Artificial intelligence is increasingly permeating many types of high-stake societal decision-making such as the work at the criminal courts. Various types of algorithmic tools have already been introduced into sentencing. This article concerns the use of algorithms designed to deliver sentence recommendations. More precisely, it is considered how one should determine whether one type of sentencing algorithm (e.g., a model based on machine learning) would be ethically preferable to another type of sentencing algorithm (e.g., a model based on old-fashioned programming). (...) Whether the implementation of sentencing algorithms is ethically desirable obviously depends upon various questions. For instance, some of the traditional issues that have received considerable attention are algorithmic biases and lack of transparency. However, the purpose of this article is to direct attention to a further challenge that has not yet been considered in the discussion of sentencing algorithms. That is, even if is assumed that the traditional challenges concerning biases, transparency, and cost-efficiency have all been solved or proven insubstantial, there will be a further serious challenge associated with the comparison of sentencing algorithms; namely, that we do not yet possess an ethically plausible and applicable criterion for assessing how well sentencing algorithms are performing. Should public opinion determine--or even influence--sentencing policy and practice? Should the punishment of criminal offenders reflect what the public regards as appropriate? These deceptively simple questions conceal complex theoretical and methodological challenges to the administration of punishment. In the West, politicians have often answered these questions in the affirmative; penal reforms have been justified with direct reference to the attitudes of the public. This is why the contention that politicians should bridge the gap between the public and criminal justice practice (...) has widespread resonance. Criminal law scholars, for their part, have often been more reluctant to accept public input in penal practice, and some have even held that the idea of consulting public opinion constitutes a populist approach to punishment. The purpose of this book is to examine the moral significance of public opinion for penal theory and practice. For the first time in a single volume the editors, Jesper Ryberg and Julian V. Roberts, have assembled a number of respected criminologists, philosophers, and legal theorists to address the various aspects of why and how public opinion should be reflected in the way the criminal justice system deals with criminals. The chapters address the myriad complexities surrounding this issue by first weighing the justifications for incorporating public views into punishment practices and then considering the various ways this might be achieved through juries, prosecutors, restorative justice programs, and other means. Epistemic anti-individualism is the view that positive epistemic statuses fail to supervene on internal, physical or mental, properties of individuals. Intellectual humility is a central intellectual virtue in the pursuit of such statuses. After some introductory remarks, this paper provides an argument for epistemic anti-individualism with respect to a virtue-theoretic account of testimonial knowledge. An outline of a dual-aspect account of intellectual humility is then offered. The paper proceeds to argue that insofar as testimonial knowledge is concerned, this stripe of (...) epistemic anti-individualism leads to a particular account of intellectual humility. (shrink)

The threshold from unicellularity to multicellularity has been crossed only in three major living domains in evolution with any lasting success. The hard problem was to create a multicellular self. Such a self is vulnerable to breakdown due to the unavoidable appearance of mutant anarchistic cells, and stringent semiotic scaffoldings had to emerge to prevent this. While a unicellular self may go on to live practically forever, the multicellular self most often must run through an individuation process ending in the (...) death of the individual. Due to basic differences in cells of plants, fungi and animals this individuation process poses very different challenges in the three kingdoms of plants, fungi and animals, and the solutions found to these differences are discussed. In the same time as multicellularity ushered life into the epoch of mortality it logically also led to the appearance of fertilization and thereby the need for a whole new set of elaborate semiotic scaffoldings. Multicellularity also opened the door to the formation symbiotic relations where cells with different genomes might collaborate or at least coexist inside the same body. All in all multicellularity led to an enormous diversification both of morphology space and the space of sensomotoric elaborations. New means for scaffolding of this expansion and diversification of possible life forms into functional patterns called for a corresponding growth in the space of semiotic tools and initiated a growth in semiotic freedom, that has continued to our days. This book gives an analysis of Hertz's posthumously published Principles of Mechanics in its philosophical, physical and mathematical context. In a period of heated debates about the true foundation of physical sciences, Hertz's book was conceived and highly regarded as an original and rigorous foundation for a mechanistic research program. Insisting that a law-like account of nature would require hypothetical unobservables, Hertz viewed physical theories as images of the world rather than the true design behind the phenomena. This paved the (...) way for the modern conception of a model. Rejecting the concept of force as a coherent basic notion of physics he built his mechanics on hidden masses and rigid connections, and formulated it as a new differential geometric language.Recently many philosophers have studied Hertz's image theory and historians of physics have discussed his forceless mechanics. The present book shows how these aspects, as well as the hitherto overlooked mathematical aspects, form an integrated whole which is closely connected to the mechanistic world view of the time and which is a natural continuation of Hertz's earlier research on electromagnetism. Therefore it is also a case study of the strong interactions between philosophy, physics and mathematics. Moreover, the book presents an analysis of the genesis of many of the central elements of Hertz's mechanics based on his manuscripts and drafts. Hertz's research program was cut short by the advent of relativity theory but its image theory influenced many philosophers as well as some physicists and mathematicians and its geometric form had a lasting influence on advanced expositions of mechanics. In strict opposition to the prevailing positivist conception of nature as senseless and deprived of meaning Jakob von Uexküll claimed that a certain planmässigkeit was operative in nature. This idea however might be taken to mean that organic evolution is not itself a creative process but a gradual, if majestic, unfolding of Nature's own master plan. Such an idea would threaten to restore determinism in the center of biological theory, and this would seriously contradict the vision of biosemiotics shared by (...) most of its proponents. It lies at the heart of biosemiotics and of Peircean cosmological philosophy that indeterminacy is primary, that “habit taking” or interpretation are real processes in the world, and therefore that belief in the law of necessity is unfounded. It is suggested that Uexküllian planmässigkeit is in fact reconcilable with a modern non-deterministic understanding. In a certain sense the Umwelten of animals have indeed developed in accordance to a natural planmässigkeit, but this is a plan that incessantly traps life in certain strategic choices and in the same time diversifies the dimensionality of options for dealing with these choices, i. e. “the adjacent possible” in the terms of Stuart Kauffman. In the past few years, we have become increasingly focused on technology use that is impulsive, unthinking, and distractive. There has been a strong push to understand such technology use in terms of dopamine addiction. The present article demonstrates the limitations of this so-called neurobehaviorist approach: Not only is it inconsistent in regard to how it understands humans, technologies, and their mutual relationship, it also pathologizes everyday human behaviors. The article proceeds to discuss dual-systems theory, which helpfully discusses impulsive technology (...) use in terms of habit instead of addiction, but can be criticized for its mentalist celebration of conscious control. Finally, the article introduces a phenomenological approach whose conceptualization of habit manifests many of the experiential qualities that we try to capture with addiction, but remains non-pathologizing and opens a space for learning: While tech addiction is bad and must be eliminated, good tech habits can be trained and cultivated. The use of artificial intelligence as an instrument to assist judges in determining sentences in criminal cases is an issue that gives rise to many theoretical challenges. The purpose of this article is to examine one of these challenges known as the “input problem.” This problem arises supposedly due to two reasons: that in order for an algorithm to be able to provide a sentence recommendation, it needs to be inputted with case specific information; and that the task of presenting (...) an adequate picture of a crime often turns out to be highly complex. Even though this problem has been noted since the earliest attempts at developing sentencing support systems, almost no one has considered the ethical nature of this challenge. The aim of this article is to fill that void. First, it is shown that the input problem has been subject to somewhat different interpretations. Second, several possible answers as to when and why the problem constitutes an ethical challenge are considered. Third, a few suggestions are presented as to how undesirable implications of complexity at the input stage might be ameliorated by tailoring the way sentencing algorithms are developed and used in the work of criminal courts. In recent years, we have witnessed the rise of a contemporary approach to cognitive psychology known as 4E cognition. According to this ‘extracranial’ view of cognition, the mind is not ensconced in the head, but dynamically intertwined with a host of different entities, social as well as technological. The purpose of the present article is to raise a concern about 4E cognition. The concern is not about whether the mind is in fact extended, but about how this condition is currently (...) portrayed in the 4E literature. It is argued that 4E scholars tend to paint an overly idealized picture of human–technology relations in which all entities are presumed to cooperate and collaborate. The article first describes the basic tenets of extended cognition and distributed cognition, two of the most thingly approaches in this new wave of cognitive psychology. It then proceeds to discuss the twin notions of cognition and representation and argues that it may be time to leave these concepts behind. Finally, it sketches out the so-called ‘dogma of harmony’ in the 4E literature and argues for the importance of making analytical room for conflictual human–technology relations. Two examples of such conflictual relations are provided: bad habits and deskilling. (shrink)

Semantic externalism is the view that the meanings of referring terms, and the contents of beliefs that are expressed by those terms, are not fully determined by factors internal to the speaker but are instead bound up with the environment. This book offers a truly interdisciplinary exploration of our patterns of engagement with politics, news, and information in current high-choice information environments. Putting forth the notion that high-choice information environments may contribute to increasing misperceptions and knowledge resistance rather than greater public knowledge, the book offers insights into the processes that influence the supply of misinformation and factors influencing how and why people expose themselves to and process information that may support or contradict their beliefs and attitudes. We survey concepts at the frontier of research connecting artificial, animal, and human cognition to computation and information processing—from the Turing test to Searle’s Chinese room argument, from integrated information theory to computational and algorithmic complexity. We start by arguing that passing the Turing test is a trivial computational problem and that its pragmatic difficulty sheds light on the computational nature of the human mind more than it does on the challenge of artificial intelligence. We then review our proposed algorithmic (...) information-theoretic measures for quantifying and characterizing cognition in various forms. These are capable of accounting for known biases in human behavior, thus vindicating a computational algorithmic view of cognition as first suggested by Turing, but this time rooted in the concept of algorithmic probability, which in turn is based on computational universality while being independent of computational model, and which has the virtue of being predictive and testable as a model theory of cognitive behavior. Neuroplasticity is a core feature of the brain throughout the entire life of the individual. And when injury to the adult brain destroys part of the circuitry mediating behaviour and/or conscious experience, neuroplasticity is required to bring about the highest possible degree of post-traumatic functional recovery. But is the brain able to recreate the lost circuitry? Scrutiny of the impressive plasticity seen during development and in the adult brain reveals many similarities -- but also some crucial differences. And studies of (...) the mechanisms of functional recovery demonstrate that even an apparently 'full recovery' of the surface phenomena of behaviour and/or conscious representations is accomplished without a recreation of the lost circuitry. Instead, the post-traumatic process utilizes mechanisms, which have evolved to mediate problem solving in the intact brain. The newly developed REF model suggests how such dynamic reorganizations occur in the intact and injured brain. (shrink)

According to robust virtue epistemology, knowledge is a cognitive achievement, where this means that the agent's cognitive success is because of her cognitive ability. One type of objection to robust virtue epistemology that has been put forward in the contemporary literature is that this view has problems dealing with certain kinds of testimonial knowledge, and thus that it is in tension with standard views in the epistemology of testimony. We build on this critique to argue that insofar as agents epistemically (...) depend on third-party members of their epistemic community as many social epistemologists contend, then there will be cases where two agents differ epistemically despite being virtue-theoretic duplicates. This means that robust virtue epistemology, at least insofar as it is understood along standard lines such that it endorses epistemic individualism, is also in tension with a central commitment of contemporary social epistemology. The idea of using artificial intelligence as a support system in the sentencing process has attracted increasing attention. For instance, it has been suggested that machine learning algorithms may help in curbing problems concerning inter-judge sentencing disparity. The purpose of the present article is to examine the merits of this possibility. It is argued that, insofar as the unfairness of sentencing disparity is held to reflect a retributivist view of proportionality, it is not necessarily the case that increasing inter-judge uniformity (...) in sentencing is desirable. More generally, it is shown that the idea of introducing machine learning algorithms, that produce sentencing predictions on the ground of a dataset that is built of previous sentencing decisions, faces serious problems if there exists a discrepancy between actual sentencing practice and the sentences that are ideally desirable. According to Sosa, knowledge is apt belief, where a belief is apt when accurate because adroit. Sosa :465–475, 2010; Judgment and agency, Oxford University Press, Oxford, 2015) adds to his triple-A analysis of knowledge, a triple-S analysis of competence, where a complete competence combines its seat, shape and situation. Much of Sosa’s influential work assumes that epistemic agents are individuals who acquire knowledge when they hit the truth through exercising their own individual skills in appropriate shapes and situations. This paper (...) explores an extension of Sosa’s framework to a social setting in which groups constitute epistemic agents over and above their individual members. The claim is that groups can be ascribed knowledge in virtue of hitting the truth through exercising their competences in appropriate shapes and situations. While knowledge at the collective level may diverge from knowledge at the individual level, the competences of groups are nothing over and above the combined competences of their members. The ensuing view thus has implications for the debate over reduction and supervenience in collective epistemology. (shrink)

It is sometimes argued that autonomous decision-making requires that the decision-maker’s desires are authentic, i.e., “genuine,” “truly her own,” “not out of character,” or similar. In this article, it is argued that a method to reliably determine the authenticity (or inauthenticity) of a desire cannot be developed. A taxonomy of characteristics displayed by different theories of authenticity is introduced and applied to evaluate such theories categorically, in contrast to the prior approach of treating them individually. The conclusion is drawn that, (...) in practice, the authenticity of desires cannot be reliably determined. It is suggested that authenticity should therefore not be employed in informed consent practices in healthcare. (shrink)

The hypothesis of extended cognition says that cognitive processes and mental states extend to include extra-organismic parts of the external world, provided certain conditions on cognitive integration are satisfied. Moreover, if knowledge is assumed to be a mental state, knowledge is, by a similar line of reasoning, equally extended. However, extended knowledge presents an additional challenge to do with cognitive bloat, given that knowledge is widely regarded as a distinctive cognitive achievement. This paper explores the idea that different types of (...) software systems, rather than specific external devices, may serve to extend knowledge beyond our bodily boundaries, and if so whether this new hypothesis of digitally extended knowledge leads to any untoward expansion of knowledge. By semiotic freedom we mean the capacity of species or organisms to derive useful information by help of semiosis or, in other words, by processes of interpretation in the widest sense of this term. Are virtual objects real? I will claim that the question sets us up for the wrong type of conclusion: Chalmers (2017) argues that a virtual calculator (like other entities) is a real calculator when it is “organizationally invariant” with its non-virtual counterpart—when it performs calculation. However, virtual reality and games are defined by the fact that they always selectively implement their source material. Even the most detailed virtual car will still have an infinite range of details which are missing (gas, (...) engines, pistons, fuel, chemical reactions, molecules, atoms). This means that even the most detailed virtual object will still have fictional aspects. Rather than argue that virtual objects are, or aren’t, real, it is preferable to think of overlaps and continuities between the fictional and the real, where even the most painstakingly detailed virtual reality implementation of a non-virtual object is still art: a human process of selection and interpretation. Virtual reality should therefore not be philosophically understood just as a technological implementation on a trajectory to perfection, but as a cultural artifact which derives its value in part from its simplification and difference from its source material. This special issue of The Journal of Ethics is devoted to ethical considerations of the use of neuroscience in the criminal justice system. In this introduction, an overview is provided of the different topics dealt with in the volume.

A sign is something that refers to something else. Signs, whether of natural or cultural origin, act by provoking a receptive system, human or nonhuman, to form an interpretant (a movement or a brain activity) that somehow relates the system to this "something else." Semiotics sees meaning as connected to the formation of interpretants. In a biosemiotic understanding living systems are basically engaged in semiotic interactions, that is, interpretative processes, and organic evolution exhibits an inherent tendency toward an increase in (...) semiotic freedom. Mammals generally are equipped with more semiotic freedom than are their reptilian ancestor species, and fishes are more semiotically sophisticated than are invertebrates. The evolutionary trend toward the production of life forms with an increasing interpretative capacity or semiotic freedom implies that the production of meaning has become an essential survival parameter in later stages of evolution. Over the past decade the use of closed circuit television (CCTV) as a means of crime prevention has reached unprecedented levels. Though critics of this development do not speak with one voice and have pointed to a number of different problems in the use of CCTV, one argument has played a dominant role in the debate, namely, that CCTV constitutes an unacceptable violation of people’s right to privacy. A popular form of virtue epistemology—defended by such figures as Ernest Sosa, Linda Zagzebski and John Greco—holds that knowledge can be exclusively understood in virtue-theoretic terms. In particular, it holds that there isn't any need for an additional epistemic condition to deal with the problem posed by knowledge-undermining epistemic luck. It is argued that the sustainability of such a proposal is called into question by the possibility of epistemic twin earth cases. In particular, it is argued that such cases demonstrate (...) the need for virtue-theoretic accounts of knowledge to appeal to an independent epistemic condition which excludes knowledge-undermining epistemic luck. A version of Birkhoff's theorem is proved by constructive, predicative, methods. The version we prove has two conditions more than the classical one. First, the class considered is assumed to contain a generic family, which is defined to be a set-indexed family of algebras such that if an identity is valid in every algebra of this family, it is valid in every algebra of the class. Secondly, the class is assumed to be closed under inductive limits.

Being the parent of a disabled child is not easy, it is experienced as a situation marked by stress, crises and grief. As Vygotsky described eighty years ago, the development of children with disabilities and the culture do not fit as they do for non-disabled children. The development of a child with disabilities is not determined by the child’s physical defect alone, but constituted by the incongruence between the physical defect and the culture. In this study, the lives of four (...) families with deafblind children were followed for two years. Interviews and observations were conducted in different settings. This study finds that because of the incongruence between the physical defect and the culture, it is difficult to reach and maintain the zone of proximal development for a child with disabilities. This study illustrates how the network of professionals and parents around the child can make a local congruence that creates a platform for the child’s development. (shrink)
