Millions of Ugandan children have become orphaned over the last two decades, the primary cause being the increasing HIV/AIDS epidemic. This phenomenon has prompted the government to institute numerous legal reforms. These internal reforms, implemented in a legal environment based on English common law and increasingly, international standards, greatly influence the legal inheritance rights of Ugandan orphans and their chances for prosperity. In many regions, however, the traditional local mores trump both national and global standards, meaning that while Ugandan parents (...) may own appreciable property upon death, their children rarely receive it, but rather fall victim to “property grabbing” or mismanagement by relatives. The key impediments to solving this problem and to Uganda’s adoption of a more egalitarian system of inheritance include the ineffectiveness of local councils, the inadequate enforcement of the Children Stature, and the heavily centralized and cumbersome structure of the national government. Therefore, significant reforms are needed, including the pronouncement of a national policy regarding orphans, the reduction of national reliance on NGOs, and the restoration of a national legislative effort to codify orphans’ property rights. This article examines the relationship between the pro-imperial Round Table Society's political vision and the omnipresent historical narrative of commonwealth that characterized the group's major publications during the First World War. It pays particular attention to the way the primary author of these publications, Lionel Curtis, interpolated Alfred Zimmern's 1911 book, The Greek Commonwealth, into this historical narrative in an attempt to reconcile the contradictions inherent in the Round Table's political project. These contradictions centred on the group's desire to democratize (...) imperial politics while excluding non-European subjects from this democracy and their belief in an imperial state that demanded the ultimate loyalty of its citizens but was not 'Prussianist'. Examining the way Curtis used the Athenian polis to address this fraught political puzzle offers us insight into both the ideological power wielded by the Round Table during this transitional era and the power of historical narrative in imperial justification more generally. It is widely held that the paradox of Achilles and the Tortoise, introduced by Zeno of Elea around 460 B.C., was solved by mathematical advances in the nineteenth century. The techniques of Weierstrass, Dedekind and Cantor made it clear, according to this view, that Achilles’ difficulty in traversing an infinite number of intervals while trying to catch up with the tortoise does not involve a contradiction, let alone a logical absurdity. Yet ever since the nineteenth century there have been dissidents (...) claiming that the apparatus of Weierstrass et al. has not resolved the paradox, and that serious problems remain. It seems that these claims have received unexpected support from recent developments in mathematical physics. This support has however remained largely unnoticed by historians of philosophy, presumably because the relevant debates are cast in mathematical-technical terms that are only accessible to people with the relevant training. That is unfortunate, since the debates in question might well profit from input by philosophers in general and historians of philosophy in particular. Below we will first recall the Achilles paradox, and describe the way in which nineteenth century mathematics supposedly solved it. Then we discuss recent work that contests this solution, reiterating the dissident dogma that no mathematical approach whatsoever can even come close to solving the original Achilles. We shall argue that this dissatisfaction with a mathematical solution is inadequate as it stands, but that it can perhaps be reformulated in the light of new developments in mathematical physics. Often, regret implies the wish not to have performed certain actions. In this article I claim that this wish can to some extent be fulfilled: it is possible, in a sense, to influence the character of actions that have already been performed. This possibility arises from combining a first person perspective with an outlook on actions as expressions of tendencies, where tendencies are identified on the basis of a number of actions. The idea is specified within the framework of Carnapian (...) reduction sentences, but this technique is in no sense mandatory: it can be formulated in other vocabularies as well. (shrink)

In this review essay, Jeanne Connell examines the influence of pragmatic philosophy on the scholarly works of twentieth‐century literary theorist and English educator Louise Rosenblatt through the lens of a recent collection of her essays originally published between 1936 and 1999. Rosenblatt grounded her transactional theory of literature in pragmatic philosophy, particularly the epistemological constructs of John Dewey. While influential as a pioneer in the early development of reader‐response theory, Rosenblatt’s theory has only recently been given attention by philosophers (...) of education. Making Meaning with Texts: Selected Essays is an important collection of articles and book chapters that highlights the evolution of her thinking in literary theory, pedagogy, and literary criticism. Rosenblatt positioned the construction of meaning in the personal lived‐through quality of the literary experience, making central the generative relation between the text and the reader. Connell argues that the educational relevance of Rosenblatt’s theory for contemporary education is that it provides a powerful critique of classroom approaches that promote shallow readings with little opportunity for critical reflection. This paper develops a two-part model of the crucial roles that episodic memory and perceptual filters play in responses to organizational crisis. We examine thecascading impacts of episodic memory, the types of filters that shape stakeholder responses to crisis, and subsequent impacts on reputation. A sound wave analogy is developed to understand the complexity of organizational crisis. The model is partially applied to the BP Deepwater Horizon oil rig disaster.

This Open Access book addresses the age-old problem of infinite regresses in epistemology. How can we ever come to know something if knowing requires having good reasons, and reasons can only be good if they are backed by good reasons in turn? The problem has puzzled philosophers ever since antiquity, giving rise to what is often called Agrippa's Trilemma. The current volume approaches the old problem in a provocative and thoroughly contemporary way. Taking seriously the idea that good reasons are (...) typically probabilistic in character, it develops and defends a new solution that challenges venerable philosophical intuitions and explains why they were mistakenly held. Key to the new solution is the phenomenon of fading foundations, according to which distant reasons are less important than those that are nearby. The phenomenon takes the sting out of Agrippa's Trilemma; moreover, since the theory that describes it is general and abstract, it is readily applicable outside epistemology, notably to debates on infinite regresses in metaphysics. This article describes the theory and process of global business citizenship (GBC) and applies it in an analysis of characteristics of company codes of business conduct. GBC is distinguished from a commonly used term, “corporate citizenship,” which often denotes corporate community involvement and philanthropy. The GBC process requires (1) a set of fundamental values embedded in the corporate code of conduct and in corporate policies that reflect universal ethical standards; (2) implementation throughout the organization with thoughtful awareness of where the (...) code and policies fit well and where they might not fit with stakeholder expectations; (3) analysis and experimentation to deal with problem cases; and (4) systematic learning processes to communicate the results of implementation and experiments internally and externally. We then identify and illustrate the three attributes of a code of conduct that would reflect a GBC approach. The three attributes are orientation, implementation, and accountability. The various components of these attributes are specified and illustrated, using website examples from six global petroleum companies. (shrink)

Suppose q is some proposition, and let P(q) = v0 (1) be the proposition that the probability of q is v0.1 How can one know that (1) is true? One cannot know it for sure, for all that may be asserted is a further probabilistic statement like P(P(q) = v0) = v1, (2) which states that the probability that (1) is true is v1. But the claim (2) is also subject to some further statement of an even higher probability: P(P(P(q) (...) = v0) = v1) = v2, (3) and so on. Thus, an infinite regress emerges of probabilities of probabilities, and the question arises as to whether this regress is vicious or harmless. Radical probabilists would like to claim that it is harmless, but Nicholas Rescher (2010), in his scholarly and very stimulating Infinite Regress: The Theory and History of Varieties of Change, argues that it is vicious. He believes that an infinite hierarchy of probabilities makes it impossible to know anything about the probability of the original proposition q: unless some claims are going to be categorically validated and not just adjudged probabilistically, the radically probabilistic epistemology envisioned here is going to be beyond the prospect of implementation. . . . If you can indeed be certain of nothing, then how can you be sure of your probability assessments. If all you ever have is a nonterminatingly regressive claim of the format . . . the probability is .9 that (the probability is .9 that (the probability of q is .9)) then in the face of such a regress, you would know effectively nothing about the condition of q. After all, without a categorically established factual basis of some sort, there is no way of assessing probabilities. But if these requisites themselves are never categorical but only probabilistic, then we are propelled into a vitiating regress of presuppositions. (shrink)

This article begins with an explanation of how moral development for organizations has parallels to Kohlberg's categorization of the levels of individual moral development. Then the levels of organizational moral development are integrated into the literature on corporate social performance by relating them to different stakeholder orientations. Finally, the authors propose a model of organizational moral development that emphasizes the role of top management in creating organizational processes that shape the organizational and institutional components of corporate social performance. This article (...) represents one approach to linking the distinct streams of business ethics and business-and-society research into a more complete understanding of how managers and firms address complex ethical and social issues. The possible relationship between widespread unauthorized copying of microcomputer software (also known as software piracy) and level of moral judgment is examined through analysis of over 350 survey questionnaires that included the Defining Issues Test as a measure of moral development. It is hypothesized that the higher one''s level of moral judgment, the less likely that one will approve of or engage in unauthorized copying. Analysis of the data indicate a high level of tolerance toward unauthorized copying and limited support (...) for the hypothesis. The most plausible explanation for these findings is that software copying is perceived as an issue of low moral intensity. This study calls into question the software industry''s strategy of concentrating exclusively on institutional compliance with copyright rules, rather than working to raise the perceived moral intensity about software piracy at the individual level. As long as the issue remains low in moral intensity, the industry cannot expect significant shifts in copying behaviors. Individuals must become more aware of and concerned about the nature and magnitude of harm to society and to the rightful copyright owners from unauthorized copying before their attitudes and behaviors come to reflect higher levels of moral judgment. Recent work in the business ethics field has called attention to the promise inherent in the concept of authenticity for enriching the ways we think about core issues at the intersection of management ethics and practice, like moral character, ethical choices, leadership, and corporate social responsibility [Driver, 2006; Jackson, 2005; Ladkin, 2006]. In this paper, I aim to extend these contributions by focusing on authenticity in relation to a set of organizational processes related to strategy making; most specifically an organization’s (...) strategic intent, arguing that these provide an ideal venue for particularising this exploration, as they represent the key processes through which an organization defines the self it aspires to be. In order to do this, I examine specifically what a shift from “business as usual” to the search for the creation of a more authentic corporate self might look like in practice, contending that such a shift offers the possibility for improving both the moral good and the business outcomes of an institution simultaneously. I conclude with assessment of the risks inherent in undertaking such a search for more authentic strategic intention in business organizations today. (shrink)

The popular view of shareholder activism focuses on shareholder resolutions and the shareholder vote via proxy statements at the annual meeting, which is treated as a "David vs. Goliath" showdown between the small group of socially responsible investors and the powerful corporation. This article goes beyond the popular view to examine where the real action typically occurs-in the Dialogue process where corporations and shareholder activist groups mutually agree to ongoing communications to deal with a serious social issue. Use of the (...) capitalized word "Dialogue" is intended to distinguish this formal process between corporations and shareholders from all the other forms of dialogue or twoway communication exchanged between a corporation and its stakeholders. The phenomenon of Dialogue between a corporation and dissident shareholders has not been analyzed in the academic literature or in the popular press because it occurs behind the scenes and out of sight from media scrutiny. Yet this is where a great deal of social change initiated by shareholder activists is negotiated. This article contributes both theoretically and empirically to the study of Dialogues between shareholder activists and corporations. We explain how Dialogues occur in the context of the shareholder resolution process and examine two Dialogues that focus on international labor issues in two industries. Then data on Dialogues during the period, 1999-2005, from the Interfaith Center on Corporate Responsibility are analyzed. This research contributes to knowledge about the Dialogue process and the emerging literature on corporation-stakeholder engagement. (shrink)

This article focuses on the question of whether Social Issues in Management (SIM) is a “field” and, if so, what kind, emphasizing specifically the recent literature on corporate social responsibility and performance (CSR/csp). Fields are defined in part by coherent bodies of knowledge that serve as guideposts for current research, and so the authors construct a simple model of CSR/csp scholarship, illustrating the relevant categories with representative publications. The authors conclude that SIM is a “low-paradigm” field but is not recognized (...) or accepted as a field by many scholars who write about CSR/csp from “outside” the field. This analysis points to the need for SIM scholars to continue to integrate useful ideas from other fields, and also to critique the work of scholars who address “failings” or “gaps” in SIM research without appropriately dealing with the existing SIM literature. The article concludes with some ideas for sustaining the institutional legitimacy of SIM and for challenging those who would “reinvent” a field with a long and fruitful history, including paying careful attention to journal review processes and the content of publications in prominent journals. A major objection to epistemic infinitism is that it seems to make justification impossible. For if there is an infinite chain of reasons, each receiving its justification from its neighbour, then there is no justification to inherit in the first place. Some have argued that the objection arises from misunderstanding the character of justification. Justification is not something that one reason inherits from another; rather it gradually emerges from the chain as a whole. Nowhere however is it made clear what (...) exactly is meant by emergence. The aim of this paper is to fill that lacuna: we describe a detailed procedure for the emergence of justification that enables us to see exactly how justification surfaces from a chain of reasons. This paper argues that the personal interview method is particularly appropriate for the kind of exploratory and complicated theory-building research that ethical decision-making, as a topic, represents at present. In doing so, it examines the key tasks of the ethics researcher, the suitability of interviews for obtaining the kind of data needed to accomplish these tasks, and the ensuing problems faced by the interview methodologist. It concludes with suggestions for enhancing the validity and reliability of interview-based ethics research.

This article argues for the recovery and re-incorporation of lost voices and debates into the history of political thought by focusing on the issue of sovereignty. It begins by examining why such a narrow understanding of the canon has come to dominate the sub-discipline and argues for critical approaches that treat the past as a “contested terrain” rather than an unfolding plot. It then turns to early twentieth-century Britain as an example of an era when thinkers who have been largely (...) forgotten by today’s political theorists argued loudly about the future of state sovereignty. It next focuses on a 1916 exchange of essays entitled “The Nature of the State in View of Its External Relations” by Delisle Burns, Bertrand Russell, and G.D.H. Cole, as an example of some of the most innovative and radical ideas to emerge from the period. The article concludes by arguing that re-engaging the work of these forgotten thinkers can broaden our conceptual horizons about sovereignty, speak to some of the most urgent issues of our time, and force open the concept of “the political” to radical reinterpretation. ABSTRACT The sections devoted to dissociation in The New Rhetoric identify many verbal forms that can express this reconceptualizing line of argument. This article reviews the linguistic options offered in English for epitomizing dissociations, including tautologies and constructions that prompt diverging meanings, orthographical devices like capitalization or subscripts that produce variants of a single word, word schemes like agnominatio and polyptoton that alter core forms, and affixes or modifiers that are either available as antonyms or require forcing apart by subsequent (...) antitheses. Paying attention to the verbal expression of dissociations highlights cases that may or may not qualify as the rich reconceptualizations Perelman and Olbrechts-Tyteca had in mind. Arguments that involve three distinguished terms may, for example, reach a limit where dissociations merge into arguments from division, a long recognized device in traditional rhetoric/dialectic. From the seventeenth through the nineteenth centuries, scientists such as Kekule, Mendel, Lavoisier and Harvey argued for insights that depended critically on antithetical expressions and reasoning. The heuristic and persuasive use of devices like the antithesis has roots in the in combined grammatical, rhetorical and dialectical training established during the early modern educational reforms of the humanists. While the entire array of figures includes devices which inscribe all the rhetorical appeals, the set of devices derived from parallel phrasing illustrates how (...) certain figures of speech express lines of reasoning iconically. But the continued use of such devices invites a general rationale for their persuasiveness based on the importance of pattern completion in language processing. (shrink)

This book contains a selection of papers from the workshop *Women in the History of Analytic Philosophy* held in October 2019 in Tilburg, the Netherlands. It is the first volume devoted to the role of women in early analytic philosophy. It discusses the ideas of ten female philosophers and covers a period of over a hundred years, beginning with the contribution to the Significs Movement by Victoria, Lady Welby in the second half of the nineteenth century, and ending with Ruth (...) Barcan Marcus’s celebrated version of quantified modal logic after the Second World War. The book makes clear that women contributed substantially to the development of analytic philosophy in all areas of philosophy, from logic, epistemology, and philosophy of science, to ethics, metaphysics, and philosophy of language. It illustrates that although women's voices were no different from men's as regards their scope and versatility, they had a much harder time being heard. The book is aimed at historians of philosophy and scholars in gender studies. (shrink)

Dans sa traduction partielle du Timée de Platon, Cicéron traduit le terme grec οὐσία par aeternitas et materia. Ces choix de traduction sont particulièrement intéressants à étudier puisqu’il n’existe pas de traduction fixe d’οὐσία en latin à l’époque de Cicéron – il n’est, en effet, pas à l’origine du néologisme essentia. Pourquoi Cicéron choisit-il deux termes latins pour traduire un même mot grec? Pourquoi deux mots si différents à la fois l’un de l’autre et du terme οὐσία? Quelle compréhension du (...) concept d’οὐσία, mais aussi du Timée, cette traduction induit-elle? Nous étudions dans cet article chacune des deux traductions latines et tentons de montrer que Cicéron est influencé par le contexte dans ses choix de traduction. Dans le « prélude » du discours de Timée, il traduit οὐσία par aeternitas lorsqu’il considère que le terme grec, opposé à γένεσις, correspond au participe substantivé τὸ ὂν ἀεί, γένεσιν δὲ οὐκ ἔχον. En traduisant οὐσία par aeternitas en 29c3, il fait du sème de l’éternité une caractéristique discriminante d’οὐσία, qui correspond également au modèle intelligible du monde. Dans le cas de materia, le mot latin traduit l’οὐσία dans le cadre du mélange de l’âme du monde par le démiurge dans un cratère. Cicéron choisit le terme materia qui sert généralement, en contexte philosophique, à désigner une matière disponible pour prendre la forme qu’on veut lui donner, selon différentes doctrines. Nous tentons de montrer que le contexte de la métaphore du mélange pousse Cicéron à considérer le terme οὐσία comme une « substance » qui entre dans la composition d’un mélange. Ces deux traductions d’οὐσία montrent que l’Arpinate choisit chacun des termes latins selon le sens précis qu’il donne à οὐσία, en fonction du contexte philosophique mais aussi en fonction du registre du discours. Various arguments have been put forward to show that Zeno-like paradoxes are still with us. A particularly interesting one involves a cube composed of colored slabs that geometrically decrease in thickness. We first point out that this argument has already been nullified by Paul Benacerraf. Then we show that nevertheless a further problem remains, one that withstands Benacerraf s critique. We explain that the new problem is isomorphic to two other Zeno-like predicaments: a problem described by Alper and Bridger in (...) 1998 and a modified version of the problem that Benardete introduced in 1964. From 1929 onwards, C. I. Lewis defended the foundationalist claim that judgements of the form 'x is probable' only make sense if one assumes there to be a ground y that is certain (where x and y may be beliefs, propositions, or events). Without this assumption, Lewis argues, the probability of x could not be anything other than zero. Hans Reichenbach repeatedly contested Lewis's idea, calling it "a remnant of rationalism". The last move in this debate was a challenge by (...) Lewis, defying Reichenbach to produce a regress of probability values that yields a number other than zero. Reichenbach never took up the challenge, but we will meet it on his behalf, as it were. By presenting a series converging to a limit, we demonstrate that x can have a definite and computable probability, even if its justification consists of an infinite number of steps. Next we show the invalidity of a recent riposte of foundationalists that this limit of the series can be the ground of justification. Finally we discuss the question where justification can come from if not from a ground. (shrink)
