Truth, Trust and Medicine investigates the notion of trust and honesty in medicine, and questions whether honesty and openness are of equal importance in maintaining the trust necessary in doctor-patient relationships. Jackson begins with the premise that those in the medical profession have a basic duty to be worthy of the trust their patients place in them. Yet questions of the ethics of withholding information and consent and covert surveillance in care units persist. It is widely assumed that memory has only the capacity to preserve epistemic features that have been generated by other sources. Specifically, if S knows (justifiedly believes/rationally believes) that p via memory at T2, then it is argued that (i) S must have known (justifiedly believed/rationally believed) that p when it was originally acquired at Tl, and (ii) S must have acquired knowledge that p (justification with respect to p/rationality with respect to p) at Tl via a non-memorial source. Thus, (...) according to this view, memory cannot make an unknown proposition known, an unjustified belief justified, or an irrational belief rational--it can only preserve what is already known, justified, or rational. In this paper, I argue that condition (i) is false and, a fortiori, that condition (ii) is false. Hence, I show that, contrary to received wisdom in contemporary epistemology, memory can function as a generative epistemic source. (shrink)

Catharine MacKinnon has claimed that pornography is the subordination of women. Rae Langton has defended the plausibility and coherence of this claim by drawing on speech act theory. I argue that considering the role of context in speech acts poses serious problems for Langton's defence of MacKinnon. Langton's account can be altered in order to accommodate the role of context. Once this is done, however, her defence of MacKinnon no longer looks so plausible. Finally, I argue that the speech act (...) approach (adapted to account for context) offers an appealing way to make sense of disagreements over pornography; but also that this will probably not be so appealing to most proponents of the speech acts approach. This investigation applies a social cognition framework to examine moral awareness in business situations. Using a vignette-based instrument, the investigation compares the recall, recognition, and ascription of importance to moral-versus strategy-related issues in business managers (n = 86) and academic professors (n = 61). Results demonstrate that managers recall strategy-related issues more than moral-related issues and recognize and ascribe importance to moral-related issues less than academics. It also finds an inverse relationship between socialization in the business context and moral awareness. (...) The Federal Trade Commission has an important role to play in the governmental oversight of mobile health apps, ensuring consumer protections from unfair and deceptive trade practices and curtailing anti-competitive methods. The FTC’s consumer protection structure and authority is outlined before reviewing the recent FTC enforcement activities taken on behalf of consumers and against developers of mhealth apps. The article concludes with identification of some challenges for the FTC and modest recommendations for strengthening the consumer protections it provides.

The law ordinarily recognises the woman who gives birth as the mother of a child, but in certain jurisdictions, it will recognise the commissioning couple as the legal parents of a child born to a commercial surrogate. Some commissioning parents have, however, effectively abandoned the children they commission, and in such cases, commercial surrogates may find themselves facing unexpected maternal responsibility for children they had fully intended to give up. Any assumption that commercial surrogates ought to assume maternal responsibility for (...) abandoned children runs contrary to the moral suppositions that typically govern contract surrogacy, in particular, assumptions that gestational carriers are not ‘mothers’ in any morally significant sense. In general, commercial gestational surrogates are almost entirely conceptualised as ‘vessels’. In a moral sense, it is deeply inconsistent to expect commercial surrogates to assume maternal responsibility simply because commissioning parents abandon children for one reason or another. We identify several instances of child abandonment and discuss their implications with regard to the moral conceptualisation of commercial gestational surrogates. We conclude that if gestational surrogates are to remain conceptualised as mere vessels, they should not be expected to assume responsibility for children abandoned by commissioning parents, not even the limited responsibility of giving them up for adoption or surrendering them to the state. In analytic political philosophy, it is common to view state-sponsored injustice as the work of a corporate agent. But as I argue, structural injustice theory provides grounds for reassessing the agential approach, producing new insights into state-sponsored injustice. Using the case of eugenic sterilization in the United States, this article proposes a structurally-sensitive conception of state-sponsored injustice with six components: authorization, protection, systemization, execution, enablement, and norm- and belief-influence. There is reason for genuine puzzlement about Hume's aim in ‘The Natural History of Religion’. Some commentators take the work to be merely a causal investigation into the psychological processes and environmental conditions that are likely to give rise to the first religions, an investigation that has no significant or straightforward implications for the rationality or justification of religious belief. Others take the work to constitute an attack on the rationality and justification of religious belief in general. In contrast to (...) these views, I argue that Hume aims to establish two important claims in ‘The Natural History of Religion’. First, almost all popular religions, including popular monotheism, are deeply superstitious. Second, superstitious monotheism is incompatible with the variety of theism supported by the argument from design. This incompatibility puts significant pressure on the rational acceptability of popular religions. (shrink)

Drawing on the work of Charles W. Mills and considering the case of reparations to Black Americans, this article defends the “structural turn” in the philosophical reparations scholarship. In the Black American context, the structural turn highlights the structural and institutional operations of a White supremacist political system and a long chronology of state-sponsored injustice, as opposed to enslavement as a standalone historical episode. Here, the question whether distributive justice is more appropriate than reparative justice is particularly pressing, since structural (...) racial inequalities form part of the basis for reparations. Derrick Darby’s pragmatic argument for non-race-specific redistributive policies and Tommie Shelby’s principled defense of distributive justice are both considered, as well as the challenge to the structural turn that comes from Carlton Waterhouse’s argument for reparations for enslavement rather than “legacy of slavery” reparations. Using resource dependency and institutional theories, we create and test a model examining the relationships among senior management commitment, resource allocations, and the structure of public affairs departments. Using a large sample of U.S.-based firms, we find a positive relationship between senior management commitment to the public affairs function and the level of human and monetary resources allocated to the public affairs department. Furthermore, firms structure their public affairs responsibilities into three common activity sets: communications, collaborations, and local activities. Ruchkin et al. ascribe a pivotal role to long-term memory representations and binding within working memory. Here we focus on the interaction of working memory and long-term memory in supporting on-line representations of experience available to guide on-going processing, and we distinguish the role of frontal-lobe systems from what the hippocampus contributes to relational long-term memory binding.

Hurley’s is a difficult book to work through—partly because of its length and the complexity of its arguments, but also because each of the ten essays of which it is composed has a rather different starting point and focus, and because few of her arguments achieve real closure. Essay 2 discusses competing interpretations of Kant, essay 4 articulates nonconceptual forms of self-consciousness, essay 5 offers fresh interpretations of commissurotomy patients’ behavior, essay 6 develops an objection to Wittgenstein on rule following, (...) essay 8 attacks an alleged assumption of externalism, and chapter 10 explores the possibility of combining a “motor theory” and a “control theory” of perception. This is a very rich brew, and at least half the challenge this book presents consists in discerning its central argument and conclusion with enough precision to bring criticism to bear. (shrink)

Findings suggest a positive impact of bilingualism on cognition, including the later onset of dementia. However, it is not clear to what extent these effects are influenced by variations in attentional control demands in response to specific task requirements. In this study, 20 bilingual and 20 monolingual older adults performed a task-switching task under explicit task-cuing vs. memory-based switching conditions. In the cued condition, task switches occurred in random order and a visual cue signaled the next task to be performed. (...) In the memory-based condition, the task alternated after every second trial in a predictable sequence without presenting a cue. The performance of bilinguals did not vary across experimental conditions, whereas monolinguals experienced a pronounced increase in response latencies and error rates in the cued condition. Both groups produced similar switch costs and mixing costs, but bilinguals produced them with lower response latencies. The cognitive benefits of bilingualism seem not to apply to executive functions per se but to affect specific cognitive processes that involve task-relevant context processing. The present results suggest that lifelong bilingualism could promote in older adults a flexible adjustment to environmental cues, but only with increased task demands. However, due to the small sample size, the results should be interpreted with caution. (shrink)

Over the last decades, curator Nicolas Bourriaud has drawn significant inspiration for his writings on contemporary art from the theories of the Situationist International (SI), an avant-garde group in existence from 1957 until 1972. Mischaracterizing the SI’s concepts of the situation, détournement, and the dérive, Bourriaud claims to update these concepts with concepts of his own: relational aesthetics, detourage, and radicant aesthetics. This article identifies such misrepresentations and highlights the differences between Bourriaud’s paradigms and those of the SI. This contextual (...) restitution also provides an opportunity to examine Bourriaud’s general methodology of substituting conceptual formalism for art historical theory. Bourriaud’s publications repeatedly claim a historical materialist perspective on aesthetics, only to eventually eliminate this perspective; his use and abuse of Situationist theory is the foundational example for this pattern. More than the artworks showcased in Bourriaud’s exhibitions and referenced in his publications, his artistic paradigms describe and delineate his own philosophical sleight of hand. (shrink)

In 2000, researchers from the Human Genome Project proclaimed that the initial sequencing of the human genome definitively proved, among other things, that there was no genetic basis for race. The genetic fact that most humans were 99.9% the same at the level of their DNA was widely heralded and circulated in the English-speaking press, especially in the United States. This pronouncement seemed proof that long-term antiracist efforts to de-biologize race were legitimized by scientific findings. Yet, despite the seemingly widespread (...) acceptance of the social construction of race, post-HGP genetic science has seen a substantial shift toward the use of race variables in genetic research and, according to a number of prominent scholars, is re-invoking the specter of earlier forms of racial science in some rather discomfiting ways. During the past seven years, the main thrust of human genetic research, especially in the realm of biomedicine, has shifted from a concern with the 99.9% of the shared genome — what is thought to make humans alike — towards an explicit focus on the 0.1% that constitutes human genetic variation. Here I briefly explore some of the potential implications of the conceptualization and practice of early 21st century genetic variation research, especially as it relates to questions of race. Launched by the United Nations in 2000, the Global Compact (GC) promotes private sector compliance with 10 basic principles covering human rights, labour standards, the environment, and anti-corruption. Its sponsors aim to establish a global corporate social responsibility (CSR) network based on a pledge to observe the 10 principles adopted by companies across the range of company size and regional origin, backed by a modest reporting system and collaborative programmes. The author analyzes the GC's progress toward building a global network (...) from its launch through 2006 and finds that, while the GC's nominal membership base of nearly 3000 companies makes it the largest system among collective action institutions (CAIs) for corporate responsibility, the GC has not reached 'critical mass'. Deficiencies in its nascent global network include limited market penetration among the largest corporations, a membership heavily weighted toward Western European companies, and major weaknesses in compliance with its reporting system. The author concludes that the GC must improve both penetration and compliance if it is to succeed in building a global standard for CSR. (shrink)

I recommend three revisions to experimental philosophy's ‘self-image’ which I suggest will enable experimentalist critics of intuition to evade several important objections to the 'negative' strand of the experimental philosophy research project. First, experimentalists should avoid broad criticisms of ‘intuition’ as a whole, instead drawing a variety of conclusions about a variety of much narrower categories of mental state. Second, experimentalists should state said conclusions in terms of epistemic norms particular to philosophical inquiry, rather than attempting to, for example, deny (...) that intuitions produce justified belief. Third, experimentalists should acknowledge the limitations of the ‘method of cases’ model of philosophical inquiry, and expand their experimental work accordingly. (shrink)

Are women's requests for aid in dying honored more often than men's, or less? Feminist arguments can support conclusions either that gendered perceptions of women as self‐sacrificing predispose physicians to accede to women's requests to die — or that cultural understandings of women as not fully rational agents lead physicians to reject their requests as irrational.

In recent years, there has been a surge in popularity of the fair-trade industry, which seeks to improve trading conditions and to promote the rights of marginalized workers. Although research suggests that fair-trade products are perceived as promoting social and economic responsibility, some individuals—namely, those who seek to maintain existing group inequalities or those induced to think inequality is a good thing—may not share this perception. Across three studies, we found that SDO relates negatively to fair-trade consumption, and this relationship (...) is mediated by the tendency for high-SDO individuals to see fair-trade products as less compatible with their conception of social justice. Our findings held after controlling for related individual-differences variables, and regardless of whether SDO was measured or manipulated. Implications for how to maximize the likelihood that people will perceive fair-trade products as “fair” are discussed. (shrink)

Under normal circumstances the church would function as an agent of change and transformation, but this article focuses on the church herself that needs radical change if she is to remain relevant in mission and ministry in this current era. Clericalism and the centralisation of hierarchical control can be identified as the root causes of institutional pathology and weakening collegiality. To address clericalism may require the adjustment of seminary training, as in the current system seminarians are nurtured in a sense (...) of separateness, promoting male-ego and feed gender exclusivity and doctrinal self-righteousness. While the seminary was once an instrument of reform in the Catholic Church, established to counter problems such as clerical concubinage and illiteracy, but now it is no longer suitable as it has become the forum that breeds other problems. Priority attention should be paid to purge the church of rampant clericalism, discriminatory scapegoating of gay persons, marginalisation of free thinkers, exclusion of women priests, the perceived moral laxity of family life issues and reception of communion by divorced Catholics without the benefits of annulment. Discrediting the personal authority of the pope is hardly an enlightened option. What ought to be transformed is the centralisation of control and allowing increased localised dominion whereby crises such as sexual abuse scandals could be addressed and solved more speedily and liberally, and limit the need to go to the top for solutions. To wait for centralised, hierarchal structures to deal with urgent issues is not desirable, as speedy accountability is needed to address issues that hurt the church in its entirety. (shrink)

Reeder's 1978 essay on “Religious Ethics as a Field and Discipline,” this essay explores debates surrounding the original intentions for the Journal of Religious Ethics (JRE) and for the field of religious ethics, as these have played out over the decades among an influential group of scholars involved with the JRE since its inception: Arthur Dyck, Ronald Green, Stanley Hauerwas, and Jeffrey Stout. While the JRE and its founding mission are in need of ongoing critique and (...) transformation, we might well still affirm the journal's ongoing importance as a site for the negotiation of a commons, the identification of possibilities for shared life, imagined beyond exclusion and domination. Environmental releases of gene edited (GEdOs) and gene drive organisms (GDOs) will likely occur under conditions of high uncertainty and in complex socioecological systems. Therefore, public deliberation is especially important to account for diverse interpretations of safety, risks, and benefits; to draw on experiential and public wisdom in areas of proposed release; to ameliorate dangers of technological optimism; and to increase the public legitimacy of decisions. Yet there is a “democratic deficit” in the United States' oversight system for GEdOs and (...) GDOs, as unconflicted experts, publics, and skeptical stakeholders are most often excluded from decision‐making and unavailable to critically examine potential risks and benefits or raise broader concerns about socioeconomic or cultural impacts. This article argues for the need to open up decision‐making for GEdOs and GDOs, discusses the challenges for doing so within the current oversight framework, and finally, proposes institutional, policy, and attitudinal changes that are likely important for overcoming barriers to public deliberation. California is the global hub for assisted reproductive technology practices, including egg donation. The rise of egg donation in the United States is surprising given the cultural context linking genetics and motherhood and rejecting the commodification of reproduction. Scholars in the hostile worlds camp have grappled with the relationship between intimacy and economics, yet employing this theory to explain the increase in egg donation is unsatisfactory. The concept of relational work, developed by Viviana Zelizer, provides scholars with a robust analytical (...) tool to account for the rise in egg donation. This paper analyzes the relational work of egg donors and fertility center staff. I argue that donors and staff construct an understanding of egg donation that avoids directly challenging the cultural context mentioned above. Analyzing egg donation as a case of relational work demonstrates the need to move beyond the reciprocity/market dichotomy upheld by the hostile worlds framework. (shrink)

Re-evaluating dominant cultural narratives around dying and death is central to new critiques of individualism and human exceptionalism. As conceptual tools for theorizing the end of the individual proliferate, the affective dimensions of this project are often overlooked, especially as they pertain to individual subjects. In contrast, a significant number of iconic queer and feminist thinkers have suffered breast cancer and written memoirs representing the subjective experience of confronting mortality. This article identifies the affective orientations towards one’s own mortality as (...) missing from queer and feminist thinking on embodiment in the Anthropocene. As a remedy, the article reads several iconic feminist breast cancer memoirs – Sontag, Lorde, Sedgwick, Jain and Boyer – for their complex representations of affect, in particular fear, in relation to dying and death. Using the affect theory of Silvan Tomkins, this analysis contributes to critiques of cancer culture in medical humanities and of mortality and embodiment in feminist environmental humanities. (shrink)
