James E. Fleming’s new contribution to the interpretive debate successfully exposes “new originalist” failures to find defensible middle ground between a Dworkinian approach to constitutional interpretation and the now widely discredited originalism of Raoul Berger. Fleming also exposes the irony of “new originalist” efforts to vindicate democracy and the rule of law. Less persuasive are Fleming’s reasons for optimism about the future of constitutional theory and fidelity to a constitution that seems increasingly beyond reform.

Standard philosophical discussions of theory-ladeness assume that observational evidence consists of perceptual outputs (or reports of such outputs) that are sentential or propositional in structure. Theory-ladeness is conceptualized as having to do with logical or semantical relationships between such outputs or reports and background theories held by observers. Using the recent debate between Fodor and Churchland as a point of departure, we propose an alternative picture in which much of what serves as evidence in science is not perceptual outputs or (...) reports of such outputs and is not sentential in structure. Michael Hand, in his recent ‘Religious upbringing reconsidered’ in this journal, has claimed to find a logical problem neglected by earlier writers on religious upbringing and parental rights. In this paper, I argue that he has mis-described the terms in which he poses the alleged problem.

Human behavior depends on the ability to effectively introspect about our performance. For simple perceptual decisions, this introspective or metacognitive ability varies substantially across individuals and is correlated with the structure of focal areas in prefrontal cortex. This raises the possibility that the ability to introspect about different perceptual decisions might be mediated by a common cognitive process. To test this hypothesis, we examined whether inter-individual differences in metacognitive ability were correlated across two different perceptual tasks where individuals made judgments (...) about different and unrelated visual stimulus properties. We found that inter-individual differences were strongly correlated between the two tasks for metacognitive ability but not objective performance. Such stability of an individual’s metacognitive ability across different perceptual tasks indicates a general mechanism supporting metacognition independent of the specific task. (shrink)

An important area of business ethics research focuses on how otherwise normal and law-abiding individuals can engage in acts of corruption. Key in this literature is the concept of rationalization. This is where individuals attempt to justify past and future corrupt deeds to themselves and others. In this article, we argue that rationalization often entails a process of overcompensation whereby the justification forwarded is excessive in relation to the actual act. Such over-rationalization provides an impetus for further and more serious (...) acts of illegality. Using a number of high profile cases, it is argued that this dynamic gap between the act and excessive rationalization can explain why corruption often escalates in severity and scope in the organization. This paper examines a legal case arising from a workplace grievance that progressed to being heard at the UK’s Supreme Court. The case of Doogan and Wood versus Greater Glasgow and Clyde Health Board concerned two senior midwives in Scotland, both practicing Roman Catholics, who exercised their perceived rights in accordance with section 4 of the Abortion Act not to participate in the treatment of women undergoing abortions. The key question raised by this case was: “Is Greater Glasgow and Clyde (...) Health Board entitled to require the midwives to delegate, supervise and support staff in the treatment of patients undergoing termination of pregnancy?” The ethical issues concerning conscientious objection to abortion have been much debated although the academic literature is mainly concerned with the position of medical practitioners rather than what the World Health Organization terms “mid-level professionals” such as midwives. This paper examines the arguments put forward by the midwives to justify their refusal to carry out tasks they felt contravened their legal right to make a conscientious objection. We then consider professional codes, UK legislation and church legislation. While the former are given strong weighting the latter was been ignored in this case, although cases in other European countries have been prevented from escalating to such a high level by the intervention of prominent church figures. The paper concludes by stating that the question put to the courts remains as yet unanswered but offers some recommendations for future policy making and research. (shrink)

Through the explicit introduction of hyperplane dependence as a form of relativistic dynamical evolution, we construct a manifestly covariant description of a single positive energy particle interacting with any one of a large class of “moving” external potentials. In1+1 dimensions, the simplified mathematics allows us to display a number of general properties of solutions to the equations of motion for evolution on hyperplanes.

Mark Mason, in his ‘A Justification, After the Postmodern Turn, of Universal Ethical Principles and Educational Ideals’ Educational Philosophy and Theory, 37 , attempts to justify transcultural multiculturalism. In this paper I argue that he fails to refute moral relativism, and that multiculturalism as he interprets it is not morally acceptable.

This paper explores the relationship between farmland investment and environmental uncertainty. It examines how farmland investors seek to “render land investible” in spite of drought, groundwater depletion, and changing regulations. To do so, we analyze a single case study: the purchase of 8000 acres of dry rangeland in California’s Cuyama Valley by the Harvard University endowment for use in creating an irrigated vineyard. Drawing from interviews with Cuyama Valley farmers and community members, participant observation at community meetings, and public document (...) analysis, we make two primary contributions to understandings of uncertain resource materiality in farmland investment. First, this case reveals that investors can turn environmental uncertainty into an advantage, exploiting both the temporal uncertainties associated with resource management under climate change and the spatial uncertainties inherent to all subsurface resources. We argue that the material and legal uncertainties of groundwater access provide investors with a potentially lucrative opening to assert their preferred land imaginaries and improve their property values. In the Cuyama Valley they did so through both participation in groundwater governance and the establishment of water-related infrastructure on their property. Second, this case highlights that the asset-making processes involved in farmland investment may be as much vertical as they are horizontal. The need to map and measure the uncertain vertical dimension of land creates an outsized role for scientific expertise in farmland assetization. (shrink)

Globalization is a ubiquitousyet highly elusive term. The debate on the cont and meaning of globalization is still waged largely in binary terms; for example, globalization is understood either as increasing standardization or as increasing difference. This article argues that the effects of globalization are best understood in terms of the following three sets of simultaneous contradictions: convergence and divergence, inclusion and exclusion, and centralization and decentralization. These contradictions can be fruitfully “unpacked” and examined through critical stakeholder analysis (CSA). This (...) technique focuses on broader structural commonalties and differences among key stakeholder groups, factors that are not incorporated in mainstream stakeholder theory. The associated normative agenda of CSA promotes a common understanding of key issues within a focal organizational field, the negotiated settlement of zero-sum situations that optimize collective stakeholder interests within that field, and the containment and minimization of negative externalities within as well as between fields. The legacy of the Frankfurt Institute for Social Research has been a powerful force for critically understanding social reality. Erich Fromm was one of the early and best known members of the Institute. Fromm emphasised the centrality of culture and interpersonal relations in the contruction of the psyche. The unconscious was not only the location for buried repressed matter but also for the imaginative potential of the human person. He is a forgotten and neglected contributor to the story of the (...) Institute having been written out of this history. This retrospective of his ideas explores his work in the light of the recent work of Jürgen Habermas who is also an active but less controversial engager with the psychoanalytic tradition. The implications for adult education will be addressed. The paper outlines Fromm’s radical reinterpretation of psychoanalysis emphasising the importance of social existence as distinct from the impact of instincts; key concepts of the market, commodity fetishism and automaton conformity; The implications for adult education in the tradition of radical (Freire) and transformative learning theory (Mezirow) and addressed and make connections between Habermas and Fromm that further the project of critical theory. Both attempted in different times to identify and realise the potential of (though neither used the term) of lifelong learning as part of the process of bringing about a more just and caring society and a shared attention to the importance of having free conversations about how the emancipated life might be created and sustained. Camus considered the most crucial philosophical problem to be that of suicide—whether to discontinue your existence by endingit. Alternatively, a most crucial philosophical problem may be procreation—whether to continue human existence by making new humans. The topic has spurred an increasing amount of debate over the past decade, with marked diversion with Anscomb’s comment that it makes no moral sense to inquire whether one should reproduce. One might as well ask why digest food or why should the wind blow. This (...) article reviews some of the most recent literature on this topic, which shows little resemblance to Anscomb’s remark. The view that complexity increases in evolution is uncontroversial, yet little is known about the possible causes of such a trend. One hypothesis, the Zero Force Evolutionary Law (ZFEL), predicts a strong drive toward complexity, although such a tendency can be overwhelmed by selection and constraints. In the absence of strong opposition, heritable variation accumulates and complexity increases. In order to investigate this claim, we evaluate the gross morphological complexity of laboratory mutants in Drosophila melanogaster, which represent organisms that arise (...) in a context where selective forces are greatly reduced. Complexity was measured with respect to part types, shape, and color over two independent focal levels. Compared to the wild type, we find that D. melanogaster mutants are significantly more complex. When the parts of mutants are categorized by degree of constraint, we find that weakly constrained parts are significantly more complex than more constrained parts. These results support the ZFEL hypothesis. They also represent a first step in establishing the domain of application of the ZFEL and show one way in which a larger empirical investigation of the principle might proceed. (shrink)

The possibility of a sub-quantum mechanical realm has been investigated in recent years by DeBroglie, Bohm, Vigier, and others. It is felt that what is needed in this investigation is some simple and direct resolution of the problem as to whether sub-quantum entities exist or not. By restricting attention to quanta of light energy there is presented a theoretical expression for a sub-quantum or micro-photon which has proven to be testable. It is possible by this development to bridge the particle-wave (...) duality wherein these two conceptions become arithmetically commensurate with one another. The theoretical expression derived for the micro-photon also leads to a different interpretative approach to Planck's constant as well as the appearance of a new unit or element of mass. (shrink)
