In April 2004 the Irish Government commissioned Judge Maureen Harding Clark to compile a report to ascertain the rate of caesarean hysterectomies at Our Lady of Lourdes Hospital in Drogheda, Republic of Ireland. The report came about as a result of complaints by midwives into questionable practices that were mainly (but not solely) attributed to one particular obstetrician. In this article we examine the findings of this Report through a feminist lens in order to explore what a feminist reading of (...) the Report and the events that led to the inquiry will bring to light. We consider how sex and gender feature in the Lourdes case, draw attention to the deeply gendered asymmetries of power and privilege that existed between the men and women at the centre of this inquiry, and explore the impact such asymmetries had on this particular situation. This research uses a survey to analyze types of benefits sought by partners in cross-sector collaborations in Spain and to test and build upon theories that indicate prior collaboration experience and partner alignment will positively affect value creation through the collaboration. Using exploratory factor analysis to operationalize a broad range of potential benefits into more specific concepts, the results of this study identify distinct factors that characterize the types of benefits sought by non-profit organizations and businesses engaged in cross-sector collaborations. (...) Findings show that prior experience and alignment positively affect each factor for value creation. Prior experience is also found to influence the type of benefits sought from cross-sector collaborations and to positively affect alignment in terms of mission and strategy. The National Institutes of Health and other federal health agencies are considering establishing a national biobank to study the roles of genes and environment in human health. A preliminary public engagement study was conducted to assess public attitudes and concerns about the proposed biobank, including the expectations for return of individual research results. A total of 141 adults of different ages, incomes, genders, ethnicities, and races participated in 16 focus groups in six locations across the country. Focus group participants voiced (...) a strong desire to be able to access individual research results. Recognizing the wide range of possible research results from a large cohort study, they repeatedly and spontaneously suggested that cohort study participants be given ongoing choices as to which results they received. Some commentators speak freely about genetics being poised to change human nature. Contrary to such rhetoric, Norman Daniels believes no such thing is plausible since ‘nature’ describes characteristic traits of human beings as a whole. Genetic interventions that do their work one individual at a time are unlikely to change the traits of human beings as a class. Even so, one can speculate about ways in which human beings as a whole could be genetically altered, and there is nothing about (...) that venture that could not be deliberated in the way other high-impact questions can be evaluated. There might well come a time when it would be defensible to use genetics to change human beings as a class, in order to protect people in the face of changed environmental circumstances or to enhance existing capacities. Moreover, if one understands human nature not in an empirically descriptive way but in a metaphysical way having implications about human behavior, it can make sense to talk about de-naturing individuals through genetic changes. Even under a metaphysical conception of human nature, however, one can still imagine that people in the future might want to alter their traits in pursuit of another normative idea of a good and valuable life, and genetic modifications might function as a pathway to that change. The role of Scripture as norm is growing significantly in Catholic theological work. But with that growth the problems of its relation to other norms become clearer and more urgent as the agenda for systematic theology.

In a capitalist economy, taxes are the most important instrument by which the political system puts into practice a conception of economic and distributive justice. Taxes arouse strong passions, fueled not only by conflicts of economic self-interest, but by conflicting ideas of fairness. Taking as a guiding principle the conventional nature of private property, Murphy and Nagel show how taxes can only be evaluated as part of the overall system of property rights that they help to create. Justice or (...) injustice in taxation, they argue, can only mean justice or injustice in the system of property rights and entitlements that result from a particular regime. Taking up ethical issues about individual liberty, interpersonal obligation, and both collective and personal responsibility, Murphy and Nagel force us to reconsider how our tax policy shapes our system of property rights. If humans are purely physical, and if it is the brain that does the work formerly assigned to the mind or soul, then how can it fail to be the case that all of our thoughts and actions are determined by the laws of neurobiology? If this is the case, then free will, moral responsibility, and, indeed, reason itself would appear to be in jeopardy. Universalistic claims about the nature of justice are presumed to require larger commitments from a global perspective than partialist claims. This essay departs from standard partialist accounts by anchoring partialist claims in a different account of the nature of responsibility. In contrast to substantive responsibility, which is akin to an obligation and derived from principles, relational responsibilities grow out of relationships and their complex intertwining. While such accounts of responsibility are less clear cut, they will prove in the long run (...) to be more valuable in thinking about global ethics. I illustrate this point by considering the moral issue surrounding abandoned relationships. The approach offered here—partiality that rests upon relational responsibilities—makes the responsibilities owed by those in higher income countries towards lower income countries much richer and more complex than is usually presumed. This paper supports the burgeoning movement that looks to find affinities between Hans urs von Balthasar's theology and various liberation theologies. It does so by offering a “recontextualization” of Balthasar's thought. Specifically, it provocatively looks to recontextualize Balthasar as a theologian of the street. The argument proceeds in three stages: First, the meaning of “context,” and so the possibility of recontextualization, is discussed. While the term has become commonplace in contemporary “contextual theologies,”, the most rigorous analysis of context is found (...) not in theology, but in literary theory. Second, the particular locale of this particular recontextualization is discussed: the street. As sign, the street is ideologically and metonymically overdetermined. Here, Derrida, Goizueta, and Maeseneer are given as examples of thinkers who think with or from the street, who are contextualized by the street. Finally, the paper turns to specific instances in Balthasar's text that demonstrate his street contextualization: namely, his criticism of Rahner's martyrless Christianity and his discussion of the saints, particularly Joan of Arc. This section rejects those claims, epitomized by Murphy, that Balthasar's name signs a totally conservative context, and so completes my project of freeing space for the aforementioned liberatory movement to continue blossoming. ABSTRACTThis article argues that, although psychoanalysis and history have different conceptions of time and causality, there can be a productive relationship between them. Psychoanalysis can force historians to question their certainty about facts, narrative, and cause; it introduces disturbing notions about unconscious motivation and the effects of fantasy on the making of history. This was not the case with the movement for psychohistory that began in the 1970s. Then the influence of American ego‐psychology on history‐writing promoted the idea of compatibility (...) between the two disciplines in ways that undercut the critical possibilities of their interaction. The work of the French historian Michel de Certeau provides theoretical insight into the uses of incommensurability, while that of Lyndal Roper demonstrates both its limits and its value for enriching historical understanding. For thousands of years, people have used nature to justify their political, moral, and social judgments. Such appeals to the moral authority of nature are still very much with us today, as heated debates over genetically modified organisms and human cloning testify. The Moral Authority of Nature offers a wide-ranging account of how people have used nature to think about what counts as good, beautiful, just, or valuable. Prompted by the trauma of his break up with Freud, he developed a method of self healing which later formed the basis of his analytic practice and is now regarded as the origin of non-directive psychotherapy and creative arts therapies. The central part of this article deals with the morality of secession. We present the three main "pure" theories about the morality of secession and suggest the greatest justifying power of an "impure" or mixed theory. At the same time, however, we advocate the need for a proper understanding of the question of the morality of secession. More specifically, we suggest that the best way to raise it is by introducing the notion of "reasonableness" into the question itself.

This paper is motivated by the increasing popularity of efficient designs for stated choice experiments. The objective in efficient designs is to create a stated choice experiment that minimizes the standard errors of the estimated parameters. In order to do so, such designs require specifying prior values for the parameters to be estimated. While there is significant literature demonstrating the efficiency improvements of employing efficient designs, the bulk of the literature tests conditions where the priors used to generate the efficient (...) design are assumed to be accurate. However, there is substantially less literature that compares how different design types perform under varying degree of error of the prior. The literature that does exist assumes small fractions are used, which is in contrast to computer-aided surveys that readily allow for large fractions. Further, the results in the literature are abstract in that there is no reference point to provide clear insight on the magnitude of any issue. Our objective is to analyze the robustness of different designs within a typical stated choice experiment context of a trade-off between price and quality. We use as an example transportation mode choice, where the key parameter to estimate is the value of time. Within this context, we test many designs to examine how robust efficient designs are against a misspecification of the prior parameters. The simple mode choice setting allows for insightful visualizations of the designs themselves and also an interpretable reference point for the range in which each design is robust. Not surprisingly, the D-efficient design is most efficient in the region where the true population VOT is near the prior used to generate the design: the prior is $20/h and the efficient range is $10–$30/h. However, the D-efficient design quickly becomes the most inefficient outside of this range, and the estimation significantly degrades above $50/h. The orthogonal and random designs are robust for a much larger range of VOT. The robustness of Bayesian efficient designs varies depending on the variance that the prior assumes. Implementing two-stage designs that first use a small sample to estimate priors are also not robust relative to uninformative designs. Arguably, the random design performs as well as any design, and it will perform even better if data cleaning is done to remove choice tasks where one alternative dominates the other. (shrink)

This paper begins by examining Erich Fromm’s “Manifesto and Program” written for the Socialist Party in 1959 or 1960, and addresses a simple question: Why would Fromm speak of something so apparently arcane as “prophetic messianism,” in his socialist program? When he insists that we have forgotten thatsocialism is “rooted in the spiritual tradition which came to us from prophetic messianism, the gospels, humanism, and from the enlightenment philosophers,” is this simply a literary flourish, a concession to liberalism, or religious (...) sentimentality? Part I, written by Nick Braune, answers the question by examining Fromm’ssocialist organizing commitments in the context of the late 1950s. Part II, written by Joan Braune, offers further defense of the term “prophetic messianism,” distinguishes two types of messianism, and suggests that Fromm may be attempting to address a problem in the Frankfurt School. In the best literature on unilateral secession, for instance, Buchanan, it is usual to distinguish between remedial theories, which require a just cause for conceding a right to secession for the inhabitants of a territory, part of a State; and primary theories, plebiscitary theories and adscriptivist or nationalist theories. In accordance to this view, only the first are capable of justifying a unilateral right to secession. Well then, in this paper, an argument is elaborated in order to show that the (...) remedial strategy is not applicable to Catalonia and, also to show that even if primary theories are applicable to the case of Catalonia —the plebiscitary strategy has given rise to the so-called right to decide—, they are not able to justify a unilateral right to secession. Natalie Davis is a quintessential storyteller in the way theorized by Walter Benjamin, Hannah Arendt, and Michel de Certeau. Her work decenters history not simply because it grants agency and so historical visibility to those who have been hidden from history or left on its margins, but also because her stories reveal the complexities of human experience and so challenge the received categories with which we are accustomed to thinking about the world.

On June 28, 1993, the United States Supreme Court ruled on the admissibility of expert scientific opinion and evidence in federal court cases. The importance of the case can be measured by the interest it stimulated. The scientific community turned out in particular force to register its views. At the heart of the controversy was a debate over the nature of scientific knowledge and its relation to law. More than any other Supreme Court case in recent memory, the amici seemed (...) to view the Daubert case both as posing a potential challenge to basic scientific premises and as an opportunity to reclaim a lost prerogative to determine how science is applied in courts. La cuestión que se quiere resolver en este artículo es si, pese a que la política queda fuera del sistema filosófico que plantea Descartes, hay espacio aún para ella en la reflexión filosófica derivada de dicho sistema. Para ello, se analizarán los siguientes textos cartesianos: la carta-prefacio de la edición francesa de Los principios de la filosofía, con el fin de aclarar la estructuración y la finalidad del sistema; Las pasiones del alma, para elucidar en qué consiste la moral que (...) ocupa el lugar más alto en el árbol de la filosofía, y plantear en consecuencia la dimensión social de la moral; la correspondencia con Elisabeth de Bohemia permitirá analizar la posición de Descartes hacia la política. La conclusión pasa por considerar una doble dimensión del fenómeno político, una ligada a la vida social y otra a la estructuración del poder político y a las acciones de los gobernantes. (shrink)

El objetivo de este artículo es intentar establecer una línea de continuidad entre Montaigne y Leibniz respecto del tema de las pasiones y la vida feliz, entendiendo como parte de ésta una adecuada gestión de las pasiones. Se sostiene que hay puntos de contacto entre Montaigne y Leibniz, que a menudo pasan por la intermediación de Descartes. Tras comparar las propuestas de estos tres autores por lo que respecta a las pasiones y la vida feliz, se concluye que el tratamiento (...) moderno de las pasiones tiene su antecedente en Montaigne, y que llega hasta Leibniz por una consideración cada vez más “racionalista”. Se sugiere además que en los tres autores es posible considerar su filosofía como una forma de vida, y que más allá de que cada uno parta de posiciones metafísicas diferentes sus propuestas de vida feliz son similares.
