We argue that Brandon and Carson's (1996) "The Indeterministic Character of Evolutionary Theory" fails to identify any indeterminism that would require evolutionary theory to be a statistical or probabilistic theory. Specifically, we argue that (1) their demonstration of a mechanism by which quantum indeterminism might "percolate up" to the biological level is irrelevant; (2) their argument that natural selection is indeterministic because it is inextricably connected with drift fails to join the issue with determinism; and (3) their view that experimental (...) methodology in botany assumes indeterminism is both false and incompatible with the commitment to discoverable causal mechanisms underlying biological processes. We remain convinced that the probabilism of the theory of evolution is epistemically, not ontologically, motivated. (shrink)

This paper addresses the relationship between law and coercive force. It defends, against Frederick Schauer's contrary claims, the following propositions: The force of law consists in three things, not one: the imposition of duties, the use of coercion, and the exercise of social power. These are different and distinct. Even if coercion is not part of the concept of law, coercion is connected to law many important ways, and these are amply recognized in contemporary analytic jurisprudence. We cannot determine how (...) important coercion is to the efficacy of law until we know what counts as coercive force. The question of what counts as coercion is not a matter for generalization or stipulation. It requires an explanation of the concept of coercion. (shrink)

Within the passion narrative Matthew adds important pericopes to the Marcan text concerning both Pilate and Judas. These additional pericopes provide a rich resource for exploring the psychological motivation of and the psychological consequences for these two key actors in the betrayal and crucifixion of Jesus. The present study employs the Jungian framework of the sensing, intuition, feeling and thinking (SIFT) approach to Biblical hermeneutics to explore the interpretation of Matthew 27:19–25 (concerning Pilate) through the lenses of sensing and intuition, (...) and the interpretation of Matthew 27:3–10 (concerning Judas) through the lenses of thinking and feeling among 24 experienced preachers in Ontario, Canada. The findings confirm the hypotheses advanced by the SIFT approach that significant differences emerge between the psychological perceptions of sensing types and intuitive types, and that significant differences emerge between the psychological evaluations of thinking types and feeling types. This qualitative study was positioned within an emerging scientific field concerned with the interaction between biblical text and the psychological profile of the preacher. The theoretical framework was provided by the sensing, intuition, feeling and thinking (SIFT) approach to biblical hermeneutics, an approach rooted in reader-perspective hermeneutical theory and in Jungian psychological type theory that explores the distinctive readings of sensing perception and intuitive perception, and the distinctive readings of thinking evaluation and feeling evaluation. The empirical methodology was provided by (...) developing a research tradition concerned with applying the SIFT approach to biblical text. In the present study, a group of 17 Anglican clergy were invited to work in psychological type-alike groups to explore two of the biblical passages identified by Year B of the Revised Common Lectionary for the Feast of Christ the King. Dividing into three workshops, according to their preferences for sensing and intuition, the clergy explored Psalm 93. Dividing into three workshops, according to their preferences for thinking and feeling, the clergy explored John 18:33–37. The rich data gathered from these workshops supported the hypothesis that biblical interpretation and preaching may be shaped by the reader’s psychological type preference and suggested that the passages of scripture proposed for the Feast of Christ the King may be a joy for intuitive thinking types, but a nightmare for sensing feeling types. Contribution: Situated within the reader perspective approach to biblical hermeneutics, the SIFT method is concerned with identifying the influence of the psychological type of the reader in shaping the interpretation of text. Employing this method, the present study contributes to the fields of homiletics and hermeneutics by demonstrating how some readers (sensing types) may struggle more than others (intuitive types) to interpret the scripture readings proposed by the lectionary for the Feast of Christ the King. Quantum mechanics and probability theory share one peculiarity. Both have well established mathematical formalisms, yet both are subject to controversy about the meaning and interpretation of their basic concepts. Since probability plays a fundamental role in QM, the conceptual problems of one theory can affect the other. We first classify the interpretations of probability into three major classes: inferential probability, ensemble probability, and propensity. Class is the basis of inductive logic; deals with the frequencies of events in repeatable experiments; describes (...) a form of causality that is weaker than determinism. An important, but neglected, paper by P. Humphreys demonstrated that propensity must differ mathematically, as well as conceptually, from probability, but he did not develop a theory of propensity. Such a theory is developed in this paper. Propensity theory shares many, but not all, of the axioms of probability theory. As a consequence, propensity supports the Law of Large Numbers from probability theory, but does not support Bayes theorem. Although there are particular problems within QM to which any of the classes of probability may be applied, it is argued that the intrinsic quantum probabilities are most naturally interpreted as quantum propensities. This does not alter the familiar statistical interpretation of QM. But the interpretation of quantum states as representing knowledge is untenable. Examples show that a density matrix fails to represent knowledge. (shrink)

Despite extinction-based processes demonstrating efficacy in the animal extinction and human anxiety literatures, extinction for substance use disorders has shown poor efficacy. Reasons for this lack of success include common threats to extinction, such as renewal and reinstatement. In recent decades, research on mindfulness for SUD has flourished, and a key aspect of these mindfulness-based interventions includes teaching individuals to stay present with whatever experience they have, even if unpleasant, without trying to change/escape/avoid it. Similarly, CET teaches individuals to not (...) escape/avoid conditioned responses by engaging in drug use behavior. This paper discusses how mindfulness-based research and practices could positively influence CET through future research, with the long-term goal of improving SUD treatment. (shrink)

One of the key intentions of fresh expressions of church is to reach the kind of people inherited church find it hard to reach. Psychological type profiling of church congregations has demonstrated that Anglican churches have particular difficulty in reaching those whose Jungian judging preference is for thinking rather than for feeling. Studies that have explored the psychological type profile of participants within fresh expressions suggest that they do not significantly differ from inherited congregations in terms of reaching thinking types. (...) Two previous studies, however, have reported higher proportions of thinking types attending cathedral carol services. The present study among 441 individuals attending the Holly Bough service in Liverpool Cathedral also found a higher proportion of thinking types among the participants. These findings suggest that cathedral carol services may be functioning as fresh expressions of church in a significant way.Contribution: Situated within the science of cathedral studies, rooted in psychological type theory, and drawing on data from 441 attendees at the Holly Bough service, this study demonstrates that cathedral services at Christmas are more successful than either inherited church or fresh expressions of church in reaching thinking types. The U.S. Department of Health and Human Services has proposed substantial changes to the current regulatory system governing human subjects research in its Advanced Notice of Proposed Rulemaking, entitled “Human Subjects Research Protections: Enhancing Protections for Research Subjects and Reducing Burden, Delay, and Ambiguity for Investigators.” Some of the most significant proposed changes concern the use of biospecimens in research. Because research involving biological materials begins with an initial interaction with an individual, such research falls squarely within the human subjects (...) research regulatory framework known as the “Common Rule,” which applies to research conducted or funded by the HHS and the other signatory agencies and departments. However, as described in detail below, much biospecimen research may fall within exemptions and exceptions under the Common Rule and, thus, may be conducted without consent. The ANPRM proposes requiring written consent for research use of biospecimens, even if the biospecimens were initially collected for a purpose other than research or have been stripped of identifiers. Jeff Jordan has put together nine essays which give those who want to gamble on God something to think about. Though only three of them are really about Pascalk wager, all of them are worth reading. The most entertaining paper is Roy A. Sorensen's "Infinite Decision Theory." Sorensen confronts the St. Petersburg Paradox, which stems from the fact that there are available wagers with a potentially infinite payoff on which no one would bet $ao. Suppose you are offered $2n for each throw of a standard balanced coin until a head turns up. N = the number of tosses. It could be a long time--forever--before heads turns up. By the time n = loo you would have a bag of gold bigger than the sun. But Sorensen says the right bet is at least $23,but not much more. It is also true that since we don't know which actions God will reward, any human action has a possible infinite payoff and since all such actions have the same potential payoff none is better than the others. (Some god was moved to save Coleridge's Ancient Mariner, who had kindly thoughts about water-snakes.) Sorensen also notes that it is often said (Pascal would have agreed) that persons can be of infinite worth. If so, is rescuing one drowning person as good as rescuing five? The total worth seems to be the same. (Luckily, if Cantor is to be believed, there are larger and smaller infinities.) Sorensen ends inconclusively, but he is right that decision theory needs to address the infinite. Pascal would have had something to say. He thought that his bet was morally good. To bet on God is to act as if God exists. One who treats everyone as saved behaves as if God exists. (You don't know who is saved, but if you treat the saved as damned God will be annoyed whereas if you treat the damned as saved you won't detract from their ultimate penalty.) You don't have to bet $3, you only have to do what you ought to do anyway. The incremental cost of the bet appears to be zero. Anyhow, Pascal thought that it was not the infinite payoff (in the sense of a life of bliss) which provided the main motive for the bet but the fact that the required action was one's moral duty. Moreover, nook REVIEWS 689 if everyone behaves as if everyone is saved the result is a world in which God could appear and not be crucified. To be sure, there is a chance of an infinite life. Pascal believed human beings are potentially infinite--as is shown by our capacity for extending our knowledge to the infinite--but we are also potentially nothing, as is shown by the fact that the person never really appears in our scientific accounts. It is through God that our infinity is to be achieved, and so betting on God is also betting on ourselves in a perfectly intelligible way. There are several forms of the Ontological Argument, but it is more or less fair to say that all hang on the contention that the notion of a perfect being entails the existence of that being, since existence is involved in perfection. My first interest is in the word "perfect." The word, I think, is usually vague but it seems to me that, in the context of the proof, it has a meaning which turns out to be much more pedestrian (...) than we would suspect. The argument, if it is valid, must assert that any perfect being would have to have every possible characteristic. It alleges that existence is a characteristic and it is, of course, over this that most debate has centered. It seems clear, however, that "perfect," as employed in the argument, merely means what we would call "complete" in less august transactions. In some forms of the proof, indeed, this is made somewhat clearer since the expression "greatest possible" being is substituted for "perfect." Ordinarily, no one would be tempted to pass lightly from the notion of "that which is complete" to the notion of "the deity." Both "perfect" and "greatest possible" appear to have moral connotations and "complete" usually does not. The slide, however, is made easier by the recurrent notion that evil is not a positive quality but merely the absence of another positive quality, usually goodness. If this view is held, it certainly does follow that whatever is "complete" must be "perfect" in the moral sense as well as in the other usual senses. It is not, here, my concern to pass judgment on this notion. I am, at the moment, merely trying to trace possible sources of confusion in the argument. (shrink)

The historical-grammatical approach to exegesis, while noteworthy for uncovering historical realities, can often lead to a dry, lifeless reading of Scripture. More subjective models seek the text's contemporary relevance, but run the risk of missing the historical truth communicated by the Spirit-inspired author. This paper explores whether these two horizons can work together, and then advance toward a transformative hermeneutic. Such an interpretive method includes an openness to the Spirit's leading and guidance, a robust historical investigation, and a contextualization of (...) the message into similar contemporary situations and contexts. Statutes criminalizing behavior that risks transmission of HIV/AIDS exemplify use of the criminal law against individuals who are victims of infectious disease. These statutes, despite their frequency, are misguided in terms of the goals of the criminal law and the public health aim of reducing overall burdens of disease, for at least three important reasons. First, they identify individual offenders for punishment, a paradigm that is misplaced in the most typical contexts of transmission of infectious disease and even for HIV/AIDS, (...) despite claims of AIDS exceptionalism. Second, although there are examples of individuals who transmit infectious disease in a manner that fits the criminal law paradigm of identification of individual offenders for deterrence or retribution, these examples are limited and can be accommodated by existing criminal laws not devoted specifically to infectious disease. Third, and most importantly, the current criminal laws regarding HIV/AIDS, like many other criminal laws applied to infectious disease transmission, have been misguided in focusing on punishment of the diseased individual as a wrongful transmitter. Instead of individual offenders, activities that enhance the scale of disease transmission—behaviors that might be characterized as ‘transmission facilitation’—are a more appropriate target for the criminal law. Examples are trafficking in human beings (including sex trafficking, organ trafficking, and labor trafficking), suppression of information about the emergence of infection in circumstances in which there is a legally established obligation to disclose, and intentional or reckless activities to discourage disease treatment or prevention. Difficulties remain with justifications for criminalizing even these behaviors, however, most importantly the need for trust in reducing overall burdens of disease, problems in identifying individual responsible offenders, and potential misalignment between static criminal law and the changing nature of infectious disease. The question 'Why should I obey the law?' introduces a contemporary puzzle that is as old as philosophy itself. The puzzle is especially troublesome if we think of cases in which breaking the law is not otherwise wrongful, and in which the chances of getting caught are negligible. Philosophers from Socrates to H.L.A. Hart have struggled to give reasoned support to the idea that we do have a general moral duty to obey the law but, more recently, the greater number (...) of learned voices has expressed doubt that there is any such duty, at least as traditionally conceived. Ethicists, researchers and policy makers have paid increasing attention to the ethical conduct of research, especially research involving human beings. Research performed with and by undergraduates poses a specific set of ethical challenges. These challenges are often overlooked by the research community because it is assumed that undergraduate student researchers do not have a significant impact on the research community and that their projects are not host to research posing important ethical issues. This paper identifies several features characteristic of research (...) in undergraduate environments. The paper pays special attention to selective small liberal arts colleges, an important segment of higher education in the US, and advocates integrating instruction in research ethics wherever undergraduates are engaged in research. This study forms part of a research project designed to test the sensing, intuition, feeling and thinking (SIFT) approach to biblical hermeneutics in respect of a wide range of biblical passages. On this occasion, two contrasting approaches to perceiving (a group of eight sensing types and a group of nine intuitive types) were invited to address two questions to John 21:1–12a: What do you see in this passage? What sparks your imagination in this passage? These two contrasting groups generated characteristically (...) different readings of the same text. Contribution: The SIFT approach to biblical hermeneutics is rooted in the reader-perspective school of interpretation and is concerned with identifying the influence of the psychological type profile of the reader on the interpretation of text. The present study adds to a developing body of evidence validating the theory underpinning the SIFT approach and does so by focusing for the first time on the resurrection appearance at the lakeside in John 21. Colorado has consistently had one of the highest rates of suicide in the United States, and El Paso County has the highest number of suicide and firearm-related suicide deaths within the state. Community-based solutions like those of the Suicide Prevention Collaborative of El Paso County may be more effective in preventing suicide as they are specific to local issues, sensitive to local culture, and informed by local data, community members, and stakeholders.
