The static properties of leaves with parallel venation from terrestrial orchids of the genus Epipactis were modelled as coupled elastic rods using the geometrically exact Cosserat theory and the resulting boundary-value problem was solved numerically using a method from Shampine, Muir and Xu. The response of the leaf structure to the applied force was obtained from preliminary measurements. These measurements allowed the Young’s modulus of the Epipactis leaves to be determined. The appearance of wrinkles and undulation characteristics for some leaves (...) has been attributed to the small torsional stiffness of the leaf edges. (shrink)

The commentaries provide a multitude of perspectives on the theory of lexical access presented in our target article. We respond, on the one hand, to criticisms that concern the embeddings of our model in the larger theoretical frameworks of human performance and of a speaker's multiword sentence and discourse generation. These embeddings, we argue, are either already there or naturally forgeable. On the other hand, we reply to a host of theory-internal issues concerning the abstract properties of our feedforward spreading (...) activation model, which functions without the usual cascading, feedback, and inhibitory connections. These issues also concern the concrete stratification in terms of lexical concepts, syntactic lemmas, and morphophonology. Our response stresses the parsimony of our modeling in the light of its substantial empirical coverage. We elaborate its usefulness for neuroimaging and aphasiology and suggest further cross-linguistic extensions of the model. (shrink)

International legal scholars tend to think of their work as the interpretation of rules: the application of a law 'out there' to concrete situations. This book takes a different approach to that scholarship: it views doctrine as a socio-linguistic practice. In other words, this book views legal scholars not as law-appliers, but as constructing knowledge within a particular academic discipline. By means of three close-ups of the discourse on cyberwar and international law, this book shows how international legal knowledge is (...) constructed in ways usually overlooked: by means of footnotes, for example, or conference presentations. In so doing, this book aims to present a new way of seeing international legal scholarship: one that pays attention to the mundane parts of international legal texts and provides a different understanding of how international law as we know it comes about. There have been two main lines in the literature on restricted games: the first line was started by Myerson (1977) that studied graph-restricted games an the second one was initiated by Faigle (1989). The present paper provides a unified way to look on the literature and establishes connections between the two different lines on restricted games. The strength and advantages of this unified approach becomes clear in the study of the inheritance of the convexity from the game to the restricted (...) game where an interesting result by Nouweland and Borm (1991) on the convexity of graph-restricted games is turned into a direct consequence of the corresponding result by Faigle (1989), by means of this relation. Objectives To evaluate whether the requirement of “minimal risk and burden” for paediatric research without direct benefit to the subjects compromises the ability to obtain data necessary for improving paediatric care. To provide evidence-based reflections on the EU recommendation that allows for a higher level of risk. Design and setting Systematic analysis of the approval/rejection decisions made by the Dutch Central Committee on Research involving Human Subjects (CCMO). Review methods The analysis included 165 proposals for paediatric research without direct benefit (...) that were reviewed by the CCMO between January, 2000, and July, 2007. A separate, in-depth analysis of all drug studies included 18 early phase drug studies and nine other drug studies without direct benefit. Results 11 out of 165 studies were definitively rejected because the CCMO did not regard the risk and/or burden to be minimal. In three of these 11 cases (including two early phase drug studies) the requirement of minimal risk and burden was cited as the only reason for rejection. Four other early phase drug studies also involved risks and/or burdens that were not regarded to be minimal but were nevertheless approved. Conclusions The requirement of minimal risk and burden, aiming to protect research subjects, occasionally leads to rejection of protocols. Early phase drug studies relatively often do not comply with the requirement. Committees may find ways to approve important studies that formally should be rejected, but that is not a desirable solution. The regulatory framework should be revised to make such occasional exceptions to the requirement legitimate and transparent. (shrink)

It is often argued that clinical research should not violate the Kantian principle that people must not be used merely as a means for the purposes of others. At first sight, the practice of clinical research itself, however, seems to violate precisely this principle: clinical research is often beneficial to future people rather than to participants; even if participants benefit, all things considered, they are exposed to discomforts which are absent both in regular care for their diseases and in other (...) areas of daily life. Therefore, in this paper we will consider whether people are used merely as a means by being enrolled in clinical research. On the basis of recent studies of Kantian scholars we will argue that clinical research is compatible with the Kantian principle if the conditions of possible consent and end-sharing have been met. Participants are not used merely as a means if they have sufficient reasons to consent to being enrolled in clinical research and can share the ends of the researchers who use them. Moreover, we will claim that even if people are used merely as a means by participating in clinical research, it may not always be morally wrong to use them in this way. (shrink)

ABSTRACTThis article discusses the French debate of the 1580s over the status of the Salic Law and its influence upon an important text in English political thought, Robert Persons’s Conference about the next Succession to the Crowne of Ingland. Polemicists on both sides of the conflict between Henri of Navarre and the Catholic League, from Pierre de Belloy to the pseudonymous ‘Rossaeus’, sought to explain the French royal succession using a concept of custom drawn from Roman law. Custom offered these (...) thinkers a way to explain the Salic Law’s peculiar limitation of the succession to males descended agnatically, but it could also be taken to imply that the people, from whom it originated, were in some way superior to the king. The concept was exploited most effectively by Rossaeus, who translated what had been a legal discourse into a freer language of political naturalism. Rossaeus’s interpretation of custom was adapted and exploited by Robert Persons in the Conference about the next Succession to the Crowne of Ingland. While, then, much of the Conference’s contemporary influence derived from how its argument mapped onto English constitutional geography, it originated as a continuation of League political thought. Infertility affects 15 per cent of the world's couples. Research at Edinburgh University has been directed at transplanting fetal ovarian tissue into infertile women, thus enabling them to bear children. Fetal ovary transplantation (FOT) has generated substantial controversy; in fact, one ethicist deemed the procedure 'so grotesque as to be unbelievable' (1). Some have suggested that fetal eggs may harbour unknown chromosomal abnormalities: however, there is no evidence that these eggs possess a higher incidence of genetic anomaly than ova found (...) in a healthy adult female. There is also concern that fetal egg children will be psychologically harmed by the knowledge of their special conceptual status. It will be demonstrated that special conceptual status in and of itself does not determine developmental success. Rather, psychological well-being is dependent upon how the family and child cope with the unique challenges inherent in FOT. Lastly, though considering FOT a legitimate method of family building, given the global population crisis the wisdom of procreational rights will be challenged. Inherent to this challenge is a re-evaluation of the treatment of infertility as a significant disease necessitating remedy. (shrink)

The philosophical literature on the ethical treatment of animals is largely divided between two distinct kinds of approaches: (1) the rights-based approach; and (2) the utilitarian approach. A third approach to the debate is possible. The general moral principle “It is wrong to cause unnecessary pain or suffering” is sufficient to render many human activities involving nonhuman animals morally wrong, provided an appropriate account of unnecessary is developed to give the principle its force. This essay considers the analysis Jacques Ellul carried out about the devaluation of language. This investigation also explores the consequences of that devaluation (or humiliation as Ellul called it) wrought by our orientation to technology. Our existence in technology transforms language and our use of it, shifting emphasis as well to the visual image. The technological mindset encourages a disregard for language. It entails as well the disuse and misuse of what is perhaps most human about us, language. Our hospital routine requires that all new admissions must be asked about their code status. It is not uncommon for an otherwise healthy patient to request that a do-not-resuscitate order be placed in their chart. Presumably, these patients who wish to have a DNR order are acting on the belief that should an unforeseen, irreversible condition occur that leads to a cardiac arrest, they would not want to undergo resuscitation. Tragically, we have witnessed several instances in which potentially life-saving interventions (...) were withheld in viable patients in non-arrest settings for reversible conditions because the patients had a DNR order in the chart. Unfortunately, this happens when the treating physicians are not aware of the limited scope of a DNR order and instead use the order as a blanket prohibition against all components of resuscitation. This communication failure is due to misconceptions that patients and their physicians have with regard to such orders. The medical community is well overdue to improve the end-of-life decisions offered to patients beyond relying on the outdated term DNR.LIMITATIONS OF DNR ORDERSDespite the major advances in critical care medicine in the past few decades, doctors have not substantially improved their ability to address end-of-life decisions any better than by using the all-encompassing term DNR.
