This paper develops and explores a new framework for theorizing about the measurement and aggregation of well-being. It is a qualitative variation on the framework of social welfare functionals developed by Amartya Sen. In Sen’s framework, a social or overall betterness ordering is assigned to each profile of real-valued utility functions. In the qualitative framework developed here, numerical utilities are replaced by the properties they are supposed to represent. This makes it possible to characterize the measurability and interpersonal comparability of (...) well-being directly, without the use of invariance conditions, and to distinguish between real changes in well-being and merely representational changes in the unit of measurement. The qualitative framework is shown to have important implications for a range of issues in axiology and social choice theory, including the characterization of welfarism, axiomatic derivations of utilitarianism, the meaningfulness of prioritarianism, the informational requirements of variable-population ethics, the impossibility theorems of Arrow and others, and the metaphysics of value. This paper presents a new kind of problem in the ethics of distribution. The problem takes the form of several “calibration dilemmas,” in which intuitively reasonable aversion to small-stakes inequalities requires leading theories of distribution to recommend intuitively unreasonable aversion to large-stakes inequalities. We first lay out a series of such dilemmas for prioritarian theories. We then consider a widely endorsed family of egalitarian views and show that they are subject to even more forceful calibration dilemmas than prioritarian theories. This paper surveys and evaluates the answers that philosophers and animal researchers have given to two questions. Do animals have thoughts? If so, are their thoughts conceptual? Along the way, special attention is paid to distinguish debates of substance from mere battles over terminology, and to isolate fruitful areas for future research.

Medicalisation is a social phenomenon in which conditions that were once under legal, religious, personal or other jurisdictions are brought into the domain of medical authority. Low sexual desire in females has been medicalised, pathologised as a disease, and intervened upon with a range of pharmaceuticals. There are two polarised positions on the medicalisation of low female sexual desire: I call these the mainstream view and the critical view. I assess the central arguments for both positions. Dividing the two positions (...) are opposing models of the aetiology of low female sexual desire. I conclude by suggesting that the balance of arguments supports a modest defence of the critical view regarding the medicalisation of low female sexual desire. (shrink)

Many jurisdictions prohibit or severely restrict the use of evidence about a defendant’s character to prove legal culpability. Situationists, who argue that conduct is largely determined by situational features rather than by character, can easily defend this prohibition. According to situationism, character evidence is misleading or paltry. -/- Proscriptions on character evidence seem harder to justify, however, on virtue ethical accounts. It appears that excluding character evidence either denies the centrality of character for explaining conduct—the situationist position—or omits probative evidence. (...) Situationism is, after all, presented as antithetical to virtue ethics. -/- This essay provides a virtue ethical defense of character evidence exclusion rules. We show that existing virtue ethical rebuttals to situationism themselves support prohibitions on character evidence; even if behavior arises from stable character traits, character evidence should be prohibited. In building our case, we provide a taxonomy of kinds of character judgment and reconcile the ubiquity and reasonableness of character judgments in ordinary life with the epistemic legitimacy of character evidence prohibitions in law. Objective interpretations of probability are usually discussed in two varieties: frequency and propensity accounts. But there is a third, neglected possibility, namely, probabilities as deriving from ranges in suitably structured initial state spaces. Roughly, the probability of an event is the proportion of initial states that lead to this event in the space of all possible initial states, provided that this proportion is approximately the same in any not too small interval of the initial state space. This idea can also (...) be expressed by saying that in the types of situations that give rise to probabilistic phenomena we may expect to find an initial state space such that any "reasonable" density function over this space leads to the same probabilities for the possible outcomes. This "method of arbitrary functions" was introduced by Poincaré, studied and extended by Hopf and more recently by Eduardo Engel, Jan von Plato and Michael Strevens. The natural-range, or method-of-arbitrary-functions approach to probabilities is usually treated as an explanation for the occurrence of probabilistic patterns, whereas I examine its prospects for an objective interpretation of probability, in the sense of providing truth conditions for probability statements that do not depend on our state of mind or information. The main objection to such a proposal is that it is circular, i.e. presupposes the concept of probability, because a measure on the initial state has to be introduced, and density functions over the space are considered. Although early-stage finance is critical to the growth of most ventures, it is even more important for social ventures as they face the challenges of balancing their social and commercial objectives. Drawing on institutional logics and signaling theory, this study uses a panel data set of 3,401 nascent social ventures to investigate the important role philanthropic grant funding plays in the organizational and financial development of social ventures. We find mixed results, with positive effects on employment and subsequent access to (...) debt finance, but no effects on revenues and access to equity. Our findings connect these theories by suggesting philanthropic grants provide social ventures with flexibility to invest in human capital without pushing them to pursue short-term financial objectives, and that receiving a philanthropic grant provides a signal that is interpreted differently by debt and equity financiers. These findings are especially relevant as funders increasingly use grants to support social entrepreneurship. (shrink)

A new public centered long-range corporate planning orientation is proposed. Underlying this orientation is the rationale that the main purpose of business activity is the satisfaction of socially desirable needs, i.e. needs that are compatible with long run public welfare. Such need satisfaction will tend to bring about improvements in the quality of private and public life. Corporate planning should thus facilitate the performance of business activities designed to achieve the satisfaction of socially desirable needs.The determination of what are socially (...) desirable needs will be based on public consensus, which corporations can periodically assess, and incorporate into their long range plans. A long-range planning procedure, incorporating social welfare considerations is developed. It is suggested that a planning procedure such as this is essential for the existence of firms in the long run. (shrink)

In the age of change in the institutional and conceptual setting in which the ancient tradition of Jewish learning would go forward, what we see in the two most important figures of the transitional generation is only the end of the old, not the beginning of the new. Saul Lieberman continued the received tradition that learning means exegesis of texts, but did not fully master the logic of that received tradition and so distorted it. Salo W. Baron undertook a new (...) intellectual tradition, one that pursued historical study in place of the exegesis of texts, but did. not really grasp the requirements of the kind of new history that he proposed to write. Announcing the advent of social history into the academy of Jewish learning, what he wrote as the economic part of that social history was merely the paraphrase of received texts, with glosses that look suspiciously like a kind of free-associative exegesis. While the one scholar demonstrated the decadence of an old tradition of learning, the other succeeded in showing only the difficulty of actually mastering the discourse of an entirely new academic world. Relationalism maintains that mind-independent objects are essential constituents of veridical perceptual experiences. According to the argument from hallucination, relationalism is undermined by perfect hallucinations, experiences that are introspectively indistinguishable from veridical perceptual experiences but lack an object. Recently, a new wave of relationalists have responded by questioning whether perfect hallucinations are possible: what seem to be perfect hallucinations may really be something else, such as illusions, veridical experiences of non-obvious objects, or experiences that are not genuinely possible. This paper argues (...) that however well new wave relationalism may handle brains in vats, drug users “seeing” pink elephants, and other extraordinary hallucinations, it struggles to accommodate mundane hallucinations, such as “hearing” your child cry out from the room down the hall when she is actually sound asleep or “feeling” vibrations on your thigh even when your phone isn't in your pocket. Mundane hallucinations are best explained as byproducts of noise in the perceptual system, and noise-induced hallucinations are resistant to the strategies that new wave relationalists deploy to explain away other hallucinations. Mundane hallucinations can thus underpin an especially powerful version of the argument from hallucination. (shrink)

Major depressive disorder is one of the most common serious illnesses worldwide; the disease is also among those with the lowest rates of treatment. Barriers to access to care, both practical and psychological, contribute significantly to these low treatment rates. Among such barriers are regulations in many nations that require a physician’s prescription for most pharmacological treatments including selective serotonin reuptake inhibitors (SSRIs). These rules are designed to protect patients. However, such regulations involve a tradeoff between the welfare of “visible” (...) victims, who might suffer negative consequences from a lack of regulation, and the well-being of invisible “victims,” who likely experience negative consequences that result from increased barriers to care. This article explores these tradeoffs and argues in favor of shifting SSRIs from prescription-only to over-the-counter status. (shrink)

As the World Anti-Doping Code is up for revision, the paper proposes a framework for reading the Code based on a relatively literal approach and an almost exclusive focus on the ?spirit of sport? as a key element of the Code. The author argues that this single element can contribute to revealing the underlying rationale of the Code, as it serves to justify bans of doping substances and methods, in some cases without recurring to evidence sustaining the claims made. For (...) a substance/method to be banned, the Code requires that two out of three criteria be met: performance enhancement, health risk and the spirit of sport. The paper demonstrates how these provisions link to other parts of the Code, (under the rules of the Code 2009) in the absence of performance-enhancing properties combined with a health risk. The paper draws implications from these findings regarding terminological (im)precision, legal certainty/predictability, transparency/accountability, limits to arbitrary exercise of power and internal/external validity. Although considerable attention has been devoted to the concepts of “visible” and “invisible” victims in general medical practice, especially in relation to resource allocation, far less consideration has been devoted to these concepts in behavioral health. Distinctive features of mental health care in the United States help explain this gap. This essay explores three specific ways in which the American mental health care system protects potentially “visible” individuals at the expense of “invisible victims” and otherwise fails to meet the needs (...) of great numbers of people with serious psychiatric conditions: prioritization of the wrong patients, incentivization of excessive caution among providers, and a narrow definition of psychiatry's purview. While each of these practices has been discussed elsewhere in the literature, they are rarely considered as part of an interrelated and systemic problem. Reconceptualizing these three issues as aspects of the larger conflict between the interests of “visible” and “invisible” victims may prove a path toward reform. (shrink)

Non-cognitive gadgets are fancy tools shaped to meet specific, local needs. Cecilia Heyes defines cognitive gadgets as dedicated psychological mechanisms created through social interactions and culturally, not genetically, inherited by humans. She has boldly proposed that many human cognitive mechanisms are gadgets. If true, these claims would have far-reaching implications for our scientific understanding of human social cognition. Here we assess Heyes’s cognitive gadget approach as it applies to mindreading. We do not think that the evidence supports Heyes’s thought-provoking thesis (...) that human children are taught to read minds the way they are taught to read words. We highlight a potential circularity lurking behind this analogy, and we explain why we are unpersuaded by Heyes’s anti-mentalistic proposal for handling data inconsistent with the gadget view, which others take to be evidence for mindreading in human infancy. We conclude that while human minds may well be filled with gadgets, mindreading is unlikely to be one of them. (shrink)

This paper assesses the scope and limits of a widely influential model of goal-ascription by human infants: the shared-intentionality model. It derives much of its appeal from its ability to integrate behavioral evidence from developmental psychology with cognitive neuroscientific evidence about the role of mirror neuron activity in non-human primates. The central question raised by this model is whether sharing a goal with an agent is necessary and sufficient for ascribing it to that agent. I argue that advocates of the (...) shared-intentionality model underestimate both the distinction between the target and the goal of a goal-directed action and the gap between sharing and ascribing a goal. This article argues that Epictetus employs the terms orexis and hormê in the same manner as the older Stoics. It then shows, on the basis of this claim, that the older Stoics recognized a distinction between dispositional and occurrent forms of motivation. On this account of Stoic theory, intentional action is in each instance the product of two forms of cognition: a value ascription that attributes goodness or badness to some object, conceiving of its possession as beneficial or harmful to (...) the agent, together with a situational judgment about appropriate action. The resulting interpretation suggests that the Stoic theory of motivation as a whole — and not merely the Stoic analysis of the pathê — has the basic shape of a practical syllogism, with more psychological depth than commentators have recognized. Secondly, on minimalist physicalist assumptions, no entity can instantiate a semantic property unless it simultaneously instantiates some physical properties. A representation's semantic property risks therefore to be deprived of causal efficacy by its physical properties . My aim in this paper is to explore an affinity between early critical theory and analytical philosophy. The affinity is in a fairly unexpected area: philosophy of science. I argue that early critical theory embraces a view of science which is a natural if somewhat unfamiliar extension of the pragmatist one defended by Quine. In particular, I argue that Horkheimer has a version of the Quine-Duhem thesis (“underdetermination of theory choice by the evidence”). How do the Frankfurt and analytical versions (...) of the underdetermination thesis differ? Quine and others have taken the thesis to motivate a form of pragmatism. What this means is that it is certain interests that ultimately determine the choice of theory: chief among them, an interest in simplicity of our theories. However, the Critical Theorists offer us a distinctly historical materialist version of the underdetermination thesis, in which it is the imperatives of the prevailing mode of production, for example, capitalism, which are decisive. The result is an unfamiliar Marxist version of an otherwise familiar thesis from the analytic tradition. (shrink)

Antonie Vos argues that Thérines’s quodlibet exhibits the influence of Scotus’s, yet no solid evidence has yet been provided for the chronology of their delivery or publication. Most scholars agree that they likely delivered their quodlibets in the same year: 1306. I investigate the role of the subject in judgment in Kant, Frege, and Husserl, situating it in the broader and less-often-considered context of their accounts of presentation as well as judgment. Contemporary philosophical usage of “representation” tends to elide the question of what Kant called the constitution of content, because of a reluctance, traced to Frege’s anti-psychologism, to attend to subjectivity. But for Kant and Husserl, anti-psychologism allows for synthesis as the subjective act necessary for both “mere presentation” and judgment. (...) In Begriffshrift, Frege alludes to a significant logical role for the subjective act of judgment, and in later work, traces of this logical role remain in the intensional notions of grasping a thought and judging as acknowledging its truth. But Frege’s anti-psychologism blocks interpreting these subjective notions in term of synthesis. Although similar in certain ways to Frege and equally anti-psychologistic, Husserl’s theory of judgment in the Logical Investigations maintains a role for subjective syntheses for presentations and judgments, and goes beyond Kant in allowing for a kind of objectivity at the level of non-judgment presentations. These two great anti-psychologists at the dawn of the parallel heydays of linguistic and phenomenological analysis are thus differentiated by the fates they assign to the act of synthesis. (shrink)

To help rectify this situation, the author here provides a comprehensive examination of Burley’s account of consequences, first recounting Burley’s enumeration, organization, and division of consequences, with particular attention to (...) the shift from natural and accidental to formal and material consequence, and then locating Burley’s contribution to the theory of consequences in the context of fourteenth-century work on the subject, detailing its relation to the earliest treatises on consequences, then to Ockham and Buridan. This study investigates factors impacting perceptions of ethical conduct of peers of 293 students in four US universities. Self-reported ethical behavior and recognition of emotions in others (a dimension of emotional intelligence) impacted perception of ethical behavior of peers. None of the other dimensions of emotional intelligence were significant. Age, Race, Sex, GPA, or type of major (business versus nonbusiness) did not impact perception of ethical behavior of peers. In this article, part of a symposium on David Miller's Global Justice and National Responsibility, I first focus on an area of disagreement: Miller‘s attempt to attribute to nations responsibility that I think ought to be generally attributed to states. I then sketch a theory that disregards nations more or less completely, and yet issues in a two-level theory like Miller‘s, sanctioning important differences between intrastate and interstate distribution. It is only like Miller‘s, because the distinction between states and nations (...) is one with a very real difference indeed. Moreover, I think that Miller aims to build up the moral and historical prestige of the nation-state to make it a viable competitor with the claims of universal morality, whereas I will engage in a kind of deflation that teaches us not to expect contingent forms of political organization to instantiate great moral truths. But this results in an account that is perhaps more like his than either is like cosmopolitanism visions, whether egalitarian or libertarian. (shrink)

This study examined the effect of the pique technique preceded by a disrupting process. Passersby in the street were asked for money, either for a common amount of change (control) or 37 cents (pique technique). In half of the cases, the requester added a disrupting sentence at the beginning of the request. Results showed that the pique technique alone and the disrupting technique alone increased compliance with the request. Adding a first disrupting sentence to the pique also increased compliance compared (...) with the other three conditions. These results support the theoretical explanation that the initial disrupting sentence associated with the pique could reduce the influence of the refusal script activated by the money request. Requests by patients for providers of specific demographic backgrounds pose an ongoing challenge for hospitals, policymakers, and ethicists. These requests may stem from a wide variety of motivations; some may be consistent with broader societal values, although many others may reflect prejudices inconsistent with justice, equity, and decency. This paper proposes a taxonomy designed to assist healthcare institutions in addressing such cases in a consistent and equitable manner.
