The connection between fear, law and the state is a topic that is given particular attention in times of social insecurity. Some approximations are explored here under the notion of fear constitutions. We are equal in fear of one another, which is why fear can be understood as a condition of modern constitutions. However, the social contract does not lead to freedom from fear, but rather fear shifts; the legal subjects remain subjects of fear, in relation to one another, but (...) in particular towards that multiple artificial person which the state comes to embody as it takes on a life of its own. The degree of fear varies with the degree of unpredictability and indeterminacy of executive action. State measures against terrorism or against the pandemic are often an unpredictable response to an unknown danger and are therefore at the same time both an expression of fear and its trigger. It would be helpful if there was a clear distinction between sensible and unreasonable, functional and dysfunctional forms of fear. Freud tried to provide criteria with his concept of neurotic fear, a concept that has been taken up in political and legal philosophy. However, the concept is obscure and cannot be used without normative specifications. (shrink)

Appraisal theories of emotion have had a strong impact on the development of theory and experimental research in the domain of the affective sciences. While there is generally a high degree of convergence between theorists in this tradition, some central issues are open to debate. In this contribution three issues have been chosen for discussion: (a) varieties of relevance detection, (b) varieties of valence appraisal, and (c) sequential-cumulative effects of appraisal results. In addressing these issues, new theoretical ideas are suggested (...) and an update of recent research on the sequence of appraisal processes is provided. The following considerations have their origin in the recent debate on inter-cultural understanding. In one respect one might characterize the opposing positions in this debate as anthropological universalism and anthropological relativism. Each party, however, imputes to the other a hidden Eurocentrism. The intention of my paper is to show that a third way between these opposing positions is possible, a way that becomes evident when one reflects explicitly on the bearing of European culture on this debate.

Evidence accumulates that pre- and postnatally circulating estrogens play an active role in the differentiation of the female brain: the susceptible period for feminization of the brain seems to extend far beyond the period during which masculinization of the brain occurs. Thus, there is a need to reevaluate the widely accepted “concept of basic femaleness” in sexual brain differentiation.

In spite of their growing specialization, modern natural sciences intend to reduce their theories to some fundamental structures: Physics tries to unify the different physical forces in one fundamental force. Chemistry tries to explain the structure of chemical substances by the quantum mechanics of molecules. Biology tries to reduce the processes of life to biochemical and biophysical laws. Mathematically, the unification of natural science can be described by structures of symmetry, the specialization of science, the variety, and emergence of new (...) phenomena by symmetry breaking. In the following, the successes and lacks of the reductionistic program are shown in recent developments of physics, chemistry, and biology. Philosophical discussions on holism, reductionism, and unification of science can be clarified by structures of symmetry and symmetry breaking. Alternative non-reductionistic view-points are not only possible, but desirable for the lacks in the reductionistic program. Nevertheless, the categorical framework of symmetry and symmetry breaking supports interdisciplinary work and gives new insight in a common structure and theory of natural science. (shrink)

Theory Reduction in the Social Sciences. The example of balance theories. A central topic both in philosophy of science as well as in the empirical sciences is the reconstruction of the relations between theories. In the past comparisons of theories by means of traditional linguistic methods have proved to be extremely difficult and complicated. In this article the reconstruction of intertheoretical relations based on model-theoretical terms is propagated, as formulated within the structuralist view of theories. The efficiency of a model (...) theoretical based comparison of theories is demonstrated by two theory elements from the social science research program of balance theories: The basic element by Heider and the transitivity theory by Holland and Leinhardt. First of all both theory elements are introduced informally and reconstructed in the structuralist format. On the basis of these reconstructions can be shown, that the Heider theory can be formally reduced to the Holland-Leinhardt theory and that the theory younger in history means an improvement. However, an integration of all balance theoretical elements into a theory net is not possible. (shrink)

In this article, I would like to clarify Austin's thesis that illocutionary acts are essentially conventional and to show, how this idea is connected with his concept of securing uptake. Contrary to what most critics believe, I will show that Austin provides a criterion characterising the nature of all illocutionary acts and allowing to distinguish them from perlocutionary acts.

The fictitious controversy turns around the question of how to know what Jesus meant by 'Kingdom of God'. Nietzsche pretended this kingdom to be merely interior and to be found only there, whereas elsewhere he declared God to be "dead". For Luther, the Kingdom of God is located in faith and the pure grace of God. On the other hand, Luther, due to his bible literalism, justifies the persecution of Jews and insurgent peasants, and this in flagrant contradiction to Jesus' (...) commandment of Love. The idea of 'Kingdom of God' has been of considerable impact and significance in the history of mind-. (shrink)

In his commentary on Aristotle’s Peri hermeneias,1 Abelard distinguishes the form of an expression2 (oratio) from what it says, that is, its content. The content of an expression is its understanding (intellectus). This distinction is surely the most well-known and central idea in Abelard’s commentary. It provides him with the opportunity to distinguish statements (enuntiationes) from other kinds of expressions without implying a diference in their content, since the ability of a statement to signify something true or false (verum vel (...) falsum)3 cannot be found in its content. More precisely, Abelard distinguishes statements both from complete expressions (orationes perfectae) that are not statements but rather questions, requests, commands, etc. and from incomplete expressions, that is, mere word strings (orationes imperfectae), such as homo albus. These kinds of expressions, according to Abelard, do not differ in the understanding they present but in the way they present it. (shrink)

The author introduces a normative conception of coherence, derived from a pragmatic interpretation of the application of norms to concrete cases. A distinction is made between the justification of a norm and its application. In the case of moral norms, justification and application can be analysed as two different discursive procedures which give rise to different aspects of the principle of impartiality. Impartial justification requires a procedure by which all interests concerned are taken into account whereas impartial application requires a (...) procedure where all features of a situation are considered. The complete description of a concrete case makes necessary a coherent interpretation of all the valid norms which are prima facie applicable. This requirement of an ideal coherent system of norms is restricted to interpretive “paradigms” in the case of legal norms, because it is necessary to produce singular judgments under the restrictive conditions of scarce time and incomplete knowledge. Diagnosing emotion disturbances should be informed by current knowledge about normal emotion processes. I identify four major functions of emotion as well as sources for potential dysfunctions and suggest that emotions should only be diagnosed as pathological when they are clearly dysfunctional, which requires considering eliciting events, realistic person-specific appraisal patterns, and adaptive responses or action tendencies. Evidence from actuarial research on the reported length of naturally occurring emotion episodes (including potential determinants) illustrates appropriateness criteria for the clinical evaluation of (...) emotion duration—an essential element in the DSM-5 symptom catalogue for major depression episodes, especially in bereavement. The need for more actuarial evidence on normal emotion responses and its consideration by the clinical community is highlighted. (shrink)

The ArgumentThe political changes in Czechoslovakia and in other Eastern European countries in 1989 are closely related to Jan Patoĉka's philosophy. He was one of the first speakers for the human rights manifesto “Charta 77” and died following his political interrogations in 1978. Vàclav Havel, the president of the ĉSFR, was one of his students. Patoĉka's philosophy is sketched here following his interpretation of Comenius, beginning with an early work of 1932 and until his interpretation of Comenius' The Paradise of (...) the World and the Labyrinth of the Heart in his book Die Philosophic der Erziehung des J. A. Comenius.As a phenomenologist who transcends both Husserl and Heidegger, Patoĉka's conflict with the political system of his country was inevitable. The regime could not put up with his thesis on the “open soul” which, due to its existential openness, can hear the “call of conscience.” Behind this thesis stands Patocka's teaching of the three movements of existence. And out of this follows his “Education of the Turning.” Patoĉka's theory of education leads straight to some nondogmatic conceptions of education such as the “Communication Pedagogics” which dates back to the dialogical education of Martin Buber. I strongly endorse many of the suggestions made by the authors of the extremely useful reviews in this issue. In particular, the need to identify the complex causal mechanisms underlying the major health risk factors requires urgent attention of the research community. I suggest considering the important role of emotional disturbances as contributors to health risks given the empirically established comorbidity between mental and somatic illness. Better knowledge of these mechanisms is an essential prerequisite to develop tailored personalized prevention and (...) intervention programs, including reliable and valid assessment of deficits. We start from the assumption that the real valued observables of a quantum system form a Jordan algebra which is equipped with a compatible Lie product characterizing infinitesimal symmetries, and ask whether two such systems can be considered as independent subsystems of a larger system. We show that this is possible if and only if the associator of the Jordan product is a fixed multiple of the associator of the Lie product. In this case it is known that the two (...) products can be combined to an associative product in the Jordan algebra or its complexification, depending on the sign of the multiple. (shrink)

Mimicry of appearance or of facial, vocal, or gestural expressions emerges frequently among members of different species. When such mimicry directly relates to affective aspects of an interaction, researchers talk about “emotional mimicry”. Emotional mimicry has been amply documented but its functionality is still debated. Why and when do people mimic the expressions of others, who benefits, the mimicker or the mimicked, and how do they benefit? Which processes underlie emotional mimicry? Is it completely automatic and unconscious or can it (...) be deliberate and conscious? The current Theory Section addresses these questions from different theoretical perspectives. The invited article by Hess and Fischer focused on the role of mimicry in social regulation and social bonding. The invited comment by Krets and Akyüz highlights information gathering and prediction in social interaction. The invited comment by Bernhold and Giles emphasizes vocal communication and its role in interpersonal accommodation. In this editorial, I propose the different theoretical perspectives may be integrated by assuming a multilevel appraisal and response generation mechanism. I also suggest that emotional mimicry research may be broadened by including social learning, vocal imitation, interspecies comparisons, and affective computing approaches. (shrink)
