This paper investigates the relationship between structural explanation and the New Mechanistic account of explanation. The aim of this paper is twofold: firstly, to argue that some phenomena in the domain of fundamental physics, although mechanically brute, are structurally explained; and secondly, by elaborating on the contrast between SE and mechanistic explanation to better clarify some features of SE. Finally, this paper will argue that, notwithstanding their apparently antithetical character, SE and ME can be reconciled within a unified account of (...) general scientific explanation. (shrink)

This paper explores the recent social phenomenon of the confrontation by critics of government officials while they are out in public, yet engaged in “private” activities, e.g. eating dinner at a restaurant, shopping in a bookstore, or getting into their cars. This paper argues that such confrontations are a symptom of the lack of trust brought on by the absence of shared social values that results in toxic forms of public discourse, the blurring of the classical liberal distinction between the (...) public and the private realms, and the inability to hold one another responsible for the violation of self-avowed moral norms. Implicit in this argument is the conclusion that such confrontations are ineffective at best. Some have suggested more physical intermingling among people who hold conflicting political views in order to establish such trust (Haidt, Wilk). In the absence of such opportunities for intermingling, sharing our value-laden personal stories with each other, in the spirit and style of Michelle Obama’s memoir Becoming, might help to create tolerance and trust among those with differing political perspectives. A worldwidemental health crisis is expected, as millions worldwide fear death and disease while being forced into repeated isolation. Thus, there is a need for new proactive approaches to improve mental resilience and prevent mental health conditions. Since the 1990s, art has emerged as an alternative mental health therapy in the United States and Europe, becoming part of the social care agenda. This article focuses on how visual esthetic experiences can create similar patterns of neuronal activity as those observed when (...) the reward system is activated. The activation of the reward structures could have a stress buffering effect, given the interdependence observed between the reward and stress systems. Therefore, could visual esthetic experiences stimulate mental resilience? And if this were the case, could art-based interventions be offered for mental health in the context of COVID-19 and beyond? During the COVID-19 pandemic, blood and convalescent plasma donors are dearly needed. There is a need to modify donor recruitment strategies in order to stimulate these donors. Financial stimulants though, cannot be possibly used. This paper will analyze, from an ethical perspective, the possible consequences regarding the blood and plasma donor system by a simple shift of attention from the voluntary unpaid donor to the paid one or the blood seller.

If Christian theological and ethical thought can be shown to explain and shore up the notion that [End Page 190] "people matter" better than other ethical outlooks—and the authors believe it can—then the work will have (1) established a proper moral foundation for holding and acting on the conviction that people matter and (2) provided a reasoned argument for why Christianity as a fundamental belief system is better and truer than the other ethical systems examined.The text of Why People Matter is accessible and well written. The essays weave together coherently around two central ideas: each human person has inherent, inalienable dignity, and Christianity is the truest way of understanding and acting on that conviction. To demonstrate what Christianity has to offer, the book begins (after a summative introduction by Kilner) with a set of essays describing five ethical outlooks: utilitarianism, collectivism, individualism, naturalism, and transhumanism. Over email a few days after the death of Daniel Callahan, cofounder of The Hastings Center and for many years its director and then president, Joseph Fins, a longtime Hastings colleague, offered this comfort: “[H]enceforth every issue of the Report is a living memorial to Dan the writer, editor, and institution builder.” In the Hastings Center Report's first issue, published in June 1971, Dan stated, “To say that [the work of the Report] must be multi‐disciplinary is only to say the (...) issues [it will address] are as complex as human beings themselves.” This July–August 2019 issue continues the tradition Dan began. Recent revisions in child support and paternity establishment legislation enacted under the 1996 welfare reform act, the Personal Responsibility and Work Opportunity Reconciliation Act, significantly alter the American welfare state's relationship to men's fathering. Through a critical review of prior research and social service literature, the authors argue that PRWORA actively constructs fatherhood not only through state policies that maintain males as “breadwinners” but also through state-sponsored social service programs that seek to influence men's identities as fathers. Background: The United Kingdom has the highest incarceration rate in Western Europe. It is known that women in prison are a vulnerable female population who are at risk of mental ill-health due to disadvantaged and chaotic life experiences. Accurate numbers of pregnant women held in UK prisons are not recorded, yet it is estimated that 6%–7% of the female prison population are at varying stages of pregnancy and around 100 babies are born to incarcerated women each year. There are limited (...) published papers that document the departure of the researcher following closure of fieldwork with women in prison. This article identifies the dilemmas and challenges associated with the closure of prison fieldwork through the interwoven reflections of the researcher. Departure scenarios are presented which illuminate moments of closure talk with five women, supported by participant reflections regarding abandonment and loss, making pledges for the future, self-affirmation, incidental add-ons at the end of an interview and red flags, alerting the researcher to potential participant harm through ill health or self-injury. Objectives: The primary intention of the study was to observe the pregnant woman’s experience with the English prison system through interviews with pregnant women and field observations of the environment. Research design: Ethnographic design enabled the researcher, a practising midwife, to engage with the prisoners’ pregnancy experiences in three English prisons, which took place over 10 months during 2015–2016. Data collection involved semi-structured, audio-recorded interviews with 28 female prisoners in England who were pregnant or had recently given birth while imprisoned, 10 members of staff and a period of non-participant observation. Follow-up interviews with 5 women were undertaken as their pregnancies progressed. Computerised qualitative data analysis software was used to generate and analyse pregnancy-related themes. Ethical considerations: Favourable ethical opinion was granted by National Offender Management Services through the Health Research Authority Integrated Research Application System and permission to proceed was granted by the University of Hertfordshire, UK. Findings: Thematic analysis enabled the identification of themes associated with the experience of prison pregnancy illuminating how prison life continues with little consideration for their unique physical needs, coping tactics adopted and the way women negotiate entitlements. On researcher departure from the field, the complex feelings of loss and sadness were experienced by both participants and researcher. Discussion: To leave the participant with a sense of abandonment following closure of fieldwork, due to the very nature of the closed environment, risks re-enactment of previous emotional pain of separation. Although not an ethical requirement, the researcher sought out psychotherapeutic supervision during the fieldwork phase with ‘Janet’, a forensic psychotherapist, which helped to highlight the need for careful closure of research/participant relationships with a vulnerable population. This article brings to the consciousness of prison researchers the need to minimise potential harm by carefully negotiating how to exit the field. Reflections of the researcher are interlinked with utterances from some participants to illustrate the types of departure behaviours. Conclusion: Closure of fieldwork and subsequent researcher departure involving pregnant women in prison requires careful handling to uphold the ethical research principle ‘do no harm’. (shrink)

ABSTRACTUsing medical literature citations, Congressional hearings, and declassified documents this paper examines the uses of pharmaceuticals in the interrogation of vulnerable populations. From the use of IV relaxants on criminal suspects during the 1920s to the Global War on Terror, the nexus of drugs, testing, and interrogations will be explored in both the domestic and international contexts.

The aim of the paper is to discuss and evaluate the role of positive emotions for cooperation in dialogical inquiry. I analyse dialogical interactions as vehicles for inquiry, and the role of positive emotions in knowledge gain is illustrated in terms of a case study taken from Socratic Dialogue, a contemporary method used in education for fostering group knowledge. I proceed as follows. After having illustrated the case study, I analyse it through the conceptual tools of distributed cognition and character-based (...) virtue epistemology, focusing on the two functions that emotions seem to play in the process of knowledge-building. These functions are motives for joint inquiry, and building blocks of the affective environment where the inquiry takes place. Positive emotions such as love and gratitude foster knowledge generation by providing an environment for posing questions and exploring aspects of a specific topic that a subject would not investigate outside of a group. This analysis helps me defend the thesis for which positive emotions are beneficial for cooperation. Because cooperation is the process that leads a group to cognitive transformation, emotions that support cooperation are beneficial for group knowledge creation as well. I assume that the beneficial function that positive emotions play within dialogical inquiry is the one of enhancement of cooperation. A beneficial factor not only comprises positive emotions that facilitate and strengthen cooperation among the agents in their epistemic practices, but also consists of such emotions that nurture the epistemic agents, enhancing their responsibility to generate epistemic goods, as propositional knowledge or explanatory understanding, for example. Thus, the responsibility toward the epistemic practice disclose the ethical dimension of group inquiry. (shrink)

Estas reflexiones surgen a partir de una experiencia pedagógica desarrollada en el marco del Programa Pueblos Originarios y Escuelas Rurales de la UNCuyo. Consideramos que la fragmentación y la discontinuidad es un rasgo de la memoria colectiva de los sectores subalternos, sin embargo, en ocasiones encuentra espacios (...) para expresarse y tensionar la historia oficial. En esa dirección, en esta ocasión, decidimos convertir nuestros espacios curriculares en ámbitos de reflexión personal y colectiva donde los y las subalternos (parafraseando a la filósofa india Gayatri Spivak) “pudieron hablar”, para luego plasmar sus historias en fanzines. As a worldwide economic crisis emerged at the end of 2008, international health agencies were quick to highlight its predictable impact on health in the poorest of communities. The World Health Organization underscored the need for a multisectoral approach to the crisis, “seeking health gains through demonstrating the importance of health in all policies” and whether current investments in health addressed the broader social determinants of health. However, despite good intentions and decades of discussion addressing the need for transformative changes (...) globally to reduce poverty and improve health equity, little progress has been made.A recent report on progress towards the Millennium Development Goals indicates that many targeted goals have not been met, with some goals lagging many years behind schedule. Although progress towards achieving the MDGs has been made for some specific conditions, where targeted interventions have had an immediate impact, limited progress is reported in more complex areas such as maternal child health. Such complex health issues require structural changes, strong political will, long-term funding, and consideration of other health determinants, such as education and exposure to environmental hazards. IntroductionIn the coronavirus disease 2019 pandemic, Romanian universities switched to emergency relocation and online education, with students experiencing a sense of isolation, which affected their well-being, pace and normal learning style, relationships with other colleagues, and Professors. Beyond the technological obstacles that have arisen in learning, the aim of this study is to highlight the psychological variables that are associated and that explain the self-perceived well-being of students, in university, in the pandemic. The psychological variables studied were the following: the (...) level of openness and personal autonomy, as personality traits of students but also the mechanisms for regulating their academic motivation.MethodWe used a questionnaire-based survey, wherein all four research instruments had been validated and adapted to the investigated population. The subjects were BA and MA students at the University of Oradea, Romania, the majority being females with the age range of 27 years old. Pearson Correlation and Multiple Linear Regression were used to test the two hypotheses.ResultsResearch data obtained in the correlation analysis, point out association relationships with moderate and high effects size, between positive attitude toward self, others and student life and: openness to learning, openness to aesthetics, behavioral autonomy, cognitive autonomy, intrinsic motivation, and identification motivation. Furthermore, in regression analysis, it was revealed that regarding the variance of results concerning students’ self-perceived well-being in university, it contributes both of students’ personality traits and their intrinsic motivation and identification motivation.ConclusionThe fundamental conclusion of the research is that, although the personality traits of students explain in a higher percentage the variability of results in students’ self-perceived well-being, motivation regulation mechanisms play an important role, especially in the conditions of online activities. The results have direct implications for the work carried out in universities. The educational policies developed by specialists and government will have to emphasize the ways of forming resilient student communities in periods of sudden transition and adaptation to change which take place in education and society. Por un lado, reconstruir las condiciones sociales de producción de las prácticas simbólicas entre 1968 y 1971. Dichas condiciones resultaron, fundamentalmente, de los marcos normativos dictados por las instituciones culturales (la Unión de Escritores y Artistas Cubanos, las declaraciones emanadas de los congresos de 1968 y 1971) tanto como de las propias prácticas de los funcionarios (...) de esas instituciones (por ejemplo, de su modo de entender qué obras merecían ser premiadas o expulsadas de la ciudad letrada). Por otro, ver de qué manera estas condiciones reguladoras de la producción simbólica fueron desafiadas por y en dos obras ocultadas por sus autores que trabajan en torno a lo indecible: Una caja de zapatos vacía (1968), de Virgilio Piñera, y El central (fundación) (1970), de Reinaldo Arenas. Desde o início dos anos 2000, a preocupação com a utilização da neurociência para justificar estereótipos de gênero e a falta de critério dos responsáveis para diferenciar as expressões “sexo” e “gênero” têm envolvido diversas neurocientistas no debate mais profundo entre natureza e cultura apresentado por essas pesquisas. The field of ethics is enjoying a much-needed renaissance. Traditional theories and approaches are appropriately coming under fire, although not every new idea will stand time's test. Feminist thinking suggests that we at least emphasize the importance of women and their interests, focus on issues specially affecting women, rethink fundamental assumptions, incorporate feminist insights and conclusions from other areas, and be consistent with respect to our concerns about equality by paying attention to race and class.

This article examines preadolescent girls in a group setting as they coconstructed heteronormativity. The authors contend that heteronormativity is not the product of a coming-of-age transformation but instead an everyday part of life, even for very young social actors. It emerges from the gender divide between boys and girls but is also reproduced by and for girls themselves. In the Girl Project, the authors sought to understand younger girls’ interests, skills, and concerns. They conducted nine focus groups with 43 elementary (...) school girls, most of whom were age nine or younger. They observed these girls as they defined “girls’ interests” as boy centered and as they performed heteronormativity for other girls. This article contributes to filling the gap in research on gender and sexuality from children’s own points of view. (shrink)

Little is known about how researchers view ethically salient aspects of human studies. As part of a National Institutes of Mental Health-funded study, the authors performed a confidential written survey to assess the attitudes, views, and experiences of researchers with institutional review board approved protocols at the University of New Mexico. A total of 363 researchers (57% response rate) participated. Investigators overall held favorable views of general ethical aspects of research and ethics-based safeguards, and they identified a positive role of (...) ethics training. Investigators with more experience encountering ethical problems (p < .001), more ethics training (p = .001), and a PhD or MD/PhD (p = .003) held more favorable general ethical perspectives. Women investigators (p < .03), nonphysician investigators (p < .001), those whose training had been helpful in resolving ethical dilemmas (p = .006), and those for whom spirituality is important (p = .008) more strongly endorsed ethical safeguards. Investigators perceive the scientific and ethical aspects of their work as valuable and linked, and they affirm the role of safeguards in human studies. Formal ethics preparation and training initiatives were also viewed positively by investigators. (shrink)

L’investigazione del testo, che pone il «valore di legge» ma che disorienta il diritto accostando al valore la «forza di legge», passa dalla sua scomposizione, dall’interrogazione delle lettere che sono depositate e custodite nei suoi anfratti, negli interstizi. Bisogna, cioè, seguire tanto l’esplicito, la superficie, quanto le tracce disseminate, talvolta nascoste, senza dimenticare che la superficie è tale per il profondo. La ricerca muove da un’opzione ermeneutica. Ogni ricerca presuppone un’ipotesi preliminare, che l’inchiesta abbia già una direzione. In principio era (...) il Verbo e il Verbo si fece carne, ma in un senso peculiare. Nella Seconda Lettera ai Corinzi, Paolo di Tarso disse che «la lettera uccide, lo spirito dà vita», opponendo la Legge cristiana, la buona novella, l’evangelo, la parola orale portata «sulle tavole di carne dei [...] cuori», alla Legge ebraica, antica, immobile, rigida, scritta «su tavole di pietra». Altrove, però, nella Lettera ai Romani, precisò: «Togliamo dunque ogni valore alla legge mediante la fede? Nient’affatto, anzi confermiamo la legge», ove la legge, a cui il valore è qui già legato da una relazione di predicazione, è la lettera giudaica e la fede è lo spirito vivente della rivelazione cristiana. Ecco che il «valore di legge» è la secolarizzazione, più o meno consapevole, di un tema messianico. E, muovendo dalla prospettiva teologica in cui la Legge “significa”, si azzarda che «la lettera uccide chi la ignora». Contro lo spettro paolino, o meglio prima del paolinismo e poi dell’agostinismo, dell’ordine nuovo dello spirito contro la antica, morta, silente, lettera, questa lettura della Legge tenta di farsi carico del peso del testo, di “valorizzarlo” e di non ridurlo a figura, a immagine di altro, ad anagogia o ad allegoria con quel tanto di nichilismo che questa porta con sé, ove la lettera assume valore ancillare. La lettera della Legge è dura, nel senso che è, teologicamente, «scrittura su tavola» ed è, nel Secolo, scrittura incisa su carta. Ha una sua fissità, seppure alterabile. La sua normatività è tutt’uno con la sua inscalfibilità, con la sua resistenza e, dunque, con la sua positività. Ma – per restare dentro l’ordine discorsivo dell’interpretazione della Scrittura – non si avanza una proposta interpretativa masoretica, che venera superstiziosamente la lettera della Scrittura originaria e men che meno il pensiero e la voce di chi la creò e rivelò. Tutto al contrario. Per dirla nel discorso dell’interpretazione delle leggi e, tra esse, della prima legge, la Costituzione, implica il testualismo, ma non nella versione soggettivistica dell’original intent, perché i testi scritti, che sono “cose”, vivono di vita propria, separata dal loro autore (o “firmatario”) e dai lettori, potenzialmente infiniti, e producono sensi e conseguenze inintenzionali. Senza arrivare alla radicale conclusione strutturalista di Roland Barthes, che già nel 1968 decretava La mort de l’auteur, perché lo impedisce – ove ritenuta applicabile alla Costituzione/legge – l’art. 12 delle preleggi che prescrive di ricavare il senso della legge fatto palese (anche) dall’intenzione del legislatore, l’autore si trasfigura in funzione (dell’autore), perde la propria individualità e intenzionalità e si confonde, si disfa, nel discorso, nell’ordine del testo. La scissione strutturalista (e non solo) tra autore e testo nella teoria costituzionale conduce difilato al rigetto delle ragioni dell’originalismo ingenuo delle intenzioni e, con esso, del mito delle origini, ma non porta affatto all’oblio del testo in nome della esclusiva normatività della unwritten o living Constitution: sostiene, anzi, il privilegio della scrittura della legge e non della voce, del corpo e non del senso. Nel mezzo, contro il dualismo tra materia e pensiero, tra il significato immanente alle lettere, “cose scritte” nel testo e il tesoro delle intenzioni di chi scrisse la Costituzione, ciò che conta è la posizione, la “incorporazione”, nel documento costituzionale, nella scrittura che si fa testo nel senso proprio di “tessuto”, del «valore di legge» che, almeno nella “lettera”, è rimasto incorrotto e che quelle lettere hanno agito sul testo che le ha accolte e il testo ha retroagito su quelle nel tempo. Le possibilità discorsive e significanti del valore di legge dipendono, cioè, strutturalmente, dal reticolo di dati interrelati e interdipendenti che lo legano seguendo la logica interna al testo costituzionale. Va da sé che la valorizzazione della (lettera della) Legge presupponga, all’origine, un sottinteso ebraico e, quindi, la lotta alla polemica paolina contro il formalismo conservatore della legge (ebraica). È una polemica simile all’accusa di conservatorismo dell’originalismo testualista. A difesa, il testualismo è conservatore o meno a seconda del testo che serve e della relazione tra il testo dell’origine e le interpretazioni che ne sono seguite. Ma, contro l’originalismo, contro la conversione del testo costituzionale in Sacra Scrittura, la lettura che qui si esperisce si apre al commento – che quel reticolo sappia analizzare – del testo, alla sua significatività mai esaurita, che annulla la concepibilità di un testo originario inteso quale testo “autentico”.
