This paper examines Judith Shklar’s Legalism in light of the paradox that emerges clearly from a law-based approach to international crises that ought to be evaluated on the basis of whether the judicial initiative—the cases examined are primarily drawn from ad hoc UN Security Council tribunals—promote, in Shklar’s words, “decent politics.” The question of whether this notion is exclusively related to liberalism, and whether it may run contrary to the role of defense counsel in such trials—deeply anchored in the (...) liberal tradition of the protection of individual liberty, and yet confronted to the politics of international criminal law and international relations, however theorized—is fundamental, as “decent politics” compete with the legalistic imperatives of the defense, and the liberal foundation of the legal systems from which UN trials have emerged. Legalism provides a theoretical thread to examine the emergence of international criminal trials as well as the relation between the universality of law and history and the politics of memory, which figure prominently as political phenomena in these trials, but which may run contrary to the liberalism inherent in the legalist form. The concept of a right is fundamental to moral, political, and legal thinking, but much of the use of that concept is selective and fragmentary: it is common merely to appeal to this or that intuitively plausible attribution of rights as needed for purposes of argument. In The Realm of Rights Judith Thomson provides a full-scale, systematic theory of human and social rights, bringing out what in general makes an attribution of a right true.

How should we live? What do we owe to other people? In Goodness and Advice, the eminent philosopher Judith Jarvis Thomson explores how we should go about answering such fundamental questions. In doing so, she makes major advances in moral philosophy, pointing to some deep problems for influential moral theories and describing the structure of a new and much more promising theory. Thomson begins by lamenting the prevalence of the idea that there is an unbridgeable gap between fact and (...) value--that to say something is good, for example, is not to state a fact, but to do something more like expressing an attitude or feeling. She sets out to challenge this view, first by assessing the apparently powerful claims of Consequentialism. Thomson makes the striking argument that this familiar theory must ultimately fail because its basic requirement--that people should act to bring about the "most good"--is meaningless. It rests on an incoherent conception of goodness, and supplies, not mistaken advice, but no advice at all. Thomson then outlines the theory that she thinks we should opt for instead. This theory says that no acts are, simply, good: an act can at most be good in one or another way--as, for example, good for Smith or for Jones. What we ought to do is, most importantly, to avoid injustice; and whether an act is unjust is a function both of the rights of those affected, including the agent, and of how good or bad the act is for them. The book, which originated in the Tanner lectures that Thomson delivered at Princeton University's Center for Human Values in 1999, includes two chapters by Thomson ("Goodness" and "Advice"), provocative comments by four prominent scholars--Martha Nussbaum, Jerome Schneewind, Philip Fisher, and Barbara Herrnstein Smith--and replies by Thomson to those comments. This is the text of The Lindley Lecture for 1976, given by Judith Jarvis Thomson, an American philosopher.

Since 9/11, citizens of all nations have been searching for a democratic public philosophy that provides practical and inspiring answers to the problems of the twenty-first century. Drawing on the wisdom of past and present pragmatist thinkers, Judith M. Green maps a contemporary form of citizenship that emphasizes participation and cooperation and reclaims the critical role of social movements and nongovernmental organizations. Starting with empowering processes of storytelling, truth and reconciliation, and collaborative vision-questing that allow individuals to give voice (...) and new meaning to their loss, anxiety, and hope, Green frames cooperative inquiries to guide transformative actions. From this "second strand" of the democratic experience, leaders and participating citizens can help to shape a more desirable democratic future. In dialogue with Richard Rorty, Judith Butler, James Baldwin, Martin Luther King Jr., Elie Wiesel, Viktor Frankl, Cornel West, and other contemporary thinkers, Green defines the need for deeper understanding and fulfillment of the potentials of the democratic ideal. Drawing insights from Thomas Jefferson, Walt Whitman, William James, John Dewey, Jane Adams, and other earlier thinkers, Green frames a pragmatist understanding of emerging realities and possibilities, growing wells of shared truths, multifaceted histories, and mutually transformative experiences of citizenship. Employing examples from America's complex history and from recent world events, Green locates four sites for effective citizen activism: government at all levels, nonprofit organizations, issue-focused campaigns and social movements, and daily urban living. Green shows how citizens can revive social hope and deepen the democratic experience by drawing on their own knowledge and developing their capabilities through inclusive civic participation. Aristotle offers a conception of the private and its relationship to the public that suggests a remedy to the limitations of liberalism today, according to Judith A. Swanson. In this fresh and lucid interpretation of Aristotle's political philosophy, Swanson challenges the dominant view that he regards the private as a mere precondition to the public. She argues, rather, that for Aristotle private activity develops virtue and is thus essential both to individual freedom and happiness and to the well-being of (...) the political order. Swanson presents an innovative reading of the Politics which revises our understanding of Aristotle's political economy and his views on women and the family, slavery, and the relation between friendship and civic solidarity. She examines the private activities Aristotle considers necessary to a complete human life--maintaining a household, transacting business, sustaining friendships, and philosophizing. Focusing on ways Aristotle's public invests in the private through law, rule, and education, she shows how the public can foster a morally and intellectually virtuous citizenry. In contrast to classical liberal theory, which presents privacy as a shield of rights protecting individuals from one another and from the state, Aristotle, Swanson argues, presents privacy as opportunity or duty to pursue excellence. She concludes that for Aristotle a regime can attain self-sufficiency only by bringing about a dynamic equilibrium between the public and the private. The Public and the Private in Aristotle's Political Philosophy engages both long-standing and contemporary debates surrounding the interpretation of Aristotle. Se revisan los criterios de validez en la investigación cualitativa en ciencias sociales, para identificar algunos elementos que fomenten la apertura de datos, ya que, mientras se plantee como una vía para replicar resultados de investigación, tendrá (...) poco eco en la comunidad que practica la investigación cualitativa. Sin embargo, el artículo muestra que el compartir datos puede fortalecer las estrategias de verificación cualitativa y preservar el conocimiento, las experiencias, las historias y los contextos cotidianos de las personas participantes. High profile breaches of data security in government and other organizations are becoming an increasing concern amongst members of the public. Academic researchers have rarely discussed data security issues as they affect research, and this is especially the case for qualitative social researchers, who are sometimes disinclined to technical solutions. This paper describes 14 guidelines developed to help qualitative researchers improve the security of their digitally-created and stored data. We developed these procedures after the theft of a laptop computer containing (...) highly sensitive data from the home of a fieldworker. This paper introduces the ‘principle of proliferation’: digitally-created and stored files (like voice recordings of interviews and text files of their transcriptions) tend to proliferate during the course of a research project by virtue of fact that they can and are copied and shared as research progresses from data collection through to analysis and archive. Our guidelines were designed as concrete strategies that researchers embarking on a project can employ, particularly researchers working in teams, to accommodate this proliferation and reduce it where possible. This article draws on the results of an inductive qualitative study on the microdynamics of framing corporate community involvement. Insight is provided into these dynamics by using the metaphor of a social movement and drawing on that literature’s framing perspective. Based on accounts of diverse organizational members, we identify several double edges in framing CCI as a strategic issue, and we develop a model that helps to understand why and how strategizing CCI may be controversial.

In this book Richard Foley formulates the problem of the authority of others’ testimony, and of the rationality of one’s own beliefs, in terms of trust. Part 1 discusses the appropriateness of trust in one’s own cognitive faculties and beliefs, while part 2 argues that those assessments provide a basis for trust in others’ beliefs as well as those of one’s earlier and later selves. He does not offer us an analysis of trust or what it is to speak of (...) trust as rational or reasonable. He simply uses the notion to discuss what is surely one form of the problem of the rationality of belief. Rationality, in this book as in his earlier works, The Theory of Epistemic Rationality and Working Without a Net, is understood from a strict internalist and first-person perspective. Assessments of the rationality of opinions, like assessments of decisions, are claims, from a particular perspective, about how effectively the belief or decision promotes a goal or set of goals. With respect to belief and rational belief, the goal is what Foley calls the traditional “epistemic goal” of accurate and comprehensive beliefs. On his view, the perspective from which the assessment is made is the individual’s, taken on reflection. From the start, Foley’s understanding of rationality involves the first-person perspective. Rational belief is belief that will stand up to an individual’s own self-criticism. (shrink)

During the past few years, feminist critics have approached writing by women with an "abiding commitment to discover what, if anything, makes women's writing different from men's" and a tendency to feel that some significant differences do exist.4 The most common answer is that women's experiences differ from men's in profound and regular ways. Critics using this approach find recurrent imagery and distinctive content in writing by women, for example, imagery of confinement and unsentimental descriptions of child care. The other (...) main explanation of female difference posits a "female consciousness" that produces styles and structures innately different from those of the "masculine mind." The argument from experience is plausible but limited in its applications: the argument from a separate consciousness is subject to mystification and circular evidence. In both cases, scholars tend to list a few characteristics of writing by women without connecting or explaining them.· 4. Self-regarding acts are frequently classified as non-moral; even more frequently, they are assumed to have less moral weight than parallel other-regarding acts. I argue briefly against the first claim, and at greater length against the second. Our intuitions about the lesser moral weight of self-regarding acts arise from imperfectly recognized, and morally relevant, differences between acts which are ordinarily described in misleadingly parallel phrases. ‘Love of self,’ for instance, and ‘love of another’ are not symmetrical attitudes, in spite of the (...) symmetrical grammar. More obviously, one cannot steal from, lie to, nor force oneself in the same way one can do these things to others. I conclude, therefore, that difference in moral weight never stems merely from a difference in the person concerned, but rather from differences between the actions themselves; furthermore, that whatever it is wrong to do to a willing other, it is wrong to do to oneself. The paper presents a set of games of competition between two or three players in which reward is jointly determined by a stochastic biased mechanism and players’ choices. More specifically, a resource can be found with unequal probabilities in one of two locations. The first agent is rewarded only if it finds the resource and avoids being found by the next agent in line; the latter is rewarded only if it finds the former. Five benchmarks, based on different psychological and (...) game-theoretic assumptions are derived and their predictions compared to actual behavior of 120, 40, and 48 participants playing repeatedly. Of the five benchmarks—the unique (Nash) equilibrium, reinforcement learning, trust-based efficiency, maximum unpredictability, and regret-based (Impulse Balance) equilibrium—regret for missed opportunities best accounts for the qualitative aspect of participants’ behavior and regret attenuated by randomization best accounts for the quantitative aspect of behavior. This article attempts to establish and examine the context of the two remaining mythological paintings in the Macellum, the central market of Pompeii. Panels of Io and Argos and of Penelope and Odysseus grace the interior walls, and while the identification of the Penelope figure has been the subject of debate, she clearly derives from Greek prototypes of Penelope, both material and theatrical. Indeed, scholars suggest that the Io panel and perhaps the Penelope painting as well are copies of Greek (...) panel paintings created by a fourth-century B.C. artist, but it is argued here that their pairing seems to be a Roman creation and that they were part of a larger narrative program. The paintings are compositional opposites and share the narrative technique of depicting moments of quiet tension; this choice of narrative moment is one that began in the Greek world; particularly during the Hellenistic period, and was developed and enhanced by the Romans. Moreover, this interest in creating tension for the spectator, and in the relationship between viewer and image, is also demonstrated by the inclusion of a spectator figure in the Penelope painting. Although the other paintings do not survive, their subjects are known from a nineteenth-century drawing and from nineteenth-century descriptions, and these too share the same narrative technique. If the lost paintings are copies of Greek originals, then the Macellum may have served as a picture gallery for Pompeii's inhabitants. A careful reading of the Macellum paintings of Greek myths, their juxtaposition and relationship to each other, and their reception in Roman literature and society reveals that the paintings were arranged as a program, a moralizing ensemble, designed to instruct the viewer on the proper behavior of Roman matrons. The impetus to revisit the issues involved in readings of Genesis 2-3 came from Deborah Rooke’s article in Feminist Theology published in 2007, and in particular follows a presentation at an ‘Afternoon of Theology’ at a girls’ secondary school, where the author provided a response to the challenge set by the history of interpretation and the subsequent cultural assumptions of the meaning of the Garden of Eden narrative. RESUMEN El presente texto expone los resultados de un estudio prospectivo, del tipo de intervención comunitaria aplicado en la Clínica Estomatológica Docente La Vigía, provincia Camagüey, con el objetivo de instrumentar una estrategia educativa en pacientes con bruxismo y disfunción temporomandibular en el período de enero de 2017 a enero de 2018. Se diseñó y aplicó una estrategia educativa según la metodología utilizada por la Maestría Nacional de Educación para la salud. Predominó el sexo femenino y las edades comprendidas entre (...) los 24 y 29 años, así como el nivel escolar universitario. Al finalizar la intervención, el nivel de conocimientos fue evaluado de bueno en casi todos los pacientes, la apertura bucal limitada, el dolor muscular y articular aparecieron en menos de la mitad de los individuos; el nivel de satisfacción respecto a la intervención fue alto. Se concluyó que la estrategia generó un impacto positivo en los pacientes estudiados. ABSTRACT The present text exhibits the results of a pilot study, of the type of community intervention applied in the Dentistry University Clinic La Vigía, Camagüey province, with the objective to arrange an educational strategy in patients with bruxism and temporomandibular dysfunction in the period from January, 2017 until January, 2018. It was designed and applied an educational strategy as the methodology used by the National Mastery of Education for the health. It predominated over the feminine sex and the ages understood between 24 and 29 years, as well as over the university school level. On having finished the intervention, the knowledge level was evaluated of good in almost all the patients, the limited mouth opening, the muscular pain and to articulate appeared in less than half of the individuals; the satisfaction level with regard to the intervention was high. It was concluded that the strategy generated a positive impact in the studied patients. (shrink)
