Since Barry Stroud's classic paper in 1968, the general discussion on transcendental arguments tends to focus on examples from theoretical philosophy. It also tends to be pessimistic, or at least extremely reluctant, about the potential of this kind of arguments. Nevertheless, transcendental reasoning continues to play a prominent role in some recent approaches to moral philosophy. Moreover, some authors argue that transcendental arguments may be more promising in moral philosophy than they are in theoretical contexts. Against this background, the current (...) volume focuses on transcendental arguments in practical philosophy. Experts from different countries and branches of philosophy share their views about whether there are actually differences between "theoretical" and "practical" uses of transcendental arguments. They examine and compare different versions of transcendental arguments in moral philosophy, explain their structure, and assess their respective problems and promises. This book offers all those interested in ethics, meta-ethics, or epistemology a more comprehensive understanding of transcendental arguments. Zusammenfassung Seit den 1980er Jahren mehren sich im Umfeld der Leichtathletik Annahmen, die der Sportart eine negative Entwicklung, u. a. hinsichtlich der Zahl der organisierten Vereinsmitglieder, besonders im Nachwuchsbereich, prognostizierten. Implizit wie explizit wurde bei der Erklärung dieser prognostizierten Entwicklung Rekurs auf Theorien sozialen Wandels genommen. Eine empirische Prüfung entwicklungsbezogener Aussagen blieb jedoch aus. Die im vorliegenden Beitrag dargestellte Längsschnittuntersuchung „Leichtathletik anbietender Organisationen“ schließt diese Lücke, indem spezifisch zur Mitgliederentwicklung in diesen Organisationen theoretisch ableitbare Hypothesen geprüft werden. Zusammenfassung Zum organisationalen Wandel existieren verschiedene theoretische Ansätze, welche sich u.a. durch ihren Umweltbezug unterscheiden. Der populationsökologische Ansatz erweitert diese intraorganisationale Perspektive um die Analyseebene des Kollektivs gleichartiger Organisationen. Auf dieser theoretischen Grundlage wird systematisch zwischen den drei Analyseebenen des einzelnen Sportvereins, dem Kollektiv bestehender Sportvereine sowie der Sportvereinspopulation unterschieden und werden Paneldaten aus zwei Befragungen pfälzischer Sportvereine hypothesengeleitet analysiert. Die Ergebnisse bestätigen zum einen die populationsökologischen Annahmen stabiler Kernmerkmale bei hochgradig wandlungs-, d.h. anpassungsfähigen peripheren Merkmalen in bestehenden Sportvereinen. The allocation of any scarce health care resource, especially a lifesaving resource, can create profound ethical and legal challenges. Liver transplant allocation currently is based upon urgency, a sickest-first approach, and does not utilize capacity to benefit. While urgency can be described reasonably well with the MELD system, benefit encompasses multiple dimensions of patients’ well-being. Currently, the balance between both principles is ill-defined. This survey with 502 participants examines how urgency and benefit are weighted by different stakeholders. Liver transplant patients (...) favored the sickest-first allocation, although all other groups tended to favor benefit. Criteria of a successful transplantation were a minimum survival of at least 1 year and recovery of functional status to being ambulatory and capable of all self-care. An individual delisting decision was accepted when the 1-year survival probability would fall below 50%. Benefit was found to be a critical variable that may also trigger the willingness to donate organs. The strong interest of stakeholder for successful liver transplants is inadequately translated into current allocation rules. (shrink)

The paper discusses the concept of the cognitive niche and distinguishes the latter from the metabolic niche. By using these posits I unpack certain ideas that are crucial for the enactivist movement, especially for its original formulation proposed by Varela, Thompson and Rosh. Drawing on the ontology of location, boundaries, and parthood, I argue that enacting the world can be seen as the process of cognitive niche construction. Moreover, it turns out that enactivism—as seen through the lens of the conceptual (...) framework proposed in the paper—considers cognition as a kind of connection between the subject and the world. The question of naturalness in logic is widely discussed in today’s research literature. On the one hand, naturalness in the systems of natural deduction is intensively discussed on the basis of Aristotelian syllogistics. On the other hand, research on “natural logic” is concerned with the implicitly existing logical laws of natural language, and is therefore also interested in the naturalness of syllogistics. In both research areas, the question arises what naturalness exactly means, in logic as well as in language. We (...) show, however, that this question is not entirely new: In his Berlin Lectures of the 1820s, Arthur Schopenhauer already discussed in depths what is natural and unnatural in logic. In particular, he anticipates two criteria for the naturalness of deduction that meet current trends in research: (1) Naturalness is what corresponds to the actual practice of argumentation in everyday language or scientific proof; (2) Naturalness of deduction is particularly evident in the form of Euler-type diagrams. There seems to be a strong sentiment in pre-philosophical moral thought that actions can be morally valuable without at the same time being morally required. Yet Kant, who takes great pride in developing an ethical system firmly grounded in common moral thought, makes no provision for any such extraordinary acts of virtue. Rather, he supports a classification of actions as either obligatory, permissible or prohibited, which in the eyes of his critics makes it totally inadequate to the facts of morality. (...) The related idea of uncommonly grand and noble deeds is frequently dismissed by Kant as high-.own emotional nonsense. Such considerations give rise to the fear that actions intuitively classed as morally commendable but not required must be re-classified as commands of duty by Kant, making his ethical theory as unbearably demanding as direct utilitarianism. The paper divides into three sections: (1) an examination of the nature of moral goodness from a meta-ethical angle that introduces some passages from Kant's writings presenting strong theoretical evidence against the case for supererogatory action; (2) a critique of Thomas Hill's suggestion that within the category of wide duty we can accommodate some of the main features of actions classified as supererogatory in other ethical systems; concluding that, contra Hill, there are no actions of wide duty that can be so characterized in any significant sense; and (3) a final discussion of the problem of how demanding the requirements of Kantian ethical theory really are. In this article I discuss the question of whether a person’s existence can be better (or worse) for him than his non-existence. Recently, Nils Holtug and Melinda A. Roberts have defended an affirmative answer. These defenses, I shall argue, do not succeed. In different ways, Holtug and Roberts have got the metaphysics and axiology wrong. However, I also argue that a person’s existence can after all be better (or worse) for him than his non-existence, though for reasons other than those (...) provided by Holtug and Roberts. (shrink)

This paper argues in favor of a hybrid conception of identity. A common conception of identity in datafied society is a split between a digital self and a real self, which has resulted in concepts such as the data double, algorithmic identity, and data shadows. These data-identity metaphors have played a significant role in the conception of informational privacy as control over information—the control of or restricted access to your digital identity. Through analyses of various data-identity metaphors as well as (...) philosophical accounts of identity, we argue in favor of a hybrid conception of identity that emphasizes the relations between the ‘real’ and the ‘digital’. A hybrid conception of identity—where the digital is an aspect on par with social relations, self-understanding, and values—ultimately calls for an understanding of privacy as the right to influence one’s own identity. Abstract Western philosophical and psychological thinking lacks an accepted theory of human personality; it has produced conflicting and inadequate notions, such as the religious one of a soul, the vague concept of the ?mind? and biological theories basing their understanding of man on the functions of the nervous system, particularly the brain, or dealing with his mental dimension only in terms of behavioural patterns. This paper explores the notions of personality in Indian systems and finds that virtually all of them (...) understand it, despite differing terminology, as a fluid complex of functions or living forces characterised by intrinsic intelligence and coordinated by a dynamic structural principle, operating on three levels of reality: phenomenal material, phenomenal immaterial and noumenal or absolute. One can say that the Indian tradition fully appreciated the complexity of the problem and produced theories of personality which are more comprehensive than western ones and merit study as well as attention from the point of view of contemporary creative philosophical thinking. The paper examines Schopenhauer’s complex diagrams from the Berlin Lectures of the 1820 s, which show certain partitions of classes. Drawing upon ideas and techniques from logical geometry, we show that Schopenhauer’s partition diagrams systematically give rise to a special type of Aristotelian diagrams, viz. (strong) α -structures.

Derek Parfit famously defends a number of surprising views about "fission." One is that, in such a scenario, it is indeterminate whether I have survived or not. Another is that the fission case shows that it does not matter, in itself, whether I survive or not. Most critics of the first view contend that fission makes me cease to exist. Most opponents of the second view contend that fission does not preserve everything that matters in ordinary survival. In this paper (...) I shall provide a critique that does not rely on either of these contentions. There are other, interrelated reasons to reject Parfit's defense of the two theses. In particular, the availability of the following view creates trouble for Parfit: I determinately survive fission, but it is indeterminate which fission product I am. (shrink)

From the mid-1600s to the beginning of the eighteenth century, there were two main circles of German scholars which focused extensively on diagrammatic reasoning and representation in logic. The first circle was formed around Erhard Weigel in Jena and consists primarily of Johann Christoph Sturm and Gottfried Wilhelm Leibniz; the second circle developed around Christian Weise in Zittau, with the support of his students, particularly Samuel Grosser and Johann Christian Lange. Each of these scholars developed an original form of using (...) geometric diagrams in logic. In this paper, I will trace the historical notes of John Venn and other modern logicians back to the original works published in the Weigel and Weise circles and describe the development of using geometric figures for logical reasoning and representation in that period of time. This review article deals with legal texts prominently inscribed on a city gate of Timnaʿ, the capital of the Ancient South Arabian state of Qataban. Following a sketch of the history of the region and its languages, the reviewer considers the legal texts published in the reviewed volume dealing with homicide, the attribution of tithes, infanticide, and other matters. It is pointed out that their interpretation by the author would have benefited from comparisons with Yemeni anthropological data that have not (...) changed since pre-Islamic times. (shrink)

In his earlier writings, Fred Dretske proposed an anti-skeptical strategy that is based on a rejection of the view that knowledge is closed under known entailment. This strategy is seemingly congenial with a sensitivity condition for knowledge, which is often associated with Dretske’s epistemology. However, it is not obvious how Dretske’s early account meshes with the information-theoretic view developed in Knowledge and the Flow of Information. One aim of this paper is to elucidate the connections between these accounts. First I (...) argue that, contrary to an objection raised by Christoph Jäger, the information-theoretic account is compatible with Dretske’s anti-skeptical strategy based on the rejection of closure. This strategy invokes the notion of channel conditions, which are roughly speaking those conditions that are necessary and jointly sufficient for a signal to carry information. I propose an interpretation of the account that is based on the idea that a signal’s carrying information requires that the channel conditions are stable. It is shown that the resulting account incorporates both a sensitivity condition and a safety condition for knowledge. Finally, I demonstrate how this proposal allows for knowledge of modally robust propositions without making its acquisition too easy, as simple safety accounts do. I end with a suggestion concerning the direction that future research should take, based on the fact that in its present form the information-theoretic account does not capture inferential knowledge. One increasingly popular approach to personal identity is called ‘animalism.’ Unfortunately, it is unclear just what the doctrine says. In this paper, I criticise several different ways of stating animalism, and put forward one formulation that I find more promising.

We explore the different meanings of “quantum uncertainty” contained in Heisenberg’s seminal paper from 1927, and also some of the precise definitions that were developed later. We recount the controversy about “Anschaulichkeit”, visualizability of the theory, which Heisenberg claims to resolve. Moreover, we consider Heisenberg’s programme of operational analysis of concepts, in which he sees himself as following Einstein. Heisenberg’s work is marked by the tensions between semiclassical arguments and the emerging modern quantum theory, between intuition and rigour, and between (...) shaky arguments and overarching claims. Nevertheless, the main message can be taken into the new quantum theory, and can be brought into the form of general theorems. They come in two kinds, not distinguished by Heisenberg. These are, on one hand, constraints on preparations, like the usual textbook uncertainty relation, and, on the other, constraints on joint measurability, including trade-offs between accuracy and disturbance. According to Kant, as far as the realisation of humanity is concerned, man is dependent on knowledge. But which science guarantees him an insight into what it means to be a human being? Philosophy? Anthropology? Philosophical anthropology? This study’s problem-oriented development of the question: ‘What is man?’ deals with the anthropological concepts of Scheler, Plessner, Portmann and Gehlen, drawing on the insights of classical philosophy. The focus of its critique is the biologism that is symptomatic of the failure of the (...) attempt to clarify the nature of man in comparative distinction to the form of existence of the animal. With reference to Herder, who understands man as a linguistic being, this book outlines the first steps on the path to overcoming the programme of modern anthropology through a form of ‘philosophy from language’. Many have argued that there is something that is a priori about all necessary truths, including a posteriori necessities. According to a particularly popular claim of this kind, one can know a priori whether a sentence is G-necessary, i.e. whether it is either necessarily true or necessarily false. In this paper, I identify the most plausible version of this claim and I argue that it fails. My discussion also reveals, and depends upon, an important feature of putative natural kind terms (...) that has been widely overlooked. I conclude by outlining a proposal of what is really a priori about necessities. (shrink)

The concept of the person is widely assumed to be indispensable for making a rights claim. But a survey of the concept's appearance in legal discourse reveals that the concept is stretched to the breaking point. Personhood stands at the center of debates as diverse as the legal status of embryos and animals to the rights and responsibilities of corporations and nations. This Note argues that personhood is a cluster concept with distinct components: the biological concept of the human being, (...) the notion of a rational agent, and unity of consciousness. Use of these component concepts (in lieu of the concept of the person) in legal reasoning would promote greater systematicity and coherence. (shrink)

According to phenomenal conservatism, seemings can provide prima facie justification for beliefs. In order to fully assess phenomenal conservatism, it is important to understand the nature of seemings. Two views are that (SG) seemings are a sui generis propositional attitude, and that (D2B) seemings are nothing over and above dispositions to believe. Proponents of (SG) reject (D2B) in large part by providing four distinct objections against (D2B). First, seemings have a distinctive phenomenology, but dispositions to believe do not. Second, seemings (...) can provide a non-trivial explanation for dispositions to believe, which wouldn’t be possible if seemings were dispositions to believe. Third, there are some dispositions to believe that are not seemings. Fourth, there are instances of seemings which are not dispositions to believe. I consider and reject each of these objections. The first and third objections rely on a misunderstanding of (D2B). The second objection fails because there are contexts in which an appeal to a previously unknown identity can provide an interesting explanation. The fourth objection overlooks the possibility of finkish and masked dispositions, phenomena which are widely accepted in the dispositions literature. I conclude that (D2B) escapes these common objections unscathed. (shrink)

To date, business ethicists, corporate social responsibility scholars as well as management theorists have been slow to provide a comprehensive and critical scrutiny of the Living Wage concept. The aim of this article, therefore, is to conceptualize the living wage in its philosophical as well as practical dimensions in order to open up the ethical implications of its introduction and implementation by companies. We set out the legal, socio-institutional and economic contexts for the debates around the LW and review arguments (...) for, and against, it. Key philosophical arguments from the perspectives of sustainability, capability and externality are invoked and discussed in order to demonstrate the issues and challenges involved for companies, state and civil society actors. Relevant examples from the private sector are examined to demonstrate some of the practical issues involved when the LW is introduced by employers. The article also recommends avenues for a research agenda into the LW for business ethicists, CSR and management researchers in contexts such as the UK, where a voluntary, rather than mandatory, approach to the implementation of the LW is adopted.
