Anthropologists have provided rich field descriptions of the norms and conventions governing behavior and interactions in small-scale societies. Here, we add a further dimension to this work by presenting hypothetical moral dilemmas involving harm, to a small-scale, agrarian Mayan population, with the specific goal of exploring the hypothesis that certain moral principles apply universally. We presented Mayan participants with moral dilemmas translated into their native language, Tseltal. Paralleling several studies carried out with educated subjects living in large-scale, developed nations, the (...) Mayan participants judged harms caused as the means to a greater good as more forbidden than harms caused as a side-effect (i.e., side-effect bias). However, unlike these other populations living in large-scale societies, as well as a more educated and less rural Mayan comparison group, the target rural Mayan participants did not judge actions causing harm as worse than omissions (i.e., omission bias). A series of probes targeting the action-omission distinction suggest that the absence of an omission bias among the rural Mayan participants was not due to difficulties comprehending the dilemmas, using the judgment scale, or in attributing a greater causal role for actions over omissions. Thus, while the moral distinction between means and side-effect may be more universal, the moral distinction between actions and omission appears to be open to greater cross-cultural variation. We discuss these results in light of issues concerning the role of biological constraints and cultural variation in moral decision-making, as well as the limitations of such experimental, cross-cultural research. This essay examines the ethics of boycotting as a social response to injustice or wrongdoing. The boycotts in question are collective actions in which private citizens withdraw from or avoid consumer or cultural interaction with parties perceived to be responsible for some transgression. Whether a particular boycott is justified depends, not only on the reasonableness of the underlying moral critique, but also on what the boycotters are doing in boycotting. The essay considers four possible interpretations of the kind of act (...) in which boycotting consists: the avoidance of complicity, protest speech, social punishment, or social coercion. Each interpretation provides a plausible account of at least some cases of boycotting, yet each raises distinct challenges to justifying boycotting activities. (shrink)

With this paper I aim to demonstrate that a look beyond the Aristotelian square of opposition, and a related non-conservative view on logical determiners, contributes to both the understanding of Aristotelian syllogistics as well as to the study of quantificational structures in natural language.

Increasingly, philosophers who write about moral responsibility and accountability practices invoke the concept of “standing,” a term they claim to borrow from legal contexts. Yet critics point out that these philosophers have been maddeningly unclear about what standing is. Worse yet, no single account of the concept of “standing” seems to accommodate its current usage. This essay presents a thin account of standing, defends its usefulness in philosophical analyses of accountability practices, and develops further conceptual tools for thinking about standing.

In her later writings Jean Hampton develops an expressive theory of punishment she takes to be retributivist. Unlike Feinberg, Hampton claims wrongdoings as well as punishments are expressive. Wrongdoings assert that the victim is less valuable than victimizer. On her view we are obligated to punish because we are obligated to respond to this false assertion. Punishment expresses the moral truth that victim and wrongdoer are equally valuable. We argue that Hampton's argument would work only if she held that exerting (...) power over another provides evidence (albeit defeasible) of one's greater value. This is clearly a premise that neither she nor her readers are likely to accept. (shrink)

The last twenty-five years or so of thought about tort law have been remarkably productive and dynamic, as the dominance of the law and economics model has been challenged by theories that reintroduce the language of corrective justice. Over this same time period, theorizing about corrective justice has sprung up in response to a wide range of social, political and moral issues. I have in mind work on restorative theories in criminal justice; on postwar justice; on truth commissions, political reconciliation (...) and transitional justice in contexts of regime change; on official apologies as responses to international crises, institutionalized abuse and historical injustices; and on interpersonal apology, the making of amends, and forgiveness as responses to everyday moral transgressions. In these writings, theorists explore what people owe to one another in the aftermath of various kinds of wrongdoing, and thereby subtly challenge our ideas about what should be included under the heading of corrective justice. One new strand of thought, which appears in many of these debates, suggests that corrective justice requires a form of reconciliation or relational repair. My goal in this chapter is to introduce this idea and explore what it might offer to the philosophy of tort law. (shrink)

As medical technology becomes more sophisticate the ability to manipulate nature and manage disease forces the dilemma of when can becomes ought. Indeed, most bioethical discourse is framed in terms of balancing the values and interests and the benefits and burdens that inform principled decisions about how, when, and whether interventions should occur. Yet, despite advances in science and technology, one caregiver mandate remains as constant and compelling as it was for the earliest shaman—the relief of pain. Even when cure (...) is impossible, the physician's duty of care includes palliation. Moreover, the centrality of this obligation is both unquestioned and universal, transcending time and cultural boundaries.Although universally acknowledged, pain is a complex phenomenon for both the patient and the caregiver, influenced as much by personal values and cultural traditions as by physiological injury and disease. Do future generations of a wrongdoing group have a responsibility to preserve the memory of the past? If so, what manner of responsibility is it? In this essay, I critically examine the categories of forward-looking and backward-looking collective responsibility to see what they might offer to this discussion. I argue that these concepts of responsibility are ambiguous in ways that threaten to prevent important questions from being raised. I draw my examples from contemporary German practices of preserving the memory of (...) the Holocaust and World War II, especially the stolpersteine, which are memorial plaques for individual victims embedded in the sidewalks of German cities. Justice Sonia Sotomayor was vilified for arguing that one's social identity can contribute positively to judgment or public reason. This paper considers and expands on Sotomayor's arguments, showing that identity is relevant to snap judgments and to sensation transference that affects how speakers are assessed. It further develops a hermeneutic account of identity that can make sense of its epistemic relevance without foreclosing individual variation.

Recent advances in molecular genetics, plant physiology, and biochemistry have opened up the new biotechnology of herbicide resistant crops (HRCs). Herbicide resistant crops have been characterized as the solution for many environmental problems associated with modern crop production, being described as powerful tools for farmers that may increase production options. We are concerned that these releases are occurring in the absence of forethought about their impact on agroecosystems, the broader landscape, and the rural and urban economies and cultures. Many of (...) the benefits and risks associated with HRCs are not apparent to either the public, farmers, policy makers, or the scientific community. HRC technology raises moral issues in three areas: our duties toward the natural environment; our political and economic responsibilities to each other; and our communal character as one generation among many. We also need a rational basis on which to make evaluations of this new biotechnology. The technical aspects of their release require a logical guide to the ecological, environmental, and biological effects the release might have in sustainable agroecosystems. The initial step should include an assessment of the intrinsic qualities of the crop, the herbicide, and the resistance mechanisms. The second step should include an assessment of effects associated with population ecology, population genetics, environmental degradation, consumer health, and farm economic viability due to the resistant crop-herbicide pair. Herbicides have been used in crop production for nearly a half a century. There has been a tremendous increase in the use of these chemicals in that time. Society has seen the use of these chemicals not only help to feed many people, but also to bring costs not anticipated before the introduction of the chemicals. We need to draw on that long history of use and learn the lessons it can provide us as we approach the introduction and commercialization of the next generation of weed control technology, herbicide resistant crops. We also need to reflect on the lessons we missed during that half century because we spend more time imagining the possible benefits that would come from the technology than scrutinizing the possible harm. In this paper, I want to contribute to understanding and improving on Keenan'sintriguing equivalence result about reducible type quantifiers (Keenan, 1992).I give an alternative proof of his result which generalizes to type quantifiers, andI show how the reduction of a reducible type quantifier to (the composition of) ntype quantifiers can be effected.

This article analyzes Nancy Fraser's account of the contrasting social movements for recognition versus those for redistribution. In her most recent analysis, only those forms of recognition struggles that she equates with identity politics are subject to critique. I argue that identity politics does not have an inevitable logic to it that destines it to fracture, border patrol, internal conservatism, etc., and further that the very redistribution claims she proposes require identity politics.

This essay asks whether restorative justice practices in criminal legal systems are consistent with the aims of a liberal state.

Bi-intuitionistic logic is the union of intuitionistic and dual intuitionistic logic, and was introduced by Rauszer as a Hilbert calculus with algebraic and Kripke semantics. But her subsequent ‘cut-free’ sequent calculus has recently been shown to fail cut-elimination. We present a new cut-free sequent calculus for bi-intuitionistic logic, and prove it sound and complete with respect to its Kripke semantics. Ensuring completeness is complicated by the interaction between intuitionistic implication and dual intuitionistic exclusion, similarly to future and past modalities in (...) tense logic. Our calculus handles this interaction using derivations and refutations as first class citizens. We employ extended sequents which pass information from premises to conclusions using variables instantiated at the leaves of refutations, and rules which compose certain refutations and derivations to form derivations. Automated deduction using terminating backward search is also possible, although this is not our main purpose. (shrink)

In this paper we generalize the pigeonhole principle by using isols as our fundamental counting tool.

Lorenzo Valla's historical methodology was linked to his stress on rhetoric; he believed in oratorical persuasion, not logical argument. Refusing to screen historical events according to their moral value, he included accounts of all events. Truth was not for him an external standard, but a standard for judging propositions. Truth lay in the correct usage of words: correct language could create a correct picture of the world. Valla's concept of verisimilitude hinged on historical plausibility, not moral worth. History should be (...) a true account, correctly worded. Because of his talent to persuade the reader, plausible events illustrating his point were also included. (shrink)

This paper provides a materialist approach to defining gender identity.

Are hierarchies necessary in human relationships? This issue is a central one for feminist theory, and there is a continuing need to rethink relationships and to envision what they might be like without any sort of dominance of some over others. To aid this process of envisioning alternatives, this paper examines more closely the way one of the most intimate of hierarchies - marriage - has been argued and envisioned historically.

Less than two decades ago, Halpern (1998) presented a convincing approach for teaching critical thought. However, nowhere in her article did she explain how to “get” faculty to teach to thinking skills to transfer across domains of knowledge using: “(a) dispositional or attitudinal component, (b) instruction in and practice with critical thought, (c) structure–training activities, and (d) a metacognitive component used to direct and assess thinking.” (p. 451) It is an open question as to what type of strategies will faculty (...) need to demonstrate to create productive, knowledgeable, thinking citizenry? In this paper I focus on the faculty’s role in promoting the teaching of critical thought, that is, critical thought processes, with particular reference to dental education. Many students can develop processes of critical thought with frequent practice involving the active use of multiple types of ill-structured problems and situations designed to require the ability (1) to recall useful information, (2) to use pattern recognition, (3) to discern pertinent information, (4) to think ahead, and (5) to anticipate outcomes and problems while (6) remaining composed enough so that their emotions do not hinder decision-making skills. The essays in this volume are all concerned with the arguments about law as a system of rule-based decision-making,particularly the ideas advanced by legal philosopher Frederick Schauer. Schauer's work has not only helped revive interest in legal formalism but has also helped relocate arguments about the relationship between posited rules and morality.
