-Nicene authority of his time—a comparative examination of the two has not yet been undertaken. This article seeks to trace and account for Augustine’s noteworthy improvement upon his predecessor’s thought in (...) the closely related realms of exegesis and Christology. It first summarizes the most relevant points of continuity and discontinuity in the Latin bishops’ uses of the Pauline language of forma dei–forma serui. From there, it turns to the role of Phil. 2 in countering subordinationist readings of hotly contested scriptural texts, arguing that Augustine more ably responds to the challenges at hand. Finally, it argues that his employment of the forma dei–forma serui paradigm is closely linked to his teaching on the revelatory capacity of Christ’s human nature. With regard to both, Augustine’s teaching marks a bona fide development of Hilary’s and thus of the Latin tradition more broadly. (shrink)

In this dialogue, we discuss the contrast between inexorable physical laws and the semiotic freedom of life. We agree that material and symbolic structures require complementary descriptions, as do the many hierarchical levels of their organizations. We try to clarify our concepts of laws, constraints, rules, symbols, memory, interpreters, and semiotic control. We briefly describe our different personal backgrounds that led us to a biosemiotic approach, and we speculate on the future directions of biosemiotics.

Social epistemology is a many-splendored subject. Different theorists adopt different approaches and the options are quite diverse, often orthogonal to one another. The approach I favor is to examine social practices in terms of their impact on knowledge acquisition . This has at least two virtues: it displays continuity with traditional epistemology, which historically focuses on knowledge, and it intersects with the concerns of practical life, which are pervasively affected by what people know or don't know. In making this choice, (...) I am not blind to the allure of alternative approaches. In this paper I explain and motivate the knowledge-centered approach by contrasting it with a newly emerging alternative that has a definite appeal of its own. According to this alternative, the chief dimension of social epistemological interest would be rationality rather than knowledge. (shrink)

Agnes's brakes fail. Should she continue straight into the busy intersection or should she swerve into the field? Add to the story, what Agnes does not and cannot know, that continuing into the intersection will cause no harm, whereas swerving into the apparently empty field will cause a death. I evaluate arguments for the claim that she should enter the intersection, i.e. for objectivism about right and wrong; and arguments for the claim that she should swerve, i.e. for subjectivism about (...) right and wrong, and conclude that subjectivism is more plausible. I also consider the view that ‘ought’ and ‘wrong’ are systematically ambiguous, that she subjectively ought to swerve and that she objectively ought to enter the intersection. I argue that most versions of this suggestion are unworkable, and that even the best version is less plausible than pure subjectivism. (shrink)

Three major questions should be answered by any theory of “folk psychology”, or mentalizing. The first question concerns the contents of mental concepts; the second concerns the processes of mental-state attribution ; and the third concerns the development or acquisition of mentalizing skills. Some major problems are presented for different variants of the “theory-theory” approach, namely, philosophical functionalism, the child-scientist approach, and the modularist approach. The approach favored here is an “introspection-simulation” approach: introspection as an account of first-person mental-state attribution, (...) and simulation as an account of third-person mental-state attribution. The simulationist part of the story is clarified and defended in some detail, including a discussion of the relation between knowledge and simulation. Special attention is given to empirical findings that support the notion that pretend states could really be “facsimiles” of their genuine counterparts, a relationship that seems to be required if simulation is to produce successful mental-state attributions. This article examines a thesis of interest to social epistemology and some articulations of First Amendment legal theory: that a free market in speech is an optimal institution for promoting true belief. Under our interpretation, the market-for-speech thesis claims that more total truth possession will be achieved if speech is regulatedonlyby free market mechanisms; that is, both government regulation and private sector nonmarket regulation are held to have information-fostering properties that are inferior to the free market. After discussing possible counterexamples (...) to the thesis, the article explores the actual implications of economic theory for the emergence of truth in a free market for speech. When confusions are removed about what is maximized by perfectly competitive markets, and when adequate attention is paid to market imperfections, the failure of the market-for-speech thesis becomes clear. The article closes by comparing the properties of a free market in speech with an adversarial system of discourse. (shrink)

That data and analysis is required to assess compliance with just war norms in assessing the conduct of the war, a framework quite distinct from human rights norms that can misapply and deform the application of norms such as proportionality (...) and obligations not to target civilians. Nonskeptical foundationalists say that there are basic beliefs. But, one might object, either there is a reason why basic beliefs are likely to be true or there is not. If there is, then they are not basic; if there is not, then they are arbitrary. I argue that this dilemma is not nearly as decisive as its author, Peter Klein, would have us believe.

This paper defends strong internalism about reasons, the view that reasons must relate to pre-existing motivational states, from several kinds of counterexamples, supposed desire independent reasons, that have been proposed. A central distinction drawn is that between there being a reason and an agent's having a reason. For an agent to have an F reason, she must be F-minded. Reasons, as what motivate us, are states of affairs and not themselves desires or motivational states, but they must connect to existing (...) motivational states. It has been claimed that rationality itself requires us to recognize certain reasons independent of our desires, that we acquire new desires by learning what is valuable, by acquiring desire-independent reasons to pursue certain values. It is claimed also that prudential and moral reasons are desire independent. By offering an account of rationality as coherence, by appealing to broader concerns as opposed to specific desires, and by appealing to the distinction noted above, the paper exposes weaknesses in recent arguments for desire independent reasons by Millgram, Smith, Korsgaard, and Searle. the reasons they propose can be interpreted as internal (not desire independent) or dismissed as nonexistent. This article employs postcolonial perspectives to examine the possibilities and limitations of drawing on Pan-African ideas to establish practices and meanings for global citizenship education at an elite secondary school in Ghana. In this examination, the authors explore the ways in which the school’s interventions to reinforce sameness/unity produce different understandings of global citizenship between students from different social class backgrounds. The article addresses how the school attempts to dissociate students from their native cultures for the purpose of teaching them (...) the ways of knowing and doing necessary to live and work/study in the West. The authors illustrate the ways in which the lessons students are being taught about what it means to be a global citizen reinscribe hegemonic discourse through Pan-African rhetoric. The article concludes by calling for alternative forms of global citizenship education that emphasize critical consciousness. (shrink)

Some of the causes of the 'sexual revolution' during the past few decades are widely known: The development of relatively safe and reliable contraceptives, especially the birth-control pill; the 'morning after' pill; antibiotics to relieve or cure sexually transmitted diseases such as gonorrhea, herpes, and syphilis; the increased social acceptance of pre-marital sex, homosexuality, and other behaviors that formerly were considered deviant; and the legalization of abortion as the ultimate 'contraceptive'. But little attention has been paid to two rather cerebral (...) factors relevant to these developments – namely, ethical theories, and theories of overpopulation. In this paper I will argue that these two less well-known and more subtle factors have been at least as powerful as the more obvious factors mentioned above, in bringing about sea-changes in sexual mores. More specifically, I will argue that some implicit approaches to ethical theory are more conducive than others to bringing about the present status quo in sexual mores, and that the widespread belief in world overpopulation has not only changed the moral climate regarding sexuality, but has helped to redefine what is moral and what is immoral. This thought-provoking study examines the foundations of moral education from a philosophical and practical perspective. It analyzes some of the typical expectations that cannot be met in the present day approach, and recommends that the teaching of ethics be treated with `theater' as the metaphor, dialogue as the genre, and Socrates as the model. Seen as a necessary and unavoidable classroom activity, moral education is presented from a humanist point of view, with emphasis on the developmental approach of Jean Piaget (...) and his followers, while pointing out the limitations of psychological methods. Technology corporations and the emerging digital health market are exerting increasing influence over the public healthcare agendas forming around the application of mobile medical devices. By promising quick and cost-effective technological solutions to complex healthcare problems, they are attracting the interest of funders, researchers, and policymakers. They are also shaping the public facing discourse, advancing an overwhelmingly positive narrative predicting the benefits of wearable medical devices to include personalised medicine, improved efficiency and quality of care, the empowering of under-resourced communities, (...) and delivery of health services previously unavailable to the citizens of developing countries. Typically techno-optimist in their description, the key barriers to this impending inflection point in healthcare are identified as technical issues such as short battery life and a lack of data protection. However, this tech innovation narrative is consistent with problematic ethical, social, and political assumptions that have practical and normative effects, and risk, one, undermining the real clinical potential of wearable devices and, two, designing social inequality and injustice into our mobile health interventions in global healthcare. I argue that the foundational assumptions dealing with the just distribution of healthcare ‘goods’, the individual as part of society, and the political framing of future healthcare policy devalue equity and despite what they promise cannot meet the distinctive needs of individuals and groups that do not conform to a standardised concept of care-receiver.
