The study of speech acts has been a flourishing branch of the philosophy of language and linguistics over the last two decades, and John Searle has of course himself made some of the most notable contributions to that study in the sequence of books Speech Acts, Expression and Meaning and Intentionality. The purpose of this article is to explain how an account of proper names can be incorporated into a general account of the intentionality of mind and language. I show that such an account supports the so-Called descriptivist conception of proper names and in so doing I answer the objections of causal theorists.

After brief analyses of (1) Newman’s view of knowledge, (2) his view of science, (3) his view of theology as a science, (4) the primacy of the philosophical habit of mind, and (5) the inherent tension within the scientific community, this article relates Newman’s thought to the twenty-first century, particularly the Second Vatican Council’s Gaudium et Spes (Pastoral Constitution on the Church in the World of Today).

This essay argues that Newman’s theology of justification is a true via media between Roman Catholicism and Protestantism because of its Trinitarian character. While conceding that Newman misunderstood Luther’s theology of justification, this essay explores Newman’s theology of justification through Christ’s divine indwelling in the Holy Spirit. Examinando os topoi retóricos utilizados por Platão, demonstro como Platão impele os limites do gênero forense da oratória em direção à criação de uma nova prática discursiva: a filosofia. Inicialmente, o artigo examina o conceito de “gênero” em conexão com a oratória forense. Esboçado a partir do trabalho de Mikhail Bakhtin, Tzvetan Todorov e Andrea Nightingale, o artigo estabelece uma consonância entre as concepções de gênero (...) destes eruditos e aquilo que outros eruditos definiram como “gênero” oratório forense. Assim, o artigo levanta a questão do porquê a Apologia de Platão tradicionalmente ter sido excluída deste gênero. Argumento que certas visões concernentes à presumida historicidade das falas rotuladas como “oratória forense” precisam ser reexaminadas, já que não há evidência clara de que os atenienses requeressem acurácia histórica de discursos que agora classificamos como oratória forense. Ao remover a exigência de historicidade, obtemos um quadro mais preciso do que constitui a oratória forense e porque a Apologia de Platão merece pertença neste gênero. O artigo, então, examina detalhadamente vários topoi retóricos na Apologia. Argumento que, pela manipulação e remodelação de tais topoi, Platão expande e redefine o gênero da oratória forense para incluir a nova prática discursiva da filosofia. O artigo revela como a redefinição platônica dos limites da oratória forense transformaram uma fala jurídica de defesa em um tribunal na condição sine qua non do filósofo e da vida filosófica. Given recent technological advances, we now are able to invade personal privacy as never before. The challenge in the business community is to make the most of the opportunities presented by the growth in communication technology while, at the same time, protecting what remains of individual privacy. The conflict between technological advances and privacy concerns is not new, but it has grown exponentially in recent years, and the development of a data protection scheme in the European Union lends a certain (...) economic urgency to meeting the challenge.Pursuant to a Directive adopted by the European Union, privacy protections throughout the EU must become more stringent and consistent throughout EU member countries. One area of great concern to the United States is the Directive's requirement for certain minimum standards of privacy protection in countries receiving information from member countries. Given the limited protections available in the United States, it does not appear that the United States meets these minimum standards. The purpose of this paper is to critically analyze the existing measurements of global privacy protections and to propose a new model which allows for their comparative evaluation. (shrink)

He was one of the most distinguished historians of philosophy of his generation. Early in his studies he had found Locke's Essay Concerning Human Understanding a challenging book that raised as many puzzles as it answered and it was his engagement with that work that dominated his intellectual enquires from his MA (...) studies until his latest book, published last year, The Two Intellectual Worlds of John Locke. Man, Person, and Spirits in the "Essay." It was his fifteenth authored book. His first book was his Oxford D. Phil. Thesis, John Locke and the Way of Ideas, published nearly fifty years ago in 1956. If Locke and Ideas were to dominate his writings, they were not exclusive of other interests. His second book was The Philosophy of A.S. Eddington. Others, not Locke-centered, were to follow. In later years he has focussed especially on the problem for all readers of Locke and other early modern philosophers including Descartes, Berkeley and Hume, as to the nature of their commitment to ideas. Did they really hold that ideas are objects that intervene between the perceiving mind and the outside world, or is the standard reification of ideas simply a mistaken reading of their argument? Yolton, since at least the early 1980s, has argued that to reify ideas in the standard way is based on a false reading of the texts. Rogers suggests that human spirituality comprises the interplay of three foundational human dynamics: suffering, interconnecting, and valuing. The spiritual orientations that result from these clusters of dynamics are primarily integrating or disintegrating. The dominant spiritual orientation in this country has been disintegrating; and this orientation has characterized the attitude of the majority population toward African Americans since the beginning of slavery, fostering radical separation, displacing the suffering of the majority onto a minority, and defining the experience and perspectives of the (...) majority as normative without regard for the minority. Rogers explores the effects of this disintegrating spiritual orientation in terms of the dynamics of oppression using the ideas of 'being' and 'non-being'. The key to ameliorating oppression is to recognize the liberating capacity of suffering as potentially subversive within ever-enlarging contexts addicted to increasing material consumption and sensual gratification. ;Chapter 1 is a general introduction to the dissertation. ;Chapter 2 provides an overview of the primary methodology for research in 'formation theory' as developed by Adrian van Kaam. Using issues from the philosophy of science, the chapter also discusses the basis for divergence from the standard methodology based in the anomalous character of the researcher's 'formative event' and perspective relative to concerns that have been researched using formation theory. ;Chapter 3 considers a conceptualization of spirit as questing for meaningfulness, which provides the experiential ground for relating spirituality and liberation: Since oppression precipitates meaninglessness through disintegration, the reaffirmation of an integrative spirituality provides the ground for meaningfulness, which in turn grounds liberation, or transcendence. ;Chapter 4 presents the construct of human spirituality using the three foundational foci of spiritual formation: suffering, relating, and valuing. ;Chapter 5 concludes the dissertation using the two principle laws of thermodynamics to develop an analogous understanding for the necessity of suffering in maintaining an integrative and liberating spirituality. Potts Jr. (bio)In December 1997, the Institute of Medicine (IOM) released a report on medical and ethical issues in the procurement of non-heart-beating organ donors. This report had been requested in May 1997 by the Department of Health and Human Services (DHHS). We will here describe the genesis of the (...) IOM report, the medical and moral concerns that led the DHHS to sponsor it, the process of producing it, and its conclusions. The analyses, findings, and recommendations of the report are also reviewed, in particular the central issues that led to suggestions for policy changes.Transplantation BackgroundAs a first step, some background in the relevant aspects of organ transplantation will prove useful. For the purposes of this analysis, “transplantation” involves the transfer of cells, tissues, or solid organs from one human to another to replace the structure or function of comparable body components that, through injury or disease, are defective or of inadequate function. The IOM report deals with solid organs, primarily kidneys and livers, whose blood supply is reconnected in the organ recipient, in contrast to cells, like bone marrow, and tissues, like corneas. A variety of donor types exists for organ transplantation, each with particular medical and scientific conditions.Living donors are healthy (and usually genetically related) individuals who volunteer to provide either a whole, paired organ such as a kidney or a section of an organ such as a liver. Cadaver donors are individuals who have died and from whom a full array of organs can be taken. “Heart-beating” cadaver donors are individuals who have suffered “brain death,” that is, irreversible cessation of function of the whole brain including the brain stem; and “non-heart-beating” donors (NHBDs) are individuals who are ill or injured, but not “brain dead,” and who have suffered cardiopulmonary death, that is, irreversible cessation of cardiac and respiratory function. NHBDs can be “controlled,” which means that [End Page 83] they can be sustained by artificial life support systems until a medical and family decision is made to terminate futile life support. This can be done at a scheduled time and in a controlled manner, and organs can then be recovered for transplantation. NHBDs can also be “uncontrolled,” which means that their hearts and breathing have stopped through disease or injury at an unexpected time or in an uncontrolled manner, and they cannot be resuscitated; the organs of some individuals of this description can be recovered for transplantation. The IOM report focused on both controlled and uncontrolled NHBDs and on problems specific to them.The questions that were asked and addressed in the IOM report became current and salient beginning in 1992 with the establishment of the University of Pittsburgh “Policy for the Management of Terminally Ill Patients Who May Become Organ Donors After Death.” This policy addressed controlled NHBDs and the ethical questions raised by their use; much of the discussion was reported in the June 1993 special issue of the Kennedy Institute of Ethics Journal. Public notice and anxiety about some of these concerns were sharpened and refocused by national and local media allegations of improper treatment of donors at the Cleveland Clinic in 1997, specifically premature—i.e., antemortem—recovery of organs and administration of drugs that allegedly might hasten donor death.The DHHS Request for StudyIt is not surprising that several federal actions would be taken in response to these events. Building on a long tradition of measuring cultural logics from a relational perspective, we analyze a recent survey of American university students to assess whether institutional logics operate in the lived experience of individuals. An institutional logic is an analytic troika of object, practice, and subject linked together through dually ordered systems of articulations. Using the formal method of correspondence analysis (MCA) we identify two latent dimensions that order physical, verbal, emotional, categorical, and moral practices of and investments in love. (...) We take these dimensions as evidence of an institutional logic. The dominant first dimension is organized through talk of love, non-genital physical intimacies, and affective investment. It has no sexual specificity. The subsidiary second dimension is organized through moral investment and it has a genital sexual specificity. There is little difference between women and men, either in the way these dimensions are organized or in the location of men and women within these dimensionalized spaces. We find that romantic love has a situated material effect in terms of increasing the probabilities of orgasm. (shrink)

Evolutionary theories of schizophrenia must account for the maintenance of putative alleles in past and present populations despite reduced fitness among the affected. Such models must also account for extant intersex and population-level variability in the expression of schizophrenia. We argue that genetic balanced-polymorphism hypotheses remain the most robust in terms of modeling and testing these processes in populations.

The obligation of a court to follow the law of a superior court is commonly taken to be stronger than the obligation of the higher court to respect its own precedent. The Supreme Court has recently asserted this stronger obligation in the most forceful terms. What follows is an attempt to demonstrate that this is wrong as a matter of policy and as a matter of law.

The American Constitution held out the hope that ordinary people were capable of deciding their own fates, and in doing so it immeasurably elevated the dignity of common people. The organization and interplay of the parts that comprise the whole American government exist to provide people the opportunity to govern themselves and, at the same time, reveal the limits of democratic self-rule. The forgetting of these limits is not only destructive to the constitution but the nation as a whole.

Though the social teachings of the U.S. Catholic bishops differ in several respects from both the Protestant social gospel and Latin American liberation theology, there is a common theological logic grounding these kindred conceptions of the role of the church in social reconstruction. Christian social concern begins with a "contrast experience" of the failure of present actuality to satisfy the felt requirements of conscience. This experience compels attention to the resources of Scripture which are brought to bear by means of (...) hermeneutical strategies that assume a social anthropology and are necessarily welded to penetrating social analysis.
