"This stunning work is without question a major contribution to Cartesian studies, to the field of early modern philosophy, and to general epistemology--original, provocative, and philosophically interesting.

Families play an essential role in deceased organ procurement. As the person cannot directly communicate his or her wishes regarding donation, the family is often the only source of information regarding consent or refusal. We provide a systematic description and analysis of the different roles the family can play, and actions the family can take, in the organ procurement process across different jurisdictions and consent systems. First, families can inform or update healthcare professionals about a person’s donation wishes. Second, families (...) can authorize organ procurement in the absence of deceased’s preferences and the default is not to remove organs, and oppose donation where there is no evidence of preference but the default is to presume consent; in both cases, the decision could be based on their own wishes or what they think the deceased would have wanted. Finally, families can overrule the known wishes of the deceased, which can mean preventing donation, or permitting donation when the deceased refused it. We propose a schema of 4 levels on which to map these possible family roles: no role, witness, surrogate, and full decisional authority. We conclude by mapping different jurisdictions onto this schema to provide a more comprehensive understanding of the consent system for organ donation and some important nuances about the role of families. This classificatory model aims to account for the majority of the world’s consent systems. It provides conceptual and methodological guidance that can be useful to researchers, professionals, and policymakers involved in organ procurement. (shrink)

Background: Improved techniques and life sustaining technology in the neonatal intensive care unit have resulted in an increased probability of survival for extremely premature babies. The by-product of the aggressive treatment is iatrogenic pain, and this infliction of pain can be a cause of suffering and distress for both baby and nurse. Research question: The research sought to explore the caregiving dilemmas of neonatal nurses when caring for extremely premature babies. This article aims to explore the issues arising for neonatal (...) nurses when they inflict iatrogenic pain on the most vulnerable of human beings – babies ≤24 weeks gestation. Participants: Data were collected via a questionnaire to Australian neonatal nurses and semi-structured interviews with 24 neonatal nurses in New South Wales, Australia. Ethical consideration: Ethical processes and procedures set out by the ethics committee have been adhered to by the researchers. Findings: A qualitative approach was used to analyse the data. The theme ‘inflicting pain’ comprised three sub-themes: ‘when caring and torture are the same thing’, ‘why are we doing this!’ and ‘comfort for baby and nurse’. The results show that the neonatal nurses were passionate about the need for appropriate pain relief for extremely premature babies. Conclusion: The neonatal nurses experienced a profound sense of distress manifested as existential suffering when they inflicted pain on extremely premature babies. Inflicting pain rather than relieving it can leave the nurses questioning their role as compassionate healthcare professionals. (shrink)

The literature of modernity, describing the fleeting, anonymous, ephemeral encounters of life in the metropolis, mainly accounts for the experiences of men. It ignores the concomitant separation of public and private spheres from the mid-nineteenth century, and the increasing segregation of the sexes around that separation. The influential writings of Baudelaire, Simmel, Benjamin and, more recently, Richard Sennett and Marshall Berman, by equating the modern with the public, thus fail to describe women's experience of modernity. The central figure of the (...) flâneur in the literature of modernity can only be male. What is required, therefore, is a feminist sociology of modernity to supplement these texts. (shrink)

Sixty-five undergraduates participating in a wide range of psychological research experiments were interviewed in depth about their research experiences and their views on the process of informed consent. Overall, 32% of research experiences were characterized positively and 41 % were characterized negatively. One major theme of the negative experiences was that experiments were perceived as too invasive, suggesting incomplete explication of negative aspects of research during the informed consent process. Informed consent experiences were viewed positively 80% of the time. However, (...) most of the participants had a limited view of the purpose of informed consent: Less than 20% viewed the process as a decision point. Results suggest a number of common pitfalls to standard informed consent practices that have not generally been recognized. Results are discussed in terms of both ethical and methodological implications. Suggestions for improving the informed consent process are also provided. (shrink)

Critically exploring medical thought in a cultural milieu with no discernible influence from the European Enlightenment, _Being Human_ reveals an otherwise unnoticed intersection of early modern sensibilities and religious values in traditional Tibetan medicine. It further studies the adaptation of Buddhist concepts and values to medical concerns and suggests important dimensions of Buddhism's role in the development of Asian and global civilization. The book opens with the bold achievements in Tibetan medical illustration, commentary, and institution building during the period of the Fifth Dalai Lama and his regent, Desi Sangye Gyatso, then looks back to the work of earlier thinkers, tracing a strategically astute dialectic between scriptural and empirical authority on questions of history and the nature of human anatomy. This article investigates conceptual and strategic relationships between corporate identity, organizational identity and ethics, utilizing the Benetton Corporation as an illustrative case study. Although much attention has been given to visual aspects of Benetton's renowned ethical brand building efforts, few studies have looked at how Benetton's employees, retail environments, and trade events express ethical aspects of their well-known corporate identity. Operational identity emerged as a useful complement to models of corporate identity. A multi-method case study, including interviews at retail outlets (...) and trade events, sheds light on several important yet under-studied components of corporate identity, including stakeholders such as retail managers and contract employees. Analysis of Benetton's operations revealed disconnection and inconsistency, as well as a failure to communicate ethical values and socially responsible attributes throughout organizational identity. We demonstrate the way in which organizations may fail to capitalize on positive aspects of their organizational identity by neglecting their operational identity. (shrink)

Historically, entities with a vested interest in a product that critics have suggested is harmful have consistently used research to back their claims that the product is safe. Prominent examples are: tobacco, lead, bisphenol A, and atrazine. Research literature indicates that about 80–90 % of studies with industry affiliation found no harm from the product, while only about 10–20 % of studies without industry affiliation found no harm. In parallel to other historical debates, recent studies examining a possible relationship between (...) mercury exposure and autism spectrum disorder show a similar dichotomy. Studies sponsored and supported by industry or entities with an apparent conflict of interest have most often shown no evidence of harm or no “consistent” evidence of harm, while studies without such affiliations report positive evidence of a Hg/autism association. The potentially causal relationship between Hg exposure and ASD differs from other toxic products since there is a broad coalition of entities for whom a conflict of interest arises. These include influential governmental public health entities, the pharmaceutical industry, and even the coal burning industry. This review includes a systematic literature search of original studies on the potential relationship between Hg and ASD from 1999 to date, finding that of the studies with public health and/or industry affiliation, 86 % reported no relationship between Hg and ASD. However, among studies without public health and/or industry affiliation, only 19 % find no relationship between Hg and ASD. The discrepancy in these results suggests a bias indicative of a conflict of interest. (shrink)

I consider a way the concept of causation could be excised from chemical practice, suggested by Kitcher's view that causes are just a subset of unifying patterns which play a particular psychological role for us. Kitcherian chemistry is at first blush well equipped to handle explanatory tasks. However, it would force chemists to accept certain unifying patterns as explanatory, which they do not think are at all explanatory. This might head off some descriptive lines of enquiry and damage prospects for (...) the identification of potentially larger‐scale explanations. More important than this, to chemists, it could put them off from finding the explanatory patterns that are true—true because they get at the real structure of the chemical phenomena in the world. There are several distinct components of the realist anti-realist debate. Since each side in the debate has its disadvantages, it is tempting to try to combine realist theses with anti-realist theses in order to obtain a better, more moderate position. Putnam attempts to hold a realist concept of truth, yet he rejects realist metaphysics and realist semantics. He calls this view internal realism. Truth is realist on this picture for it is objective, rather than merely intersubjective, and eternal. Putnam introduces (...) a concept of epistemic idealization — epistemically ideal conditions, or idealized justification — to try to ground the strong objectivity of truth without sliding into metaphysical realism. I argue that the concept of ideal conditions to which Putnam appeals does not cohere with his (anti-realist) commitment to an assertability conditions account of meaning. (shrink)

Furthermore, several new entries and additional cross-references have also been added, and the chronology of feminism now extends through 2005. This paperback edition has a short bibliography of classic and contemporary materials for use by students and the general public. The dictionary, which contains several hundred cross-referenced entries on persons, organizations, key terms, canonical publications, (...) public policies, and campaigns, addresses feminism as both a social movement and a political theory in all nations and periods. This essay explores ethical conflicts underlying the discourse of the policy debate about transracial adoption, focusing on the adoption of Black children by whites. Three underlying conflicts are analyzed, namely, the values of equality versus community, interracial community versus multiculturalism, individuality versus racial-ethnic community. The essay concludes with observations on multicultural families.

This book challenges the World Medical Associationâ (TM)s (WMA) International Code of Ethics statement in 2004, which declared that â ~medical ethics in armed conflict is identical to medical ethics in times of peaceâ (TM). This is achieved by examining the professional, ethical, and legal conflicts in British Military healthcare practice that occur in three distinct military environments. These are (i) the battlefield, (ii) the operational environment and (iii) the non-operational environment. As this conflict is exacerbated by the need to (...) achieve Operational Effectiveness, this book also explores the dual loyalty conflict that Military Health Care Professionals (MHCPs) encounter between following military orders and professional codes of practice. The method used to challenge the WMAâ (TM)s statement and explore these conflicts is the use of real-life problem-solving vignettes, which mirror actual ethical and professional conflicts and dilemmas that may occur in the three environments. The areas of law analysed similarly reflect the difficulties that MHCPs face when caring for the sick and wounded in violent locations when under attack. In particular, the book questions whether it is right for a MHCP to owe their patients a duty of care in hostile environments. This leads on to questioning if any MHCP could be protected by combat immunity where no duty of care is owed to fellow soldiers in the battlefield. The book also questions whether the standard of care should be variable in hostile environments. It also explores the dual loyalty conflict of a wounded senior officer refusing treatment from a junior officer. In addition, it examines the difficulties of a doctor maintaining patient confidentiality when a soldier refuses treatment for a psychological injury but wishes to redeploy to the battlefield. The book successfully challenges the WMAâ (TM)s statement. It also concludes by suggesting that neither a military-focused approach nor a professional healthcare-focused approach towards military healthcare is the best way to solve the dual loyalty conflict. Many contemporary philosophers contend that a positive answer to Molyneux’s Question -- the question of whether a “man born blind and made to see” would be able to identify spatial figures, without touching them, on first viewing -- requires that there be a *rational connection* between the representations of those figures afforded by vision and by touch. This paper explores the question of what this could mean if the representations are non-discursive, or “pure recognitional” concepts, and argues that the most (...) plausible answer to this question can be invoked to resolve analogous questions about the individuation of phenomenal concepts. In Naming and Necessity, Kripke argues that clearly conceived (or imagined) scenarios that seem to be counterexamples to a posteriori identity theses can indeed count as evidence against them—but only if, after reflection on our understanding of their constituent terms and the relevant empirical facts, we find that they cannot be acceptably reconstrued as intuitions about something else. This makes trouble for phenomenalphysical identity statements such as ‘pain is C-fiber stimulation’, since most agree that such statements cannot be so reconstrued—and (...) thus some materialists reject Kripke’s account of the link between conceivability and possibility entirely. In my view, however, this is a mistake, since it impoverishes our resources for evaluating a posteriori modal claims;the better strategy for materialists is to show that phenomenal-physical identity statements comprise a special class of statements to which Kripke’s general strategy does not apply. In this paper I contribute to this project by examining, and challenging, Stephen Yablo’s (2005) general objections to Kripke’s strategy, and sketch a principled way to draw a distinction between phenomenal-physical identity statements and other a posteriori modal claims. Teaching is often framed in terms of performance: an orator stands before a crowd, attempting to capture attention and to deliver material prepared in advance. This analogy falls apart, however, when one considers the extent to which teaching is a dialogical endeavor. Looking to the Meno, the Symposium, and the Republic, this paper offers an interpretation of these texts which deepens our understanding of Plato’s theory of education. First, a Platonic view of education recommends a view of educators not as (...) imparters of wisdom upon passive recipients, but as mediators of student growth. Second, the tragic and comic nature of the above Platonic dialogues suggests that the content of a lesson will always be inflected by the personal characters of the students and teacher. This has direct implications for how philosophers approach their task as teachers, the most notable being that the personal characters and classroom dynamics are factors which must be taken into account in the formulation and development of effective pedagogical methods. Arguing for censorship of the poets in the Republic, Socrates draws most of his examples from Homer. These examples often depict soldiers facing death on the battlefield. Homer, in turn, often represents a soldier’s death with the image of dogs and birds scavenging upon his body. Homer’s representations of death, then, often include dogs or birds, and these images are found in the near background of Plato’s Republic. How does Plato himself use these animal images? As the medical director read aloud his patient profile, “Sixty–eight year old frail appearing Caucasian male with a terminal diagnosis of...” (...) I was already formulating excuses in my head as to why I would not be able to accept this charge. However, when she finished, I dutifully replied, “Ok, I’ll give it my best shot.” At the time, I was well aware that this assignment would test my resolve and commitment to providing the same high quality compassionate [End Page 117] care to every patient, but what I did not realize was how much I would grow personally and professionally in the process.Stan was well known in the organization for being “non–compliant” and “difficult.” Through his past actions he earned the label of racist and misogynist, having zero tolerance for people whom he perceived as different from him in any way. He was profoundly disrespectful toward women and was known to abuse his animals. Having been raised in a liberal household in New Jersey, surrounded by civil rights activists, animal activists and feminists, I was genetically programmed to abhor social injustice and raised to serve as an advocate for the disenfranchised and vulnerable. Since childhood, I’ve experienced visceral reactions to acts of injustice or cruelty of any kind. The very idea of someone like Stan was appalling.I found myself assigned to Stan’s case by default. He fired his first nurse because she was African American and painted her as dishonest and incompetent. He fired his second nurse because he was male and therefore must be gay. He fired his social worker because she was overweight, which certainly meant she was lazy. He fired the chaplain because he was not Catholic and thus unworthy of having any meaningful spiritual discourse. He would not accept the recommendations of our medical director because she was a woman. His family had given up on him a long time ago. His wife left him shortly after his youngest child had gone off to college, and all four of his children were estranged. Stan’s disease was progressing, despite therapy, and he was becoming too weak to care for himself at home without hospice support. His oncologist pleaded with us to give it one more try, even though we were running out of staff. These people that Stan had dismissed so unpleasantly were my colleagues and friends. The first nurse Stan dismissed served as my ever patient and knowledgeable preceptor when I was new to hospice and fumbling my way through unfamiliar protocols. The second nurse Stan rejected was a dedicated colleague and devoted friend, supporting me through several life challenges. I had witnessed our chaplain, judged as unworthy by Stan, tirelessly provide comfort to patients, family members and staff members in the darkest of hours. I knew them all as well–meaning, competent and compassionate team members and Stan’s disrespect for them offended me.Apparently, Stan was offended as well. His oncologist revealed to us that Stan was angered by his referral to hospice. He felt abandoned. I was Stan’s last hope; however, he didn’t see it that way. Neither Stan nor I was enthusiastic about our impending partnership.Stan was an engineer by trade, and apparently very successful in business. He lived on a sprawling plantation located at the end of his private road, which he named Black Horseman Lane. As I turned down the drive, aware of his reputation as a bigot, I contemplated how Stan might have arrived at this name. With the assistance of my smartphone, I was able to ascertain that there was, indeed, a Black Horseman of the Apocalypse, which was associated with famine. Delving further, into Wikipedia, my interpretation was that the Black Horseman’s famine decimated the grain crop, sparing the olive groves and grapevines, driving up the price of grain but leaving oil and wine... Initially, models of chemical systems displaying oscillatory behavior were judged successful if they could show how such behavior was even possible. Recently, however, reaction mechanisms for chemical oscillators have been subjected to more stringent experimental tests. I examine strategies for model testing that flow from theoretical considerations, in particular, the types of feedback relations between chemical species required to produce oscillatory behavior in mechanistic models. These theoretical considerations allow chemists to work around important practical considerations such as an inability to (...) measure certain species in the experimental system. These sorts of testing strategies illuminate chemists' desiderata for a "good model.". (shrink)

The ‘return to beauty’ raises a number of questions for feminism. This paper begins by suggesting that there is no real reason for a feminist distrust either of beauty or of the discourses of beauty. The more difficult question is how to comprehend the bases of aesthetic judgement more generally, given feminist and other critiques of aesthetics and art criticism. The paper proposes looking at the cognate ‘value’ fields of ethics and political philosophy, in order to develop an approach to (...) aesthetics that recognizes aesthetic criteria as grounded in community. It has been argued that uncertainty is the necessary basis for morality and for political judgement after the demise of ideologies of universalism. For the same reasons, an ‘aesthetics of uncertainty’ can be developed which refuses both the new universalism of the ‘return to beauty’ and the temptation to abandon principled criteria of judgement. A segunda metade do século xx ficou profundamente marcada pela configuração de um novo diálogo com a natureza, o que aconteceu sobretudo mediante a introdução de um novo modo de ver as coisas centrado no reconhecimento da complexidade e do acaso como elementos constitutivos da realidade. Nesse sentido, o presente artigo tem por objectivo proceder a uma exposição dos princípios fundamentais desta emergente perspectiva, à qual se dá o nome de paradigma da complexidade, paradigma este que nasce a partir do (...) próprio seio das lacunas inerentes ao paradigma clássico de matriz newtoniana. Mostra-se também como até muito recentemente a ciência foi incapaz de dar atenção a aspectos como a não linearidade ou a assimetria temporal características dos processos próprios dos sistemas abertos e interactuantes com o meio circundante, como é o caso dos organismos vivos, ou seja, daqueles processos que dão propriamente sentido à temporalidade do tempo. A autora mostra ainda até que ponto este novo prisma, ou modo de ver as coisas, que impregna todas as disciplinas, requer novos instrumentos para abordar a realidade de forma qualitativa, exigência esta que, naturalmente, haveria de dar lugar a novos conceitos. Em suma, o artigo defende que o reconhecimento da complexidade do real nos impõe uma nova abertura à interdisciplinaridade e, não menos, a uma nova visão do mundo, uma, precisamente, em que este não aparece como um mero agregado de partes, mas sim como uma rede na qual tudo está interconectado e em contínua transformação. /// The second half of the 20 th -Century points towards a new dialogue with nature under a view that recognizes complexity and fate as constituent elements of reality. In this sense, the present article explains some of the basic principles underlying this new understanding of the world, which goes here by the name of complexity s paradigm, one that is born out of the hollows of the classical newtonian paradigm. At stake are issues like non-linearity or temporary asymmetry which distinguish living creatures as open and interactive systems, and give sense to the concept of time, even though until very recently science has not given enough attention to such concepts. But it is also shown how this new paradigm is pervasive across all the disciplines, whereby it requires new instruments to analyze the qualitative dimension of the real. Finally, the author of the article also claims that the acknowledgement of such complexity of the real presupposes an opening of the minds to interdisciplinary and to a vision of the world in which the real is not seen as a mere addition of pieces, but in which each portion of the real is seen in connection with everything else and as being in constant transformation. Feminist ethics has questioned the limits of and possibilities for the recognition of moral diversity within the Enlightenment legacy of Western rationality and modern universalism. I pursue this question by reading two contemporary theorists, Jürgen Habermas and Seyla Benhabib, who express a strong commitment to the recognition of diversity within a reason-centered reading of the Enlightenment. Despite their strong commitments, however, neither Habermas nor Benhabib can ultimately maintain a balance between the poles of egalitarianism and universalism within the framework of (...) Western rationality. As a result, they fail to recognize diversity fully. Through these readings, I suggest a feminist ethics which subversively appropriates the Enlightenment tradition. This feminist ethics de-centers rationality and dis-locates modernity in order to find an alternate path toward the fulfillment of Enlightenment promises of emancipation. (shrink)

Morag Buchan explores Plato's writings to argue his notions of the inferior female and the superior male. While Plato appears to allow women equal opportunity and participation of political life in the Ideal State in The Republic , his motivation rests on masculine ideals. Women in Plato's Political Theory examines issues including women's (...) relationship to men, to reproduction, to rational thought and politics in Plato's work, and addresses more generally the problem of sexual identity in philosophy. The purpose of this study is to expand our understanding of the factors that influence ethical behavioral intentions of public accountants. Recent scandals have dominated the news and have caused legislators, regulators and the public to question the role of the accounting profession. Legislative changes have brought about major structural changes in the profession and continued scrutiny will surely lead to further changes. Thus, developing an understanding of the personal and contextual factors that influence ethical decisions is critical. An extension (...) of the theory of planned behavior [Ajzen, I.: 1985, Action Control-From Cognition to Behavior ], the model used in this study examined the influence of personal, social and organizational factors on ethical intentions. Specifically, the individual level model tested direct eects of attitudes, subjective norms, perceived behavioral control, moral sensitivity and ethical climate. Professionals from five accounting firms completed a survey that measured responses to ethical dilemmas related to the public accounting domain. To minimize the potential impact of common method bias, the survey instrument was administered in two phases. Hypotheses were evaluated using a structural modeling technique, partial least squares. Results show strong support for a direct relationship between attitudes and ethical intentions. The proposed direct eect of subjective norms was not supported. However, a significant relationship between subjective norms and attitudes was found. Professionals' attitudes towards ethical issues clearly influence intentions. Moreover, this study illustrates the potential influence of social factors in attitude formation. Future research should explore the factors in the public accounting domain that most strongly influence attitude formation. This study suggests that the theory of reasoned action oers a useful framework for exploring these issues. (shrink)

When Australia was circumnavigated by Europeans in 1801–02, French and British natural historians were unsure how to describe the Indigenous peoples who inhabited the land they charted and catalogued. Ideas of race and of savagery were freely deployed by both British and French, but a discursive shift was underway. While the concept of savagery had long been understood to apply to categories of human populations deemed to be in want of more historically advanced ‘civilisation’, the application of this term in (...) the late 18th and early 19th centuries was increasingly being correlated with the emerging terminology of racial characteristics. The terminology of race was still remarkably fluid, and did not always imply fixed physical or mental endowments or racial hierarchies. Nonetheless, by means of this concept, natural historians began to conceptualise humanity as subject not only to historical gradations, but also to the environmental and climatic variations thought to determine race. This in turn meant that the degree of savagery or civilisation of different peoples could be understood through new criteria that enabled physical classification, in particular by reference to skin colour, hair, facial characteristics, skull morphology, or physical stature: the archetypal criteria of race. While race did not replace the language of savagery, in the early years of the 19th century savagery was re-inscribed by race. (shrink)
