Sharing on social media has become a daily routine for millions of users worldwide. Sharing transforms the experience of international migration as it enables migrants to maintain social relations and adapt to a new socioeconomic environment. But what does the term “sharing” mean for migrants active on Facebook? What are the contemporary meanings of sharing encouraged by Facebook’s affordances? This paper explores individual sharing strategies on Facebook among Polish migrants in Germany and the UK. On the basis of the material (...) collected through in-depth interviews (N=17) with Poles who have settled in Germany and the UK, it is proposed that the contemporary meaning of sharing has five dimensions: commercial, altruistic, social, connective and addictive. Different compositions of these dimensions can be found in most sharing practices on social media. Following a critique of commercial sharing on social media, it is further established that selling and other profit-driven activities are rather well recognized by the interviewees. However, some of them engage in commercial sharing with no direct selling intention. The article emphasizes that sharing practices help Polish migrants adapt to their bicultural reality in Germany and the UK. (shrink)

We examine how social diversity and inclusiveness on corporate boards affect corporate performance and monitoring in Sri Lanka, a country subject to decades of polarization, civil war, and even genocide. Barely more than a decade after the civil war, we find that board social diversity on the basis of ethnicity, religion, language, gender, and nationality of the board members is positively related to corporate performance, both in terms of stock market performance and accounting returns, and to corporate financial stability. The (...) main positive effects of social diversity derive from ethno-linguistic inclusiveness. The results are confirmed by an instrumental variable approach that addresses endogeneity issues. One of the distinguishing features of Alasdair MacIntyre’s political theorising is his trenchant critique of the modern state. The article aims to explore the underlying reasons behind MacIntyre’s antistatism. Beginning with MacIntyre’s critique of the traditional arguments justifying political obligation, it then proceeds to the crucial issue of politics of common good. The author argues that MacIntyre rejects the modern state as an instrument of politics of common good mainly for two main reasons: 1) the close partnership between the modern (...) state and capitalism; 2) the bureaucratic and often unjustly coercive character of the modern state. Wojciechowskiego był oryginalny, szczególnie gdy weźmie się pod uwagę kontekst historyczny. Whether or not we call a love-like relationship with robots true love, some people may feel and claim that, for them, it is a sufficient substitute for love relationship. The love relationship between humans has a special place in our social life. On the grounds of both morality and law, our significant other can expect special treatment. It is understandable that, precisely because of this kind of relationship, we save our significant other instead of others or will not testify against (...) her/him. How as a society should we treat love-like relationships humans with robots? Based on the assumption that robots do not have an inner life and are not moral patients, I defend the thesis that this kind of relationship should be protected by criminal law. (shrink)

Robots are becoming more visible parts of our life, a situation which prompts questions about their place in our society. One group of issues that is widely discussed is connected with robots’ moral and legal status as well as their potential rights. The question of granting robots rights is polarizing. Some positions accept the possibility of granting them human rights whereas others reject the notion that robots can be considered potential rights holders. In this paper, I claim that robots will (...) never have all human rights, even if we accept that they are morally equal to humans. I focus on the role of embodiment in the content of the law. I claim that even relatively small differences in the ontologies of entities could lead to the need to create new sets of rights. I use the example of Neanderthals to illustrate that entities similar to us might have required different legal statuses. Then, I discuss the potential legal status of human-like robots. (shrink)

The debate on alternative punishments appears to be stagnating. The impasse may be overcome if we consider humans from a different philosophical perspective. If we answer differently the question of who we are punishing, we open new possibilities regarding the question of how we punish. In particular, by applying the extended mind thesis we can arrive at interesting outcomes and reopen the debate on alternative punishments. According to this theory, external artifacts—such as smartphones—can be considered part of our minds. In (...) this article, I defend the thesis that restricting access to personal technologies that are a part of one's self should be considered a form of punishment. Thus, a human who is considered from an extended perspective can be punished in a new way. (shrink)

Ponadto Profesor analizuje proces narastania prądów dysydenckich wśród zwolenników marksizmu po Październiku ’56 i wyjaśnia ostateczny rozkład post-stalinowskiej ortodoksji w polskim życiu intelektualnym tego okresu. Jak również dowodzi, że choć Marks stanowi ważny i wciąż warty badania rozdział w historii filozofii europejskiej, to marksizm, z uwagi na zawarty w nim koncept „radykalnej wspólnoty”, jest ideologią z gruntu utopijną. Artykuł ten stanowi omówienie koncepcji szczęścia, którą można wywieść z pism św. Augustyna z Hippony. Autor podejmuje się systematycznej rekonstrukcji poglądów tego myśliciela, argumentując na rzecz tego, iż dokonanie jej jest możliwe, i twierdząc, iż pewne podstawowe wątki w jego myśli pozostały takie same w ciągu całej jego działalności intelektualnej. Są nimi przede wszystkim: twierdzenie, iż dążenie człowieka do osiągnięcia szczęścia jest dla niego naturalne; twierdzenie, że istotą szczęścia jest osiągnięcie Boga; oraz twierdzenie, że droga do owego szczęścia wiedzie przez (...) zyskiwanie przez człowieka mądrości. Autor przedstawia również główną zmianę w Augustyńskiej wizji szczęścia, którą stanowi „przeniesienie” możliwości jego osiągnięcia z życia obecnego na przyszłe. (shrink)

Artykuł ten stanowi próbę omówienia wpływu, jaki poglądy Williama Ockhama wywarły na przejście od średniowiecznego do nowożytnego rozumienia celowości świata natury. Rozważeniu poddaje się sposób, w jaki do idei celowości świata natury odnosili się wybrani autorzy nowożytni. Krytyce poddaje się „tradycyjną” interpretację przejścia, jakie dokonać miało się w tym aspekcie między średniowieczem a nowożytnością, podług której nowożytność miała przynieść całkowity kres posługiwaniu się celowością w filozofii natury, zastępując ją odwołaniami do przyczynowości sprawczej. Następnie wskazuje się na nowsze, bardziej subtelne próby (...) podejścia do tego zagadnienia, wskazujące na to, iż w filozofii nowożytnej mamy raczej do czynienia z reinterpretacją, a nie porzuceniem idei przyczynowości celowej. W związku z tym autor artykułu proponuje wyróżnienie w obrębie owej filozofii dwóch głównych nurtów. Dalszą część stanowi analiza koncepcji Ockhama, polegająca na wskazaniu w niej tych wątków, które – jak się twierdzi – mogły wywrzeć szczególny wpływ na narodziny nowożytnego rozumienia celowości świata natury. Autor wymienia cztery takie wątki, próbując je powiązać z wyróżnionymi wcześniej dwoma nurtami nowożytnego rozumienia teleologii natury. (shrink)

In the nineteenth century, the French utopian socialists, Saint-Simonians and Fourierists, developed different concepts of the colonisation of Africa. These concepts collided in Algeria. The Saint-Simonians were impressed by the Arab system of the tribal ownership of land. They wanted to preserve it and ultimately bring the two peoples, the Arabs and the French, together in the spirit of a commune. On the other hand, the Fourierists wanted to expropriate Arabs from their land and hand it over to the French (...) colonists so that they could build new economic communities of a phalanstery type. This article presents the theoretical disputes between the two schools and also describes the actual practical consequences of these disputes for the French colonial politics. (shrink)

The notion of Attention Deficit Hyperactivity Disorder (ADHD) may have its origins in 1763, when Scottish physician Sir Arthur Crichton observed people who could be easily distracted to a degree approaching the nature of delirium. Since then, the notion of ADHD matured and aroused controversy concerning whether it is a real illness and the motives behind particular methods of its treatments. Despite the controversy, ADHD is well established as a research subject and a frequently diagnosed disorder. Thus, the aim of (...) this paper is not to deal with controversies but rather to show the evolution of methods used for the detection of this disorder. Literature analysis revealed that those methods varied from classical psychological tests/questionnaires to analyses of: eye-motion, micro-motion, brain activity, and behavioral patterns in virtual reality. The main conclusion is that the above methods tend to be heavily computer-aided and that the future belongs to mobile solutions incorporated into complex e-health systems. (shrink)

The law of responsibility (compensation), which was formed around the concept of the ḍamān and was developed by the scholars within the system of furû‘ al-fiqh (substantive law) over time, constitutes one of the important parts of Islamic law. Although compensation law (ḍamān) was not addressed as a private subject in the first period fiqh literature, it is seen that the literature on this specific area started to emerge after the early period. It is the Hanafi jurists who first brought (...) together these issues that are scattered in the classical books of fiqh that are related to the law of responsibility. Compensation law took its classical form in the texts of the early periods and was shaped around the views of the founding imams of the Ḥanafī school (madhab). It has later been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Hanafi in the type of waqi'at works. These works were a product of the need for the law to adapt to the new conditions. These issues, which are related to the compensation law in the Hanafi school have been covered as a special section (chapter) in the studies that are classified as waqi'at, such as Usrūshanī’s al-Fuṣūl fī al-muʿāmalat (Fuṣūl al-Usrūshanī), ʿImād al-Dīn al-Marginānī’s Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn’s Jāmiʿal-Fuṣūlāyn. Later, the topics discussed in these works were developed and continued, and ultimately separate works related to this field have been copyrighted. In this study, the kinds of development and expansion which are in the literature and related subjects will be discussed by examining the above-mentioned works. Therefore; first of all, the first examples of Hanafi jurists related the compensation will be analysed comparatively. Afterwards, the place of ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah of Fuḍayl Chalābī (d. 991/1583), one of the Zenbillizade’s, will be addressed.Summary: The core idea of the law of responsibility, which constitutes one of the important parts of Islamic law, was stated in the Qur'an and Hadith, and then have accumulated by the contributions of the jurists (fuqaha), as they developed the idea of the law of responsibility within the furû‘ al-fiqh in relation to the systematic of the legal school (madhab) that they belonged to.These issues, which constitute one of the important parts of the law, were addressed by sprinkling among the topics in almost every part of classical fiqh books. In other words, the subject of ḍamān (responsibility) was not considered as a separate subject in the fiqh works of the first period. In this way, it is seen that the literature on compensation law started to emerge in the following periods, and at first several independent sections on this subject, and then separate works specific to this field, albeit limited in number, were written.It is the Ḥanafī jurists who first brought together these issues that are scattered in the classical fiqh books related to the law of responsibility. Compensation law, which took its classical form in the texts from early periods, shaped around the views of the pioneering imams of the Ḥanafī school, has been expanded with the fatwā and interpretations of the Sheikhs (mesāikh) of Ḥanafī in the waqi'at works, which is a product of the need for the law to adapt to new conditions. Firstly, one of the Ḥanafī jurists, Majd al-Dīn al-Usrūshanī (d. 637/1240) dealt with the responsibilities arising from the contract and unfair acts in the 29th section of his book named al-Fuṣūl fī al-muʿāmalat under the title “Types of Compensation Required to be Paid and Their Situation”. The method and system that Usrūshanī started in this work, the Ḥanafī jurisits ʿImād al-Dīn al-Marginānī in the Fuṣūl al-iḥkām fī uṣūl al-aḥkām and Shaykh Badr al-Dīn Ibn Qāḍī Samāwnā in the Jāmiʿ al-Fuṣūlāyn continued to develop the compensation section in their books. Afterwards Fuḍayl Chalābī (d. 991/1583), one of the members of Zenbillizade’s family, enriched these issues and made it an individual work, named ad-Ḍamānāt fī al-furūʻ al-Ḥanafīyyah. Marginānī titled the issues that Usrūshanī had handled in the compensation section and systemised it even more by gathering the fatwās on the related issues under one heading. It is noteworthy to mention that when the compensation sections of both works are compared, the way the subjects handled are exactly the same. But unlike Usrūshanī, Marginānī added the compensation for damages to the fetus in the womb and the responsibility of the person who brought back the fleeing slave at the end of the chapter. On the other hand, unlike them, Shaykh Badr al-Dīn added only the responsibility of the person who found the lost item. Considering that almost all of the topics in the compensation section of Sheikh Badr al-Dīn existed exactly in the compensation section of Marginānī, and that most of them were stated in Usrūshanī’s al-Fuṣūl, it is necessary to say that all of these discussions are based on Usrūshanī as the main backbone of this particular subject and that his work has a unique place in the Islamic legal literature. Chalābī’s ad-Ḍamānāt, is the first work that was written as a separate book in the field of compensation law. Even though in some modern works claim that the work Ghānim al-Baghdādī’s (d. 1030/1620) book named Majma‘ al-ḍamānāt fī madhhab al-Imām al-A'zam Abī Ḥanīfa al-Nu'mān was the first written book in this field; it is known that Chalābī's ad-Ḍamānāt had been written before Baghdādī’s Majma‘ al-ḍamānāt. As a matter of fact, the work of Chalābī had been completed in 984 Hijra, and the Baghdādī’s Majma‘ al-ḍamānāt was completed in 1027 Hijra. Although the subject sequence in Baghdādī’s work is different; this work is regarded as a continuation of the same tradition.An examination of the systematic and the content of the work reveals that Chalabi’s ad-Ḍamānāt is the continuation of the type of writing that Usrūshanī started and developed by Marginānī and Shaykh Badr al-Dīn. When compared with the compensation sections of these works before him, Chalābī has added new compensation issues to his book that are not addressed in these three works; such as partnership, mudaraba, suretyship (kafāla) transfer (ḥawāla), peace, legal disability (hajr), freedom of trade (idhn) and testament. Among the works mentioned above, works out of Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn and Baghdādī’s Majma‘ al-ḍamānāt are available as manuscripts in the libraries. Therefore, these works have not been used much in modern studies on compensation. In addition, the Chalābī's ad-Ḍamānāt is almost unknown. Although there is little information about this work in some bibliographic studies, it is noteworthy to state that this work is not used as a source in contemporary studies written in Arabic on compensation law. The fact that this work is available as manuscripts in Istanbul libraries is probably the reason for this outcome. It is also very difficult to say that this work is known and used sufficiently in studies written in Turkish.Usrūshanī’s al-Fuṣūl fī al-muʿāmalat and Marginānī’s Fuṣūl al-iḥkām are currently in the form of manuscripts, so there is no comprehensive study on the whole work and the compensation section. It is possible to see the compensation issues discussed in the work, since Shaykh Badr al-Dīn’s Jāmiʿ al-Fuṣūlāyn, which has been published as printed, was translated into Turkish by an editorial group under the presidency of H. Yunus Apaydın. In addition, Kemal Yıldız, who translated the compensation section in this translation, published this section in Jāmiʿal-Fuṣūlāyn as a separate book with the name of “Sources of the Jāmiʿ al-Fuṣūlāyn and Compensation in the Practice of Ḥanafī School”. Yıldız, first introduced the sources of the Jāmiʿ al-Fuṣūlāyn in the first part of this work and then translated the compensation section from beginning to end by adding his own explanations and evaluations around the subject during the second part. Even though some introductory information about the books of Usrūshanī and Marginānī is presented in Yıldız’s study, the absence of information on the contents of the compensation sections of these books does not allow the opportunity for the researchers to evaluate on the subject wholly. The recent developments in applications of artificial intelligence bring back discussion about risks posed by AI. Among immediate risks that need to be tackled here and now, there is also a possible problem of existential threats related to Artificial General Intelligence (AGI). There is a discussion on how to mitigate those risks by appropriate regulations. It seems that one commonly accepted assumption is that the problem is global, and thus, it needs to be tackled first of all on an international (...) level. In this paper, I argue that national criminal laws should also be considered one of the possible regulatory tools for mitigating threats posed by AGI. I propose to enact AGI crimes that complement the varieties of legal responses to existential risks that might motivate and speed up further regulatory changes. (shrink)

Uncontrolled access to information on the Internet has many advantages, but it also leads to the phenomenon of fake news. Fake news is dangerous in many spheres, including that of health. For example, we are facing an increase in the amount of vaccine hesitancy. This has been w considered by the World Health Organization in 2019 as one of the greatest threats to public health. This specific phenomenon is linked with the spread of information on the Internet around that issue. (...) In this paper, I discuss a proposition of new crime, which has the aim of fighting medical fake news by stopping its spread. This proposition should be considered only if other non-criminal measures are inefficient. The present study is the first to measure event-related potentials associated with the processing of the emotional Stroop task (EST) with the use of an orthogonal factorial manipulation for emotional valence, arousal, and subjective significance (the importance of the current experience for goals and plans for the future). The current study aimed to investigate concurrently the role of the three dimensions describing the emotion-laden words for interference control measured in the classical version of the EST paradigm. The results showed that (...) reaction times were affected by the emotional valence of presented words and the interactive effect of valence and arousal. The expected emotional arousal effect was only found in behavioral results for neutrally valenced words. Electrophysiological results showed valence and subjective significance correlated with the amplitude differences in the P2 component. Moreover, the amplitude of the N450 component varied with the level of subjective significance. This study also demonstrated that exploratory event-related potential analysis provides additional information beyond the classical component-based analysis. The obtained results show that cognitive control effects in the EST may be altered by manipulation in the subjective significance dimension. (shrink)

At Protagoras 353de, Socrates gives three possible reasons for calling some pleasures `wrong'. Scholarly attention has focused on the second of these, according to which pleasures are `wrong' when they have negative consequences. This paper argues that the first reason (the pleasures are fleeting) corresponds to beliefs held by Democritus, among others; and that the third reason (the pleasant things “give pleasure in whatever way and for whatever reason“) is the view adopted by Socrates in the dialogue.

Ḥanafī scholars resorted to various methods such as abrogation (naskh), specification (takhṣīṣ), preference, (tarjīh) interpretation (taʾwīl) in order to eliminate the incompatibility between the views of the founding authorities of the madhab (ashāb) and the nass (verses and hadiths). According to the famous narration attributed to Abu’l-Hasan al-Karkhī (d. 340/952), one of the Iraqī Ḥanafī scholars, it is thought that the nass contradicting the views of the madhhab scholars are abrogated, or that other evidence is preferred over them, but it (...) is more appropriate to reconcile and interpret them. However, this approach adopted by the Hanafīs has brought some criticism and accusations that the views of the madhab scholars are prioritized over the nass or that these were ignored in the face of their views. On the other hand, the discourse that the views of the madhab scholars should be preferred in case of incompatibility between the views of theirs and the nass, seems problematic and in need of explanation at first glance. Due to the reason mentioned, these statements, which reveal the general attitude of Ḥanafīs, need to be explained theoretically. In this study, firstly, the Hanafīs’ justifications for adopting this approach are discussed, and then it is seen that this does not mean “the nass is ignored or the views of the jurists are prioritized” as it is claimed.
