I propose an account truthmaking that provides truthmakers for negative truths. The account replaces Truthmaker Necessitarianism with a "Duplication Principle", according to which a suitable entity T is a truthmaker for a proposition P just in case the existence of an appropriate counterpart of T entails the truth of P, where the counterpart relation is cashed out in terms of qualitative duplication. My account captures an intuitive notion of truthmakers as "things the way they are", validates two appealing principles about (...) entailment and containment proposed by David Armstrong, and invalidates the controversial Disjunction Thesis. This article reconsiders Hannah Arendt’s account of “totalitarianism” in light of the climate catastrophe and the apparent inability of our political-economic system to respond to it adequately. In the last two chapters of The Origins of Totalitarianism, Arendt focuses on the “ideology” of totalitarian regimes: a pathological denial of reality, a privileging of the ideological system over empirical evidence, and a simultaneous feeling of total impotence and total omnipotence—an analysis that maps remarkably well onto the climate zeitgeist. Thus, while Arendt (...) used the concept of “totalitarianism” to foreclose alternatives to liberal capitalist democracy, the climate impasse suggests that the totalitarian label more properly belongs to the prevailing system itself. Against the backdrop of the massive carnage of the wars in Afghanistan and Iraq, this article examines the institution of conscientious objection and the treatment of conscientious objectors. It concludes that while the number of objectors discharged from the US military in the two wars was small, the issues of conscience they articulated resonated widely through the ranks. The focus is on the moral, legal, and political questions that arise when individuals who commit collective crimes, such as crimes against humanity, are held accountable by international criminal tribunals. These tribunals challenge one of the most sacred prerogatives of states - sovereignty - and breaches to this sovereignty can be justified in limited circumstances, following what the author calls a minimalist account of the justification (...) of international prosecution. Language and tradition have long been relegated to the sidelines as scholars have considered the role of politics, science, technology and economics in the making of the modern world. This reading of over two centuries of philosophy, political theory, anthropology, folklore and history argues that new ways of imagining language and representing supposedly premodern people - the poor, labourers, country folk, non-europeans and women - made political and scientific revolutions possible. The connections between language ideologies, privileged linguistic codes, and political (...) concepts and practices shape the diverse ways we perceive ourselves and others. This 2003 book demonstrates that contemporary efforts to make schemes of social inequality based on race, gender, class and nationality seem compelling and legitimate, rely on deeply-rooted ideas about language and tradition. Showing how critics of modernity unwittingly reproduce these foundational fictions, it suggests strategies for challenging the undemocratic influence of these voices of modernity. (shrink)

One of the standard approaches to the metaphysics of personal identity has some counter‐intuitive ethical consequences when combined with maximising consequentialism and a plausible (though not uncontroversial) doctrine about aggregation of consequences. This metaphysical doctrine is the so‐called ‘multiple occupancy’ approach to puzzles about fission and fusion. It gives rise to a new version of the ‘utility monster’ problem, particularly difficult problems about infinite utility, and a new version of a Parfit‐style ‘repugnant conclusion’. While the article focuses on maximising consequentialism (...) for simplicity, the problems demonstrated apply more widely to a range of ethical views, especially flavours of consequentialism. This article demonstrates how these problems arise, and discusses a number of options available in the light of these problems for a consequentialist tempted by a multiple occupancy metaphysics. Gils-Schmidt and Salloch recognise that human and climate health are inextricably linked, and that mitigating healthcare-associated climate harms is essential for protecting human health.1 They argue that physicians have a duty to consider how their own practices contribute to climate change, including during their interactions with patients. Acknowledging the potential for conflicts between this duty and the provision of individual patient care, they propose the application of Korsgaard’s neo-Kantian account of practical identities to help navigate such scenarios. In this commentary, (...) we argue that by focusing attention on this physician–patient level, the authors overlook the complexity of climate change, both within the healthcare sector and beyond. We recognise the importance of individual agency in tackling this issue, and we also recognise that the authors do briefly acknowledge the importance of considering these broader complexities; however, we emphasise the need for climate and health discussions/action to be situated in a wider framework of systemic change. Our concern is that overemphasis on patient-level interactions risks normalising the prioritisation of individual-level approaches to addressing climate change, detracting from such a broader approach. David Lewis claimed that deterministic chance was impossible. But deterministic chance seems ubiquitous in casinos, in statistical mechanics, and in evolutionary theory. It would be best for Lewis's metaphysics if, in spite of what he says, we could reconcile his core views with deterministic chance. In this chapter, the author briefly rebuts two Lewisian objections to deterministic chance. The first is that our world is indeterministic at the quantum level, and this lower‐level indeterminism translates to indeterminism at higher levels. The (...) chapter explains how deterministic chances are possible on a broadly Lewisian theory. It also explains how there can be deterministic chances that function as nomological magnitudes, guide credence, and arise in objectively chancy situations. It is true that the author's deterministic chances are not time‐indexed. It is also true that they do not exactly satisfy principles, proposed by Lewis and others in a broadly Lewisian tradition, that presuppose time‐indexing. (shrink)

In the last two decades there has been a meteoric rise of international criminal tribunals and courts and also a strengthening chorus of critics against them. Today it is hard to find strong defenders of international criminal tribunals and courts. This book attempts such a defense against an array of critics. It offers a nuanced defense, accepting many criticisms but arguing that the idea of international criminal tribunals can be defended as providing the fairest way to deal with mass atrocity (...) crimes in a global arena. Fairness and moral legitimacy will be at the heart of this defense. The authors take up the economic and political arguments that have been powerfully expressed, as well as arguments about sovereignty, punishment, responsibility, and evidence; but in the end they show that these arguments do not defeat the idea of international criminal courts and tribunals. ABSTRACTIf representative democracy is not about elected officials responding directly to voters’ preferences, and if the voters do a poor job of voting their interests in referendums, then what is democracy about? In our view, a satisfactory theory of democracy would focus normatively on the social identities and political interests of citizens rather than on their expressed policy preferences, and empirically on the ability of organized or attentive groups to get those identities and interests effectively recognized and acted on in (...) the governmental process. A group-theoretic version of democratic theory along these lines would dispense with the most important illusions of the conventional “folk theory” of democracy. However, much hard work remains to clarify how actual democracies make policy and to construct a wise normative standard—inspirational but not innocent—against which they can be judged. (shrink)
