Death’s Dominion is Simon Woods’ addition to the excellent and thought-provoking Facing Death series. Its timeliness is hardly at issue: the debate on euthanasia, end-of-life care and associated issues looks set to rage for some time. And it comes out at a time when the UK Parliament is debating a palliative care bill, designed to promote a duty of the state to provide palliative care to all who need it. The real concern with a work in this area is (...) knowing whether it is worth reading. I think it is. Relatively few are the texts that deal with palliative care, and fewer still are those that deal with it in such a careful and comprehensive manner. No thorough analysis of issues regarding the roles of the state and health care in individuals’ end-of-life decision-making can afford to ignore the specialty, yet it is often left unmentioned. For anyone who wishes to know about it and to see it in a clear social and ethical context, this book will prove highly valuable.The book is logically structured, consisting of eight chapters. I distinguish two claims about human ‘dominion’ over nature: (1) Humans have the right to supervise, manage, and direct the rest of nature; (2) Humans have a special value, superior to the rest of nature. I discuss some ways of rejecting either or both claims, and point to some surprising consequences of such rejections. Then I compare the ways in which Aristotelianism and sentientism might try to keep hold of both claims. After a brief overview of the scientific data on cloning, the article examines the ethical issues put forth by this particular form of reproduction. A distinction is made between the application of cloning to the animal and vegetable realms and to the human species. The cloning of plants and animals is ethically permissible if it guarantees the preservation of species and of genetic diversity within the species. Humankind is not entitled to an absolute and irresponsible dominion -ius utendi et (...) abutendi - over the world. As the Yahwist has taught us, the human person has been placed in the middle of the garden as its guardian and caretaker . On the other hand, the prudent use of vegetable and animal cloning can render a great service to humankind both in agriculture and in medicine. When it comes to the application of cloning to the human species, the article introduces a distinction between the «procreation» of human beings through these techniques and the reproduction of human cells for therapeutic uses. The author concludes that the production of human persons through the application of cloning techniques is morally unacceptable. The ethical objections are presented under three major headings: 1) the respect due to the human embryo; 2) the dignity of the human person ; and 3) the authentic meaning of human procreation as a fully human activity. With rare exception, Roman Catholic moral theologians condemn the sale of human organs for transplantation. Yet, such criticism, while rhetorically powerful, often over-simplifies complex issues. Arguments for the prohibition of a market in human organs may, therefore, depend on a single premise, or a cluster of dubious and allied premises, which when examined cannot hold. In what follows, I will examine the ways in which such arguments are configured. For example, Thomas Aquinas’(1224-1274) understandings of embodiment and moral uses of the (...) body are usually interpreted as, and cited in support of, foreclosing a market in human organs. Aquinas’ principle of totality requires that one preserve the wholeness of the human body. In approaching Aquinas’ texts, I will assume the role of a revisionist who takes seriously his core commitments, while at the same time indicating that one can further develop his understanding of the body in ways which are supportive of the sale of human organs while remaining in conformity with the author's core concerns. Such considerations will provide significant grounds for concluding that a market in human organs for transplantation appreciates the embodied nature of the human person, respects the body and its parts as personal, rather than as mere things, is consistent with acknowledging God’s dominion over our lives and bodies, and constitutes an appropriate utilization of God's gifts to us. Moreover, such a market would likely create significant opportunities charitably to help others, to enhance human dignity and to protect against the serious dehumanization of current national bureaucratic procedures for organ donation. Conservation scholarship and policies are concerned with the viability of idealized ecological communities constructed using human metrics. We argue that the discipline of conservation assumes an epistemology and ethics of human sovereignty/dominion over animals that leads to violent actions against animals. We substantiate our argument by deconstructing a case study. In the context of recent bushfires in Australia, we examine recent legislation passed by the parliament of New South Wales, policy documents, and academic articles by conservationists that support breaking (...) communities of horses and/or killing 4,000 horses in Kosciuszko National Park, NSW. Theoretically framing our deconstruction against human sovereignty over animals and anthropocentrism, we affirm an intersectional, ecofeminist approach that values animals as relational and vulnerable agents. We uncover first the epistemic violence of categorizing horses as “pests,” and the anthropocentric nature of recently passed legislation in NSW. We analyze next the deficient ethics of NSW's government, and the argument that killing animals is justifiable when they suffer from starvation and dehydration. We close with a realistic proposal that does not involve breaking horses’ communities and/or killing horses, and a plea to the government of NSW and conservationists not to harm any horses in KNP. This question takes us to the very center of the cooperation of the human powers in the act of choice. If prudence is wanting, that act of dominion is neither truly human nor truly praiseworthy. Unless there can be truly praiseworthy human excellence in the absence of love the answer to our question ought to be affirmative. Surely the affirmative answer is favored by I Cor. 13:13 and John 14:23. Is the dominion then still human? A negative answer (...) to the question of our title is favored by what seems an Aristotelian firmness. Prudence, then, with that negative answer is nothing but knowledge? Yet Thomas Aquinas says in a very simple text: “love moves within prudential actuality”. This article examines the regalist reforming critique and the curial defence of papal temporal dominion in the eighteenth-century Italian peninsula. The discussion examines the little-explored links between the justification for papal supremacy in the Church and the historico-theological defence of its theocratic rule. The refusal of the Curia to grant reform gave rise to a radical reforming movement which produced some astoundingly bitter anti-curial polemics little known outside Italian studies, but of some significance in the history of political thought.

This little volume, by the Director of the Center for Medieval and Renaissance Studies at the University of California is a splendid work. Lynn White, who considers himself a Christian and a humanist, has written an important book linking together cultural changes in the modern world with those events in earlier periods which precipitated the changes. His major thesis is that the alienation of the humanist from technology is unfortunate, and that a rapprochement between the two is possible if one (...) reads history accurately. Technology developed, White argues, in the fertile cultural and intellectual soul of the Christian middle ages. It was the Christian view of reality that allowed man to take nature seriously and to permit him to think in terms of measuring and analyzing it. The Christian saw the world as a manifestation of the working of the mind of God, and his science was an attempt to decipher God's thought by exploring the nature of his handiwork. The technological innovations of the Middle Ages were possible because of the Christian's conviction that God had given man power and dominion over all creation: "The men who worshiped the Virgin also developed water wheels to perform all kinds of tasks that previously had been done by hand." To medieval man, the machine came from God. What White seems to be saying is that the Christian view of reality is one which produces a full-blown humanism, one in which man is free to develop his natural capacities, in a world which has been created by God for man to enjoy and in which man can best fulfill himself as a human. Abortion. The history of the treatment of abortion in the Catholic tradition is the history of an evaluation. This evaluation was somewhat muddied by [End Page 387] unclarity and inconsistency in the use of terms. Thus, some theologians distinguished three types of abortion: prevention of conception, abortion of an inanimate fetus, and abortion of an animated fetus. Others regarded all interventions into the life-giving process as homicides. Still others argued that termination of a nonanimated fetus was justified to save the life of the mother. And still others said such termination was anticipated homicide or the misuse of semen conceptum.Such unclarities and qualifications eventually vanished and produced an evaluation of fetal life that yielded to very few competing interests, what John Noonan (1970) referred to as “an almost absolute value.” There was some dominion or control, but the limits became increasingly clear and powerful.2. Individual and corporate self-defense. Augustine disallowed lethal individual or personal self-defense, but established the first elementary rules for war. Aquinas allowed both. Over the centuries, Christian thinkers, such as Thomas Aquinas, permitted the use of capital punishment. Three justifications were proposed to found this right of the state: retribution, deterrence, and reform. In the past decades, however, these justifications have been seriously questioned. Both the American and Philippine bishops’ conferences have rejected all use of capital punishment. Most recently John Paul II (1995, n. 56, p. 709) adduces defense of society as the only possible justification for it and sees such cases as “very rare if not practically non-existent.”4. The preservation of life. The theme of a balance between dominion and limits is perhaps nowhere clearer than in the Catholic approach to life preservation. Catholic tradition does not accept our culture’s rejection of death. Rather it asserts that the facts that we are pilgrims, that Christ has overcome death and lives, and that we also will live with him yield a general value judgment on the meaning and value of life as we now live it: Life is a basic good but not an absolute one. It is basic because, as the Congregation for the Doctrine of the Faith (1980, p. 511) worded it, it is the “necessary source and condition of every human activity and of all society.” It is not absolute because there are higher goods for which life can be sacrificed—e.g., the glory of God, salvation of souls, service of one’s brethren, and the like. Thus in John (15:13): “There is no greater love than this: to lay down one’s life for one’s friends. ExcerptNow a century old, Carl Schmitt’s The Crisis of Parliamentary Democracy still provides useful training for historians in the necessary task of making distinctions between “liberalism” and “democracy,” two movements that arose with overlapping but distinct core principles in eighteenth-century Europe, often competed with each other, and sometimes came into bloody conflict. Schmitt makes one highly controversial assertion, however, near the beginning of this book. After agreeing with Alexis de Tocqueville that the spread of democracy was the most powerful political (...) trend of the nineteenth century, a trend that became almost irresistible,1 Schmitt declares that there is a crucial flaw in the argument of Jean-Jacques Rousseau that exposes a major problem with democratic theory in general. Democracy has taken so many different forms, according to Schmitt, that it can only be defined according to the basic principle that political decisions are only binding for those who participated in making them. This belief presupposes “that the will of the outvoted minority is in truth identical with the will of the majority. Rousseau’s frequently cited arguments in the Contrat social are fundamental [emphasis added] for democratic thought and ultimately conform to an old tradition.”2 Schmitt refers here to Rousseau’s argument in On the Social Contract (book IV, ch. 2) that if the proposition you supported fails to gain a majority in a referendum, you should acknowledge that you had been mistaken when you voted, because the question posed to citizens was not exactly whether they personally approved of the proposition, but “whether or not it conforms to the general will that is theirs.”3 Schmitt observes caustically that “with this Jacobin logic one can, it is well known, justify the rule of a minority over the majority, even while appealing to democracy.” The first democratic movement of the modern era, the Levellers in the English Civil War, had already attempted this, Schmitt argues, when they proclaimed in 1649 that only the “well-affected” deserved the right to vote in parliamentary elections.4 Schmitt concludes that democracy is therefore highly vulnerable to the emergence of dictatorship, and that the Bolsheviks had just as strong an argument in 1923 that their brutal dominion by an “enlightened” minority was truly democratic as did the Jacobins of 1793. “Theoretically, and in critical times also practically, democracy is helpless [emphasis added] before the Jacobin argument, that is, when faced with the authoritative identification of a minority as the people.” The meaning here of “authoritative identification” (entscheidenden Identifikation) is unclear; Schmitt does not seek to explain why the majority in a democracy should ever accept a minority’s claim that it alone possesses civic virtue or wisdom.5 A very similar argument about Rousseau was made nevertheless by J. L. Talmon in The Origins of Totalitarian Democracy (published in 1952), which has in turn influenced some recent scholars who, like Talmon, do not acknowledge any intellectual debt to Schmitt.6. Martin Heidegger’s understanding of art and Paul Ricoeur’s reading of the poetics of existence, developed through his hermeneutics of symbols, metaphor and narrative, open an immense vista to a theological thinking that desires to place primacy on the hearing of the symbolic language of poetry and literature. Beginning a few decades ago, various theologians have ventured along this trajectory, but theology still remains under the dominion of “theoria” and “praxis” and is not very open to “poiesis”. The study presented (...) here revisits the book of J.-P. Manigne on the Poetics of Faith from the 1970s, and the doctoral thesis of A. Thomasset on the Poetics of Morality, from the 1990s, showing how poetic reason provoked theological discourse in the second half of the 20th century. This paper argues that human psychological resilience is a central virtue in sport and in human life generally. Despite its importance, it is an overlooked virtue in philosophy of sport and classical and contemporary virtue theory. The phenomenon of human resilience has received a great deal of attention recently in other quarters, however. There is a large and instructive empirical psychological literature on resilience, but connections to virtue theory are rarely drawn and there is no agreement about what the concept (...) refers to. This paper attempts to clarify the concept of resilience and explain how it fits into and supports a traditional Aristotelian conception of virtue. It shows how resilience figures centrally in sport and can extend and enrich our understanding of virtue and success in sport and of sport's internal values. The investigations into the nature of resilience in sport can also help us to understand better sport's contributions to human culture and well-being. (shrink)

Artificial Neural Networks have reached “grandmaster” and even “super-human” performance across a variety of games, from those involving perfect information, such as Go, to those involving imperfect information, such as “Starcraft”. Such technological developments from artificial intelligence (AI) labs have ushered concomitant applications across the world of business, where an “AI” brand-tag is quickly becoming ubiquitous. A corollary of such widespread commercial deployment is that when AI gets things wrong—an autonomous vehicle crashes, a chatbot exhibits “racist” behavior, automated credit-scoring processes (...) “discriminate” on gender, etc.—there are often significant financial, legal, and brand consequences, and the incident becomes major news. As Judea Pearl sees it, the underlying reason for such mistakes is that “... all the impressive achievements of deep learning amount to just curve fitting.” The key, as Pearl suggests, is to replace “reasoning by association” with “causal reasoning” —the ability to infer causes from observed phenomena. It is a point that was echoed by Gary Marcus and Ernest Davis in a recent piece for theNew York Times: “we need to stop building computer systems that merely get better and better at detecting statistical patterns in data sets—often using an approach known as ‘Deep Learning’—and start building computer systems that from the moment of their assembly innately grasp three basic concepts: time, space, and causality.” In this paper, foregrounding what in 1949 Gilbert Ryle termed “a category mistake”, I will offer an alternative explanation for AI errors; it is not so much that AI machinery cannot “grasp” causality, but that AI machinery (qua computation) cannot understand anything at all. Many writers have paid tribute to its power: Shakespeare urged his audiences to use it to create a setting; Hobbes asserted that "imagination and memory are but one thing; " for Wordsworth it was "the mightiest leveler known to moral world; " and to Baudelaire it represented "the queen of truth. " Imagination as artistic, poetic, and cultural predicate remains one of the most influential ideas in the history of Western thought. It has been simultaneously feared as a dangerous, uncontrollable (...) force, and revered as the supreme visionary power. The questions of its origins, nature, function, and effects have absorbed writers, theologians, and philosophers alike. J. M. In his analysis of the moral act, the Pope holds that the object of the act is "the primary and decisive element for moral judgment" (VS # 79). Actions which by the nature of their object are unable to be ordered to man's true end can never be "good" actions. Further, he notes that acts, even individual acts, are determinative of the goodness or badness of the person. These points are summarized nicely in the following passage: Activity is morally good when it attests to and expresses the voluntary ordering of the person to his ultimate end and the conformity of a concrete action with the human good as it is acknowledged in its truth by reason. If the object of the concrete action is not in harmony with the true good of the person, the choice of that action makes our will and ourselves morally evil, thus putting us in conflict with our ultimate end, the supreme good, God himself (VS # 72). I believe that Keenan's study commendably highlights the freedom of the will in the order of exercise, and its power to exercise dominion over the intellect in the order of specification. Keenan also insightfully emphasizes the central role of the love of God as the root of our striving to live well. Yet any willing can only be consequent to some knowing. Further, the willingness to strive and be determined, if it is good, is a willingness to be determined, or specified, by the true good known by reason and faith. This willingness, which is a crucial element in moral goodness, must be completed by actions in conformity with the true good. Within the Church Macintyre entered, however, there existed, and exists, widespread doubt and confusion about "moral absolutes" or " exceptionless moral norms." Certain eminent Catholic moral theologians today dissent from Pope John Paul's teaching that " there exist acts which per se and in themselves, independently of circumstances, are always seriously wrong by reason of their object." In the face of this dissent, John Finnis has produced a powerful philosophical and theological defense of the papal teaching. Moral Absolutes presents the 1988 Michael J. McGivney Lectures which Finnis delivered at the John Paul II Institute for Studies on Marriage and the Family. In this provocative work, J. L. Schellenberg addresses those who, influenced by science, take a negative view of religion, thinking of it as outmoded if not decadent. He promotes the view that transcendently oriented religion is developmentally immature, showing the consilience of scientific thinking about deep time with his view. From this unique perspective, he responds to a number of influential cultural factors commonly thought to spell ill for religion, showing the changes – changes favorable to religion – that are (...) now called for in how we understand them and their proper impact. Finally, he provides a defense for a new and attractive religious humanism that benefits from, rather than being hindered by, religious immaturity. Not long ago, one of us has clarified and defended a bare particular theory of individuation. More recently, D. W. Mertz has raised a set of objections against this account and other accounts of bare particulars and proffered an alternative theory of individuation. He claims to have shown that 'the concept of bare particulars, and consequently substratum ontology that requires it, is untenable.' We disagree with this claim and believe there are adequate responses to the three arguments Mertz raises against (...) bare particulars. To substantiate this assertion, we clarify the nature of bare particulars as individuators, state Mertz's objections, and respond to them. After measuring consumers' sentiments toward business ethical practices in mostly Christian countries, the Business Ethics Index was expanded to two Muslim countries — Turkey and Egypt. The overall BEI for both countries was on the negative range, with Egypt exhibiting the widest gap between personal ethical perceptions and vicarious ones. No difference between genders was observed.
