This paper explores ways of defining the political within the framework of legal reality. The relevance of the research topic is due to modern processes of economic globalization, which contribute to the establishment of a neoliberal type of state that transforms the state of exception, turning the exceptional measure into a permanent management technology. Economic globalization raises anew the question of the specificity of the political. It is shown that the dual nature of the state of exception establishes two different (...) ways of interpreting the political. In the first version, the political is defined through the legal boundary, where it relates to the state of full power of the sovereign and/or dictator (Schmitt). In the second version, the political is defined through the boundary indicating the state of exhaustion of legal competence, which corresponds to the situation of a lack of legal rights of homo sacer (Agamben). Olivier Pelon et Anne Schmitt Étude en laboratoire des céramiques dites de Vassiliki (Crète orientale) p. 431-442. La céramique minoenne dite de Vassiliki est datée du Minoen Ancien II et se rencontre sur la plupart des sites crétois de cette époque ; très reconnaissable, elle se caractérise par un décor flammé constitué de plaques irrégulières, rouges orangées et noires. Pour la détermination de son lieu de production, on a procédé à l'étude chimique globale par fluorescence X, complétée par une (...) étude pétrographique, de divers échantillons provenant de Malia, de Myrtos-Pyrgos, de Myrtos-Fournou Koryphi et de Vassiliki même. Cette étude conduit à distinguer deux groupes de composition chimique différente. Le premier, bien représenté à Malia et à Vassiliki – ce qui autorise l'hypothèse d'échanges entre les deux sites –, pourrait provenir de Vassiliki. Le second, de facture beaucoup plus grossière et beaucoup plus abondant que le premier à Malia, est, selon toute vraisemblance, de provenance locale ; les caractéristiques de l'argile utilisée le rapprochent en effet de celle des formations métamorphiques du massif du Sélinari, à quelques kilomètres à l'Est du site. The purpose of the study is to develop theoretical and organizational and methodological recommendations for improving state financial control. The article analyses the main performance indicators of the state financial control bodies, identifies the weaknesses of their activities, groups of problems and shortcomings of the current state financial control system. The scientific novelty consists in the development of a set of measures aimed at improving state financial control in the Russian Federation. A widespread assumption in experimental comparative cognition is that, barring compelling evidence to the contrary, the default hypothesis should postulate the simplest cognitive ontology consistent with the animal’s behavior. I call this assumption the principle of cognitive simplicity . In this essay, I show that PoCS is pervasive but unjustified: a blanket preference for the simplest cognitive ontology is not justified by any of the available arguments. Die Reaktion auf seine Schriften, Handlungen und Ausstrahlungen ist vielfältig; die Spanne reicht von entrüsteten, für die er der Teufel in Person bleibt, über viele Zwischenstufen bis zu jenen Lesern, die ihn für einen der subtilsten, noch keineswegs ausgeloteten Geistern dieses Jahrhunderts halten. Sein Leben lang war Carl Schmitt ein passionierter Schreiber von Briefen. Meist handelte es sich um handschriftlich verfasste, die für den Schreibenden (...) die Fortsetzung eines konkreten Gespräches mit anderen Mitteln war. Das macht das authentische und die Spontanität der Schmitt-Briefe aus. Als erste Edition einer umfangreichen Korrespondenz wird in dem Buch die Korrespondenz zwischen Carl Schmitt und Armin Mohler veröffentlicht. Der Briefwechsel umfasst die Zeit von 1947 bis 1980 und enthält 280 Briefe und Karten von Carl Schmitt an Armin Mohler. Von dem Briefpartner und Herausgeber wird in der Regel aus den eigenen Briefen nur auszugsweise zitiert, sofern es für das von Carl Schmitt Geschriebene notwendig ist. Armin Mohler (1920 bis 2003), ist einer der bekanntesten rechtskonservativen Schriftsteller, Kritiker und Historiker in Deutschland. Sein Handbuch zur Konservativen Revolution ist ein Standardwerk. In der Zeit des Briefwechsels war Mohler von 1949 bis 1953 Sekretär Ernst Jüngers, danach Korrespondent großer Zeitungen in Paris und von 1964 an Geschäftsführer der Carl Friedrich von Siemens Stiftung, in der er sehr beachtete Symposien zu aktuellen wissenschaftlichen Themen organisierte. Der Briefwechsel ist für die Deutung Carl Schmitts in der Nachkriegszeit in seinem Sauerländer "Exil" grundlegend, gleichzeitig enthält er pointierte Schlaglichter auf das politische und kulturelle Geschehen der frühen und mittleren Bundesrepublik sowie auf Werk und Leben von Ernst Jünger. The aim of this article is to discuss quantitative content analysis as established in communication sciences as a method for research in business ethics. We argue that communication sciences and business ethics are neighboring disciplines, which allow the transfer of quantitative content analysis from communication sciences to business ethics. Technically, quantitative content analysis can be applied through human as well as software coding. Examples for both applications are provided and discussed. We make reference to the software solutions ‘Leximancer’, ‘Crawdad’, and (...) ‘Wordle’, and examine their suitability and limitations with regard to ethical questions for researching business ethics. We recommend a mixed‐method approach, combining human and software coding. Furthermore, we propose a three‐step process that discusses quantitative content analysis as a method for business ethics, including an ethical research objective, and most importantly, concluding with ethical reasoning and interpretation of the quantitative results. We critically reconsider an old hypothesis of the role of the dekad in Pythagorean philosophy. Unlike Zhmud, we claim that: 1) the dekad did play a role in Philolaus’ astronomical system, and 2) Aristotle did not project Plato’s theory of the ten eidetic numbers onto the Pythagoreans. We claim that the dekad, as the τέλειος ἀριθμός, should be understood in Philolaus’ philosophy as completeness and the basis of counting in Greek – as in most other languages – in a decimal (...) system. Additionally, we argue that the number ten is not even a candidate for the τέλειος ἀριθμός in Plato’s philosophy. As a final result of our discussion, we compare and contrast Philolaus’, Plato’s, and Speusippus’ accounts of completeness in relation to numbers. (shrink)

In guarding against inferential mistakes, experimental comparative cognition errs on the side of underattributing sophisticated cognition to animals, or what I refer to as the underattribution bias. I propose eliminating this bias by altering the method of choosing the default, or null, hypothesis. Rather than choosing the most parsimonious null hypothesis, as is current practice, I argue for choosing the best-evidenced hypothesis. Doing so at once preserves the risk-controlling structure of the current statistical paradigm and introduces a sensitivity to probability-conferring (...) empirical and theoretical information. This analysis illustrates how values like parsimony can covertly shape statistical-experimental design and inference. (shrink)

The question "Where do we come from?" has fascinated philosophers, scientists, and artists for generations. This book reorients the question of the matrix as a place where everything comes from (_chora_, womb, incubator) by recasting it in terms of acts of "matrixial/maternal hospitality" producing space and matter of and for the other. Irina Aristarkhova theorizes such hospitality with the potential to go beyond tolerance in understanding self/other relations. Building on and critically evaluating a wide range of historical and contemporary (...) scholarship, she applies this theoretical framework to the science, technology, and art of ectogenesis (artificial womb, neonatal incubators, and other types of generation outside of the maternal body) and proves the question "Can the machine nurse?" is critical when approaching and understanding the functional capacities and failures of incubating technologies, such as artificial placenta. Aristarkhova concludes with the science and art of male pregnancy, positioning the condition as a question of the hospitable man and newly defined fatherhood and its challenge to the conception of masculinity as unable to welcome the other. Based on a dual process view of ethical judgment, we examine the role of empathic concern and perspective taking on the acceptability of lying to protect the company. We hypothesize that these traits will matter to a different extent under conditions of high and low perceived time hurriedness. Our research hypotheses are tested in a survey of 134 US workers. Results show that empathic concern reduces the acceptability of lying to protect the company for individuals who tend to do things (...) quickly and feel in a hurry at work. On the other hand, perspective taking reduces the acceptability of lying for individuals who experience low levels of time hurriedness. Theoretical and practical implications of the findings are discussed. (shrink)

In this chapter, the author examines how the simplicity heuristic adversely affects a relatively new tool in experimental comparative cognition: cognitive models. It does so, she argues, by directing intellectual resources into the development and refinement of putatively simple cognitive models at the expense of putatively more complex ones, which in turn directs experimenters to develop tests to rule out these simple models.

This volume provides the first English translation of Hans Kelsen's and Carl Schmitt's influential Weimar-era debate on constitutional guardianship and the legitimacy of constitutional review. It includes Kelsen's seminal piece, 'The Nature and Development of Constitutional Adjudication', as well as key extracts from the 'Guardian of the Constitution' which present Schmitt's argument against constitutional review. Also included are Kelsen's review of Schmitt's 'Guardian of the Constitution', as well as some further material by Kelsen and Schmitt on (...) presidential dictatorship under Article 48 of the Weimar Constitution. These texts show Kelsen and Schmitt responding to one another, in the context of a debate focused on a concrete constitutional crisis, thus allowing the reader to assess the plausibility of Kelsen's and Schmitt's legal and constitutional theories. Many scholars consider that Socrates in the Lysis holds that friendship and love are egoistic and utility-based. In this paper, I will argue against those readings of Plato’s Lysis. I will analyze how Socrates treats utility and egoism in the many different kinds of friendship he discusses in the dialogue, from parental love, like-to-like, and unlike-to-unlike relationships, to the accounts of friendship rooted in the human relation to the good and the ways in which we can belong with some other (...) human beings. The upshot of my paper is twofold. I endeavor to prove that some of these relationships, as Plato’s Socrates discusses them, are not egoistic and that Plato represents and valorizes a particular type of friendship having to do with philosophy and philosophical way of life, which is for the sake of another. The famous pithy aphorisms that Carl Schmitt used to open his major works - 'the sovereign is he who decides on the exception', 'the concept of the state presupposes the concept of the political', etc. - have become a part of the common discourse of contemporary scholarship on politics and the law. The theoretical framework that animates these slogans, however, has remained somewhat opaque. It has often been (...) argued that there is no such framework, that Schmitt was a situational thinker whose works are best understood as interventions in concrete political debates that do not add up to a grand theoretical vision. In this paper I will discuss Aristotle?s controversial philosophical views on women. I will critically examine three main interpretations of his claim that women have deliberative faculty?without authority?. According to the first line of interpretation, Aristotle has in mind that women?s incapacity of advice-giving and decision-making in public affairs are determined by conventions in the political context of his time. I will attempt to point out the disadvantages of this kind of interpretation. Furthermore, I will put forward the reasons why (...) is implausible the more recent interpretation, given by Marguerite Deslauriers. According to her reading, the lack of authority of deliberative faculty in women means nothing else than the tasks over which women have authority are for the purpose of the tasks put forth by men. The prevailing interpretation among scholars is that, in Aristotle?s view, women are naturally inferior to men, due to the fact that they are all too frequently overruled by the irrational?forces? of their nature. I will argue that this line of interpretation elucidates what Aristotle presumably has in mind, although it makes his account of women and their rationality, if not inconclusive, then indisputably problematic. In other words, I attempt to prove that, if the prevailing line of interpretation is correct, such view of women produces some philosophically?insurmountable? problems for Aristotle. The aim of the last section of the paper is to point out how some of these problems could eventually be resolved. (shrink)

У статті проаналізовано наукові підходи та сучасні дослідження проблеми соціальної адаптації та дезадаптації. Із філософської точки зору розглядається взаємозв'язок процесів адаптації та дезадаптації батьків й вихованням дитини з вадами психофізичними розвитку. Проаналізовано співвідношення понять соціальна адаптація та соціальна дезадаптація. У статті доведено, що народження та виховання особливої дитини викликає у батьків комплекс негативних реакцій і переживань, кризових емоційних станів з притаманними їм емоційною пригніченістю, депресивними тенденціями, ситуативною та особистісною тривожністю, що є ознаками соціальної дезадаптації.

Social philosophy is knowledge that is called to answer the question about the goals of human existence and human historical life. In this sense, it is a valuative philosophy. This determines the specificity and boundaries of its object. It includes: 1) society as self-organizing system of sociality reproduction, 2) historical process in its relation with value meanings and constants of human existence, and 3) social epistemology, exploring the possibilities and ways of adequately social reality comprehension. Social philosophy conceptually crosses theoretical (...) sociology and the philosophy of history within the boundaries of its problem field. The main theme of social philosophy is a theme of human, focusing research interest on the question “Who are we and where are we going?” Today boundaries of social philosophy are blurring under the postmodern influence on the humanities. Philosophical vision of social reality is replaced by the description of narratives designed by communicative practice that cannot be represented as a whole and do not obey to general analytical logic. This actualizes an appeal to social philosophy as a way of explanation of socio-cultural realities and, in this connection, to the problematics specifying the existing ideas about its object. We suggest that understanding unethical behavior in organizations involves understanding how people view themselves and their relationships with others, a concept known as self-construal. Across multiple studies, employing both field and laboratory settings, we examine the impact of three dimensions of self-construal (independent, relational, and collective) on unethical behavior. Our results show that higher levels of relational self-construal relate negatively to unethical behavior. We also find that differences in levels of relational self for men and women mediate gender differences in (...) unethical behavior. This article addresses the oft-neglected nexus between the mother and the machine, specifically in relation to the notion of ectogenesis (that is, conception, gestation and birth outside the maternal body). After a discussion of the technologies and the discourses of ectogenesis as symptomatic of what I call an ectogenetic desire, I move on to critically consider the work of Smith-Windsor on her own maternal experience with an incubator. This is followed by an evaluation of feminist writings on reproductive technologies, leading (...) to a discussion of why the critical dichotomy between the maternal body and the machine needs to be reevaluated, to develop the possibility of a different ethics of/for the maternal body. This paper investigates the role of pictures in mathematics in the particular case of Cayley graphs—the graphic representations of groups. I shall argue that their principal function in that theory—to provide insight into the abstract structure of groups—is performed employing their visual aspect. I suggest that the application of a visual graph theory in the purely non-visual theory of groups resulted in a new effective approach in which pictures have an essential role. Cayley graphs were initially developed as exact mathematical (...) constructions. Therefore, they are legitimate components of the theory (combinatorial and geometric group theory) and the pictures of Cayley graphs are a part of practical mathematical procedures. (shrink)

We analyze programs for undergraduate women in science and engineering as strategic research sites in the study of disparities between women and men in scientific fields within higher education. Based on responses to a survey of the directors of the universe of these programs in the United States, the findings reveal key patterns in the programs’ definitions of the issues of women in science and engineering, their solutions to address the issues, their goals and perceived success with goals, and their (...) organizational characteristics and relationship to the larger institutional environments. The findings—which are conceptually grounded in the distinction between structural/institutional and individual issues facing women in science—have implications for understanding gender, science, and higher education, and for initiatives undertaken to improve the condition of women in scientific fields. The findings may also inform strategic efforts to reduce gender disparity in other organizational contexts. (shrink)

The examination will entail a comparative study of two distinct forms of intellectuals: Sergej Ivanovich, who is actively engaged in aristocratic spheres, and Levin, who maintains a deliberate distance from such political and public involvement. Levin's pursuits center on a meticulously planned overhaul of his economy, prioritizing the welfare of the peasantry. This interview took place on the 8th of April 2010 in München, at Professor Waldenfels’ house. The questions for this interview were meant to touch the most important ideas of Bernhard Waldenfels’ philosophy—the idea of universal order as a sign for a limited and dictatorial thinking, the respondent that replaces the traditional subject, the idea that an ethics according to which a subject is responsible for something to someone overestimates the unity of the subject and does injustice to all the (...) three instances of a happening (subject—for something—to someone). In this article I attempt to conceptualize myexistential and institutional experience as thedirector of the Kharkov Center for GenderStudies acquired in the course of introducinggender studies into the system of post-Soviethigher education. The main subject of thearticle concerns the logical ground of genderdiscourse and the complicated relations betweenthe notions of `gender studies', `women'sstudies', and, within the latter, `feminism' inthe former USSR, all in the framework ofconcepts from Western feminists theory.

Carl Schmitt, the author of such books as Political Theology and The Crisis of Parliamentary Democracy, was one of the leading political and legal theorists of the twentieth century. His critical discussions of liberal democratic ideals and institutions continue to arouse controversy, but even his opponents concede his uncanny sense for the basic problems of modern politics. Political Romanticism is a historical study that, like all of Schmitt's major works, offers a fundamental political critique. In it, he defends (...) a concept of political action based on notions of good and evil, justice and injustice, and attacks the political passivity entailed by the romanticization of experience. The book has three strands. The first is an attack on received notions of the origins of the Romantic Movement. Schmitt argues that this movement represents a secularization, subjectification, and privatization in which God is replaced by the emancipated, private individual of the bourgeois social order. The second is an assault on political romanticism that includes a broader attack on the new European bourgeoisie, which Schmitt characterizes as the historical bearer of the movement. The third strand is a defense of political conservatism and a refutation of the view that political romanticism is intrinsically linked with romanticism. Here Schmitt argues that the political romantic is tied not to positions but to aesthetics, and can therefore as easily become a Danton as a Frederick the Great. Guy Oakes's introduction places the book in historical context and also suggests its continuing relevance through his discussion of the latest outcropping of political romanticism in the late 1960s, intriguingly brought out in his example of Norman Mailer as a political romantic. When Johannes Hevelius’ Selenographia, sive Lunae descriptio (Selenography, or A Description of The Moon) was printed in 1647, its rich paratext featured a portrait epigram and a collection of nine Neo-Latin poems praising the first book of the Danzig (Gdańsk) astronomer. The present article examines these ten poems as a place where Hevelius’ authority as an author and astronomer is being constructed, focusing on the fictionalized and fictional relationships between Hevelius and other authorities depicted in the text. In a sort (...) of kaleidoscope, the poems relate Hevelius to prominent astronomers like Galileo and Copernicus, to Columbus, the paragon of the discoverer, to figures from ancient myth, and even, in the form of anagrams, to his own name. Moreover, they highlight Hevelius’ personal qualities as an astronomer, as a member of the realm of literature, and as a citizen of Danzig. The image of the author that emerges from the poems asserts Hevelius’ place in the public space of literature and fashions him into an authoritative figure at the threshold of his text. (shrink)

Dealing with errors in psychotherapy is challenging, both ethically and practically. There is almost no empirical research on this topic. We aimed (1) to explore psychotherapists’ self-reported ways of dealing with an error made by themselves or by colleagues, and (2) to reconstruct their reasoning according to the two principle-based ethical approaches that are dominant in the ethics discourse of psychotherapy, Beauchamp & Childress (B&C) and Lindsay et al. (L).

Alexander Moiseevich Piatigorsky was, as we can read from numerous sources, an internationally renowned Russian and English philosopher, buddhologist, indologist, translator and writer.

White matter makes up about fifty percent of the human brain. Maturation of white matter accompanies biological development and undergoes the most dramatic changes during childhood and adolescence. Despite the advances in neuroimaging techniques, controversy concerning spatial, and temporal patterns of myelination, as well as the degree to which the microstructural characteristics of white matter can vary in a healthy brain as a function of age, gender and cognitive abilities still exists. In a selective review we describe methods of assessing (...) myelination and evaluate effects of age and gender in nine major fiber tracts, highlighting their role in higher-order cognitive functions. Our findings suggests that myelination indices vary by age, fiber tract, and hemisphere. Effects of gender were also identified, although some attribute differences to methodological factors or social and learning opportunities. Findings point to further directions of research that will improve our understanding of the complex myelination-behavior relation across development that may have implications for educational and clinical practice.
