The concept of Integrative Bioethics is the idea of an equal discussion between different ethical concepts from different backgrounds. This concept is not only suitable for the specific situation in Southeast Europe. It can also be a basis to affect the ethical discourse in other parts of the world, either with a homogeneous historical background or within a very diverse ethical setting. With this essay I will try to point out the possibilities for the discussion of ethical problems in other (...) parts of the world if the core idea of Integrative Bioethics is added to bioethical discussions. It seems to be a chance to find a way to deal with the differences between traditional and modern concepts of ethics. Der Entwurf der integrativen Bioethik steht für die Idee einer gleichgestellten Auseinandersetzung zwischen verschiedenerlei ethischen Konzepten aus differenten Hintergründen. Dieses Schema ist nicht lediglich am außerordentlichen Beispiel des Südosteuropas verwendungsfähig. Es könnte gleichermaßen als Basis zur Einflussnahme auf den ethischen Diskurs in den restlichen Regionen der Welt fungieren, entweder jenen mit einem homogenen historischen Hintergrund oder denjenigen mit einer mannigfaltigen ethischen Färbung. Innerhalb dieses Essays wage ich den Versuch, auf die Möglichkeiten zur Debatte über ethische Angelegenheiten in anderen Teilen der Welt zu verweisen, sollte die Kernidee der integrativen Bioethik den bioethischen Erörterungen hinzugefügt werden. Sie nimmt sich aus als die Chance, einen Weg ausfindig zu machen, die Differenzen zwischen den traditionellen und zeitgenössischen Konzepten der Bioethik in Angriff zu nehmen. (shrink)

It has been a longstanding problem to show how the irreversible behaviour of macroscopic systems can be reconciled with the time-reversal invariance of these same systems when considered from a microscopic point of view. A result by Lanford shows that, under certain conditions, the famous Boltzmann equation, describing the irreversible behaviour of a dilute gas, can be obtained from the time-reversal invariant Hamiltonian equations of motion for the hard spheres model. Here, we examine how and in what sense Lanford’s theorem (...) succeeds in deriving this remarkable result. Many authors have expressed different views on the question which of the ingredients in Lanford’s theorem is responsible for the emergence of irreversibility. It is argued that Plessner’s work demonstrates the fundamental indispensability of the qualitative humanities vis-à-vis the natural-scientific study of man. Plessner’s non-reductionist, emergentist naturalism allots complementary roles to the causal and functional investigations of the life sciences and the phenomenological and (...) hermeneutic interpretation of the phenomenon of life in its successive levels and stages. Within this context, human agency can be understood as a higher-order property of organic life, which act by the selective activation of lower-level psychophysical powers. Plessner’s three ‘anthropological laws’ are used to situate the notion of practical self-understanding in between two extremes: deterministic views that deny human freedom and responsibility and views that ascribe an unrealistic amount of autonomy to human beings. This book argues that ultimately human rights can be actualized, in two senses. By answering important challenges to them, the real-world relevance of human rights can be brought out; and people worldwide can be motivated as needed for realizing human rights. Taking a perspective from moral and political philosophy, the book focuses on two challenges to human rights that have until now received little attention, but that need to be addressed if human rights are to remain plausible as a global (...) ideal. Firstly, the challenge of global inequality: how, if at all, can one be sincerely committed to human rights in a structurally greatly unequal world that produces widespread inequalities of human rights protection? Secondly, the challenge of future people: how to adequately include future people in human rights, and how to set adequate priorities between the present and the future, especially in times of climate change? The book also asks whether people worldwide can be motivated to do what it takes to realize human rights. Furthermore, it considers the common and prominent challenges of relativism and of the political abuse of human rights. This article explores the conceptions of spirituality in a large and representative sample of the general population in the Netherlands. Spirituality is described mostly in cognitive terms, especially in the form of general references to a transcendent reality. Experiential expressions are used in more than a quarter of the descriptions. Important patterns in the descriptions are: spirituality as the transcendent God, spirituality as inwardness, and spirituality as mental health. In the sample, 21% distance themselves from spirituality; among people with a (...) secular outlook this percentage is 35%. We paid special attention to differences in conceptions of spirituality between people inside and outside institutional religious contexts and between people who self-identify as ‘spiritual’ and those who do not. One very important question about poverty is what rich people like us should do to fight it. In this article, I argue that we can, at little cost to ourselves, give tithes of our money and live within our so-called ‘ecological footprint’. At the end of the article, it is argued that we should, morally, do these things.

The 2008 UN Convention on the Rights of Persons with Disabilities (CRPD) provides a landmark articulation of the universality of human rights. The future of health research will be characterised by three continuing trends: rising demand for health data; increasing impracticability of obtaining specific consent for secondary research; and decreasing capacity to effectively anonymise data. In this context, governments, clinicians and the research community must demonstrate that they can be responsible stewards of health data. IRBs and RECs sit at heart of this process because in many jurisdictions they have the capacity to grant consent waivers when research is judged to be of (...) particular value. However, several different terms are used to refer to this value, indicating a lack of conceptual clarity regarding the appropriate test for access to health data for research without consent. In this paper we do three things. First we describe the current confusion and instability in terminology relating to public interest in the context of consent waivers. Second we argue for harmonisation of terminology on the grounds of clarity, transparency and consistency. Third we argue that the term ‘public interest’ best reflects the normative work required to justify consent waivers because it is the broadest of the competing terms. ‘Public interest’ contains within its scope positive and negative implications of a study, as well as welfare, justice and rights considerations. In making this argument, we explain the normative basis for consent waivers, and provide a starting place for further discussion about the precise conditions in which a given study can be said to advance the public interest. High degrees of uncertainty and a lack of effective therapeutic treatments have characterized the COVID-19 pandemic and the provision of drug products outside research settings has been controversial. International guidelines for providing patients with experimental interventions to treat infectious diseases outside of clinical trials exist but it is unclear if or how they should apply in settings where clinical trials and research are strongly regulated. We propose the Professional Oversight of Emergency-Use Interventions and Monitoring System as an alternative pathway based (...) on guidance developed for the ethical provision of experimental interventions to treat COVID-19 in Singapore. We support our proposal with justifications that establish moral duties for physicians to record outcomes data and for institutions to establish monitoring systems for reporting information on safety and effectiveness to the relevant authorities. Institutions also have a duty to support generation of evidence for what constitutes good clinical practice and so should ensure the unproven intervention is made the subject of research studies that can contribute to generalizable knowledge as soon as practical and that physicians remain committed to supporting learning health systems. We outline key differences between POEIMS and other pathways for the provision of experimental interventions in public health emergencies. (shrink)

In this essay I examine the contributions of the pragmatist tradition to the philosophy of ethnicity. From the pragmatist philosophies of Dewey and Locke I derive a reconstructive model for the clarification and improvement of the life experiences of ethnic groups. Addressing various problems and objections, I argue that this Deweyan and Lockean reconstructive model rejects any sharp separation between race and ethnicity and avoids the pitfalls of the biologist race paradigm and the culturalist ethnicity paradigm. This article argues that universities have duties to negotiate contracts with the pharmaceutical industry that are favourable to the world’s poor, and to do more research into diseases which disproportionately strike the global poor. It is argued that these duties are related to human rights (in particular to a human right to health) and that they are therefore very weighty. Furthermore, these duties are in line with some of the most important things that Universities Allied for Essential Medicines (UAEM), a (...) worldwide group of students and academics, wants universities to do. A number of objections are discussed, among other things to do with safeguarding pharmaceutical innovation, and it is argued that the aforementioned duties should, as UAEM also advocates, often be combined with efforts on the part of universities to work towards more long-term, large-scale institutional arrangements to ensure access to and availability of essential medicines for the global poor. -/- . This paper argues that one problem that besets black-box AI is that it lacks algorithmic justifiability. We argue that the norm of shared decision making in medical care presupposes that treatment decisions ought to be justifiable to the patient. Medical decisions are justifiable to the patient only if they are compatible with the patient’s values and preferences and the patient is able to see that this is so. Patient-directed justifiability is threatened by black-box AIs because the lack of rationale provided (...) for the decision makes it difficult for patients to ascertain whether there is adequate fit between the decision and the patient’s values. This paper argues that achieving algorithmic transparency does not help patients bridge the gap between their medical decisions and values. We introduce a hypothetical model we call Justifiable AI to illustrate this argument. Justifiable AI aims at modelling normative and evaluative considerations in an explicit way so as to provide a stepping stone for patient and physician to jointly decide on a course of treatment. If our argument succeeds, we should prefer these justifiable models over alternatives if the former are available and aim to develop said models if not. (shrink)

It is said that the Second Vatican Council rediscovered the role of Holy Spirit in the Church. In this article I want to explore how the Holy Spirit was conceived before the Council, in order to know how that rediscovery can be said to have started before the Council. I will explore the different understandings of the Holy Spirit’s role in the Church in the period 1900 and 1960; explore their historical-theological background; and venture a theological appreciation of those views. (...) We will see that, around 1900, the Holy Spirit was viewed as the guarantee of the truthfulness of magisterial teaching. From the 1930s, He was understood as the soul of the mystical body. His role remained hierarchical, but grew larger, and included the bestowing of grace as well as truth. Thirdly, in the 1950s, the Holy Spirit was considered to work through charisms. As charisms do not exclusively belong to the hierarchy, they implicitly challenged earlier hierarchy focused pneumatology. I will conclude that the Holy Spirit was rediscovered indeed, yet, that his rediscovery made a modest start only. For on the one hand ecclesiology became more theological, and theology more trinitarian, but on the other hand, ecclesiology continued to be rather hierarchy focused, and the dominance of Christocentrism continued to be a serious problem for any appreciation of the Holy Spirit’s role in the Church. Increased pressures on agri-food systems have indicated the importance of intermediaries to facilitate sustainability transitions. While producer organizations are acknowledged as intermediaries between individual producers and other food system actors, their role as sustainability transition intermediaries remains understudied. This paper explores the potential of producer organizations as transition intermediaries to support producers in their needs to adopt sustainable production practices. Ten cases of producer organizations in conventional (regime) and organic (niche) vegetable systems in Uruguay were studied qualitatively. Findings show that (...) the classic intermediary roles that producer organizations fulfil in food systems also address the needs of producers in their transition to sustainable food systems. By providing organic inputs, organizing access to output markets, sharing knowledge, and facilitating sustainable production practices, producer organizations support producers within and across regime and niche. Producer organizations mostly function as implicit transition intermediaries, facilitated by their legitimacy among producers, their embeddedness in rural networks, and by refraining from taking a strong normative position. Producer organizations have the potential to be more explicit transition intermediaries, however this position comes with limitations. We provide policy recommendations to optimize the transition intermediary potential of producer organizations in their facilitation towards sustainable food systems. (shrink)

This article examines whether cosmetic interventions by dentists and plastic surgeons are medically indicated and, hence, qualify as medical interventions proper. Cosmetic interventions (and the business strategies used to market them) are often frowned upon by dentists and physicians. However, if those interventions do not qualify as medical interventions proper, they should not be evaluated using medical-ethical norms. On the other hand, if they are to be considered medical practice proper, the medical-ethical principles of nonmaleficence, beneficence, justice and others hold (...) true for cosmetic interventions as much as they do for other medical and dental interventions. It is concluded that most cosmetic interventions do not qualify as medical interventions proper because they do not restore or maintain the patient's health (defined as the patient's integrity) by any objective standards. Rather, cosmetic interventions are intended to enhance a person's physical appearance; more specifically, they intend to fulfill the client's subjective perception of an enhanced appearance. Este documento busca revisar el estado actual del pensamiento católico sobre el respeto al agenciamiento del paciente, a la autonomía y al consentimiento. Sin embargo, no se pretende llegar a una revisión definitiva. De hecho, encontraremos un amplio apoyo de estos conceptos dentro de la bioética católica, a pesar de que persiste un importante disenso sobre aspectos específicos. En primer lugar, el artículo ofrece una descripción resumida de algunas diferencias importantes entre el entendimiento prevaleciente de la autonomía del paciente en (...) la bioética secular y en la bioética católica. En la primera, se suele entender que el respeto a la autonomía del paciente considera las necesidades y deseos subjetivos de éste, incluso cuando, o tal vez precisamente, porque quedan fuera del ámbito de comprensión del profesional de la salud. En la segunda, este respeto se fundamenta en la dignidad delpaciente individual, que abarca los deseos y necesidades subjetivas del paciente, pero que es esencialmente un concepto objetivo y, por lo tanto, intersubjetivamente accesible. Para explicar con más detalle cómo puede respetarse el agenciamiento del paciente dentro de ese marco de referencia objetivo, en el documento se examinan diferentes tipos de agenciamiento del paciente dentro de la relación terapéutica. Para que la atención de la salud sea clínicamente óptima y éticamente sólida –como exigen los principios éticos de beneficencia y no maleficencia–, el paciente debe participar activamente en: 1) la evaluación y el diagnóstico; 2) la planificación del tratamiento, y 3) la terapia propiamente dicha. Además –como exige el principio ético del respeto a la autonomía–el proveedor de atención sanitaria debe: 4) proteger la confidencialidad del paciente; 5) proporcionarle información adecuada, y 6) obtener el consentimiento del paciente para cualquier intervención. A continuación, se examinan diferentes tipos de consentimiento. En una sección final, se revisará la cuestión de si es moralmente permisible que los proveedores de atención de la salud obliguen a los pacientes a rechazar los tratamientos que se consideren inmorales. One of the founders of modern hermeneutics, German philosopher Wilhelm Dilthey (1833-1911) confronted the question of how modern, postmetaphysical human beings can cope with the ambivalence, contingency, and finitude that fundamentally characterize their lives. This book offers a reevaluation and fresh analysis of Dilthey's hermeneutics of life against the background of the development of philosophy during the past two centuries. Jos de Mul relates Dilthey's work to other philosophers who influenced or were influenced by him, including Kant, Schleiermacher, Hegel, Comte, (...) Mill, Nietzsche, Husserl, Heidegger, Gadamer, and Derrida. Weaving together systematic analysis and historical investigation, de Mul begins the book with an account of the horizon on which Dilthey developed his unfinished masterwork, Critique of Historical Reason. The author then elaborates a systematic reconstruction of Dilthey's ontology of life, relates the ontology to the work of other twentieth-century philosophers, and positions Dilthey's thought within current philosophical debate. The paper deals with the interpretation of Wittgenstein's views on the power of occurrent mental states to sort objects or states of affairs as in accord or in conflict with them, as presented in the rule‐following passages of the Philosophical Investigations. I shall argue first that the readings advanced by Saul Kripke and John McDowell fail to provide a satisfactory construal of Wittgenstein's treatment of a platonist account of this phenomenon, according to which the sorting power of occurrent mental states (...) is to be explained by reference to the mind's ability to grasp universals. I contend that the argument that Kripke extracts from Wittgenstein's discussion doesn’t succeed in undermining the platonist position. Then I argue that McDowell's reading exhibits a more serious shortcoming: the position that he ascribes to Wittgenstein is indistinguishable from the platonist account. Then I put forward a proposal as to how to articulate the relationship between Wittgenstein's views and the platonist position. (shrink)

In this article, I argue that the relationship between patients and their health care providers need not be construed as a contract between moral strangers. Contrary to the (American) legal presumption that health care providers are not obligated to assist others in need unless the latter are already contracted patients of record, I submit that the presence of a suffering human being constitutes an immediate moral commandment to try to relieve such suffering. This thesis is developed in reference to the (...) French philosopher Levinas and the Dutch theologian Schillebeeckx. An expanded version of the biblical parable of the Good Samaritan serves as test case. (shrink)

Part of being a good professional is, so we contend, to have ideals. Ideals essentially complement the deontic considerations that are usually taken as the main components of professional moral deliberation. Yet the notion of professional ideals is problematic. As professional ideals they refer to a profession collectively, while as professional ideals they are first of all strong personal commitments of individual professionals. As collective aspirations, professional ideals have a kind of external normative thrust on individual professionals, but people cannot (...) be forced to identify with ideals on demand. Endorsing ideals can only come from within. On the basis of an analysis of ?professional ideals? and ?professional identity?, we conclude that professional ideals are necessary constituents of the personal identity of professionals. This explains the dual character of professional ideals: they are pursued by a collective and constitute the group professional identity but they also need to be endorsed by individual professionals in order to be able to say that the ideals are their own. We end with a short and tentative description of some practical implications for the fostering and education of professional ideals. (shrink)

This paper investigates what the source of time-asymmetry is in thermodynamics, and comments on the question whether a time-symmetric formulation of the Second Law is possible.

Although a low genetic barrier is said to separate humans from apes, Homo sapiens is characterized by striking developmental and anatomical particularities. On the one hand, humans have a very extended life history (retardation). On the other hand, human anatomy shows many instances of both neoteny and hypermorphosis.In 1918, Bolk proposed his ''retardation theory'' that links both aspects of the human condition. We show in this paper that his theory becomes surprisingly powerful when Bolk''s retardation principle is applied to generalized (...) developmental gradients (such as the cephalocaudal gradient that dominates overall ontogeny). In this way, the main particularities of the human body (extended life history; long limbs, and very long legs; very low brachial and crural indices; highly developed pollex and hallux; reduced prognathism; advanced telencephalization etc.) can be reduced to a single developmental matrix. The starting point of the present paper is Bell’s notion of local causality and his own sharpening of it so as to provide for mathematical formalisation. Starting with Norsen’s analysis of this formalisation, it is subjected to a critique that reveals two crucial aspects that have so far not been properly taken into account. These are the correct understanding of the notions of sufficiency, completeness and redundancy involved; and the fact that the apparatus settings and measurement outcomes have very different (...) theoretical roles in the candidate theories under study. Both aspects are not adequately incorporated in the standard formalisation, and we will therefore do so. The upshot of our analysis is a more detailed, sharp and clean mathematical expression of the condition of local causality. A preliminary analysis of the repercussions of our proposal shows that it is able to locate exactly where and how the notions of locality and causality are involved in formalising Bell’s condition of local causality. In this paper, it is argued that the most fruitful approach to developing normative models of argument quality is one that combines the argumentation scheme approach with Bayesian argumentation. Three sample argumentation schemes from the literature are discussed: the argument from sign, the argument from expert opinion, and the appeal to popular opinion. Limitations of the scheme-based treatment of these argument forms are identified and it is shown how a Bayesian perspective may help to overcome these. At the same time, (...) the contributions of the standard scheme-based approach are highlighted, and it is argued that only a combination of the insights of different traditions will yield a complete normative theory of argument quality. Central to the concept of a learning organization is the ability to set up dialogues or conversational inquiries. But the techniques to accomplish this have nowhere in the literature been adequately described. This reduces the concept of a leaming organization to an unattainable ideal. These techniques were for ages, in the form of dialectic, an important instrument for investigation, until they were replaced by the formation of scientific theories. But several fundamental organizational problems cannot be solved by scientific knowledge. On one side of his sign board, a nineteenth century surgeon depicted a physician operating on a patient's leg; the other side showed the Good Samaritan taking care of the victim's wounds. Christ's parable has often been quoted and depicted as a primary example of human compassion, to be followed by all persons and, a fortiori, by so-called professionals such as physicians and nurses. If we grant that the parable has not lost its narrative power for 20th century “postmodern” readers (...) living in a “pluralistic” society, it merits a closer analysis. (shrink)
