En el marco de los treinta años de la publicación en castellano de la segunda edición de la Teoría pura del derecho y de los setenta y cinco años de la primera publicación en alemán de dicha obra, del profesor austriaco Hans Kelsen, el Programa de Derecho de la Facultad de Relaciones Internacionales y Ciencias Jurídicas y Políticas de la Universidad de Bogotá Jorge Tadeo Lozano, celebró, en octubre de 2009, el Congreso Académico Internacional Hans Kelsen: una Teoría Pura (...) del Derecho, del cual se originó el libro que lleva el mismo nombre. La relevancia que produjo dicho evento en el ámbito académico, así como el interés despertado para la generación de un espacio similar con otros autores de importancia para la ciencia jurídica, se establecieron como el punto de encuentro y la razón de producción de aquello que lleva el nombre hoy de jornadas Académicas Internacionales de Argumentación y Filosofía del Derecho que, adicionalmente, sirvieron para una modulación de actividades desarrollas en el Foro de Interpretación, Argumentación y Decisión judicial del año 2010, llevado a cabo en nuestra Universidad, con presencia del profesor portugués Boaventura de Sousa Santos. In the seventh and most recent edition of their classic book, Principles of Biomedical Ethics, Tom Beauchamp and James Childress define a virtue as a character trait that is “socially valuable and reliably present” and a moral virtue as such a trait that is also both “dispositional” and “morally valuable”. The virtues that they single out as “focal” within biomedical ethics are compassion, discernment, trustworthiness, integrity, and conscientiousness. Not all is well in their treatment of virtue. Beauchamp and Childress seem (...) to worry that an ethical theory in which virtues are fundamental will neglect duties, rights, and societal needs. Further, they insist that there is no reason to think that, within ethical theory, one family of ethical concepts is the most important, nor that one theoretical approach is correct, or even superior to others. I will try to show, that there are strong reasons to see language, concepts, and matters of virtue as fundamental within normative ethical theory, both generally and in such specialized subareas as medical ethics. These reasons reveal themselves when we analyze concepts at the core of the alternative approaches to theorizing ethics that Beauchamp and Childress identify. (shrink)

Con ocasión de la publicación de la exhortación Evangelii Gaudium, y a los 50 años de la promulgación del decreto Unitatis redintegratio, textos ambos que proponen el principio de “jerarquía de verdades”, el autor analiza la historia de este principio y la intención de los padres conciliares al incorporarlo al decreto conciliar sobre el ecumenismo. En un segundo momento, ofrece elementos relativos a la interpretación teológica y magisterial de la “jerarquía de verdades” en el ámbito de la Iglesia católica. Luego, (...) teniendo en cuenta que el principio se indicaba para los diálogos teológicos interconfesionales, el autor presenta algunos datos relativos a su acogida por parte de teólogos protestantes, el recurso al mismo en los diálogos teológicos oficiales, y la única explicación ecuménica presente en el documento de estudio publicado por el Grupo Mixto de Trabajo entre el Consejo Mundial de Iglesias y la Iglesia católica. Como modo de verificación de la aplicabilidad de la “jerarquía de verdades”, se recogen algunos elementos relativos a la puesta en práctica del mismo por el Groupe des Dombes en su documento sobre la teología mariana. Finalmente, y a modo de conclusión, regresando a la propuesta de Evangelii Gaudium, el autor avanza algunas reflexiones ante la posible aplicación de la “jerarquía de verdades” en el ámbito de la enseñanza moral de la Iglesia. Even though the university has the potential to help humanity in what amounts to a paradigmatic transition, it has been very restrictive and very selective in the kinds of knowledges it validates. In fact, the kinds of knowledges in which it has excelled are those most responsible for the paradigmatic crisis in which humanity finds itself. In a nutshell, the paradigmatic change calls for cognitive justice, justice for the different ways of knowing that circulate in society. Cognitive justice is the (...) polar opposite of ‘anything goes’. The assumption is that there is no global social justice without global cognitive justice, justice among knowledges. Looking back, while privileging one specific kind of knowledge and, indeed, granting it a cognitive monopoly, the university has been the privileged site for producing and legitimating cognitive injustice. As a result, the immense epistemic diversity of the world has been ignored or suppressed. In the following, I identify the problem and the promise for overcoming it. (shrink)

In the 10 years after the launch of the United Nations Global Compact (GC), there have been very few empirical assessments of the initiative in the academic literature. In this study, drawing from institutional theory and the resource-based view of the firm, we examine motivations of business participants to adopt the GC principles in the Spanish context. Using survey data from Spain – the country reporting the highest volume of business participants in the GC – we find that external institutional (...) forces as well as internal organisational resources shape motivations for adopting GC principles. In particular, we find that early and late adopters are motivated similarly by the perceived opportunity of achieving image gains, while late adopters are motivated more by economic gains than early adopters. We further find that regardless of the extent of internal intangible resources possessed, firms are similarly motivated by economic gains. The results also show that companies with more intangible resources are motivated more by image gains than those with fewer resources. Our findings indicate that contrary to its earlier days, economic gains have emerged as an important motivator for the adopters of the GC principles with image gains still being an important motivator. With these two perspectives Hegel seeks to open the path towards speculative thinking where subject and object find their final identity and towards the ‘sublating’ (aufheben) of Religion into Philosophy in the threefold sense of suppressing, elevating and preserving it. This paper discusses the claim that citizens lack sufficient political knowledge to make sound judgements on public matters. It is contended that practical judgements raise essentially two types of claims, namely a claim to empirical truth and a claim to normative rightness, and that there are good reasons to believe that people's insufficient political knowledge undermines both of them. Yet, an examination of the dynamics of public opinion formation reveals that there is an epistemic potential in public opinion, though it (...) is dependent upon the quality of public debate. Building on this idea and on the concept of deliberative responsiveness, two paths of political reform are proposed, which should illustrate the practical implications of the theoretical argument made in this paper by demonstrating how the quality of public debate and, thus, the epistemic value of public opinion could be enhanced. I claim that the increase in complexity in the trace of Paleolithic stone tools can be parsimoniously explained by postulating the emergence of effective mechanisms for the social transmission of representations. I propose that Paleolithic tools, similar to more contemporary tools, were subject to a process of evolution by artificial selection based on functionality.

El artículo analiza las condiciones de validez del testimonio en ciencias sociales. Sus potencialidades centrales son el constituir un campo de exploración e investigación de acercamiento a la subjetividad, especialmente a la de los sectores populares. Ello ha permitido incorporar sus discursos y representaciones en las ciencias sociales. Sin embargo, dicha incorporación se ha realizado bajo una perspectiva empirista, según la cual el testimonio es una representación inmediata, directa de los sujetos, lo que oculta la mediación del testimonio a través (...) del cientista social, particularmente a través de la entrevista. Por ende, la idea del testimonio como una ¿voz de los sin voz¿ oculta el diálogo entre investigador-sujetos, que podría ser potenciado en un tipo de investigación hermenéutica en la que el investigador ya no ostentaría el monopolio de la interpretación. Se señala que los compromisos del Pacto de Nueva Imperial tienen niveles parciales de cumplimiento que dejan a Chile por debajo en estas materias en el concierto latinoamericano, lo (...) que ha llevado a que la relación entre el gobierno y la CONADI con el movimiento indígena está atravesada por contradicciones y conflictos difíciles de solucionar. John Ackrill argued that Aristotelian bodies are conceptually promiscuous, since they fail to exemplify the modal relations that are expected to hold between their matter and their form. Although “potentially alive”, organic bodies are bound to be ensouled, on pain of lacking the required potential; but to the extent that they are ensouled, they are already actually alive. It seems odd to claim that a body may lack what it cannot help having. This paper claims that the standard solution falls (...) short of the strong unity living beings display, given that nothing in them can be accidentally alive. An alternative proposal is advanced, based on two distinctions Aristotle draws in his philosophical lexicon: both matter and form have a claim to being called “nature”; formal nature may be found in its subject either in actuality or in potentiality. It is argued that the characterization of organic bodies as “potentially alive” conforms to, a pattern that helps explain the specific way in which bodies share in the organisms’ life. By any standard, nonrationality is an undertheorized concept in sociology. This paper attempts to open a discussion on nonrationality by analyzing one of the most fruitful theorizations of the concept: Simmel's. Simmel developed a theory that placed nonrationality on the same plane with rationality and attributed to the former a role as fundamental as the latter's in the foundations of action, and as central as the latter's in the generation of existential meanings. The gradual eclipse of the nonrational elements of (...) life in the expanses of a modern, highly rationalized world imply, then, an impoverishment of being. I argue that Simmel's theory of the nonrational can serve as a model capable of enriching our understanding of society and of the person and can, in this sense, serve as a counterpoint to current sociological theories that emphasize the rational elements of life and conceive the person in primarily rational terms. Research on Augmented Reality in education has demonstrated that AR applications designed with diverse components boost student motivation in educational settings. However, most of the research conducted to date, does not define exactly what those components are and how these components positively affect student motivation. This study, therefore, attempts to identify some of the components that positively affect student motivation in mobile AR learning experiences to contribute to the design and development of motivational AR learning experiences for the Vocational Education (...) and Training level of education. To identify these components, a research model constructed from the literature was empirically validated with data obtained from two sources: 35 students from four VET institutes interacting with an AR application for learning for a period of 20 days, and a self-report measure obtained from the Instructional Materials Motivation Survey. We found that the following variables: use of scaffolding, real-time feedback, degree of success, time on-task and learning outcomes are positively correlated with the four dimensions of the ARCS model of motivation: Attention, Relevance, Confidence, and Satisfaction. From Jean-Luc Marion’s examination of Gustave Courbet and his painting, it is shown how grief can operate as a model for the hermeneutics of love. This hermeneutics of grief, in turn, makes possible a consideration of all phenomena, and not only the human, as saturated phenomena.

One can expect a scientific journal to fulfill the purpose of disseminating research results, spreading works and new ideas and, now more than ever, franking space for the fruitful exchange among institutions under the dictum of the knowledge’s internationalization. Honoring its commitment as an academical philosophy journal, the present issue of the Aoristo - International Journal of Phenomenology, Hermeneutics and Metaphysics assumes the three afore mentioned missions, with emphasis on the last one.
