Though responses to Stout's book, "Democracy and Tradition," have touched on his discussion of rights, none has comprehensively examined his position on the subject. Having endorsed several objections Stout raises against some influential views on democracy and rights, this article proceeds to criticize Stout's description and theoretical account of the natural and human rights traditions. The central argument is that Stout cannot successfully both affirm the traditions and adhere to his account.

In this article I describe the development of my collaboration with the textile artist Susie Freeman in the production of the visual arts project Pharmacopoeia. Over the last 3 years we have created a body of work that aims to provide information about common medical treatments in a way that engages the public imagination. The work is dominated by the use of active pharmaceuticals, both pills and capsules, which are incorporated into dramatic fabrics by a process known as pocket knitting. (...) These fabrics are then made into clothing and accessories, making their individual messages easier to ‘read’. The work aims to encourage people to think about their own medical and pharmacological history, and to reflect on their relationship with commonly prescribed drugs. In recent years there has been an explosion of philosophical work on blame. Much of this work has focused on explicating the nature of blame or on examining the norms that govern it, and the primary motivation for theorizing about blame seems to derive from blame’s tight connection to responsibility. However, very little philosophical attention has been given to praise and its attendant practices. In this paper, I identify three possible explanations for this lack of attention. The traditional focus of debate in philosophy of action has been the causal theory of action and metaphysical questions about the nature of actions as events. One of the key challenges confronting cognitive science is to discover natural categories of cognitive function. Of special interest is the unity or diversity of cognitive control mechanisms. Evolutionary history is an underutilized resource that, together with neuropsychological and neuroscientific evidence, can help to provide a biological ground for the fractionation of cognitive control. Comparative evidence indicates that primate brain evolution has produced dissociable mechanisms for external action control and internal self-regulation, but that most real-world behaviors rely on a combination (...) of these. The archeological record further indicates the timing and context of distinctively human elaborations to these cognitive control functions, including the gradual emergence of increasingly complex hierarchical action control. The ethic of care provides not only a basis for understanding relationships of care at the micro level but also a potent form of political ethics, relevant to the development of welfare services. Williams (2001), for example, argues that the concept of care has the capacity to be a central referent in social policy?a point at which social and cultural transformations meet with the changing relations of welfare (Williams 2001, p. 470). English social care services are currently in another period (...) of change precipitated by the ?personalisation agenda?. This agenda is seen as having the potential to revolutionise social care, to create the conditions needed to tailor services to individual needs, and to give service users greater choice and control, including, where possible, control over their own service budgets or direct possession and management of care funds. These developments are inextricably linked to broader economic and social trends, key amongst which are the ageing of the population and changing economic conditions affecting both the labour market and the market for care services. This article applies the feminist ethic of care to an analysis of the personalisation agenda in the context of care for dependent older people. It highlights fundamental political questions posed concerning the nature and extent of older people's need for care, responsibility for meeting these needs and the associated costs. It questions whether the personalisation agenda could potentially offer a more responsive form of care, by placing more power and control in older people's hands. Key points considered are the individualisation of care and the ways in which control is conceptualised. The article concludes with an assessment of the feminist ethic of care as a basis for policy evaluation. (shrink)

There has been increasing attention given to the way in which racial genetic clusters are constructed within population genetics. In particular, some scholars have argued that the conception of “whiteness” presupposed is such analyses is inherently problematic. In light of these ongoing discussions, this article aims to further clarify and develop this implicit relationship between whiteness, purity and contemporary genetics by offering a Foucauldian critique of the discourse of race within these genetic admixture studies. The goals of this article, then, (...) are twofold: first, to unearth some of the presuppositions operative in this genetics discourse that make possible a biological conception of race; and second, to examine some of the social and historical origins of those presuppositions. What is artificial life? Much has been said about this interesting collection of efforts to artificially simulate and synthesize lifelike behavior and processes, yet we are far from having a robust philosophical understanding of just what Alifers are doing and why it ought to interest philosophers of science, and philosophers of biology in particular. In this paper, I first provide three introductory examples from the particular subset of artificial life I focus on, known as ‘soft Alife’ (s-Alife), and follow up (...) with a more in-depth review of the Avida program, which serves as my case study of s-Alife. Next, I review three well-known accounts of thought experiments, and then offer my own synthesized account, to make the argument that s-Alife functions as thought experimentation in biology. I draw a comparison between the methodology of the thought-experimental world that yields real-world results, and the s-Alife research that informs our understanding of natural life. I conclude that the insights provided by s-Alife research have the potential to fundamentally alter our understanding of the nature of organic life and thus deserve the attention of both philosophers and natural scientists. The paper is concerned with the metaphysics of emotion. It defends the claim that all emotional states, whether dormant or active, are dispositional, arguing against the prevailing view that dispositional emotional states are dispositions to go into actual emotional states. A clear distinction may be made between first-order and second-order emotional dispositions, where second-order emotional dispositions are dispositions of emotional sensitivity and first-order emotional dispositions are the emotional states themselves. Active emotional states are treated as dispositional emotional states in the (...) process of being manifested, not as different states altogether. Describing active states as occurrent states is misleading as it suggests an exclusive distinction between active/occurrent and dispositional, which is what is being questioned. The idea that dispositional states have no subjectivity is challenged, as is the argument that being flooded with a feeling as a result of an encounter with a frightening or aggravating situation cannot be the manifestation of a disposition. The paper defends a version of the perceptual account of bodily feelings, according to which having a feeling is feeling something about one’s body. But it rejects the idea, familiar in the work of William James, that what one feels when one has a feeling is something biological about one’s body. Instead it argues that to have a bodily feeling is to feel an apparent bodily indication of something – a bodily appearance. Being aware of what one’s body is apparently (...) indicating to one is being aware of something about one’s body, but the focus of attention is on what is apparently being indicated, which is not something about one’s body. This is one way of making sense of the idea in contemporary phenomenology that the body is conspicuous in feelings that do not take the body as an object of awareness. Bodily inclinations are apparent indications of what one is going to do, and it is argued that feeling one’s bodily inclinations constitutes an important class of bodily feelings – e.g. feeling like crying or feeling like being sick. Such inclinations are often felt through a process of resisting them. Bodily inclinations also have some intentionality, albeit quite limited, and this goes some way towards explaining Peter Goldie’s concept of feelings towards. (shrink)

Although ethics instruction has become an accepted part of the business school curriculum at both the undergraduate and graduate levels, some scholars have questioned its effectiveness, and research results have been mixed. However, studies yield interesting results regarding certain factors that influence the ethicality of business students and may impact the effectiveness of business ethics instruction. One of these factors is gender. Using personal and business ethics scenarios, we examine the main and interactive effects of gender and business ethics education (...) on moral judgment. We then analyze the relationships between gender and business ethics education on personal ethical perspectives. Our results indicate that women are generally more inclined to act ethically than men, but paradoxically women who have had business ethics instruction are less likely to respond ethically to business situations. In addition, men may be more responsive to business ethics education than women. Finally, women’s personal ethical orientations may become more relativistic after taking a business ethics class. The Substituted Judgment Standard for surrogate decision-making dictates that a surrogate, when making medical decisions on behalf of an incapacitated patient, ought to make the decision that the patient would have made if the patient had decisional capacity. Despite its intuitive appeal, however, SJS has been the target of a variety of criticisms. Most objections to SJS appeal to epistemic difficulties involved in determining what a patient would have decided in a given case. In this article, I offer an alternative (...) standard for surrogate decision-making that avoids these difficulties. I then offer an account of its theoretical underpinnings which shows that it preserves the central moral justification for SJS, namely, respect for patient autonomy. (shrink)

Clinical ethics consultations exist to support patients, families and clinicians who are facing ethical or moral challenges related to patient care. They provide a forum for open communication, where all stakeholders are encouraged to express their concerns and articulate their viewpoints. Ethics consultations can be requested by patients, caregivers or members of a patient’s clinical or supportive team. Althoughpatientsand by extension their families (especially in cases of decisional incapacity) are the common denominators in most ethics consultations, these constituents are theleastlikely (...) to request them. At many healthcare organisations in the USA, ethics consultations are overwhelmingly requested by physicians and other clinicians. We believe it is vital that healthcare institutions bridge the knowledge gaps and power imbalances over access to ethics consultation services through augmented policies, procedures and infrastructure. With enhanced education and support, patients and families may use ethics consultation to elevate their voices and prioritise their unique characteristics and preferences in the delivery of their healthcare. Empowering patients and families to request ethics consultation can only strengthen the patient/family–clinician relationship, enhance the shared decision-making model of care and ultimately lead to improved patient-centred care. These are things that were, are, or will be happening—like the ongoing process of someone reading or my writing this paper, for instance. Contemporary law and public policy often treat human beings as selfish creatures who respond only to punishments and rewards. Yet every day we behave unselfishly--few of us mug the elderly or steal the paper from our neighbor's yard, and many of us go out of our way to help strangers. We nevertheless overlook our own good behavior and fixate on the bad things people do and how we can stop them. In this pathbreaking book, acclaimed law and economics scholar Lynn (...) Stout argues that this focus neglects the crucial role our better impulses could play in society. Rather than lean on the power of greed to shape laws and human behavior, Stout contends that we should rely on the force of conscience. Stout makes the compelling case that conscience is neither a rare nor quirky phenomenon, but a vital force woven into our daily lives. Drawing from social psychology, behavioral economics, and evolutionary biology, Stout demonstrates how social cues--instructions from authorities, ideas about others' selfishness and unselfishness, and beliefs about benefits to others--have a powerful role in triggering unselfish behavior. Stout illustrates how our legal system can use these social cues to craft better laws that encourage more unselfish, ethical behavior in many realms, including politics and business. Humility is regarded as beneficial for individuals, relationships, and society. It is believed to increase well-being and tolerance of difference and enhance interpersonal relationships. Educating for humility could be regarded as an important element and goal of education as it helps students realise their limitations and consider different (even opposite) perspectives. However, as with other virtues, humility may be conceptualised and expressed differently across diverse cultural communities. Similarly, how to educate for humility may look different in schools around the world. (...) This special issue includes varied explorations of the philosophical and theoretical roots underpinning different conceptions of humility and their implications for education. Taken together, the papers in this issue provide a foundation for understanding the importance of humility across cultural and historical traditions of past and present, particularly those of western and Chinese societies. As such, this special issue can be informative to colleagues in virtue ethics, comparative philosophy, and moral education, as well as others who are interested in understanding contexts and meanings of humility around the world, in society and education today. What is the future of Philosophy of education? Or as many of scholars and thinkers in this final ‘future-focused’ collective piece from the philosophy of education in a new key Series put it, what are the futures—plural and multiple—of the intersections of ‘philosophy’ and ‘education?’ What is ‘Philosophy’; and what is ‘Education’, and what role may ‘enquiry’ play? Is the future of education and philosophy embracing—or at least taking seriously—and thinking with Indigenous ethicoontoepistemologies? And, perhaps most importantly, what is that (...) ‘Future’? These debates have been located in the work of diverse scholars: from the West, from Global South, from indigenous thinkers. In this collective piece, we purposefully juxtapose diverse takes on the future of these intersections. We have given up the urge to organise, place together, separate with subheadings or connect the paragraphs that follow. Instead, we let these philosophers of education and thinkers who use philosophical texts and ideas to sit together in one long read as potentially ‘strange and unusual bedfellows’. This text urges us to understand how these scholars and thinkers perceive our educational philosophical futures, and how the work and thinking they have done on thinking about what the future of that new key in philosophy of education may look like is embedded in a much deeper and richer literature, and personal experience. Moral philosophy is concerned with matters of right and wrong, and with answering questions about how we should live. Moral philosophy aims to tell us how to think about particular moral dilemmas; it aims to give us principles by which we can make moral decisions; and it aims to give us insight into how those moral principles are grounded. Starting from the assumption that one can literally perceive someone's anger in their face, I argue that this would not be possible if what is perceived is a static facial signature of their anger. There is a product–process distinction in talk of facial expression, and I argue that one can see anger in someone's facial expression only if this is understood to be a process rather than a product.

In this paper we address the interrelated questions of why and how certain features of an organism’s environment become meaningful to it. We make the case that knowing the biology is essential to understanding the foundation of meaning-making in organisms. We employ Miguel Nicolelis et al’s seminal research on the mammalian somatosensory system to enrich our own concept of brain-objects as the neurobiological intermediary between the environment and the consequent organismic behavior. In the final section, we explain how brain-objects advance (...) the ongoing discussion of what constitutes a biosemiotic system. One major aspect of interest in Filipino philosophy is education. Reflecting on the nature, aims, and problems of education, Filipino philosophy of education investigates philosophical issues and emerging trends of philosophical thinking in education which are distinctive to the Filipino context. Filipino philosophy of education has a rich potential that encompasses revisiting cultural and historical narratives, considering inclusivity, reevaluating the educational system, challenging existing pedagogies, and re-discovering indigeneity. Rowland Stout presents a new philosophical account of human action which is radically and controversially different from all rival theories.
