All the papers included here have been published previously, although (...) many of them in places where they might not be easily accessible to English-speaking philosophers. While some of the articles will be familiar to Kant scholars, this collection should be useful to specialists and valuable to students first delving into the third Critique.One essay in the volume, Guyer's own piece on "Kant's Principles of Reflecting Judgment," will be of particular interest to Kant scholars. Guyer's thesis here is that the account of reflecting judgment Kant offers in the Critique of the Power of Judgment is both continuous with the account of regulative principles of reason in the Critique of Pure Reason and the basis of the unity of the third Critique as a whole. He supports this by demonstrating how each of the sorts of judgment discussed in the work can be seen as an application of the broader account of reflecting judgment in general. Guyer identifies five such applications, and shows that each of them has three features central to regulative principles: they set a goal of constructing a system within a certain specific range of cognitions; they require the suitability of objects for attainment of the goal in question, and thus are transcendental [End Page 499] and not merely logical principles; and they supply heuristic advice for the investigation of nature. Thus every form of judgment can with justice be considered as an instance of the general activity of reflecting, that is, finding a universal for a given particular.Several of the essays included here concern the most prominent issues relating to the Analytic of the Beautiful. Nick Zangwill's piece deals with the disinterestedness of aesthetic judgment, while Christopher Janaway's "Kant's Aesthetics and the Empty Cognitive Stock" debunks what he sees as misguided readings of the role of concepts in judgments of taste. In "The Idealism of Purposiveness," an excerpt from his 1993 book Kantian Aesthetics Pursued (Edinburgh, 1993), Anthony Savile criticizes what he calls the "established reading" of Kant's claim that beautiful objects exhibit "purposiveness without purpose." On this reading, to say that a thing is purposive without purpose is to say that it appears to be designed, but to no particular purpose. Savile argues instead that we should take purposiveness without purpose to indicate that an object is suitable for a function, but not as a result of conscious design. Articles by Eva Schaper (from her well-known book on Kant's aesthetics) and Malcolm Budd discuss the distinction between free and dependent beauty and the account of the sublime, respectively.Some of the other selections in the volume are interesting for their focus on somewhat neglected aspects of the third Critique. One such aspect is the role of the imagination in Kant's account of aesthetic appreciation, and by extension in cognition more generally. In "Imaginative Freedom and the German Enlightenment," Jane Kneller argues that appreciation of the role of imaginative freedom in Kant's account of aesthetic judgment helps to connect Kant to the Enlightenment rationalist tradition that saw the value of art in its ability to educate and improve those who appreciate it. This education cannot, of course, be of the most straightforward nature, since Kant emphatically argues that to judge a thing beautiful is altogether different from judging it morally good. Instead, Kneller argues, our awareness of our own imaginative freedom provides us with evidence of our ability to realize the "highest good" on earth, evidence otherwise denied us in Kant's philosophy. Clicks, comments, transactions, and physical movements are being increasingly recorded and analyzed by Big Data processors who use this information to trace the sentiment and activities of markets and voters. While the benefits of Big Data have received considerable attention, it is the potential social costs of practices associated with Big Data that are of interest to us in this paper. Prior research has investigated the impact of Big Data on individual privacy rights, however, there is also growing recognition of (...) its capacity to be mobilized for surveillance purposes. Our paper delineates the underlying issues of privacy and surveillance and presents them as in tension with one another. We postulate that efforts at controlling Big Data may create a trade-off of risks rather than an overall improvement in data protection. We explore this idea in relation to the principles of the European Union’s General Data Protection Regulation as it arguably embodies the new ‘gold standard’ of cyber-laws. We posit that safeguards advocated by the law, anonymization and pseudonymization, while representing effective counter measures to privacy concerns, also incentivize the use, collection, and trade of behavioral and other forms of de-identified data. We consider the legal status of these ownerless forms of data, arguing that data protection techniques such as anonymization and pseudonymization raise significant concerns over the ownership of behavioral data and its potential use in the large-scale modification of activities and choices made both on and offline. R. S. Peters and a small group of contemporaries set the foundations for analytic philosophy of education in the 1960s, a field which continues to this day. This article asks about the value of analytic philosophy of education today, and proposes alterations to its initial aims and methods to make its value clearer. I outline some critiques of analytic philosophy of education, and respond by clarifying its aims. The key insight is that if analytic philosophy of education is explicitly aligned (...) with recent trends in social philosophy to focus on ameliorative analysis, then its value and relevance as a method in educational studies becomes clearer. Ameliorative analysis starts with the social role that a concept plays, and analyses it with this purpose in mind. I illustrate how R. S. Peters analysis of education would be approached differently with ameliorative analysis in mind, and conclude by pointing to some interesting points of discussion that arise from this approach. The thesis of this book is that Kant employs a single conception of reason throughout his analysis of the fundamental principles of natural science, morality and politics, rational religion, and the practice of philosophy itself, and that this conception is that reason is the source of the ultimate goals or ideals for our conduct of both inquiry and action, but never a faculty that yields cognition of objects that exist independently of us, whether sensible or supersensible. In Neiman’s words, “The (...) basis of Kant’s reconception” of reason “is the denial that the rational is, or is centrally concerned with, the cognitive”, and the heart of his thesis of the unity of reason is his view that “the regulative principles of reason... shape our actions in science, morality, religion and philosophy itself”. Neiman’s work is refreshingly ambitious in its attempt to demonstrate that these generalities hold for all four of the areas she lists, but the general claims themselves will not come as a surprise to contemporary students of Kant. So for the work to succeed, it would have to break new ground in either the detailed analysis of the regulative functions of reason or in our understanding of reason’s general function in unifying the several branches of philosophy as Kant understands it. In my view, the book does neither. Neiman offers some interesting insights about Kant’s treatment of science, morality, and religion, but does not offer a rigorous analysis of the structure of Kant’s thought in any of these areas that goes beyond what many others have already provided. More importantly, she misses the opportunity to make a major advance in our understanding of the general structure of Kant’s thought. For what she describes is really similarities in our use of reason in the various areas of our inquiry and conduct; she does not show how Kant uses his conception of reason to unify the apparently disparate realms of theory and practice, or, in his terms, of nature and freedom. This task dominates the Critique of Judgment, where, far from merely recapitulating his previous accounts of the regulative use of reason in both science and morality, Kant argues as he never did before that we must be able to see the realms of nature and freedom not merely as compatible but as unified, yet also makes explicit the regulative status of reason and of this vision of unity precisely by stating his theory of the unity of reason as the culmination of a theory of reflective judgment. Neiman largely ignores Kant’s own most mature account of the unity of reason. (shrink)

Critical Notice of Scott Sturgeon's The Rational Mind.

: Both Mendelssohn and Kant were strong supporters of the separation between church and state, but their arguments differed. Mendelssohn joined many others in following Locke in arguing that only freely arrived at conviction could be pleasing to God, so the state could not serve the purpose of religion in attempting to enforce it: a religious premise for religious liberty. Kant argued for religious liberty as an immediate consequence of the innate right to freedom. I suggest that Kant’s straightforward argument (...) is worth recalling in the present attack on the separation of church and state in the US and elsewhere. (shrink)

Residential aged care facilities (RACF) are sites of high antibiotic use in Australia. Misuse of antimicrobial drugs in RACF contributes to antimicrobial resistance (AMR) burdens that accrue to individuals and the wider public, now and in the future. Antimicrobial stewardship (AMS) practices in RACF, e.g. requiring conformation of infection, are designed to minimise inappropriate use of antibiotics. We conducted dialogue groups with 46 participants with a parent receiving aged care to better understand families’ perspectives on antibiotics and care in RACF. (...) Participants grappled with value trade offs in thinking about their own parents’ care, juggling imagined population and future harms with known short term comfort of individuals and prioritising the latter. Distributive justice in AMR relies on collective moral responsibility and action for the benefit of future generations and unknown others. In RACF, AMS requires value trade-offs and compromise on antimicrobial use in an environment that is heavily reliant on antimicrobial drugs to perform caring functions. In the context of aged care, AMS is a technical solution to a deeply relational and socio-structural problem and there is a risk that carers (workers, families) are morally burdened by system failures that are not addressed in AMS solutions. Schopenhauer presents his moral philosophy as diametrically opposed to that of Kant: for him, pure practical reason is an illusion and morality can arise only from the feeling of compassion, while for Kant it cannot be based on such a feeling and can be based only on pure practical reason. But the difference is not as great as Schopenhauer makes it seem, because for him compassion is supposed to arise from metaphysical insight into the unity of all being, thus from (...) pure if theoretical reason, while for Kant pure practical reason works only by effecting a feeling of respect (in the works) or by cultivating, i.e. affecting, natural dispositions to moral feeling (in the works). BackgroundHIV cure research involving cell and gene therapy has intensified in recent years. There is a growing need to identify ethical standards and safeguards to ensure cell and gene therapy (CGT) HIV cure research remains valued and acceptable to as many stakeholders as possible as it advances on a global scale.MethodsTo elicit preliminary ethical and practical considerations to guide CGT HIV cure research, we implemented a qualitative, in-depth interview study with three key stakeholder groups in the United States: (1) biomedical (...) HIV cure researchers, (2) bioethicists, and (3) community stakeholders. Interviews permitted evaluation of informants’ perspectives on how CGT HIV cure research should ethically occur, and were transcribed verbatim. We applied conventional content analysis focused on inductive reasoning to analyze the rich qualitative data and derive key ethical and practical considerations related to CGT towards an HIV cure.ResultsWe interviewed 13 biomedical researchers, 5 community members, and 1 bioethicist. Informants generated considerations related to: perceived benefits of CGT towards an HIV cure, perceived risks, considerations necessary to ensure an acceptable benefit/risk balance, CGT strategies considered unacceptable, additional ethical considerations, and considerations for first-in-human CGT HIV cure trials. Informants also proposed important safeguards to developing CGT approaches towards an HIV cure, such as the importance of mitigating off-target effects, mitigating risks associated with long-term duration of CGT interventions, and mitigating risks of immune overreactions.ConclusionOur study identified preliminary considerations for CGT-based HIV cure across three key stakeholder groups. Respondents identified an ideal cure strategy as one which would durably control HIV infection, protect the individual from re-acquisition, and eliminate transmission to others. Known and unknown risks should be anticipated and perceived as learning opportunities to preserve and honor the altruism of participants. Preclinical studies should support these considerations and be transparently reviewed by regulatory experts and peers prior to first-in-human studies. To protect the public trust in CGT HIV cure research, ethical and practical considerations should be periodically revisited and updated as the science continues to evolve. Additional ethics studies are required to expand stakeholder participation to include traditionally marginalized groups and clinical care providers. (shrink)

In this book, Lucy Jane Ward argues that although contemporary scholarship tends to divide Agnes Heller's work chronologically in terms of her “Marxist” and subsequent “post-Marxist” periods, a closer reading reveals her work as a continuing engagement both with and against Marx's idea of the human being rich in need.

Can Kant’s theory of fine art serve as a theory of modern art? It all depends on what ‘modern’ means. The word can mean current or contemporary, indexed to the time of use, and in that sense the answer is yes: Kant’s theory of genius implies that successful art is always to some extent novel, so there should always be something that counts as contemporary art on his theory. But ‘modern’ can also be used adjectively, perhaps more properly as ‘modernist’, (...) to refer to art of a particular moment, in some cases superseded by postmodern art. Kant’s theory is not a theory of modernist art in at least one prominent form, the formalism of Clement Greenberg. But other theories, such as those of George Dickie and Arthur Danto, although triggered by particular works of modernist art and meant to accommodate them, were meant to be theories of what art was always doing, and Kant’s is too. In that sense it can be considered a modern theory of art but not a theory of modern art. (shrink)
