Some rules seem more important than others. The moral rule to keep promises seems more important than the aesthetic rule not to wear brown with black or the pool rule not to scratch on the eight ball. A worrying number of metaethicists are increasingly tempted to explain this difference by appealing to something they call “authoritative normativity” – it’s because moral rules are “authoritatively normatively” that they are especially important. The authors of this chapter argue for three claims concerning “authoritative (...) normativity”: (1) that motivation for it originates in a parochial conception of “normative flavours”; (2) that arguments against alternative ways of explaining e.g., morality’s importance are overblown; and (3) that there are strong reasons against theorizing in terms of “authoritative normativity”. The overarching aim is not to show that “authoritative normativity” is incoherent or entirely unmotivated. Rather, it is to discuss some of “authoritative normativity’s” deeper commitments to correct the impression that is it largely benign or that it is entailed by familiar and popular “metanormative” positions. Authoritative normativity, it seems to us, is a solution in search of a problem. (shrink)

Entrepreneurs of contested commodities often face stakeholders engaged in market excluding boundary work driven by ethical considerations. For example, the conversion of academic scientific knowledge into technologies that can be owned and sold is a growing global trend and key stakeholders have different ethical responses to this contested commodity. Commercialization of science can be viewed as a good thing because people believe it bolsters economic growth and broadly benefits society. Others view it as bad because they believe it discourages basic (...) research that ought to be freely shared without concern for profit. Taking a descriptive sociological approach, we posit that the stance of a religious tradition toward capitalism will help shape individual scientists’ views on science commercialization and test whether the religious tradition of scientists correlates with their attitude toward the commercialization of science. To maximize variance on the religious tradition dimension, we analyze pooled data from a cross-national survey of university biologists and physicists encompassing France, Hong Kong, India, Italy, Taiwan, Turkey, UK and the USA. We indeed find religious tradition differences. Hindus and scientists with no religious tradition are more likely to agree that commercialization of science “harms a university’s commitment to knowledge production” than Protestants. We end with a discussion on business ethics and the moral limits of the market as well as implications for entrepreneurs of contested commodities. (shrink)

HIS ARGUMENT HAS THREE PREMISES: FIRST, THAT TO CALL SOMETHING OBSCENE IS TO EXPRESS STRONG BUT OFTEN NONMORAL DISAPPROVAL; SECOND, THAT THIS STRONG DISAPPROVAL COMMITS ONE TO SEEK LEGISLATION KEEPING THE MATERIAL FROM CHILDREN; THIRD, THAT SUCH LEGISLATION IS A FORM OF CENSORSHIP. I QUESTION EACH PREMISE.

The normative notion of fittingness figures saliently in the work of a number of ethical theorists writing in the late nineteenth and mid-twentieth centuries and has in recent years regained prominence, occupying an important place in the theoretical tool kits of a range of contemporary writers. Yet the notion remains strikingly undertheorized. This article offers a (partial) remedy. I proceed by canvassing a number of attempts to analyze the fittingness relation in other terms, arguing that none is fully adequate. In (...) explaining why various analyses of fittingness fail, I draw into relief certain of the relation’s constitutive features and spotlight some of its interesting and important connections to various other properties. Along the way, I highlight the relation’s relevance to a number of ongoing debates in normative and metanormative philosophy. I conclude by indicating some directions for further research. (shrink)

There is considerable evidence that the hippocampal system contributes both to (1) the temporary maintenance of memories and to (2) the processing of a particular type of memory representation. The findings on amnesia suggest that these two distinguishing features of hippocampal memory processing are orthogonal. Together with anatomical and physiological data, the neuropsychological findings support a model of cortico-hippocampal interactions in which the temporal and representational properties of hippocampal memory processing are mediated separately. We propose that neocortical association areas maintain (...) shortterm memories for specific items and events prior to hippocampal processing as well as providing the final repositories of long-term memory. The parahippocampal region supports intermediate-term storage of individual items, and the hippocampal formation itself mediates an organization of memories according to relevant relationships among items. Hippocampal-cortical interactions produce (i) strong and persistent memories for events, including their constituent elements and the relationships among them, and (ii) a capacity to express memories flexibly across a wide range of circumstances. Commentators have sometimes interpreted Arendt’s criticism of the use of measures in politics as leading to an anti-idealistic vision of politics that prioritizes sui generis action over normatively guided action. In this essay, I argue that Arendt was more ambivalent on the role of measures in politics than has often been supposed. I argue, first, that Arendt’s criticism of measures in The Human Condition extends only as far as instrumental kinds derived from extra-worldly sources, like a transcendent realm of forms (...) or an immanent realm of passions or cognitions. Second, I argue that Arendt prepares for an appropriately political conception of measures within The Human Condition, thus linking that text to her later writings on judgment where exempla are suggested as fulfilling this role. Finally, I summarize how exempla satisfy a conception of measures consistent with worldliness, plurality and natality. (shrink)

This is a collection of articles which represents current research on the metaphysics of causation and laws of nature, mostly by authors working in or active in the Australasian region. The book provides an overview of current work on the theory of causation, including counterfactual, singularist, nomological and causal process approaches. It also covers work on the nature of laws of nature, with special emphasis on the scientific essentialist theory that laws of nature are, at base, the fundamental dispositions or (...) capacities of natural kinds of things. Because the book represents a good cross-section of authors currently working on these themes in the Australasian region, it conveys something of the interest and excitement of an active philosophical debate between advocates of several different research programmes in the area. Is torturing innocent people ever morally required? I rebut responses to the ticking-bomb dilemma by Slote, Williams, Walzer, and others. I argue that torturing is morally required and should be performed when it is the only way to avert disasters. In such situations, torturers act with dirty hands because torture, though required, is vicious. Conversely, refusers act wrongly, yet virtuously, thus displaying admirable immorality. Vicious, morally required acts and virtuous, morally wrong acts are odd, yet necessary to preserve the ticking-bomb (...) dilemma’s phenomenology, the role of habituation in moral development, the virtue/continence distinction, and morality’s overridingness, consistency, and plausibility. A recent conference had as a theme, Ethics in the Fractured State. That theme presumes that there is a fractured state – if not everywhere then somewhere, if not now, then soon. This paper looks at the nature of the fracture and at the implications for the teaching of ethics. Three important lines of fracture – plural, secular, anti-business – are considered in the paper, each described and distinguished separately. The fracture makes ethics more relevant not only in business schools (...) but also in professional faculties such as engineering and pharmacy. The recent rise in anti-business sentiment and its potential impact for the teaching of ethics, especially business and professional ethics, is discussed. Extract in lieu of Abstract: The purpose of this paper is to propose a hypothesis to illuminate Ortega's critical response to Heidegger's question of being (Seinsfrage). While Ortega integrated the classical requirements for the idea of Being into his idea of human life as radical reality, Heidegger's delineation of human life (Dasein) was only preliminary to the final philosophical task of understanding the question of Being itself (Sein) as the transcendent horizon for human life. For Ortega human life is not (...) merely a preliminary ontology that points to another transcendent reality, but final reality itself. I shall argue here that: (1) Ortega saw Heidegger's Seinsfrage as both empty and dead-ended as a philosophical enterprise; (2) by Heidegger's refusal to understand human life and its circumstances as the final goal of philosophy, he failed to account for the reality of human life in its circumstantial, historical, and methodological dimensions; and (3) Heidegger's philosophical project results in a frozen and metaphysical concept of human nature that transcends the historicality of humanity's actual existence and artificially bifurcates history into opposed metaphysical and empirical dimensions that only Ortega's doctrine of historical reason can synthesize. This article presents the findings of an empirical investigation into the role of third party interventions in the House of Lords. It examines all the judgments in that court from 1994 to 2009 and tests four hypotheses concerning the impact of the Human Rights Act 1998 upon the incidence of interventions and their influence on the decision-making of the Law Lords.

This short paper provides preliminary findings into the level of moral development and ethical decision-making patterns of public relations practitioners inAustralia and New Zealand. Our findings suggest that most PR practitioners rely on their own sense of right or wrong when addressing ethical dilemmas. However, these practitioners also only exhibit very low levels of concern for Kohlberg’s postconventional stages of moral reasoning.

The present essay expands on some of the analogies which Aquinas himself, though no proponent of AI theory, might have found interesting.
