Background: Prior research has explored reasons why health care providers may or may not choose to seek an ethics consultation. Although low-quality communication is evident in many ethics consultations, it is unknown whether poor communication in clinical settings is related to health care providers' requests for ethics involvement. Objective: To assess the relationship between self-reported ratings of health care providers' inter- and intraprofessional communication and ethics consultation requests. Method: This cross-sectional survey was conducted using a self-administered questionnaire of physicians and (...) nurses in six intensive care units at one academic medical center in the United States. The questionnaire assessed perceptions about requesting ethics consultations and how health care providers perceive communication. Results: Two hundred sixty-two participants (228 nurses and 34 physicians) responded to the survey (response rate 55%; 59% for nurses and 41% for physicians). Requests for an ethics consult were positively associated with perceived quality of interprofessional communication (r =.13, p <.05), but perceptions of the number of ethical dilemmas that occur on participants' units each month were negatively associated with the perceived quality of intra-professional communication (r = −.17, p <.01). Conclusion: The relationship that was hypothesized between perceived poor communication and increased number of ethics consultations was not borne out by these data. Indeed, we found the opposite; these finding suggests that good inter- and intraprofessional communication may promote the use of outside resources, such as ethics, when they are needed. (shrink)

For all of the emphasis on quality improvement—as well as the acknowledged overlap between assessment of the quality of healthcare services and clinical ethics—the quality of clinical ethics consultation has received scant attention, especially in terms of empirical measurement. Recognizing this need, the second edition of Core Competencies for Health Care Ethics Consultation identified four domains of ethics quality: (1) ethicality, (2) stakeholders’ satisfaction, (3) resolution of the presenting conflict/dilemma, and (4) education that translates into knowledge. This study is the (...) first, to our knowledge, to directly measure all of these domains. Here we describe the quality improvement process undertaken at a tertiary care academic medical center, as well as the tools developed to measure the quality of ethics consultation, which include post-consultation satisfaction surveys and weekly case conferences. The information gained through these tools helps to improve not only the process of ethics consultation, but also the measurement and assurance of quality. (shrink)

It is pointed out that the Higgs field may be supplanted by an ordinary Klein-Gordon field conformally coupled to the space-time curvature, and with very small, real, rest mass. Provided there is a bare cosmological constant of order of its square mass, this field can induce spontaneous symmetry breaking with a mass scale that can be as large as the Planck-Wheeler mass, but may be smaller. It can thus play a natural role in grand unified theories. In the theory (...) presented here the physical cosmological constant is small, being of order of the squared mass, and can meet observational constraints without having to be cancelled accurately. The physical gravitational constant differs somewhat from the coupling constant in Einstein's equation, and is temperature dependent in the broken symmetry regime. Evidence‐based medicine has become both the mantra of clinical practice and the dominant contemporary approach to patient care. Gordon Guyatt et al. first proposed applying the concept to medical education in the early 1990s, arguing for training that “de‐emphasizes intuition, unsystematic clinical experience, and pathophysiologic rationale” in favor of “examination of evidence from clinical research”; over the following twenty‐five years, nearly every medical school and residency program in the United States incorporated these methods into its training. During this same (...) period, admissions requirements and protocols have continued to rely on subjective, non‐evidence‐based ideals largely developed a century earlier. In light of the continued underrepresentation of certain demographic groups among matriculants, as well as the national controversy surrounding admissions standards at undergraduate institutions—most notably embodied in the lawsuit by Students for Fair Admissions against Harvard University—the moment may be ripe for a radical reexamination of those requirements. In the history of zoology the English anatomist Morrison Watson (1845–1885) is considered to be the discoverer of the masculinized sexual organs of the spotted hyena. Beginning in 1877, Watson had published a series of anatomical studies on the spotted hyena (Watson, 1877, 1878, 1881, Watson and Young, 1879), in which he, in which he for the first time made public the anatomical peculiarities of the female spotted hyena’s genitalia. This scientific achievement is well documented. But now we can also (...) state that a hundred years before Watson the Dutch amateur zoologist Robert Jacob Gordon (1743–1795), while serving in the Scots Brigades at the Cape of Good Hope, had already made the same discovery and merely unfortunate personal circumstances prevented publication. During his stay at the Cape, Gordon had studied spotted hyenas intensively and recorded his observations in accurate drawings and comments. These drawings have been preserved as part of a large collection of animal drawings entitled Gordon Atlas. With his discovery, Gordon actually was the first to provide empirical evidence of a “curious and inexplicable case of dimorphism” (Darwin on a beetle) in mammalians, long before Étienne Geoffrey Saint-Hilaire (Cours de l’histoire naturelle des mammifères, 1829) started examining masculinized sexual organs in the mole or Darwin recognized the importance of sexual dimorphism (Descent of Man, 1871). In this paper we reproduce for the first time all hyena drawings from the Gordon Atlas, including Gordon’s handwritten notes in the margins in the original Dutch and in translation. Additionally, we briefly delineate the knowledge about the South African spotted hyena in Gordon’s time and indicate that we doubt Watson’s explanation for the age-old confusion about the hyena. This article argues that Epictetus employs the terms orexis and hormê in the same manner as the older Stoics. It then shows, on the basis of this claim, that the older Stoics recognized a distinction between dispositional and occurrent forms of motivation. On this account of Stoic theory, intentional action is in each instance the product of two forms of cognition: a value ascription that attributes goodness or badness to some object, conceiving of its possession as beneficial or harmful to (...) the agent, together with a situational judgment about appropriate action. The resulting interpretation suggests that the Stoic theory of motivation as a whole — and not merely the Stoic analysis of the pathê — has the basic shape of a practical syllogism, with more psychological depth than commentators have recognized. In this brilliantly conceived volume, William Talbott takes aim at the ‘Proof Paradigm’, composed of five erroneous principles, which as he sees it has dominated Western epistemology since the ancient Greeks, and proposes to replace it with a superior alternative, one that involves on his part daring speculation about the metaphysical necessity of the principles of proper reasoning. One may at first glance be inclined to dismiss Talbott's project: Who now adheres to the Proof Paradigm, which, among other things, holds (...) that knowledge is based on infallibly known premises and what is deduced from them? Does the book merely echo ‘battles long ago’? Talbott would reply that although strict adherence to the Proof Paradigm has gone by the boards, the efforts to replace it remain in the grip of some of its principles. Moreover, recognition of the Proof Paradigm's failure has led many people to embrace scepticism and relativism, a fact Talbott deems of deep concern. These challenges to knowledge lead to and exacerbate unfortunate trends in our society, in particular prejudiced thinking, the nature of which he explains with both care and passion in Chapter 7. Talbott discusses a vast number of issues in the book, and in what follows, I shall be able to comment on only a few of these. (shrink)

This paper draws on some lines of thought in Kant’s Critique of Judgment to construct an aesthetic counterpart to the moral argument for the existence of God that Kant formulates in the Critique of Practical Reason. The paper offers this aesthetic version as a theistic way of explaining how the natural world can be thought valuable independently of human desires and purposes. It further argues that such an argument must commend itself to anyone who is as deeply committed to the (...) preservation of nature as to the promotion of justice. (shrink)

Talmudic history, understood as how events are organized and narrated to teach, cannot be said to deal with great affairs; it simply tells what those responsible for compiling it thought about the world around them. But if manifest history is scarcely present, a rich and complex world of latent history does lie ready at hand. The Talmud and related literature contain two sorts of historical information: stories about events within an estate of clerks, and data on the debates of those (...) who produced the Talmud. The authors of the Mishnah found no reason to narrate history because what was important in Israel's existence was sanctification, an ongoing process. Its framers recognized the pastness of the past and hence, by definition, laid out a conception of the past that constitutes an historical doctrine. The Talmud of the Land of Israel, spurred by the story of the suffering of Israel and efforts to explain the tragedy, moves toward an interest in the periodization of history and a willingness to include events of far greater diversity than the Mishnah. A teleology lacking all eschatological dimension - the Mishnah - here gives way to an explicitly messianic statement that the purpose of the law is to attain Israel's salvation -the Talmud of the Land of Israel. What I will argue here is that the ethical potentiality of the human being that Aristotle cites in the Nicomachean Ethics refers to the general, rational capacity for someone to appropriate and develop their own specific, natural capacities which make them human; the name of this ability is called virtue, which, when expressed in actions, we call good. To separate out the concepts at work here demands an exegesis of the two kinds of dunamis in Metaphysics Theta, that is, dunamis (...) as causal power of change and dunamis as a potential way of being for an existent capacity. Once we grasp this, we can clarify the nature of virtue as the active, complete state of a capacity in human being which defines their function even though it must be acquired, and it need not ever be actualized. The concepts of habit ( ethos) and practical judgment ( phronesis) give Aristotle the means to solve the problem of how such a potentiality is acquired and how it is actualized, and hence we will end with a discussion of them. Kierkegaard's relationship to the literary Socrates of antiquity, an ironic and ambiguous figure who reflects the uncertain nature of reality itself, uniquely recapitulates Plato's relationship to the historical Socrates. For Kierkegaard as for Plato, contact with Socrates results in an explosion of poetic and philosophical creativity—a demonstration of Socrates’ pedagogical potency that implicitly resolves what Plato calls the “ancient quarrel between philosophy and poetry.” This chapter reflects on that ancient quarrel and its connection with the figure of Socrates, traces the (...) birth of Kierkegaard's Socrates in his dissertation, and sketches the developing significance of Socrates in Kierkegaard's major pseudonymous writings. Social contract theory imagines political societies as resting on a fundamental agreement, adopted at a discrete moment in hypothetical time, that both bound individual persons together into a single polity and set fundamental rules regarding that polity's structure and powers. Written constitutions, adopted at real moments in historical time, dictating governmental structures, bounding governmental powers, and entrenching individual rights, look temptingly like social contracts reified. I argue in this article, however, that something essential is lost in the casual slippage between (...) social contract theory and the practice of constitutionalism. Enacted constitutions do not come into being against the background of a state of nature of isolated individuals; and by this I do not mean to invoke the too-familiar critique of the supposedly decontextualized liberal person, but rather to critique the aspiration to decontextualize the legal and political order. Constitutions are enacted in ongoing societies (whether newly politically sovereign or otherwise) with pre-existing laws and legal systems, political organizations, cultural and linguistic and religious divisions, and norms and mores. Moreover, the practice of constitutionalism is usually, at least in part, a practice of reconciling those legacies to a new political order, of making use of those legacies to build loyalties to or counterbalances against the state (or both). Most constitutions cannot be well-understood by retrospectively characterizing them as the kind of complete and radical break with the past envisioned by social contract theory. Contractarian blinders lead us to look for greater individualism, greater social unity, and greater coherence of principles than can actually be expected of constitutions or constitutionalism. Real constitutional orders appropriate, incorporate, and channel the histories and divisions of the societies they govern. Treating them as if they are social contracts will flatten and distort them, making those engagements with the past or with social plurality appear anomalous and encouraging their minimization. I aim to redirect some of our attention to non-contractarian constitutionalism, or non-contractarian strands within constitutionalism, both as intellectual inheritance and as lived practice. Non-contractarian elements persisted in constitutional theory across the apparent break of the late 1700s, even though these have to some degree been lost sight of more recently; and they have persisted and should persist in constitutional practice. These notes discuss some aspects of the sort of symmetry considerations that arise in philosophy of physics. They describe and provide illustration of: (i) one common sort of symmetry argument; and (ii) a construction that allows one to eliminate symmetries from a given structure.

We suggest that the hierarchical predictive processing account detailed by Clark can be usefully integrated with narrative psychology by situating personal narratives at the top of an individual's knowledge hierarchy. Narrative representations function as high-level generative models that direct our attention and structure our expectations about unfolding events. Implications for integrating scientific and humanistic views of human experience are discussed.

This paper offers a psychobiographical study of the connection between the life and work of Heije Faber , the internationally best known Dutch psychologist of religion. Initially, Faber studied theology, qualifying in philosophy of religion; in later years, he studied psychology . As a politically active pastor, he had to hide from the Nazi-occupation of The Netherlands during World War II. In 1970 he became the first professor of the psychology of religion at a Dutch theological faculty. Faber was interested (...) in a psychoanalytic approach to religion, by the end of his life particularly in selfpsychology as developed by Heinz Kohut. There is a curious contradiction in his work: although Faber employs several types of psychology in his autobiography to interpret aspects of his own development, he neglects the Kohutian psychology that he had himself helped to introduce to The Netherlands. This article tries to solve the paradox and suggests some psychological hypotheses as to the relationship of Faber psychodynamics and his contribution to psychology. (shrink)
