Do fetuses have a right to life in virtue of the fact that they are potential adult human beings? I take the claim that the fetus is a potential adult human being to come to this: if the fetus grows normally there will be an adult human animal that was once the fetus. Does this fact ground a claim to our care and protection? A great deal hangs on the answer to this question. The actual mental and physical capacities of (...) a human fetus are inferior to those of adult creatures generally thought to lack a serious right to life, and the mere fact that a fetus belongs to our species in particular seems morally irrelevant. Consequently, a strong fetal claim to protection rises or falls with the appeal to the fetus's potentiality, for nothing else can justify it. (shrink)

China’s business sector has been described as facing serious ethical challenges, including corruption and bribery, distributive injustice, environmental pollution, and misspending of public funds. Unethical decision-making in business represents a potentially destabilizing force for government, business, and society. Recent calls for research that is detailed, nuanced, contemporary, and context-specific on the effects of Asian national business systems on ethical business practices, according to Pereira et al. (2017), are particularly relevant for countries including China that possess the entanglement of a “multiplexity”-multiple (...) business systems co-existing within the same economy reliant on ethics and institutional trust for effective functioning, as discussed by Witt and Redding (2013). To this end, we conduct exploratory research investigating the relationship among Confucian values, Hofstede’s national culture, and ethical decision-making within a business context in China. Using data collected from 550 Chinese MBA students and business executives, results indicate that although both Confucian values and Hofstede’s national culture dimensions are associated with the use of egoism and justice in ethical decision-making scenarios, differential patterns emerged in these relationships. Confucian values were more predictive of outcomes. Of particular interest were the relationships between Confucian values and ethical criteria of yi and justice as well as li and zhi with egoism. Results suggest if the goal is enhancing institutional trust through an increased use of more principled justice-oriented ethics in business in China, an emphasis should be placed on yi (righteousness), coupled with a deemphasis on hierarchy and tradition in the form of li (ritual propriety) and zhi (wisdom). Including love of learning (haoxue), trust (xin), a long-term orientation, and individualistic messages oriented towards family and self-sufficiency may also strengthen overall ethical decision-making for SMEs, MNCs, and SOEs in navigating a multiplexity environment. This study examines the contestability of “relevance” as an abstract construction with no fixed meaning when applied, and questions its usage in the research quality debate. It finds that different research agendas and approaches have their own idiosyncratic logic and that any logic has its own criteria for assessing quality which cannot be applied to assess the quality of others. This is illustrated by delineating practitioner-led research from academic-led research and by comparing and contrasting research perspectives as examples. The research (...) quality debate becomes meaningless when it is limited to a singular research agenda or approach as in practice these are invariably combined. Having said this, however, every agenda and approach can be argued to be legitimate as potentially each can find what otherwise cannot be noticed. As a result, this study challenges the conventional unitarist wisdom that conceptualises knowledge as commodity, and suggests instead that heterogeneity, linked to tolerance and relative independence of means and mind, free from the control or influence of others to enable critical distance from context and status quo and facilitate judgement, is the key to those seeking a meaningful research quality debate that acknowledges tolerance of the diversity of knowledge, difference, contestation and struggle. Although such heterogeneity may at first appear to add confusion rather than clarity, without first looking at this heterogeneity it is not possible to develop a dialogue, in the context of the present neo-liberal post-political drift that emphasises consensus, the annulment of dissensus and diverts attention from relationships of power, through which a positive contribution can be made to the research quality debate. This article examines E.H. Gombrich’s critical appraisal of Arnold Hauser’s book, The Social History of Art. Hauser’s Social History of Art was published in 1951, a year after Gombrich’s bestseller, The Story of Art. Although written in Britain for an English-speaking public, both books had their origins in the intellectual history of Central Europe: Gombrich was an Austrian art historian and Hauser was Hungarian. Gombrich’s critique, published in The Art Bulletin in 1953, attacked Hauser’s dialectical materialism and his sociological interpretation (...) of art history. Borrowing arguments from Karl Popper’s critique of historicism, Gombrich described Hauser’s work as collectivist and deterministic, tendencies at odds with his own conception of art history. However, in his readiness to label Hauser a proponent of historical materialism, Gombrich failed to recognize Hauser’s own criticism of deterministic theories of art, especially formalism. This article investigates Gombrich’s reasons for rejecting Hauser’s sociology of art. It argues Gombrich used Hauser as an ideological counterpoint to his own version of art history, avowedly liberal and individualist in outlook. (shrink)

ABSTRACT Between the publication of Montaigne's Essais and Hobbes's Leviathan rhetors became increasingly anxious about arguing in utramque partem. Paradiastolic discourse, fundamental to Montaigne's early essays, is anxiously though expertly deployed in Leviathan. Paradiastole fuses the ability to see and speak about an issue from antithetical perspectives with the ambivalence such power arouses in. Beyond their skepticism, Montaigne and Hobbes share a concern for how phenomena can be interpreted and represented through language. Despite Hobbes's desire for a method that would (...) ensure constant and determinate linguistic acts that would render rhetoric supererogatory, Leviathan demonstrates his unremarkable affinities with mainline Renaissance humanists alongside his uneasy affinities with the Sophists. Both the humanist and the Sophist used the trope to probe and to persuade, though both were anxious about the reversibility of such rhetorical redescriptions. Paradiastolic discourses, we argue, integrate the cognitive procedures of philosophy with the judicative procedures of rhetoric. The trope operates through exploiting the reciprocity between similar qualities, as exemplified by the influential paradiastolic pairing of ferox and fortis. (shrink)

We explore some aspects of the elusive idea of a "teachable moment" with a special emphasis on the role of emotion, intuition, and imagination as well as intuition, paradox and possibility. The teachable moment occurs when students and teachers genuinely share an interest in better understanding something, some situation, or, in the case discussed, some text, and wish to inquire into the object of mutual concern together. Some of the aesthetic elements of John Dewey's theory of inquiry serve as a (...) way to gain insight into the "logic" of creating and sustaining teachable moments. (shrink)

The first two East-West Philosophers’ Conferences at the University of Hawai‘i constitute an important chapter in the history of comparative philosophy. Wing-tsit Chan recalls the first meeting in 1939 as a “very small beginning,” one that served primarily as the impetus for F.S.C. Northrop’s thesis that East and West represented two contrasting styles of thought. The concept of political obligation has not attracted much attention within Heideggerian scholarship. In this paper, we identify and explicate Heidegger’s conception of political obligation embedded in his pre-Kehre works. It will be argued that Heidegger’s magnum opus Being and Time and his address as Rector of Freiburg contain a latent associative account of political obligation. We argue that the ontological framework disclosed in Being and Time and the more concrete policy prescriptions of the Rectoral Address reveal a communitarian ethos (...) which animates the early Heideggerian canon and grounds his account of political obligation. For Heidegger, Dasein must be connected to a particular community’s ontological heritage in order to delimit its ontical possibilities in concrete situations. It will be argued that this relationship between ontological heritage and ontical possibilities is what defines political obligation for Heidegger. (shrink)

We develop a number of variants of Lifschitz realizability for $\mathbf {CZF}$ by building topological models internally in certain realizability models. We use this to show some interesting metamathematical results about constructive set theory with variants of the lesser limited principle of omniscience including consistency with unique Church’s thesis, consistency with some Brouwerian principles and variants of the numerical existence property.

It is widely held that all hope for a satisfactory environmental ethic rests on the question whether intrinsic value can be discovered in non-human nature, for it is also widely held that intrinsic value is what, if anything, grounds human obligations to non-human nature. The work of J. Baird Callicott on intrinsic value has been central to the contemporary discussion of environmental ethics and the present paper leads off with an overview of some aspects of his work in this area.

Faculty members in science, technology, engineering, and mathematics disciplines are typically expected to pursue grant funding and publish to support their research or teaching agendas. Providing effective professional development programs on grant preparation and management and on research publications is crucial. This study shares the design and implementation of such a program for Native STEM faculty from two tribal colleges and one public, non-tribal, Ph.D. granting institution during a 3-year period. The overall development and implementation of the program is centered (...) on the six R’s Indigenous framework – Respect, Relationship, Representation, Relevance, Responsibility, and Reciprocity. The role of NAF-STEM and their interactions with the program, as members of the community formed by their participation, impacted the program. Their practices and the program co-emerged over time, each providing structure and meaning for the other. Through such reciprocity, NAF-STEM and the program research team continually refined the program through their mutual engagement. They took on the shared responsibility of the program while they participated in and shaped its practices. The process and results of formative and summative assessment and the impact of COVID-19 on the program are reported. Results of the program offer lessons on the implementation of six R’s framework in professional development at institutions of higher education. (shrink)

This is just a brief description of the people involved and activities that occurred during a full-day pre-conference event that included a winery tour, a luncheon, apanel discussion of management systems, and a wine tasting. We completed a facility tour at Gallo’s Frei Ranch Winery that highlighted the environmental performance opportunities that exist for wine production. The rest of the day’s schedule was held at MacMurray Ranch. There was a panel that featured presentations and discussions about Gallo of Sonoma’s sustainability (...) management systems, the Benziger Family Winery’s Biodynamic vineyard practices, and the application of environmental management systems in the wine industry and other industries. By revisiting Hegel's Philosophy of Right, I mount a Hegelian defense of same‐sex marriage rights. I first argue that Hegel's account of the Idea of freedom articulates both the necessity of popular shifts in the determinations of the institutions of right, as well as the duty to struggle to progressively actualize freedom through them. I then contend that Hegel, by grounding marriage in free consent, clears the path for expanding this ethical institution to include all monogamous couples. The demanding frontier life of My Ántonia or Little House on the Prairie may be long gone, but the idyllic small town still exists as a cherished icon of American community life. Yet sprawl and urban density, rather than small towns and farms, are the predominant features of our modern society, agribusiness and other commercial forces have rapidly taken over family farms and ranches, and even the open spaces we think of as natural retreats only retain the barest façade of (...) their former frontier austerity. The fading communities, social upheaval, and enduring heritage of the Northern Plains are the subject of Jim Dow’s Marking the Land, a stirring photographic tribute to the complex and unyielding landscape of North Dakota. Jim Dow began making pilgrimages to this remote territory in 1981 and, with a commission from the North Dakota Museum of Art, he took photographs of the passing human presence on the land. The simple, stolid pieces of architecture carved out against the Dakota skies—whether the local schoolhouse, car wash, prison, homes, hunting lodge, or churches—evoke in their spare lines and weather-battered frames the stoic and toughened spirit of the people within their walls. Folk art is also an integral part of the landscape in Dow’s visual study, and he examines the subtle evolution of local craftsmanship from homemade sculptures, murals, and carvings to carefully crafted pieces aimed at tourists. Anchoring all of these explorations is the raw and striking landscape of the North Dakota plains. Marking the Land is a moving reflection by a leading American photographer on the state of the Northern Plains today, forcing us all to rethink our conceptions of America’s forgotten frontier. Data analytics, particularly the current rhetoric around “Big Data”, tend to be presented as new and innovative, emerging ahistorically to revolutionize modern life. In this article, we situate one branch of Big Data analytics, spatial Big Data, through a historical predecessor, geodemographic analysis, to help develop a critical approach to current data analytics. Spatial Big Data promises an epistemic break in marketing, a leap from targeting geodemographic areas to targeting individuals. Yet it inherits characteristics and problems from geodemographics, including a (...) justification through the market, and a process of commodification through the black-boxing of technology. As researchers develop sustained critiques of data analytics and its effects on everyday life, we must so with a grounding in the cultural and historical contexts from which data technologies emerged. This article and others develop a historically situated, critical approach to spatial Big Data. This history illustrates connections to the critical issues of surveillance, redlining, and the production of consumer subjects and geographies. The shared histories and structural logics of spatial Big Data and geodemographics create the space for a continued critique of data analyses’ role in society. (shrink)

Considering the mutual benefits of blockchain and transhumanism, this essay proposes crypto cloudminds as a safe mechanism by which the human mind might transcend its unitary limitations by permissioning partial resources to join a multi-party mind in a cloud-based environment. Cloudminds could have diverse purposes including problem solving, learning, experience, exploration, innovation, artistic expression, and other personal development activities. Crypto cloudminds could be multicurrency, operating with payment remuneration, security, and ideas as the denominations of measure. For thriving in the future, (...) mind node peers could enter “Yes-and” Payment Channels with one another for collaborative idea development. For surviving in the future, good-player behavior could be game-theoretically enforced with the simultaneous privacy-transparency property of blockchains, together with the immutable peer-confirmed consensus algorithm and audit-log checks and balances system. Overall, blockchains might serve as an institutional technology that is the basis for treaties and progress in a multi-species society of human, algorithm, and machine, guiding the way to positive transhuman futures. Donald Davidson finds folk-psychological explanations anomalous due to the open-ended and constitutive conception of rationality which they employ, and yet monist because they invoke an ontology of only physical events. An eliminative materialist who thinks that the beliefs and desires of folk-psychology are mere pre-scientific fictions cannot accept these claims, but he could accept anomalous monism construed as an analysis, merely, of the ideological and ontological presumptions of folk-psychology. Of course, eliminative materialism is itself only a guess, a marker for (...) material explanations we do not have, but it is made plausible by, inter alia, whatever difficulties we have in interpreting intentional folk-explanations realistically. And surely anomalous monism does require further explanation if it is to be accepted realistically and not dismissed as an analysis of a folk-idiom which is to be construed instrumentally at best. Some further explanation is needed of how beliefs, desires, etc. can form rational patterns which have ‘no echo in physical theory’ and yet those beliefs, desires etc. be physical events. To this end I propose to graft on to anomalous monism a modest version of functionalism. (shrink)

There is a long liberal political tradition of marshalling arguments aimed at convincing Christians that distinctively Christian reasons for issuing coercive laws are not sufficient to justify those laws. In the first part of this paper I argue that the two most popular of these arguments, attributable to Locke, will not reliably convince committed biblical Christians, nor, probably, should they. In the second part I argue that even if the Lockean arguments fail, committed biblical Christians should think that God has (...) authorized the state only to fill the same general role that political liberals have identified for it. Twentieth century philosophers such as Simondon and Heidegger propose theories of subjectivation that inform our thinking about the definition of personhood and how it arises; including in the potentially wide-ranging context of personhood beyond the human. Simondon’s theory of transindividuation unfolds as a series of decenterings that provides a context for future persons that is a dynamic world of processes without fixity or attachment to any one kind of subject. Subjects participate in but do not cause individuation; and they exist (...) on a spectrum of capacity for action with other living beings including animals; human persons; and possibly a variety of future persons. The role of collectivity in the form of the other has been an important aspect of individuation; however I claim that the function of alterity need not be provided exclusively by a self-similar subject. Philosophical individuation theories serve as a foundation for an approach that opens up greater possibility for individuation in the context of future persons by identifying and alternatively fulfilling the underlying functionality required by individuation. In a world with limited resources, allocation of resources to certain individuals and conditions inevitably means fewer resources allocated to other individuals and conditions. Should a patient's personal responsibility be relevant to decisions regarding allocation? In this project we combine the normative and the descriptive, conducting an empirical bioethical examination of how both Norwegian and British doctors think about principles of responsibility in allocating scarce healthcare resources. A large proportion of doctors in both countries supported including responsibility for illness in (...) prioritization decisions. This finding was more prominent in zero‐sum scenarios where allocation to one patient means that another patient is denied treatment. There was most support for incorporating prospective responsibility (through patient contracts), and low support for integrating responsibility into co‐payments (i.e. through requiring responsible patients to pay part of the costs of treatment). Finally, some behaviours were considered more appropriate grounds for deprioritization (smoking, alcohol, drug use)—potentially because of the certainty of impact and direct link to ill health. In zero‐sum situations, prognosis also influenced prioritization (but did not outweigh responsibility). Ethical implications are discussed. We argue that the role that responsibility constructs appear to play in doctors' decisions indicates a needs for more nuanced—and clear—policy. Such policy should account for the distinctions we draw between responsibility‐sensitive and prognostic justifications for deprioritization. (shrink)
