The fourteen authors in this collection used phenomenology and hermeneutics to conduct deep inquiry into perplexing and wondrous events in their work and personal lives. These seasoned scholar-practitioners gained remarkable insight into areas such as health care and illness, organ donation, intercultural communications, high-performance teams, artistic production, jazz improvisation, and the integration of Tai Chi into education. All authors were transformed by phenomenology's expanded ways of seeing and being.

It is argued that, of the three distinct approaches usually adhered to in discussions of this controversy, none will produce an adequate reconstruction of the episode. The philosophical-methodological type of approach leads to a glossing over of the intricacies of deductive and inductive procedures inhering in the writings of both antagonists (§ 1). The metaphysical approach leads to oversimplification as to the thinking of either scientist on the problem of the continuous or discontinuous character of Nature(§ 2). The epistemological (theory (...) of knowledge) type of approach, finally, leads authors to posit a Linnaean realism vs. a Buffonian nominalism, whereas the true position was much more complex than what transpires(§ 3). The paper proceeds, therefore, to provide a novel reconstruction of this wellknown controversy (§ 4-5), concentrating on the differing choices made by the two naturalists in their work of botanical or zoological classification : thus seeking to show that the clash came about because Buffon rejected the rigid principle of character subordination put forward by Linnaeus, and, on a more general level, because the two protagonists were proceeding from deeply diverging views of what natural history, and what the naturalist's function, should be. La Mettrie shows in his philosophical and medical works, and particularly in Ouvrage de Pénélope, a real interest in the natural sciences of his time and above all in the works of Linnaeus with whom he is the exact contemporary. Even if he speaks ironically about his botanical and zoological classification and criticizes his teleological conception of nature, La Mettrie appreciates the analogical reasoning of Linnaeus which is the fundamental method of the Linnaean apprehension of knowledge, as much as the (...) metaphoric language that he will use in L'homme-plante. From this point of view, La Mettrie is one of the first French popularizers of Linnaeus' works and, at the same time, his first critic. (shrink)

D’une double formation de naturaliste et de philosophe, Émile Callot a consacré une partie de ses travaux à étudier les relations entre ces deux disciplines : à les définir d’abord, à les légitimer ensuite et, enfin, à les constater dans diverses œuvres de savants et de philosophes. Dans cet esprit, il commença par dresser un tableau de la Renaissance des sciences de la vie au XVIe siècle, où il fit apparaître le caractère novateur des premiers Naturalistes européens. Il s’attacha ensuite (...) à déterminer cet esprit et cet objet d’une façon théorique dans sa "Philosophie biologique", et d’une façon historique dans son "Histoire de la philosophie biologique par les textes". C’est également dans le contexte historique, qu’il décrivit la Philosophie de la vie au XVIIIe siècle, visant à dégager les idées biologiques chez des auteurs aussi différents que d’Holbach, Montesquieu et Linné. Dans cette voie, il mit en valeur Maupertuis, le savant et le philosophe, en donnant de cet auteur une étude où l’œuvre est analysée et illustrée par les extraits les plus significatifs. Enfin, il consacra à la Philosophie biologique de Cournot une monographie, où il souligna la part déterminante du vitalisme dans la pensée de cet auteur. C’est de la même façon que, dans sa Philosophie biologique de Gœthe, Émile Callot cherche, à partir des travaux scientifiques de Gœthe, à dégager les grandes lignes de sa méthode et les principes directeurs de sa conception du monde vivant. Mais ce monde prend place dans la Nature, dont le philosophe et l’artiste se sont fait également les interprètes. Il convenait donc, après l’analyse de ce domaine restreint, de montrer comment celui-ci se situe dans la vision globale et unificatrice de la pensée et de la sensibilité gœthéennes. Aussi, cet ouvrage apporte-t-il une contribution importante, non seulement à l’étude des idées biologiques qui eurent cours à la fin du XVIIIe siècle, mais encore à une compréhension mieux informée de cet esprit génial. Thomas Kuhn’un ufuk açıcı eseri Bilimsel Devrimlerin Yapısı’nda yer verdiği bilimin yapısı ve işleyişi konusundaki tespitleri ve bilimin gerçek doğasını anlama yönündeki girişimleri bilime yönelik sergilenen pozitivist bakış açısını değiştirerek eğitici ve öğrencilerin modern bilim anlayışının özelliklerini daha iyi anlamalarında ve eğitim alanında yeni düzenlemelerin yapılmasında giderek etkili olmaktadır. Başta fen eğitimi araştırmacıları olmak üzere her geçen yıl eğitimciler tarafından Kuhn’un çalışmalarına yönelik artan ilgi ve başvuru bu durumu destekler niteliktedir (Loving ve Cobern, 2000, s. 187). Eğitim araştırmalarında Kuhn’un görüşlerinin (...) etkisinin en çok hissedildiği alanlar kavramsal değişim araştırmaları, yapılandırmacı öğrenme yaklaşımı, Bilim, Teknoloji ve Toplum çalışmaları ile bilime ilişkin kültürel çalışmalar gösterilebilir (Matthews, 2022: 38). Fen eğitimi araştırmalarında ise kavramsal değişim kuramları ile yapılandırmacı öğrenme kuramlarında bu etki görülmektedir (Loving ve Cobern, 2000, s. 187). Fen eğitimi ve öğrenimi konusundaki mevcut yaklaşımlar göz önüne alındığında Kuhn’un düşüncelerinin eğitim alanındaki yansımaları yapılandırmacı öğrenme kuramının temel kaynaklarından birisi olarak değerlendirilmekte (Hodson, 1988, s. 32), bilimsel ilerleme kapsamında paradigma, paradigma değişimi ve paradigmaların eşölçülemezliği gibi bilimin işleyişine yönelik belirlemeleri ise kavramsal değişim kuramında sıklıkla başvurulan görüşler olarak karşımıza çıkmaktadır. Kavramsal değişim kuramlarını desteklemek amacıyla birçok eğitimci (Loving ve Cobern, 2000; Songer ve Linn, 1991; Duschl ve Gitomer, 1991; Metz, 1991) tarafından Kuhn’un bilimsel ilerlemeyi örneklendirmek üzere başvurduğu fizik gibi bilimlerde görülen gelişim ve değişim ile bilimlerde meydana gelen paradigma değişiklerine yönelik düşünceleri, eğitimde gerçekleşen bireysel gelişim ve değişim sonucunda insan zihninde meydana gelen bilişsel değişimler ve kavramsal değişimlerle ilişkilendirilerek öğrencilerin eğitilmesine yönelik araştırmalarda kullanılmaktadır. Fen eğitimi özelinde kavramsal değişim araştırmaları bireysel öğrenme sırasında ya da sonucunda zihinde gerçekleşen kavramsal değişim ve bilişsel gelişim aşamaları ile bilimsel devrimler sonucunda bilim insanları ve bilim topluluğunda meydana gelen kavramsal değişim ve bilimin gelişim aşamaları arasında benzerlik kurularak öğrencilerin fen öğrenimi sırasındaki zihinsel durumlarının araştırmacılar tarafından daha iyi anlaşılabilmesi amacıyla ileri sürülmektedir (Hewson, 1981, s. 383). Kavramsal değişim araştırmaları, Piaget’nin (1969) çocukların bilişsel gelişimi konusundaki görüşleri ile Thomas Kuhn'un (1970a) bilimsel bilginin tarihsel gelişimi hakkındaki çalışmalarının ilişkilendirilmeye başlanmasından yola çıkılarak inşa edilmekle birlikte kavramsal değişim kuramı ya da yaklaşımı fen eğitimi araştırmalarında ön plana çıkan bir yöntem ya da paradigma haline gelmeye başlamıştır (Abell, Appleton, ve Hanuscin, 2013, s. 7; 59). Kavramsal değişim konusunda araştırma yapanlar Kuhn’un bilimin yapısı hakkındaki görüşlerinden hareketle öğrencilerin eğitim alırken karşılaştıkları yeni bilgiler ile zihinlerindeki mevcut ön kabuller ve bilgiler arasındaki uyum ya da uyumsuzluk durumunu belirtmek amacıyla yararlanmaktadırlar (Abimbola 1987, Duit 1991, Villani, 1992). Bu kapsamda çalışmada ilk olarak fen eğitimi alanında kavramsal değişim yaklaşımının temel unsurlarına öncülük eden Kuhn’un bilim anlayışı çerçevesinde bilimsel ilerleme, paradigma değişimi ve farklı paradigmaların eşölçülmezliğine yönelik görüşlerinin detaylarına yer verilerek kavramsal değişim yaklaşımını hangi açılardan etkilediğinin tespiti yapılmaktadır. Ardından Kuhn’un fen eğitimine yönelik görüşleri doğrultusunda ileri sürdüğü öğrencilerin zihninde paradigma gibi önceden bir kabul olduğu düşüncesi sonucunda eğitim araştırmalarında öğrenci merkezli anlayışın ön plana çıkması ile kavramsal değişim yaklaşımının detaylarına yer verilmektedir. Son olarak Margaret Masterman’ın belirlemeleri ile Kuhn’un Bilimsel Devrimlerin Yapısı’nda paradigma kavramını çeşitli anlamlarda kullanmasının kavramsal değişim yaklaşımının temel öğretilerine hangi açılardan kaynaklık ettiği vurgulanmaktadır. Böylelikle bilim tarihinde ya da bilimsel ilerleme süreçlerinde görülen kavramsal değişim ile eğitimcilerin yararlandığı bireylerin zihinlerinde gerçekleşen kavramsal değişime yönelik kurulan benzerlik ilişkisinde öğrencilerin bilişsel ve zihinsel durumlarını daha iyi anlamak için başvurulan kavramsal değişim yaklaşımına ilişkin öğeler derinleştirilerek Kuhn’un görüşlerinin bu öğelerle nasıl ilişkilendirildiği ortaya konulmaktadır. The old ritual word macte was only vaguely understood even in Republican times. As is well known, the ancient critics connected the word with magis, magnus, and explained it as magis auctus. A glance at Walde's Wörterbuch reveals that many attempts have been made in modern times to solve the mystery; but the formidable equipment of the modern philologist has yielded little better results than the popular etymology of the ancients, the most favoured view to-day seeing in mactus the PPP (...) of a verb mago with macto as the frequentative which replaces it. The supposed semantic development of this verb, originally meaning ‘to increase’, has been set forth by Warde Fowler in a well-known passage, to which recent authorities have accorded their assent and praise: ‘the vitality of the deity … was really increased by placing on the altar the organs of life of the victim’. But this is a solution which ignores half the problem: macte and mactare are used not only of the deities but also of the victim. One can perhaps understand lovem mactare as ‘to magnify J.’, but not even by the most superficial analogy can we find a transition from here to the meaning typified in mactare vinum. Yet this is one of the most frequent usages of the word. So deep a gulf lies between the two semantic spheres of the verb that some scholars have sought to find in it two different verbs. But this is a counsel of despair which the editor of the Thesaurus dismisses with a non recte. We must agree, then, with Hey that the modern explanation is ‘sicher eine unrichtige’ and with Meillet-Ernout that there exists ‘aucune étymologie claire’. It is, therefore, surprising that so ill-founded a preconception should lead investigators to ignore or even dismiss important evidence which the ancient authorities offer for the solution of this problem. In order to get out of present day discussions between determinism and free will, creationism and evolution, bios and zoē, human existence and biological life – those dead end binaries of our present day thinking into which we have manoeuvred ourselves – we need to revisit the Ancient discussions relating to the care of the soul and human existence. I will draw together these two themes from Jan Patočka’s writings by anchor-ing them in his account of Socrates who was the (...) first to emphasise the idea of human re-sponsibility not only for thinking but also for human acting in the world. I will argue that the significant common feature – the care for our own being, our existence – brings Patočka’s reflections on the care for the soul and care for our human existence together. While, according to Patočka, the notion of the care for the soul was displaced from the philosophical reflection by the modern scientific venture, the idea of human existence is, although problematic from the scientific point of view, still a part of our experience.Para librarnos de discusiones contemporáneas entre determinismo y libre albedrío, creacionismo y evolución, bios y zoē, existencia humana y vida biológica, estos binomios, callejones de salida del pensamiento de hoy en los que nos hemos metido, tenemos que volver a escuchar las discusiones de la Antigüedad sobre el cuidado del alma y la existencia humana. Voy a recuperar estos dos temas de escritos de Jan Patočka, anclándolos en su interpretación de Sócrates, el primero en poner énfasis en la idea de responsabilidad humana no solo de su pensamiento sino también de su actuar en el mundo. Argumentaré que el significativo rasgo común, esto es, el cuidado por nuestro propio ser, nuestra existencia, es lo que une las reflexiones de Patočka sobre el cuidado del alma y el cuidado de la exitencia humana. Mientras que, según Patočka, la noción del cuidado del alma ha sido desplazada de la reflexión filosófica por la empresa científica moderna, la idea de la existencia humana, a pesar de lo problemático que puede resultar desde un punto de vista científi-co, todavía forma parte de nuestra experiencia. Hanlester Network v. Shalala ) marks the first test of the application of the Medicare-Medicaid anti-kickback statute to physician self-referral joint ventures. The most recent development in this ongoing litigation was the April 6, 1995 decision of the Ninth Circuit Court of Appeals, holding the Hanlester Network vicariously liable for its marketing vice president's knowing and willful violation of the antikickback statute. The vice president had offered to pay physician-investors in order to induce their referrals of program-related business.The Hanlester Network (...) was a California general partnership comprised of corporations, clinical laboratories, and individual investors. In April 1987, it entered into a management agreement on behalf of the clinical laboratories with SmithKline BioScience Laboratories. (shrink)

The level of medical care to patients and the success of the implementation of the national project "Health" depend on the health status and doctor's professionalism. Modern healthcare reform is being implemented by optimizing costs, merging medical organizations, closing ineffective hospitals, expanding the use of high-tech care and informatization of the doctor's activities. All this makes it necessary to assess the health of doctors. Scientists have studied the quality of life and identified the professional burnout of doctors in children's clinics (...) in different age groups. Primary care pediatricians have a higher quality of life score when compared to the standard [1]. However, all groups have a high level of professional burnout. The pre-retirement group of doctors has more unfavorable profile. They are highly professional specialists but may experience emotional discomfort because the pension system has been reformed. This situation requires the introduction of preventive work with doctors of this age as a group with great potential and capable of professional longevity. (shrink)

This article uses two concepts—trying on gender and local gender regime—to examine adolescent gendering processes for 26 girls from two northeastern communities. Based on a four-year study, the author found that the process of becoming a woman is much more provisional than previously thought. Adolescent girls resist, experiment, and practice gender in a trying-on process; gender, race, and class structures in the communities mutually reinforce particular kinds of femininities. This article describes the gender regime of each community and examines how (...) the gender regimes differentially shape the process of trying on gender as these girls make the transition to womanhood. The question addressed here is whether evidence concerning defendants' past criminal records should be introduced at their trials because such evidence reveals their character and thus reveals whether they are the kinds of persons likely to have committed the crimes with which they are currently charged. I strongly caution against the introduction of such evidence for a number of reasons. First, the link between defendants' past criminal records and claims about their standing dispositions to think and act is tenuous, at (...) best. Second, noncharacter, or trace, evidence should have primacy in determining the guilt or innocence of defendants. Third, character evidence will vary in its freshness and specificity. Other things being equal, only relatively fresh and specific character evidence has probative value. Moreover, such evidence will have greater probative value in criminal cases where the issue before the court is whether a crime has been committed than in cases where the issue is whether it was the defendant who committed the crime. Finally, we might be more sanguine about the introduction of fresh and specific character evidence under conditions likely to work against its misuse or misinterpretation. However, the relevant conditions may not often be satisfied in the real world of criminal trials and defendants. (shrink)
