In this paper, I highlight an interesting difference between belief on the one hand, and suspended judgment and credence on the other hand. This difference is the following: credences and suspended judgments are suitable to serve as transitional as well as terminal attitudes in our reasoning, whereas beliefs are only appropriate as terminal attitudes. The notion of a transitional attitude is not an established one in the literature, but I argue that introducing it helps us better understand the different roles (...) suspended judgments and credences can play in our reasoning. Transitional and terminal attitudes have interestingly different descriptive and normative properties. I also compare my account of transitional attitudes to other inquiry-guiding attitudes that have recently been characterized in the literature and explain why they are different. (shrink)

Epistemic permissivism is the view that it is possible for two people to rationally hold incompatible attitudes toward some proposition on the basis of one body of evidence. In this paper, I defend a particular version of permissivism – unacknowledged permissivism (UP) – which says that permissivism is true, but that no one can ever rationally believe that she is in a permissive case. I show that counter to what virtually all authors who have discussed UP claim, UP is an (...) attractive view: it is compatible with the intuitive motivations for permissivism and avoids a significant challenge to permissivism: the arbitrariness objection. There is long standing agreement both among philosophers and linguists that the term ‘counterfactual conditional’ is misleading if not a misnomer. Speakers of both non-past subjunctive (or ‘would’) conditionals and past subjunctive (or ‘would have’) conditionals need not convey counterfactuality. The relationship between the conditionals in question and the counterfactuality of their antecedents is thus not one of presupposing. It is one of conversationally implicating. This paper provides a thorough examination of the arguments against the presupposition view as applied to (...) past subjunctive conditionals and finds none of them conclusive. All the relevant linguistic data, it is shown, are compatible with the assumption that past subjunctive conditionals presuppose the falsity of their antecedents. This finding is not only interesting on its own. It is of vital importance both to whether we should consider antecedent counterfactuality to be part of the conventional meaning of the conditionals in question and to whether there is a deep difference between indicative and subjective conditionals. Abstract:Open neural tube defects or myelomeningoceles are a common congenital condition caused by failure of closure of the neural tube early in gestation, leading to a number of neurologic sequelae including paralysis, hindbrain herniation, hydrocephalus and neurogenic bowel and bladder dysfunction. Traditionally, the condition was treated by closure of the defect postnatally but a recently completed randomized controlled trial of prenatal versus postnatal closure demonstrated improved neurologic outcomes in the prenatal closure group. Fetal surgery, or more precisely maternal-fetal surgery, raises (...) a number of ethical issues that we address including who the patient is, informed consent, surgical innovation and equipoise as well maternal assumption of risk. As the procedure becomes more widely adopted into practice, we suggest close monitoring of new fetal surgery centers, in order to ensure that the positive results of the trial are maintained without increased risk to both the mother and fetus. This volume launches a new series of contemporary conversations about scientific classification. Most philosophical conversations about kinds have focused centrally or solely on natural kinds, that is, kinds whose existence is not dependent on the scientific process of synthesis. This volume refocuses conversations about classification on unnatural, or synthetic, kinds via extensive study of three paradigm cases of unnatural kinds: nanomaterials, stem cells, and synthetic biology.

Kentucky and West Virginia are among the states most severely affected by opioid poisonings and deaths. The legislatures of both states have enacted a broad range of bills intended to address related issues. We present an overview of legislation enacted in 2017 and 2018, along with an approach to analysis of practitioner response to one type of legislation.

The defeat of the Constitutional Treaty by French and Dutch voters in 2005 and the following stalemate of the Lisbon Treaty have sparked a soul-searching process for European constitutional scholarship. Among the numerous academic efforts devoted to contemplating the future of European constitution, Michelle Everson and Julia Eisner's The Making of a European Constitution: Judges and Law Beyond Constitutive Power deserves a close look. Everson and Eisner argue for a postconstituent view of European constitutionalization, which they call ‘Rechtsverfassungsrecht’. Departing (...) from the myth of the constituent power, they interpret the development of a European constitution as a self-creating process by which the ordinary legal system gives itself a set of core values and thereby remakes itself into a constitutional order. Moreover, against the criticisms of juridification, they defend this lawyer-centred process of European constitutionalization as incorporating politics into the daily operation of the legal system. Engaging with Everson and Eisner's argumentation, I argue that their account of European constitutional development does not so much put out a realist theory of the EU constitutionalization as sets out a realist academic lawyering for the next round of European constitutional politics, which is shared among European constitutional scholars. Contrasting this community-based legal profession in Europe with the situation of epistemic pluralism in American jurisprudence, in this article I observe that a lawyer-centred European constitutional theory as Everson and Eisner's book illustrates is premised on an inherited consensus that has held a European legal profession together. However, this lawyer-centred account of European constitutionalization presumes either the projection of a professional community onto a Europe-wide civic culture or the self-appointment of legal professionals as the fiduciary of the citizenry. Each is a fiction, however. This fictional character of the legalist-constructivist strategy to European constitutional politics is the underlying cause of the dilemma facing European constitutional ordering. (shrink)

Depending on the research project, the subject of study, and other factors, data can comprise a variety of different types, including full texts, images, audio, video, and bibliographic metadata. Publications and project reports generally describe their results and the methods and algorithms employed, but few discuss the challenges of the initial data collection process or how it fits into the overall research data life cycle. This art-science-interaction article focuses on moral implications of a recent science announcement. Against the background of literary and cultural theories, it compares a YouTube story with narratives employed in fictional stories.

Despite the fact that US presidential candidates commonly position themselves as Washington outsiders, this broadly populist positioning has thus far been significantly undertheorized. On the one hand, scholars of political representation have explored how politicians connect with political audiences; on the other, populism research has focused on the construction, mainstreaming and appeal of populist performances. A detailed theorization of the paradoxical performative operation by which self-styled political outsiders come to be more effective in connecting with political audiences than accomplished politicians (...) has yet to be undertaken. This article explores the performativity of outsider positioning, paying particular attention to its effect on perceptions of legitimacy. The article investigates legitimacy as a complex and paradoxical performative phenomenon that involves multiple competing sources of agency. The case is made that, by discouraging the perception of the political system as a unified whole, populist-style performances by mainstream politicians undermine institutional legitimacy. In a way that is at odds at odds with the cooperative demands inherent in the US federal government, these performances encourage the perception that the self-styled outsider is engaged in a strictly competitive zero-sum game with the institutional structure and its representatives. Policy-makers involved in cybersecurity governance should pay close attention to the ‘generative metaphors’ they use to describe and understand new technologies. Generative metaphors structure our understanding of policy problems by imposing mental models of both the problem and possible solutions. As a result, they can also constrain ethical reasoning about new technologies, by uncritically carrying over assumptions about moral roles and obligations from an existing domain. The discussion of global governance of cybersecurity problems has to date been dominated by the (...) metaphor of ‘cyber war’. In this paper, I argue that this metaphor diminishes possibilities for international collaboration in this area by limiting states to reactive policies of naming and shaming rather than proactive actions to address systemic features of cyberspace. We suggest that alternative metaphors—such as health, ecosystem, and architecture—can help expose the dominance of the war metaphor and provide a more collaborative and conceptually accurate frame for negotiations. This essay argues that the logical significance of most natural language expressions is indefinitely elastic. This, it is argued, undermines the idea that the meaning of a word is an item for which it stands, and puts pressure on the methods of conceptual analysis and theoretical elucidation that require context-invariant stable application conditions. Furthermore, it is argued that the insistence that such semantic content is needed which—impervious to local pragmatic concerns—remains stable and available for reasoning, gets things back to front. (...) For in order to determine the correct inflection of any given use of an expression, its inferential relations—in the context of an utterance—must already be discerned. The lack of contextually independent content, however, presents no mystery about language use. For the ability to understand what is said is explained not only by shared practices and common interests, but also by the capacity for interlocutors to ask questions and explain what they mean. In the Stoics we find a combination of two perspectives which are commonly thought to conflict: the embedded perspective from within one's social context, and the universal perspective of the member of the moral community of rational beings. I argue that the Stoics do have a unified theory, one which avoids problems that trouble some modern theories which try to unite these perspectives.

Gottfried Wilhelm Leibniz (1646-1716) was a true polymath: he made substantial contributions to a host of different fields. Within the philosophy of mind, his chief innovations include his rejection of the Cartesian doctrines that all mental states are conscious and that non-human animals lack souls as well as sensation.

This paper traces back on a personal tone a provocative evocation of Jean-Paul Sartre and Simone de Beauvoir. The author considers existentialism as a laboratory of existence that influenced a generation's manner of living and writing and made one's existential desires into historical and political acts. Its most representative mode of expression, literature, was as an indicator of the presence of the private throughout the public world and time. Philip Kitcher’s account of scientific realism in 'The Advancement of Science' (AS) differs from his account in 'Science, Truth and Democracy' (STD). We demonstrate that (1) contrary to appearance, Kitcher in AS proposes a so-called Kantian realism that is accompanied not by a correspondence theory, but by a hybrid conception of truth. (2) Also, we point out that Kitcher does not pertain to the “promiscuous realism” proposed in STD stringently, but falls back on his Kantian realism of AS at points. (...) Bioethics has evolved from a non-institutional, ideal, and ahistorical model toward a more political, institutional, and historically anchored one. This change is healthy and has, in part, been a product of the devastating consequences of globalization. I illustrate the distinct moments in the evolution of bioethics with an analysis of three discussions within the discipline: the debate on autonomy and the right to health and some of the issues raised by biotechnology, especially by the patenting of genetic material.

This volume contains papers by a group of leading experts on Aristotle and the later Aristotelian tradition of Neoplatonism. The discussion ranges from Aristotle's treatment of Parmenides, the most important pre-Socratic Greek philosopher, to Neoplatonic and medieval use of Aristotle, for which Aristotle himself set guidelines in his discussions of his predecessors. Traces of these guidelines can be seen in the work of Plotinus, and that of the later Greek commentators on Aristotle. The study of these commentators, and the recognition (...) of the philosophical interest and importance of the ideas which they expressed in their commentaries, is an exciting new development in ancient philosophy to which this book makes a unique and distinguished contribution. The long section on knowledge and the philosopher in books V–VII of the Republic is undoubtedly the most famous passage in Plato's work. So it is perhaps a good idea to begin by stressing how very peculiar, and in many ways elusive, it is. It is exciting, and stimulating, but extremely hard to understand.

Solidarität wird in Krisenzeiten sowie bei Ungerechtigkeit und Marginalisierung gefordert. Sie tritt dabei in unterschiedlichen Reichweiten und Akteurskonstellationen auf und basiert auf verschiedenen Motiven und Ausgangslagen. Julia Masurkewitz-Möller nimmt sich dieser Vielfalt an und erarbeitet eine Systematisierung der Solidarität, die Ordnung in den begrifflichen Dschungel des Konzepts bringt. Sie zeigt, dass verschiedene Solidaritätsformen trotz ihrer Unterschiede einen gemeinsamen Kern und eine Beziehung zueinander haben - und damit die Transformationen von Solidaritätsformen möglich machen.

The book's methodology is set out: we must be critically aware of the theoretical assumptions we bring to the study of ancient ethics, or we risk importing anachronism. The limits of the ancient evidence should also be respected. We must also be aware of the structures of modern ethical theories and prepared to find that ancient theories differ. The ancient traditions and their major sources are listed: Aristotle, Stoics, Sceptics, Cyrenaics, Epicurus and hybrid theories.

One of the assumptions that impregnate academic discourse, even that of social scientists committed to the re-incorporation of their disciplines, is its extra-corporeal character. This article analyzes the scholastic construction of producing and perceiving oral, written or silent discourses as non-corporeal acts. First, it argues that there is a certain continuity between monastic rituals that build the spirit as something different from and higher than the body and academic rituals that train people to place the source of discourse in the (...) mind. Second, it explores how the separation of discourse from the discourse-producing body is currently built and reproduced through participation in university and academic rituals. It holds that such participation installs in the bodies of academics an identification with the habit of producing discourses. Finally, it suggests that the fact that attempts to re-incorporate body to social life are performed by academics who have been trained in disembodying their discourses conditions the results of such attempts.
