In international arbitration, timely application and enforcement of interim measures can have a substantial effect on the possibility of the enforcement of final arbitration award, especially when issues relating to the protection of assets or evidence arise before or during the course of arbitration proceedings. Though the substantive amendments to the UNCITRAL Model Law on International Commercial Arbitration concerning the application and enforcement of interim measures in international arbitration were made in 2006, the legal regulation of these matters in Lithuania (...) by the Law on Commercial Arbitration remained as previous. Hence, the purpose of this article is to provide a brief analysis of the contemporary universal legal doctrine and international practice regarding the availability, application and enforcement of interim measures in international arbitration; to examine and evaluate the Lithuanian law and court practice, their compliance with the analyzed contemporary universal legal doctrine and international practice on the application and enforcement of interim measures in international arbitration. Cross-cultural comparisons often investigate values that are assumed to have long-lasting influence on human conduct and thought. To capture and compare cultural values across cultures, Geert Hofstede's Cultural Dimensions Theory has offered an influential framework. Hofstede also provided a survey instrument, the Values Survey Module (VSM), for measuring cultural values as outlined in his Cultural Dimensions Theory. The VSM has since been subject to a series of revisions. Yet, data on countries have been derived from the original VSM — and (...) not on one of the revised versions of VSM. We tested three scales (indulgence, power distance, and individualism) from the latest version, the VSM 2013, as part of a larger survey across 57 countries. Two main findings emerged. For one thing, country scores based on the VSM 2013 scales correlated only weakly with country scores of the same cultural dimensions obtained in a large previous study. Thus, the validity of the VSM 2013 is in doubt. For another thing, the internal consistency of the VSM 2013 scales was overall poor, indicating that the scales did not reliably measure well-defined constructs. ArgumentTwo medical delegations, one from Palestine and one from the United States, were sent to detainment camps in Cyprus in the summer of 1947. The British Mandatory government had set up these camps in the summer of 1946 to stem the flow of Jewish immigrants into Palestine after World War II. The purpose of the medical delegations was to screen the camps' inhabitants and to propose a mental-health program for their life in Palestine. We examine the activities of these two (...) delegations within the context of their scientific interest in the psycho-pathology of displaced persons after World War II and as part of a broader project of mental hygiene. According to the delegations, the detainees would be a potential source of strength for building a new society if they adapted to life in Palestine. However, they would become a burden if they failed to be absorbed. At the same time, the medical delegations also saw the detainee camps as a potential “living laboratory” for scientific exploration. The case of the two medical delegations in Cyprus is also a story about constructing and transgressing medical borders. Apart from the obvious fact that this case study deals with movement of people, refugees as well as health-care workers, it is also about the transmission of knowledge and professions across the ocean. Currently the two popular ways to practice Robinson’s nonstandard analysis are the model-theoretic approach and the axiomatic/syntactic approach. It is sometimes claimed that the internal axiomatic approach is unable to handle constructions relying on external sets. We show that internal frameworks provide successful accounts of nonstandard hulls and Loeb measures. The basic fact this work relies on is that the ultrapower of the standard universe by a standard ultrafilter is naturally isomorphic to a subuniverse of the internal (...) universe. (shrink)

The aim of this paper is to present a revision of international versions of the Utrecht Work Engagement Scale and to describe the psychometric properties of a Portuguese version of the UWES-9 developed simultaneously for Brazil and Portugal, the validity evidence related with the internal structure, namely, Dimensionality, measurement invariance between Brazil and Portugal, and Reliability of the scores. This is the first UWES version developed simultaneously for both countries, and it is an important instrument for understanding employees' (...) work engagement in the organizations, allowing human resources departments to better use workforces, especially when they are migrants. A total of 524 Brazilian workers and 522 Portuguese workers participated in the study. Confirmatory Factor Analysis, group comparisons, and Reliability estimates were used. The use of workers who were primarily professionals or administrative support, according to ISCO-08, reinforced the need to collect data on other professional occupations. Confirmatory factor analysis showed acceptable fit for the UWES-9 original three-factor solution, and a second-order factor structure has been proposed that presented an acceptable fit. Full-scale invariance was obtained between the Portuguese and Brazilian samples, both for the original three-factor first-order and second-order models. Data revealed that Portuguese and Brazilian workers didn't show statistically significant differences in the work engagement dimensions. This version allows for direct comparisons of means and, consequently, for performance of comparative and cross-cultural studies between these two countries. (shrink)

The aim of this paper is to give one kind of internal proportional systems with general representation and without closure and finiteness assumptions. First, we introduce the notions of internal proportional system and of general representation. Second, we briefly review the existing results which motivate our generalization. Third, we present the new systems, characterized by the fact that the linear order induced by the comparison weak order ≥ at the level of equivalence classes is also a weIl order. (...) We prove the corresponding representation theorem and make some comments on strong limitations of uniqueness; we present in an informal way a positive result, restricted uniqueness for what we call connected objects. Climate change harmfully affects social and natural systems. These outcomes adversely affect the human and natural systems, resulting in adopting related-response measures whose implementation yields similar outcomes, especially when poorly designed. Climate-related projects, actions, and policies cause harmful environmental impacts, even though the United Nations Convention on Climate Change and its subsequent instruments urge parties, when dealing with climate change, to employ methods that preserve the quality of the environment. Few studies have established the effects of these environmentally, economically, culturally, (...) and socially unsound mechanisms on public participation, although research usually proves that ecological and environmental citizenship can enhance climate action. The study also highlights gaps in the common understanding of public participation in climate action. This reflection analyses the relationships between public participation and climate response measures and concludes that uncertainty related to response measures could affect the perception of climate action by the public. The reflection, therefore, shows that many international environmental law legal instruments, policies, and scholarships attempt to address the issue. (shrink)

Clinics and hospitals around the globe are offering stem cell treatments to persons with serious conditions for whom no effective therapies are available in their home countries. Many of these treatments, which are touted as cures for such conditions as Parkinson's and Alzheimer's Diseases, multiple sclerosis, and spinal cord injuries, have not gone through clinical trials that establish their safety and efficacy. Indeed, it is unclear whether some of them even utilize stem cells. State regulation of these therapies tends to (...) be weak or nonexistent in some of the countries in which they are offered. This work provides the means for re-establishing the unity of science by interpreting the whole of modern experimental science from the perspective of analogous transfer of the metaphysical principle of unity rather than in terms of efficient causality.

This article replicates a U.S. study of marketing norms in an international setting. The dimensionality and reliability of the scales are tested in the U.S., Singapore and South Africa. Support is found for the use of the scales, as modified. The norms of the current respondents are compared with those of the original U.S. respondents and each other. Differences between the three countries are found with respect to general honesty and integrity norms, but not for specific marketing-related norms. Language meets reality by measuring it. My aim in this paper is to shed some light on Wittgenstein's metaphors of language's meeting and measuring reality. My additional aim will be to delimit to what extent or in what sense these functions of language are transcendental.

In the present paper the relation between objective and subjective time is studied from a neutral non-dualist perspective Adoption of the relational concept of time leads to fundamental problems of time measurement of the uniformity of time measures, and of a native measure of duration in subjective experience. Experimental data on discrimination and reproduction of time intervals are reviewed and relevant models of internal time representations are discussed. Special attention is given to the 'dual klepsydra model' (DKM)and to (...) the outstanding properties of the reproduction func- tion yielded by the DKM Time scales generated by a DKM-based reproduction mechanisms are studied It is shown that such 'klepsydraic clocks' generate time measures which are non-uniform with respect to objective time yet internally consistent within an ensemble of such clocks and in this sense 'quasi-uniform' . Measurement instruments assessing multiple emotions during epistemic activities are largely lacking. We describe the construction and validation of the Epistemically-Related Emotion Scales, which measure surprise, curiosity, enjoyment, confusion, anxiety, frustration, and boredom occurring during epistemic cognitive activities. The instrument was tested in a multinational study of emotions during learning from conflicting texts. The findings document the reliability, internal validity, and external validity of the instrument. A seven-factor model best fit the data, suggesting that epistemically-related emotions should be conceptualised (...) in terms of discrete emotion categories, and the scales showed metric invariance across the North American and German samples. Furthermore, emotion scores changed over time as a function of conflicting task information and related significantly to perceived task value and use of cognitive and metacognitive learning strategies. Although considerable research indicates that mental energy is an important factor in many domains, including athletic performance (Cook & Davis, 2006), athletic mental energy (AME) has never been conceptualized and measured. Therefore, the aim of this study was to conceptualize and develop a reliable and valid instrument to assess athletic mental energy. In Study 1, a focus group interview established the initial framework of athletic mental energy. Study 2 used a survey to collect athletes’ experiences of athletic mental energy and (...) develop a scale draft titled “Athletic Mental Energy Scale (AMES).” In Study 3, we examined the psychometric properties and the underlying structure of AMES via item analysis, internal consistency, and exploratory factor analysis (EFA). In Study 4, we used confirmatory factor analysis (CFA) to examine AMES’s factorial validity; and examined concurrent and discriminant validity by examining correlations with athletes’ life stress, positive state of mind, and burnout. In study 5, we examined the measurement invariance of the 6-factor, 18-item AMES with Taiwanese and Malaysian samples. Study 6 examined the predictive validity by comparing AMES scores of successful and unsuccessful martial artists. Across these phases, results showed a 6-factor, 18-item AMES had adequate content validity, factorial structure, nomological validity, discriminant validity, predictive validity, measurement invariance, and reliability. We suggest future studies may use AMES to examine its relationships with athletes’ cognition, affect, and performance. The application of AMES in sport psychology was also discussed. (shrink)

BackgroundThe rating of perceived exertion scales with respiratory and muscular illustrations are recognized as simple and practical methods to understand individual psychometric characteristics in breathing and muscle exertion during exercise. However, the implementation of respiratory and muscular RPE to quantify training load in futsal training camps has not been examined. This study investigates respiratory and muscular RPE relationships during domestic training camps and overseas training camps in an under 20 futsal national team.MethodsData collected from eleven field players were used for (...) comparison in this study. All players reported Borg CR10 RPE and 7-scales respiratory RPE and muscular RPE after training sessions and matches. Additionally, total distance covered and training impulse were used to quantify external and internal loads via the Polar Team Pro system. Paired-sample t-tests were used to compare the RPECR10, RPErespiration, RPEmuscle, TD, and TRIMP between DTC and OTC. Furthermore, linear regression was performed to determine the relationships among all RPE scales, TD, and TRIMP.ResultsThe RPECR10, TD, and TRIMP showed significant difference between DTC and OTC. Furthermore, linear regression analyses showed significant correlation between RPErespiration and RPEmuscle, RPECR10 and RPErespiration, and RPECR10 and RPEmuscle.ConclusionPictorial RPErespiration or RPEmuscle can be used as an alternative to quantify perceived measures of internal loads during DTC and OTC in futsal players. Interpretation of perceived measures of training load and cardiac-related responses in association with external training loads during short-term training camps would be useful in further understanding the demands of futsal players’ experience in these circumstances. My response to the commentaries highlights three main points. First, the Sociosexual Orientation Inventory (SOI) has demonstrated adequate reliability and validity across dozens of studies, and it deserves its reputation as a useful measure of basic human mating strategies. Second, the sampling limitations of the International Sexuality Description Project (ISDP) do not negate the conclusion that sex differences in sociosexuality are likely universal across cultures. Third, the ISDP results support several theories of human sexuality, although some are based on faulty (...) assumptions that render them less viable than others. (shrink)

The huge amounts spent on store security and crime prevention worldwide, not only costs international businesses, but also amounts to a hidden tax on those law-binding consumers who bear higher prices. Most previous research has focused on shoplifting and ignored many other ways in which consumers cheat businesses. Using a hybrid of both qualitative research and survey approaches in four countries, an index of 37 activities was developed to examine consumers’ unethical activities across UK, US, France, and Austria. The findings (...) indicate that around three quarters of consumers in all four countries can be classified as heavy offenders for these minor cheats. The paper argues that government agencies, marketers, and retailers should adopt more pro-active preventative approaches, rather than reactive loss limitation measures to combat unethical behavior. In this article, the authors study the interpretation of macro-level data on international co authorship collaboration. They address such questions as how one might explain country- to-country differences in the rates of international coauthorship, networks of interna tional scientific collaboration among countries, and patterns of international collaboration in scientific fields. Attention is drawn to cognitive, social, historical, geopolitical, and economic factors as potential determinants of the observed patterns. The Meaning in Life Questionnaire is a popular tool to measure the presence of and one’s search for meaning in life. Although the validity of the MLQ has been verified in previous studies, the evidence from longitudinal measurement invariance of the MLQ is still lacking. The current study aimed to examine the LMI of the MLQ in a sample of Chinese college students at a 1-year interval. Multigroup confirmatory factor analysis was used to examine the LMI of the MLQ (...) over four time points. Results indicate that the MLQ has strict longitudinal invariance across 1-year in Chinese college students, and the latent means difference of MLQ-P is not significant differences across time, while the latent means difference of MLQ-S show significant differences between Time 1 and the other time points. Moreover, the internal consistency reliabilities of the MLQ scores were acceptable at all four time points, and the stability coefficients across time were moderate. These findings provide preliminary evidence that the MLQ has satisfactory longitudinal properties in Chinese college students. (shrink)

Neoliberal precepts of the governance of academic science-deregulation; reification of markets; emphasis on competitive allocation processes have been conflated with those of performance management—if you cannot measure it, you cannot manage it—into a single analytical and consequent single programmatic worldview. As applied to the United States’ system of research universities, this conflation leads to two major divergences from relationships hypothesized in the governance of science literature. (1) The governance and financial structures supporting academic science in the United States’ system of (...) higher education are sufficiently different from those found in many other OECD countries where these policies have been adopted to produce political pressures for an increase rather than a decrease in governmental control over university affairs. (2) The major impact upon academic science of performance measurement systems has come not externally from new government requirements but internally from the independent adoption of these techniques by universities, initially in the name of rational management and increasingly as devices to foster reputational enhancement. The overall thrust of the two trends in the U.S. has been less a shift as experienced elsewhere from bureaucratic to market modes of governance than the displacement of professional-collegial control by internal bureaucratic control. In the early stages of the COVID-19 pandemic, Italy, Spain, New York, and Hong Kong stood out for the ir high rates of infections. Given this scenario, a web-based international multisite and cross-sectional study was conducted between April and May 2020 to investigate the psychological impact of the pandemic and the restrictions imposed by the governments in these countries. We expected similar patterns in European countries, and no significant differences in terms of psychological impairment between Hong Kong and the other (...) areas. Participants were 1955 adults from the above-mentioned areas. We assessed anxiety, depression, COVID-19-related threats, and perceived burden of restrictive measures. Two-explorative factor analyses with Promax rotation identified COVID-19-related factors: personal physical threat, personal economic threat, global economic threat, and restriction-related burden. ANOVAs studied locations’ differences and two-separate hierarchical multiple regression analyses by location determined whether and how COVID-19-related variables were associated with anxiety and depression, adjusting for age and sex. Italy and Hong Kong showed higher anxiety than Spain ; Hong Kong scored higher on depression than Italy and Spain, which highlighted the lowest mean-score. New York participants showed the poorest mental health conditions. Anxiety was predicted by restriction-related burden and personal economic threat in New York and Hong Kong ; by global economic threat and restriction-related burden in Italy ; and by personal physical threat in Spain. Depression was predicted by restriction-related burden and personal economic threat in New York and Hong Kong ; by global economic threat in Italy ; and no predictors emerged in Spain. Findings could contribute to understanding the specific impact of the pandemic on people’s psychological health in each area, along with the factors that impacted mental health. This information may be useful to implementing prevention interventions in case of restrictions. (shrink)

The main thesis guiding the conceptual development of our corporate performance measurement model is that business success – defined as long-term survival and growth – is determined by relationship quality (1) among the various organizational departments (internal stakeholders), (2) between internal and external stakeholders, and (3) between internal and distal stakeholders. Relationship quality among internal stakeholders is conceptualized and operationalized in terms of internal service quality. Relationship quality between internal and external stakeholders is (...) conceptualized and operationalized in terms of external service quality. Relationship quality between internal and distal stakeholders is conceptualized and operationalized in terms of company goodwill. Thus, corporate performance of manufacturing firms can be measured by a survey of representatives of internal, external, and distal stakeholders. Our primary aim in this paper is to sketch the account of virtue that we think most amenable to virtue measurement. Our account integrates Whole Trait Theory from psychology with a broadly neo-Aristotelian approach to virtue. Our account is ‘ecumenical’ in that it has appeal for a wide range of virtue ethicists. According to WTT, a personality trait is composed of a set of situation-specific trait-appropriate responses, which are produced when certain “social-cognitive” mechanisms are triggered by the perception of (...) trait-relevant stimuli in a person’s external and/or internal environment. Moving from this starting point, we discuss our conception of a virtue and respects in which it both aligns with and diverges from Aristotle’s conception. We discuss roles for practical wisdom and motivation in our conception of virtue, and highlight respects in which WTT provides an amenable empirical framework into which key Aristotelian elements can be integrated. We conclude with brief remarks about our conception as an empirically adequate and measurable account. (shrink)

Social desirability bias is a pervasive measurement challenge in the social sciences and survey research. More clarity is needed to understand the performance of social desirability scales in diverse groups, contexts, and cultures. The present study aims to contribute to the international literature on social desirability measurement by examining the psychometric performance of a short version of the Marlowe-Crowne Social Desirability Scale in a nationally representative sample of teachers in Kazakhstan. A total of 2,461 Kazakhstani teachers completed the (...) MCSDS – Form C in their language of choice. The results failed to support the theoretical unidimensionality of the original scale. Instead, the results of Random Intercept Item Factor Analysis model suggest that the scale answers depend more on the method factor rather than the substantial factor that represents SDB. In addition, an alternative explanation indicates that the scale seems better suited to measuring two SDB correlated factors: attribution and denial. Internal consistency coefficients demonstrated unsatisfactory reliability scores for the two factors. The Kazakhstani version of the MCSDS – Form C was invariant across geographic location, language, and partially across age groups. However, no measurement invariance was demonstrated for gender. Despite these limitations, the analysis of the Kazakhstani version of the MCSDS – Form C presented in this study constitutes a first step in facilitating further research and measurement of SDB in post-Soviet Kazakhstan and other collectivist countries. The Gratitude Questionnaire-Six Item Form (GQ-6; McCullough et al., 2002) is a well-established instrument for measuring gratitude. Recently, the Multi-Component Gratitude Measure (MCGM) was developed as a more holistic approach (Morgan et al., 2017). While the GQ-6 mainly focuses on the emotional component of gratitude, the MCGM encompasses conceptual, attitudinal and behavioral aspects. As of today, there is no validated German measure for gratitude. In order to close that research gap, the present study focused on validating the German versions of (...) the GQ-6 (GQ-6-G) and of the MCGM (MCGM-G). In addition, multi-group comparisons were conducted to test for cultural measurement invariance. Construct validity was tested similar to original validation studies of the two scales focusing on affect, well-being, empathy, anxiety and depression. The online survey was completed in random order by 508 participants. The one-factor model of the GQ-6-G and the hierarchical structure of the MCGM-G could be replicated. However, model fit of the Gratitude Questionnaire was significantly better after eliminating one item (GQ-5-G). Multi-group comparisons revealed cultural measurement invariance was established for the GQ-5-G and partial measurement invariance for five of six factors of the MCGM-G, respectively. Reliability analyses revealed good internal consistency for both instruments and measures for criterion-related and discriminant validity have shown hypothesized relationships. Thus, the GQ-5-G and the MCGM-G are two instruments with good reliability and validity for measuring gratitude in Germany. (shrink)

The Satisfaction With Life Scale (Diener, Emmons, Larsen, & Griffin, 1985) has been the dominant measure of life satisfaction since its creation more than 30 years ago. We sought to develop an improved measure that includes indirect indicators of life satisfaction (e.g., wishing to change one’s life) to increase the bandwidth of the measure and account for acquiescence bias. In 3 studies, we developed a 6-item measure of life satisfaction, the Riverside Life Satisfaction Scale, and obtained reliability and validity evidence. (...) Importantly, the Riverside Life Satisfaction Scale retained the high internal consistency, test– retest stability, and unidimensionality of the Satisfaction With Life Scale. In addition, the Riverside Life Satisfaction Scale correlated with other well-being measures, Big Five personality traits, values, and demographic information in expected ways. This dissertation seeks to answer the following question: does a commitment to liberalism require state remediation of illiberal practices of illiberal minority cultures that only affect their own members? Put differently, it asks: should the state deny illiberal minority cultures such as those of the Amish, Ultra-Orthodox Jews, Pueblo Indians, et cetera the freedom to be internally illiberal from a liberal viewpoint? The answer proposed by this dissertation is a qualified ‘no’. Assuming that liberalism is fundamentally committed to the protection (...) of individual freedom, I argue that states should allow illiberal minority cultures to be internally illiberal in order to respect the individual freedom of citizens with illiberal conceptions of the good. At the same time, I propose limits to this toleration in order to protect the individual freedom of progressive-minded citizens, as well as to guard children from severely harmful cultural practices. Whether the state should tolerate illiberal practices of illiberal minority cultures that only affect their own members, I claim, should depend on whether the following conditions are met: Their adult members are guaranteed substantive exit rights, i.e. rights to a realistic ability to change cultural affiliations. The cultural communities in question do not engage in illiberal practices that inflict severe harm on children. To realise condition, which forms the core of this dissertation’s ‘substantive exit rights strategy’, I argue that the state should take five measures. These include making an autonomy-facilitating education compulsorily for children, providing particular groups of defectors with financial assistance, and ensuring that the liberal majority culture is open to ex-members of illiberal minority cultures. By contrast, condition is not considered to be central to this dissertation’s substantive exit rights strategy, the reason being that it is dubious whether liberalism’s core commitment to the protection of individual freedom alone can justify a ban on cultural practices that severely harm children. Even so, it will become clear that adding this condition renders this approach more plausible. My central claim is that this dissertation’s substantive exit rights strategy better protects the individual freedom of members of illiberal minority cultures than the main rival liberal strategies, as proposed by Will Kymlicka and Chandran Kukathas. Whereas Kymlicka gives members of these groups too little liberty to engage in illiberal practices, I argue that Kukathas makes the opposite mistake of granting them too much liberty. In both cases, we will see that the individual freedom of some members of illiberal minority cultures is not appropriately protected. This holds true, I conclude, regardless of whether individual freedom is construed as personal autonomy or in a less demanding way, namely as ability to live in accordance with one’s conception of the good.
