Scholars disagree to what extent Cicero comes in conflict with the traditional Roman norm structure, when he constitutes the Roman state and its law in “De re publica” and “De legibus” referring to a higher reason. By mentioning any form of rationality, he had to be careful not to deprive the regulations that had been successfully established in Roman politics and the mediation processes which were typical for Roman political culture. This article tries to show that Cicero was apparently aware (...) of this problem and faced it as, whenever he spoke about ratio or lex, he didn’t put the ‘reason’ (Vernunft), but the more flexible ‘mind’ (Verstand) in the center of his philosophy. Thinking is a kind of dialogue ─ according to Plato thinking is a silent and inner conversation of the soul with itself. Understanding presupposes thinking. Therefore, understanding presupposes a kind of dialogue. From this conclusion arises not only the question of what dialogue and understanding are in essence, but also the question of the connection between dialogue and understanding. Consequentialist positions in philosophy spell out normative notions by recourse to final aims. Hedonistic versions of ETHICAL consequentialism spell out what is MORALLY right/justified via recourse to the aim of increasing pleasure and decreasing pain. Veritistic versions of EPISTEMIC consequentialism spell out what is EPISTEMICALLY right/justified via recourse to the aim of increasing the number of true beliefs and decreasing the number of false ones. Even though these theories are in many respects structurally analogous, there are also interesting disanalogies. For (...) example, popular versions of epistemic consequentialism implicitly endorse the truth-indication principle (which claims that a belief is epistemically justified only if there are factors indicating that the belief itself is true), whereas popular versions of ethical consequentialism do not subscribe to an analogous pleasure-indicating principle (which claims that an act is morally justified only if there are factors indicating that performing the act itself is pleasurable). In a first step I will argue that this difference rests on the fact that plausible versions of epistemic consequentialism have to meet certain constraints, which versions of ethical consequentialism do not have to satisfy. As these constraints can be easily met by incorporating the truth-indication principle, epistemic consequentialists tend to subscribe to it. In a second step I will investigate whether the identified constraints can also be met independent from the truth-indication principle. Are there plausible versions of veritistic epistemic consequentialism that reject the principle, thereby allowing that some beliefs can be epistemically justified even though no factors speak in favor of their truth? Building on ideas put forward by Ludwig Wittgenstein, Crispin Wright, and others, I will answer this question affirmatively. (shrink)

ZusammenfassungPflegende und Ärzte haben in der beruflichen Alltagspraxis unterschiedliche Perspektiven. Dies zeigt sich insbesondere in ethisch relevanten Entscheidungssituationen, in denen sie oft zu grundlegend unterschiedlichen Urteilen kommen. Aus dieser „Unterschiedlichkeit der Perspektiven“ können in der beruflichen Alltagspraxis mitunter erhebliche Dissonanzen entstehen, die einer konstruktiven Zusammenarbeit im Wege stehen. Die vorliegende Arbeit will zum einen den in der Praxis der klinischen Ethik gewonnenen Eindruck und die daraus formulierte These einer „perspektivischen Differenz“ empirisch nachweisen. Um dies zu leisten, wurde am Universitätsklinikum Frankfurt (...) eine quantitative Erhebung durchgeführt. Zum anderen sollen die empirischen Ergebnisse zur Erklärung in einem weiteren theoretischen Kontext verortet werden. Hierfür wird im Anschluss an Bourdieu das Habituskonzept rekonstruiert, um zu erklären, warum die perspektivische Differenz weder unmittelbar wahrgenommen wird noch ohne weiteres überwunden werden kann. Die These der perspektivischen Differenz wird durch die empirische Studie gestützt. Dieser Sachverhalt ist insbesondere vor dem Hintergrund der habitustheoretischen Rekonstruktion von erheblicher Relevanz für die klinische Ethik, die einerseits Verfahren zur diskursiven Bearbeitung ethischer Konflikte in der klinischen Praxis und andererseits Konzepte für die medizinethische Fortbildung anbietet. Standard evolutionary explanations seem unable to account for inclusivist shifts that expand the circle of moral concern beyond strategically relevant cooperators. Recently, Allen Buchanan and Russell Powell have argued that this shows that that evolutionary conservatism – the view that our inherited psychology imposes significant feasibility constraints on how much inclusivist moral progress can be achieved – is unjustified. Secondly, they hold that inclusivist gains can be sustained, and exclusivist tendencies curbed, under certain favorable socio-economic conditions. I argue that Buchanan (...) and Powell concede too much to the evolutionary conservative, because their second point shows that conservatives are right about the first: inclusivist shifts are unrealistic where it matters most, namely under harsh social, political and economic conditions. I suggest two promising strategies for solving this problem. One is to focus on different forms of moral progress to secure the same moral gains. The other is to look beyond possible extensions of our psychological capacities altogether, by providing institutional support that renders them irrelevant. We should bypass, rather than further stretch, the constraints of our evolved psychology to make moral progress possible. (shrink)

In this paper, I argue that recent evidence regarding the psychological basis of moral cognition supports a form of (moderate) moral abolitionism. I identify three main problems undermining the epistemic quality of our moral judgments – contamination, reliability, and bad incentives – and reject three possible responses: neither moral expertise, nor moral learning, nor the possibility of moral progress succeed in solving the aforementioned epistemic problems. The result is a moderate form of moral abolitionism, according to which we should make (...) fewer moral judgments much more carefully. (shrink)

To relate theories of affordance and frame with the tradition of formal aesthetics, philosophical iconology and the life sciences (keyword Vitality Semiotics) is the starting point of the paper. According to this approach, the structural preconditions of images, as determined by materials, techniques and the composition of the design means, become essential. Through these structures, the producers are able to set impulses that become decisive for the interpretation of space and time or the "scene" as a dynamic event. Against the (...) social and cultural background of the recipients the "scene" gains a meaning to their life. This means to understand the productʼs conception and composition as an affordance which determines the framework of the reception conditions. The benefit of this approach lies in the identification of changes in the self-understanding and thus of trends in to new standards of societies. In recent research, dual-process theories of cognition have been the primary model for explaining moral judgment and reasoning. These theories understand moral thinking in terms of two separate domains: one deliberate and analytic, the other quick and instinctive. -/- This book presents a new theory of the philosophy and cognitive science of moral judgment. Hanno Sauer develops and defends an account of "triple-process" moral psychology, arguing that moral thinking and reasoning are only insufficiently understood when described in terms of (...) a quick but intuitive and a slow but rational type of cognition. This approach severely underestimates the importance and impact of dispositions to initiate and engage in critical thinking – the cognitive resource in charge of counteracting my-side bias, closed-mindedness, dogmatism, and breakdowns of self-control. The connection between fear, law and the state is a topic that is given particular attention in times of social insecurity. Some approximations are explored here under the notion of fear constitutions. We are equal in fear of one another, which is why fear can be understood as a condition of modern constitutions. However, the social contract does not lead to freedom from fear, but rather fear shifts; the legal subjects remain subjects of fear, in relation to one another, but (...) in particular towards that multiple artificial person which the state comes to embody as it takes on a life of its own. The degree of fear varies with the degree of unpredictability and indeterminacy of executive action. State measures against terrorism or against the pandemic are often an unpredictable response to an unknown danger and are therefore at the same time both an expression of fear and its trigger. It would be helpful if there was a clear distinction between sensible and unreasonable, functional and dysfunctional forms of fear. Freud tried to provide criteria with his concept of neurotic fear, a concept that has been taken up in political and legal philosophy. However, the concept is obscure and cannot be used without normative specifications. (shrink)

This article investigates the ways in which individuals assume two distinct viewpoints in both speech and gesture - both simultaneously and sequentially - when they represent the uncertain knowledge that characterizes risk. In the mimetic viewpoint, individuals represent events as characters in their own narrative or mimic the character viewpoint of an Other. In the analytic viewpoint, individuals move outside of embodied experience to analyze events from a distance. As part of a larger study investigating viewpoint in discourses of risk, (...) this study suggests the important role of viewpoint in understanding individual accounts of risk. Together, speech and gesture provide a richer representation of risk than either speech or gesture alone. But viewpoints represented in gesture may be rendered invisible in written accident reports and investigations. This study suggests that individual accounts of risk ultimately reflect highly local sensory experiences that are situated - literally and physically - by an individual's position in institutional and material sites. Within these institutions, individuals can access a range of analytic and mimetic viewpoints in both speech and gesture in order to represent their experiences. This research has important implications for rhetorical theory and risk and decision science. (shrink)

Abstract In this paper, I argue that there is a recursive relationship between history and philosophy that provides the methodological basis for the moral (human) sciences in the work of David Hume. A grasp of Hume's use of history is integral to understanding his project which I believe to be the establishment of “moral science” (i.e., the social sciences) on an empirical basis by linking that history and philosophy as two sides of the same discourse about human beings.

Rationalists about the psychology of moral judgment argue that moral cognition has a rational foundation. Recent challenges to this account, based on findings in the empirical psychology of moral judgment, contend that moral thinking has no rational basis. In this book, Hanno Sauer argues that moral reasoning does play a role in moral judgment—but not, as is commonly supposed, because conscious reasoning produces moral judgments directly. Moral reasoning figures in the acquisition, formation, maintenance, and reflective correction of moral intuitions. (...) Sauer proposes that when we make moral judgments we draw on a stable repertoire of intuitions about what is morally acceptable, which we have acquired over the course of our moral education—episodes of rational reflection that have established patterns for automatic judgment foundation. Moral judgments are educated and rationally amenable moral intuitions. -/- Sauer engages extensively with the empirical evidence on the psychology of moral judgment and argues that it can be shown empirically that reasoning plays a crucial role in moral judgment. He offers detailed counterarguments to the anti-rationalist challenge (the claim that reason and reasoning play no significant part in morality and moral judgment) and the emotionist challenge (the argument for the emotional basis of moral judgment). Finally, he uses Joshua Greene's Dual Process model of moral cognition to test the empirical viability and normative persuasiveness of his account of educated intuitions. Although the computational properties of the Region Connection Calculus RCC-8 are well studied, reasoning with RCC-8 entails several representational problems. This includes the problem of representing arbitrary spatial regions in a computational framework, leading to the problem of generating a realization of a consistent set of RCC-8 constraints. A further problem is that RCC-8 performs reasoning about topological space, which does not have a particular dimension. Most applications of spatial reasoning, however, deal with two- or three-dimensional space. Therefore, a consistent (...) set of RCC-8 constraints might not be realizable within the desired dimension. In this paper we address these problems and develop a canonical model of RCC-8 which allows a simple representation of regions with respect to a set of RCC-8 constraints, and, further, enables us to generate realizations in any dimension d = 1. For three-and higher-dimensional space this can also be done for internally connected regions. (shrink)

Philosophical and empirical moral psychologists claim that emotions are both necessary and sufficient for moral judgment. The aim of this paper is to assess the evidence in favor of both claims and to show how a moderate rationalist position about moral judgment can be defended nonetheless. The experimental evidence for both the necessity- and the sufficiency-thesis concerning the connection between emotional reactions and moral judgment is presented. I argue that a rationalist about moral judgment can be happy to accept the (...) necessity-thesis. My argument draws on the idea that emotions play the same role for moral judgment that perceptions play for ordinary judgments about the external world. I develop a rationalist interpretation of the sufficiency-thesis and show that it can successfully account for the available empirical evidence. The general idea is that the rationalist can accept the claim that emotional reactions are sufficient for moral judgment just in case a subject’s emotional reaction towards an action in question causes the judgment in a way that can be reflectively endorsed under conditions of full information and rationality. This idea is spelled out in some detail and it is argued that a moral agent is entitled to her endorsement if the way she arrives at her judgment reliably leads to correct moral beliefs, and that this reliability can be established if the subject’s emotional reaction picks up on the morally relevant aspects of the situation. El artículo sigue una serie de temas profundizados por el autor, y concluye recordándonos que el aterrador impacto del moderno mundo Occidental, no cancela la verdad de que el la historia del hombre ha sido marcadamente pluralista, y que no existen leyes generales de la sociedad, sino únicamente acuerdos culturales.

Moral judgements are based on automatic processes. Moral judgements are based on reason. In this paper, I argue that both of these claims are true, and show how they can be reconciled. Neither the automaticity of moral judgement nor the post hoc nature of conscious moral reasoning pose a threat to rationalist models of moral cognition. The relation moral reasoning bears to our moral judgements is not primarily mediated by episodes of conscious reasoning, but by the acquisition, formation and maintenance (...) ? in short: education ? of our moral intuitions. Societies change over time. Chattel slavery and foot-binding have been abolished, democracy has become increasingly widespread, gay rights have become established in some countries, and the animal rights movement continues to gain momentum. Do these changes count as moral progress? Is there such a thing? If so, how should we understand it? These questions have been receiving increasing attention from philosophers, psychologists, biologists, and sociologists in recent decades. This survey provides a systematic account of recent developments in the understanding of (...) moral progress. We outline the concept of moral progress and describe the different types of moral progress identified in the literature. We review the normative criteria that have been used in judging whether various developments count as morally progressive or not. We discuss the prospects of moral progress in the face of challenges that claim that moral progress is not psychologically possible for human beings, and we explore the metaethical implications of moral progress. The most popular argument against moral realism is the argument from disagreement: if there are mind‐independent moral facts, then we would not expect to find as much moral disagreement as we in fact do; therefore, moral realism is false. In this paper, I develop the flipside of this argument. According to this argument from agreement, we would expect to find lots of moral disagreement if there were mind‐independent moral facts. But we do not, in fact, find much moral disagreement; therefore, (...) moral realism is false. I defend the argument, explain the empirical evidence that supports it, and show what makes this challenge novel and powerful. (shrink)

Einstein's early thoughts about superconductivity are discussed as a case study of how theoretical physics reacts to experimental findings that are incompatible with established theoretical notions. One such notion that is discussed is the model of electric conductivity implied by Drude's electron theory of metals, and the derivation of the Wiedemann-Franz law within this framework. After summarizing the experimental knowledge on superconductivity around 1920, the topic is then discussed both on a phenomenological level in terms of implications of Maxwell's equations (...) for the case of infinite conductivity, and on a microscopic level in terms of suggested models for superconductive charge transport. Analyzing Einstein's manuscripts and correspondence as well as his own 1922 paper on the subject, it is shown that Einstein had a sustained interest in superconductivity and was well informed about the phenomenon. It is argued that his appointment as special professor in Leiden in 1920 was motivated to a considerable extent by his perception as a leading theoretician of quantum theory and condensed matter physics and the hope that he would contribute to the theoretical direction of the experiments done at Kamerlingh Onnes' cryogenic laboratory. Einstein tried to live up to these expectations by proposing at least three experiments on the phenomenon, one of which was carried out twice in Leiden. Compared to other theoretical proposals at the time, the prominent role of quantum concepts was characteristic of Einstein's understanding of the phenomenon. The paper concludes with comments on Einstein's epistemological reflections on the problem. (shrink)

Current developments in empirical moral psychology have spawned a new perspective on the traditional metaethical question of whether moral judgment is based on reason or emotion. Psychologists and cognitive neuroscientists such as Joshua Greene argue that there is empirical evidence that emotion is essential for one particularly important subclass of moral judgments: so-called ?deontological judgments.? In this paper, I scrutinize this claim and argue that neither the empirical evidence for Greene's dual process-theory of moral judgment nor the normative conclusions it (...) is supposed to yield can be maintained. More specifically, I argue that the evidence from neuroimaging relies on a problematic reverse inference, that the behavioral data are flawed, and that the findings from focal brain damage do not support the model. From a normative point of view, Greene fails to show that we ought to discount the intuitions that give rise to deontological judgments because they respond to morally irrelevant factors: firstly, I show that they do not pick up on the factors Greene deems to be morally irrelevant in the first place, and secondly, I argue that there generally is reason to trust our deontological intuitions.
