According to Roderick Chisholm, there are three ways of responding to the Problem of the Criterion and they all leave something to be desired. Michael DePaul, Paul Moser, and Earl Conee have each proposed variations of a fourth way of responding to this problem that rely on reflective equilibrium. We argue that these four options for responding to the Problem of the Criterion leave one with a tough choice: accept one of the three that Chisholm describes or DePaul’s reflective equilibrium (...) approach and beg the question or accept a reflective equilibrium response of the sort Conee and Moser propose and embrace epistemic circularity. This article proposes to elucidate Wilfrid Waluchow’s notion of constitutional morality by explaining how it relates to the classical common law idea of artificial reason. It examines how Waluchow’s effort to reconcile insights from the thought of H.L.A. Hart and Ronald Dworkin through the idea of constitutional morality is both reminiscent of the artificial reason of the common law and distinct from it. It shows that constitutional morality evokes the subtle union of custom and reason found in artificial reason, but (...) also that it proposes, under the influence of Hart’s notion of rule of recognition, a narrower understanding of law’s foundation in established practices, and that it gives, consistent with Dworkin’s vision of law as integrity, a greater theoretical scope to law’s rationality. Husserl seems to have devoted roughly equal amounts of energy and pages to the description of perception, judgement, and imagination. By “description,” he meant the analysis of the traits and components of mental states or acts and their objects. As his views changed over the years about the nature of intentionality and philosophy, the descriptive psychology of the Logical Investigations (1900/01) gave way to descriptive programmes in which the objects of perception and of judgement were conceived of in terms of (...) a new, analytic framework; in particular Husserl lost interest in describing the things and processes in the real world that are the objects of perception and judgement and so too in describing their relations to these acts. His new analytic framework, particularly as it applies to perception, has been thoroughly expounded and discussed in the literature. My aim here is to expound Husserl's first descriptions of perception within the framework of the Investigations and to incorporate as far as possible his later descriptive results to the extent that these are separable from his later turn to idealism. Contemporary political philosophers disagree about whether theories of justice should be utopian or realistic. Contributors to this volume largely deny that the choice between realism and idealism is binary. Their contributions represent a continuum between realism and idealism that best represents the contemporary state of the debate.

. The potential for financial conflicts of interest to influence scientific research has become a significant concern. Some commentators have suggested that the development of standardized study protocols could help to alleviate these problems. This paper identifies two problems with this solution: scientific research incorporates numerous methodological judgments that cannot be constrained by standardized protocols; and standardization can hide significant value judgments. These problems arise because of four weaknesses of standardized guidelines: incompleteness, limited applicability, selective ignorance, and ossification. Therefore, the (...) standardization of study designs should not serve as an alternative to addressing the interests and power relations that pervade science policy-making. Policy makers should take at least two steps to prevent powerful interest groups from co-opting standardized guidelines. First, their development and review should be made as transparent as possible and should be subjected to broadly-based deliberation. Second, standardized guidelines should be supplemented with efforts to scrutinize the conditions under which financial COIs tend to have the most worrisome effects so that additional steps can be taken to eliminate and mitigate those conditions. In his second appearance to Aeneas in Aeneid 4 Mercury drives the hero to flee Carthage with a false allegation that Dido is planning an attack, capping his warning with an infamous sententia about the mutability of female emotion. Building on a previous suggestion that Mercury's first speech to Aeneas is modelled on Athena's admonishment of Telemachus at the opening of Odyssey 15, this article proposes that Mercury's second speech as well is modelled on Athena's warning, in which the goddess (...) uses misdirection about Penelope's intentions and a misogynistic gnōmē about the changeability of women's affections to spur Telemachus’ departure from Sparta. After setting out how Virgil divides his imitation of Athena's speech verbally and thematically between Mercury's two speeches, the discussion turns to why both Athena and Mercury adopt these deceptive tactics. The speeches are shown to be culminations of the poets’ similar approaches to creating doubt and foreboding around the queens’ famed capacities for using δόλος. Common features in the ensuing hasty departures of Telemachus and Aeneas further confirm Virgil's use of Odyssey 15 in devising Aeneas’ escape from Carthage. (shrink)

Among contemporary liberal political theorists in the West, there appears to be a standoff between two camps. One camp promotes tighter social bonds through collective responsibility and patriotic fellow-feeling while the other insists on the need for relaxed social bonds through respect for individual freedom. This essay shows how two Vietnamese thinkers—Ho Chi Minh (1872–1969) and Nguyen Manh Tuong (1909–1997)—can help move this intractable debate about collective responsibility and individual freedom beyond statements of principle to a more pragmatic discussion of (...) what should be done to maintain a healthy polity. They present an alternative to the static standoff, arguing that dynamic oscillation between two activities can forge national fraternal solidarity while also respecting individual freedom when the needs arise: ‘criticism and self-criticism' which tightens social bonds, and ‘liberal self-exploration' which relaxes social bonds. This essay develops a novel account of the distinction between a publicly justified polity and modus vivendi regimes by appealing to the ideal of congruence in public reason liberalism. A fully publicly justified polity is one whose laws are supported by congruent “first-personal” and “second-personal” moral reasons to internalize laws as personally binding on those subject to them. Regimes approach modus vivendi status to the extent that their laws fail to be justified by either type of reason, or where firstpersonal (...) and second-personal reasons fail to justify internalization. This paper is the second phase of a project that was begun more than three years ago. The first phase culminated in the publication of a paper working toward a critical appropriation of Aristotle’s Nicomachean Ethics.1 Therein Aristotle famously argues that human wellbeing (eudaimonia) is constituted by “activity of the soul in accordance with moral and intellectual virtue.”2 This earlier paper brought into focus all the main lines of Aristotle’s theoretical web in the N. Ethics: including the nature of the (...) soul, intellectual virtue, moral virtue, etc. That paper went on to give a developed critique of Aristotle’s theoretical web, and against that background it argued for a very different way of thinking about intellectual virtue, and it prepared the ground for different ways of thinking about moral virtue. This current paper explores the various conceptual understandings of “the mean” in Aristotelian and in Confucian thought. It begins with an explanatory sketch of “the mean” as understood in Aristotle’s Nicomachean Ethics, and then in a second section goes on to explore “the mean” as presented in classical Confucianism. The third section of this paper offers some reflections oriented toward a tentative formulation of a modified conception of “the mean” as it might be construed from a humanistic Marxist perspective. This is a working paper that presents the first phase of what will eventually be a huge project, namely a critical appropriation of Aristotle’s Nicomachean Ethics. Early on it provides a sketch of the main strands of Aristotle’s theoretical web in his N. Ethics. Following that, the paper offers some critical commentary concerning some of Aristotle’s main positions: especially his views on moral virtue, the soul, intellectual virtue, and human well-being. The paper then turns to the development of some significantly (...) different ways of construing both intellectual virtue as well as moral virtue. With respect to intellectual virtue, I present my own perspective in interconnection with a process-oriented way of understanding reality, as opposed to Aristotle’s substance-oriented way. With respect to moral virtue, I present my interpretation in relation to a thisworldly understanding of the human spirit/soul, as well as a humanistic-Marxist interpretation of human well-being. Toward the paper’s end, I offer some suggestions concerning a modified “doctrine of the mean” that would be a sort of critical synthesis of the views of Aristotle and Confucius. (shrink)

Although theories that examine direct links between behavior and brain remain incomplete, it is known that brain expansion significantly correlates with caloric and oxygen demands. Therefore, one of the principles governing evolutionary cognitive neuroscience is that cognitive abilities that require significant brain function (and/or structural support) must be accompanied by significant fitness benefit to offset the increased metabolic demands. One such capacity is self-awareness (SA), which (1) is found only in the greater apes and (2) remains unclear in terms of (...) both cortical underpinning and possible fitness benefit. In the current experiment, transcranial magnetic stimulation (TMS) was applied to the prefrontal cortex during a spatial perspective-taking task involving self and other viewpoints. It was found that delivery of TMS to the right prefrontal region disrupted self-, but not other-, perspective. These data suggest that self-awareness may have evolved in concert with other right hemisphere cognitive abilities. (shrink)

This essay consists of responses to several papers on my book *Kingdoms of God.*.

Christian Ethics and Commonsense Morality goes against the grain of various postmodern approaches to morality in contemporary religious ethics. In this book, Jung seeks to provide a new framework in which the nature of common Christian moral beliefs and practices can be given a new meaning. He suggests that, once major philosophical assumptions behind postmodern theories of morality are called into question, we may look at Christian morality in quite a different light. On his account, Christian morality is a historical (...) morality insofar as it is rooted in the rich historical traditions of the Christian church. Yet this kind of historical dependence does not entail the evidential dependence of all moral beliefs on historical traditions. It is possible to argue for the epistemic autonomy of moral beliefs, according to which Christian and other moral beliefs can be justified independently of their historical sources. The particularity of Christian morality lies not in its particular historical sources that also function as the grounds of justification, but rather in its explanatory and motivational capacity to further articulate the kind of moral knowledge that is readily available to most human beings and to enable people to act upon their moral knowledge. But beyond doubt also, the primacy that Plato gives to the imitation of, or participation in the Ideas, apparently substantially existing, is the main reason why critics have refused to recognize or consider possible any mode of conceptual immanence in the mind of the Demiurge or whomever they regard as the Platonic God. Text on text could be cited to exemplify the role of the Ideas as archetypes. Yet it seems rather strange that Plato should conceive of two simultaneous objects (...) of imitation, the Supreme Being and the Ideas. Despite the plurality of Ideas, however, some critics have recognized a centripetal tendency in the dialogues toward the primacy of the Good, or the One, or the Beautiful, or Being, over subordinate Ideas. Was there possibly some similar tendency toward unity of some sort between the Supreme Intellect and the Intelligibles, his archetypes, which in the Timaeus are the ideal Living Exemplar of the cosmos? It has been asserted that preaching in the first half of the twenty-first century is in crisis by the authors of Engaging Preaching. This crisis has arisen, so say the authors, due in part to those who have been entrusted to preach the ‘oracles of God’ (1 Peter 4:11), having failed to faithfully proclaim the Word of the Lord. No longer do the words of ‘Thus saith the Lord’, regularly fill the halls of the sanctuary. Instead of a sure word (...) from the Bible, those in attendance are just as likely to give tips on self-fulfillment or achieving one’s dreams. By this practice, it seems there are a significant number of pulpit practitioners who neither trust in the authority or the sufficiency of the Word of God. The situation seems bleak, but there is a remedy to be applied to this situation. Carl F. H. Henry has left us a wealth of theological writings that speak to this very problem. This paper will argue as Henry has masterfully argued for the authority of Scripture, the preacher finds a sure footing for a pulpit practice that displays the authority and the sufficiency of the Bible. It will be argued that expositional preaching is the most natural response to a robust view of the authority and sufficiency of the Word of God. (shrink)

This paper argues that John Hick's commitment to the moral principle of altruism undermines his pluralistic claim that all of the major world religions are equally efficacious from a soteriological perspective. This argument is placed in a context of a discussion evaluating the theoretical virtues of various hypotheses about religious diversity. (Published Online April 7 2006).

In this paper I will point to some of the common themes that have emerged when we ask whether engineering ethics is just business ethics I will then reflect on some of the implications of the approaches suggested by Michael Davis, Vivian Weil, and Rachelle Hollander.

This paper analyzes the political and legal context in which the 1999 Omaha (Nebraska) Public Schools bond issue was proposed and approved, and the conception of social justice that underpins it. I argue that the 1999 bond issue marks a shift from an ideal of social justice centered on integration toward another ideal of justice centered on fair distribution of resources. I indicate some of the limits of this distributive conception of justice from both a theoretical and a practical point (...) of view. I argue that distributive justice must be carried out in a context of participatory democracy in order to achieve social justice in public education in present-day Omaha. (shrink)

In March 1956 there appeared in Monde Nouveau a relatively short piece by Emmanuel Levinas called “Maurice Blanchot et le regard du poète.” It is an extended review of L’Espace littéraire, published by Gallimard the previous summer, which is also laced with a polemic against Heidegger. Levinas observes that Blanchot is close to the Heidegger of Vorträge und Aufsätze (1954), almost to the point of immediate intellectual intuition, but he is just as quick to register the distance between the two (...) on a decisive issue: on Blanchot’s account of literature we are led away from the world of dwelling and rootedness that Heidegger affirms in his meditations on art. Here as elsewhere, Levinas is profoundly disturbed by Heidegger’s slighting of ethics and, in turning to show that his friend finds a way beyond the primacy of Sein, he observes parenthetically that Blanchot “also abstains from ethical preoccupations, at least in explicit form.” A little later he remarks, more pointedly, that Blanchot’s concern with “authenticity” must one day “herald an order of justice” if it is to be more than “a consciousness of the lack of seriousness of edification, anything other than derision” (137; SMB 24). Clearly, Levinas is uneasy at the proximity of his friend to the Heidegger of Sein und Zeit (1927) and beyond, having freed himself from “the climate of that philosophy,” starting in “De l’évasion” (1935) and then more completely in De l’existence à l’existent (1947) (EE 19; DEE 19). The invitation is for Blanchot to render his ethics explicit. Levinas’s review even hints at how this can be done. Other essays by Levinas, later collected in Sur Maurice Blanchot (1975), return to the prediction or hope registered in this review that someone will express “the latent meaning” of his friend’s novels and récits (133; SMB 17), and there is no doubt when reading his reflections on L’Attente l’oubli (1962) and La Folie du jour (1973) that for Levinas their manifest meaning is ethical, at least in part. "Mystic Maybe's": the title comes from Augustine Birrill's words on the death of Matthew Arnold. Is it true that Richard Kearney's philosophy of religion, like Arnold's reflections on the Bible, are "mystic maybe's," mere flirtations with possibility? In order to answer this question I seek to understand Kearney's expression "the God who may be" and to see if it fits into a non-metaphysical philosophy of religion. The expression is clarified by way of comparisons with Wolfhart Pannenberg's eschatological understanding of God (...) and Eberhard Jungel's theology of possibility. One weak point in Kearney's philosophy of religion, it is argued, is its avoidance of theology in the name of the philosophy of religion. A sound philosophy of religion needs to engage with theology. /// "Mystic Maybe's" (Possibilidades místicas): Este titulo deriva das palavras de Augustine Birrill acerca da morte de Mathew Arnold. O autor do artigo pergunta até que ponto a filosofia da religião de Richard Kearney não será, tal como as reflexões de Arnold acerca da Bíblia, um mew "místico talvez", um simples namoro com a possibilidaãe. Em ordem a responder à questão, o autor procura compreender o sentido da expressão de Richard Kearney acerca do "Deus que pode ser" de modo a avaliar até que ponto a expressão se adequa a uma filosofia não-metafísica da religião. O artigo clarifica a expressão de Kearney mediante uma comparação quer com a compreensão escatológica de Deus de Wolfhart Pannenberg quer com a teologia da possibilidade de Eberhard Jüngel. Mostra-se, desta forma, que um dospontos maisfracos na filosofia da religião de Richard Kearney consiste na sua tentativa de escapar à teologia em nome da filosofia da religião. I argue against Lori Watson and Christie Hartley's recent criticisms of convergence approaches to public justification. In particular, I argue that convergence approaches can capture what is distinctive about democratic decision‐making and provide an attractive account of stability for the right reasons.

The success of fecal microbiota transplantation as a treatment for Clostrioides difficile infection has stirred excitement about the potential for microbiota transplantation as a therapy for a wide range of diseases and conditions. In this article, we discuss vaginal microbiota transplantation as “the next frontier” in microbiota transplantation and identify the medical, regulatory, and ethical challenges related to this nascent field. We further discuss what we anticipate will be the first context for testing VMT in clinical trials, prevention of the (...) recurrence of a condition referred to as bacterial vaginosis. We also compare clinical aspects of VMT with FMT and comment on how VMT may be similar to or different from FMT in ways that may affect research design and regulatory decisions. (shrink)
