The proposed European Artificial Intelligence Act (AIA) is the first attempt to elaborate a general legal framework for AI carried out by any major global economy. As such, the AIA is likely to become a point of reference in the larger discourse on how AI systems can (and should) be regulated. In this article, we describe and discuss the two primary enforcement mechanisms proposed in the AIA: the _conformity assessments_ that providers of high-risk AI systems are expected to conduct, and (...) the _post-market monitoring plans_ that providers must establish to document the performance of high-risk AI systems throughout their lifetimes. We argue that the AIA can be interpreted as a proposal to establish a Europe-wide ecosystem for conducting AI auditing, albeit in other words. Our analysis offers two main contributions. First, by describing the enforcement mechanisms included in the AIA in terminology borrowed from existing literature on AI auditing, we help providers of AI systems understand how they can prove adherence to the requirements set out in the AIA in practice. Second, by examining the AIA from an auditing perspective, we seek to provide transferable lessons from previous research about how to refine further the regulatory approach outlined in the AIA. We conclude by highlighting seven aspects of the AIA where amendments (or simply clarifications) would be helpful. These include, above all, the need to translate vague concepts into verifiable criteria and to strengthen the institutional safeguards concerning conformity assessments based on internal checks. On the whole, the US Algorithmic Accountability Act of 2022 (US AAA) is a pragmatic approach to balancing the benefits and risks of automated decision systems. Yet there is still room for improvement. This commentary highlights how the US AAA can both inform and learn from the European Artificial Intelligence Act (EU AIA).

This article argues that corporate social responsibility may contribute to product differentiation in export markets and thus improve export performance. We test this argument by observing a period of decreasing export competitiveness in a leading emerging economy. Using a large-scale survey design with 252 questionnaires completed by mediumand large-sized Brazilian exporters, we used structural equations modelling to test our hypotheses. The results suggest that CSR product differentiation predicts export performance better than product quality differentiation and almost as well as product (...) innovation differentiation. Multi- group analysis further revealed that the positive and significant effect of CSR product differentiation on export performance is likely to be contingent on the number and type of countries that are targeted. Our study contributes to the literature on CSR and export performance by developing and empirically validating a model that explains under which conditions CSR-based product differentiation may lead to improved export performance. Healthcare systems are grappling with critical challenges, including chronic diseases in aging populations, unprecedented health care staffing shortages and turnover, scarce resources, unprecedented demands and wait times, escalating healthcare expenditure, and declining health outcomes. As a result, policymakers and healthcare executives are investing in artificial intelligence (AI) solutions to increase operational efficiency, lower health care costs, and improve patient care. However, current level of investment in developing healthcare AI among members of the global digital health partnership does not seem to (...) yield a high return yet. This is mainly due to underinvestment in the supporting infrastructure necessary to enable the successful implementation of AI. If a healthcare-specific AI winter is to be avoided, it is paramount that this disparity in the level of investment in the development of AI itself and in the development of the necessary supporting system components is evened out. This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

Who are we, and how do we relate to each other? Luciano Floridi, one of the leading figures in contemporary philosophy, argues that the explosive developments in Information and Communication Technologies is changing the answer to these fundamental human questions. As the boundaries between life online and offline break down, and we become seamlessly connected to each other and surrounded by smart, responsive objects, we are all becoming integrated into an "infosphere". Personas we adopt in social media, for example, (...) feed into our 'real' lives so that we begin to live, as Floridi puts in, "onlife". Following those led by Copernicus, Darwin, and Freud, this metaphysical shift represents nothing less than a fourth revolution. "Onlife" defines more and more of our daily activity - the way we shop, work, learn, care for our health, entertain ourselves, conduct our relationships; the way we interact with the worlds of law, finance, and politics; even the way we conduct war. In every department of life, ICTs have become environmental forces which are creating and transforming our realities. How can we ensure that we shall reap their benefits? What are the implicit risks? Are our technologies going to enable and empower us, or constrain us? Floridi argues that we must expand our ecological and ethical approach to cover both natural and man-made realities, putting the 'e' in an environmentalism that can deal successfully with the new challenges posed by our digital technologies and information society. Luciano Floridi presents an innovative approach to philosophy, conceived as conceptual design. His starting-point is that reality provides the data which we transform into information. He explores how we make, transform, refine, and improve the objects of our knowledge, and defends the radical idea that knowledge is design.

According to Kant, the axioms of intuition, i.e. space and time, must provide an organization of the sensory experience. However, this first orderliness of empirical sensations seems to depend on a kind of faculty pertaining to subjectivity, rather than to the encounter of these same intuitions with the real properties of phenomena. Starting from an analysis of some very significant developments in mathematical and theoretical physics in the last decades, in which intuition played an important role, we argue that nevertheless (...) intuition comes into play in a fundamentally different way to that which Kant had foreseen: in the form of a formal or “categorical” yet not sensible intuition. We show further that the statement that our space is mathematically three-dimensional and locally Euclidean by no means follows from a supposed a priori nature of the sensible or subjective space as Kant claimed. In fact, the three-dimensional space can bear many different geometrical and topological structures, as particularly the mathematical results of Milnor, Smale, Thurston and Donaldson demonstrated. On the other hand, it has been stressed that even the phenomenological or perceptual space, and especially the visual system, carries a very rich geometrical organization whose structure is essentially non-Euclidean. Finally, we argue that in order to grasp the meaning of abstract geometric objects, as n-dimensional spaces, connections on a manifold, fiber spaces, module spaces, knotted spaces and so forth, where sensible intuition is essentially lacking and where therefore another type of mathematical idealization intervenes, we need to develop a new form of intuition. Toleration is one of the fundamental principles that inform the design of a democratic and liberal society. Unfortunately, its adoption seems inconsistent with the adoption of paternalistically benevolent policies, which represent a valuable mechanism to improve individuals’ well-being. In this paper, I refer to this tension as the dilemma of toleration. The dilemma is not new. It arises when an agent A would like to be tolerant and respectful towards another agent B’s choices but, at the same time, A is (...) altruistically concerned that a particular course of action would harm, or at least not improve, B’s well-being, so A would also like to be helpful and seeks to ensure that B does not pursue such course of action, for B’s sake and even against B’s consent. In the article, I clarify the specific nature of the dilemma and show that several forms of paternalism, including those based on ethics by design and structural nudging, may not be suitable to resolve it. I then argue that one form of paternalism, based on pro-ethical design, can be compatible with toleration and hence with the respect for B’s choices, by operating only at the informational and not at the structural level of a choice architecture. This provides a successful resolution of the dilemma, showing that tolerant paternalism is not an oxymoron but a viable approach to the design of a democratic and liberal society. (shrink)

This sceptical challenge - known as the problem of the criterion - is one of the major issues in the history of epistemology, and this volume provides its first comprehensive study, in a span of time that goes from Sextus Empiricus to Quine. After an essential introduction to the notions of knowledge and of philosophy of knowledge, the book provides a detailed reconstruction of the history of the problem. The digital is deeply transforming reality. Through discussion of concepts such as identity, location, presence, law and territoriality, this article explores why and how these transformations are occurring, and highlights the importance of having a design and a plan for our new digital world.

Artificial agents (AAs), particularly but not only those in Cyberspace, extend the class of entities that can be involved in moral situations. For they can be conceived of as moral patients (as entities that can be acted upon for good or evil) and also as moral agents (as entities that can perform actions, again for good or evil). In this paper, we clarify the concept of agent and go on to separate the concerns of morality and responsibility of agents (most (...) interestingly for us, of AAs). We conclude that there is substantial and important scope, particularly in Computer Ethics, for the concept of moral agent not necessarily exhibiting free will, mental states or responsibility. This complements the more traditional approach, common at least since Montaigne and Descartes, which considers whether or not (artificial) agents have mental states, feelings, emotions and so on. By focussing directly on mind-less morality we are able to avoid that question and also many of the concerns of Artificial Intelligence. A vital component in our approach is the Method of Abstraction for analysing the level of abstraction (LoA) at which an agent is considered to act. The LoA is determined by the way in which one chooses to describe, analyse and discuss a system and its context. The Method of Abstraction is explained in terms of an interface or set of features or observables at a given LoA. Agenthood, and in particular moral agenthood, depends on a LoA. Our guidelines for agenthood are: interactivity (response to stimulus by change of state), autonomy (ability to change state without stimulus) and adaptability (ability to change the transition rules by which state is changed) at a given LoA. Morality may be thought of as a threshold defined on the observables in the interface determining the LoA under consideration. An agent is morally good if its actions all respect that threshold; and it is morally evil if some action violates it. That view is particularly informative when the agent constitutes a software or digital system, and the observables are numerical. Finally we review the consequences for Computer Ethics of our approach. In conclusion, this approach facilitates the discussion of the morality of agents not only in Cyberspace but also in the biosphere, where animals can be considered moral agents without their having to display free will, emotions or mental states, and in social contexts, where systems like organizations can play the role of moral agents. The primary cost of this facility is the extension of the class of agents and moral agents to embrace AAs. (shrink)

Modern digital technologies—from web-based services to Artificial Intelligence (AI) solutions—increasingly affect the daily lives of billions of people. Such innovation brings huge opportunities, but also concerns about design, development, and deployment of digital technologies. This article identifies and discusses five clusters of risk in the international debate about digital ethics: ethics shopping; ethics bluewashing; ethics lobbying; ethics dumping; and ethics shirking.

This Guide provides an ambitious state-of-the-art survey of the fundamental themes, problems, arguments and theories constituting the philosophy of computing.

The use of “levels of abstraction” in philosophical analysis (levelism) has recently come under attack. In this paper, I argue that a refined version of epistemological levelism should be retained as a fundamental method, called the method of levels of abstraction. After a brief introduction, in section “Some Definitions and Preliminary Examples” the nature and applicability of the epistemological method of levels of abstraction is clarified. In section “A Classic Application of the Method ofion”, the philosophical fruitfulness of the new (...) method is shown by using Kant’s classic discussion of the “antinomies of pure reason” as an example. In section “The Philosophy of the Method of Abstraction”, the method is further specified and supported by distinguishing it from three other forms of “levelism”: (i) levels of organisation; (ii) levels of explanation and (iii) conceptual schemes. In that context, the problems of relativism and antirealism are also briefly addressed. The conclusion discusses some of the work that lies ahead, two potential limitations of the method and some results that have already been obtained by applying the method to some long-standing philosophical problems. In this commentary, we discuss the nature of reversible and irreversible questions, that is, questions that may enable one to identify the nature of the source of their answers. We then introduce GPT-3, a third-generation, autoregressive language model that uses deep learning to produce human-like texts, and use the previous distinction to analyse it. We expand the analysis to present three tests based on mathematical, semantic, and ethical questions and show that GPT-3 is not designed to pass any of them. (...) This is a reminder that GPT-3 does not do what it is not supposed to do, and that any interpretation of GPT-3 as the beginning of the emergence of a general form of artificial intelligence is merely uninformed science fiction. We conclude by outlining some of the significant consequences of the industrialisation of automatic and cheap production of good, semantic artefacts. (shrink)

One of the open problems in the philosophy of information is whether there is an information logic (IL), different from epistemic (EL) and doxastic logic (DL), which formalises the relation “a is informed that p” (Iap) satisfactorily. In this paper, the problem is solved by arguing that the axiom schemata of the normal modal logic (NML) KTB (also known as B or Br or Brouwer’s system) are well suited to formalise the relation of “being informed”. After having shown that IL (...) can be constructed as an informational reading of KTB, four consequences of a KTB-based IL are explored: information overload; the veridicality thesis (Iap → p); the relation between IL and EL; and the Kp → Bp principle or entailment property, according to which knowledge implies belief. This article offers an account and defence of constructionism, both as a metaphilosophical approach and as a philosophical methodology, with references to the so-called maker's knowledge tradition. Its main thesis is that Plato's “user's knowledge” tradition should be complemented, if not replaced, by a constructionist approach to philosophical problems in general and to knowledge in particular. Epistemic agents know something when they are able to build (reproduce, simulate, model, construct, etc.) that something and plug the obtained information into the correct (...) network of relations that account for it. Their epistemic expertise increases with the scope and depth of the questions that they are able to ask and answer. Thus, constructionism deprioritises mimetic, passive, and declarative knowledge that something is the case, in favour of poietic, interactive, and practical knowledge of something being the case. Metaphilosophically, constructionism suggests adding conceptual engineering to conceptual analysis as a fundamental method. (shrink)

New developments in the field of communication and information technology will profoundly reshape the answers to questions of deep interest for humanity and philosophy. Who are we and what kind of relationship we establish among us? The boundaries between real life and virtual life tend to evanish. We are progressively becoming part of a global “infosphere”. This candid interview with professor Floridi try to shed some light on these issues, by considering the philosophical framework developed by the “infosphere philosopher”.

This paper focuses on the relation between icon and depiction and their equally central role both in verbal and in nonverbal artistic texts. For this purpose, I will examine the contact points between Jakobson and Bakhtin’s theory of text. In particular, I will dwell on Jakobson’s “Quest for the essence of language” and on Bakhtin’s “The Problem of the Text in Linguistics, Philology, and the Human Sciences.” Both Jakobson and Bakhtin build their idea of text on this dialogue between different (...) dimensions. According to Bakhtin dialogical logic is the specific logic of the text. Though indispensable in the initial phase of understanding, the first is reductive if it claims to exhaust the semantic import of the text. Both in Bakhtin and in Jakobson, this idea of text based upon a dialogue between different dimensions implies that sign expression cannot be exhausted in representation because there is something which exceeds representation. I will call this excedent element “depiction.” Depiction is what is at stake in the artistic text, what exceeds the symbolic level of representation. “Depiction” can be configured, both in verbal and non-verbal text, as an idea of iconicity which exceeds resemblance and immediate visibility. Intentaremos (...) mostrar que Filón utiliza la metáfora de dos maneras distintas que manifiestan la fuerte ambivalencia existente en su pensamiento respecto de la valoración del cuerpo humano. The idea that the body (σῶμα) is a tomb (σῆμα) where the soul remains confined as a punishment for an ancient fault is transmitted by Plato, who attributes it to the orphics. Philo of Alexandria made use of this metaphor of orphic origin in various passages of his work. Our interest is to analyze the sense that Philo assigns to it and the way in which he reelaborates the meaning that was ascribed to it in orphic tradition and in the platonic interpretation. We will try to demonstrate that Philo uses the metaphor in two different ways that show the strong ambivalence existing in his thought with respect to the value of the human body. (shrink)

The essential difficulty about Computer Ethics' (CE) philosophical status is a methodological problem: standard ethical theories cannot easily be adapted to deal with CE-problems, which appear to strain their conceptual resources, and CE requires a conceptual foundation as an ethical theory. Information Ethics (IE), the philosophical foundational counterpart of CE, can be seen as a particular case of environmental ethics or ethics of the infosphere. What is good for an information entity and the infosphere in general? This is the ethical (...) question asked by IE. The answer is provided by a minimalist theory of deseerts: IE argues that there is something more elementary and fundamental than life and pain, namely being, understood as information, and entropy, and that any information entity is to be recognised as the centre of a minimal moral claim, which deserves recognition and should help to regulate the implementation of any information process involving it. IE can provide a valuable perspective from which to approach, with insight and adequate discernment, not only moral problems in CE, but also the whole range of conceptual and moral phenomena that form the ethical discourse. Developing the concept of infraethics, this paper argues that all societies need rules for effective co-ordination and collaboration of their infrastructures, and that their design and maintenance is one of the crucial challenges for our own world today. -/- .

AI is revolutionizing everyone’s life, and it is crucial that it does so in the right way. AI’s profound and far-reaching potential for transformation concerns the engineering of systems that have some degree of autonomous agency. This is epochal and requires establishing a new, ethical balance between human and artificial autonomy.

This paper outlines a quantitative theory of strongly semantic information (TSSI) based on truth-values rather than probability distributions. The main hypothesis supported in the paper is that the classic quantitative theory of weakly semantic information (TWSI), based on probability distributions, assumes that truth-values supervene on factual semantic information, yet this principle is too weak and generates a well-known semantic paradox, whereas TSSI, according to which factual semantic information encapsulates truth, can avoid the paradox and is more in line with the (...) standard conception of what generally counts as semantic information. After a brief introduction, section two outlines the semantic paradox implied by TWSI, analysing it in terms of an initial conflict between two requisites of a quantitative theory of semantic information. In section three, three criteria of semantic information equivalence are used to provide a taxonomy of quantitative approaches to semantic information and introduce TSSI. In section four, some further desiderata that should be fulfilled by a quantitative TSSI are explained. From section five to section seven, TSSI is developed on the basis of a calculus of truth-values and semantic discrepancy with respect to a given situation. In section eight, it is shown how TSSI succeeds in solving the paradox. Section nine summarises the main results of the paper and indicates some future developments. (shrink)

The philosophy of information (PI) is a new area of research with its own field of investigation and methodology. This article, based on the Herbert A. Simon Lecture of Computing and Philosophy I gave at Carnegie Mellon University in 2001, analyses the eighteen principal open problems in PI. Section 1 introduces the analysis by outlining Herbert Simon's approach to PI. Section 2 discusses some methodological considerations about what counts as a good philosophical problem. The discussion centers on Hilbert's famous analysis (...) of the central problems in mathematics. The rest of the article is devoted to the eighteen problems. These are organized into five sections: problems in the analysis of the concept of information, in semantics, in the study of intelligence, in the relation between information and nature, and in the investigation of values. The paper argues that digital ontology (the ultimate nature of reality is digital, and the universe is a computational system equivalent to a Turing Machine) should be carefully distinguished from informational ontology (the ultimate nature of reality is structural), in order to abandon the former and retain only the latter as a promising line of research. Digital vs. analogue is a Boolean dichotomy typical of our computational paradigm, but digital and analogue are only “modes of presentation” of Being (to paraphrase (...) Kant), that is, ways in which reality is experienced or conceptualised by an epistemic agent at a given level of abstraction. A preferable alternative is provided by an informational approach to structural realism, according to which knowledge of the world is knowledge of its structures. The most reasonable ontological commitment turns out to be in favour of an interpretation of reality as the totality of structures dynamically interacting with each other. The paper is the first part (the pars destruens) of a two-part piece of research. 2017 saw the occurrence of two major IT disasters: the meltdown that plunged into chaos British Airways’ flights at Heathrow and Gatwick airports, and the WannaCry malware hit on Microsoft Windows systems. Incidents like these exemplify how fragile the digital is and how systemic the problems caused by digital failures can be. This paper explores some possible solutions to ensure that any damage caused by such failures is limited. These include redundancy, reflexivity and insurance, accountability, and collaboration.

O uso de drogas é complexo e multicausal com impactos para as pessoas, famílias e sociedade. Este estudo investigou legislações, políticas públicas e estratégias, que possam diminuir vulnerabilidades e contribuir para os ODS. Foi realizado levantamento documental, em legislações e documentos, para análise da realidade social, a partir das experiências profissionais, e ainda levantamento bibliográfico, na BVS e LILACS, de 2016 a 2018. Observou-se que o Estado se mantém disciplinador e entre as políticas mais relevantes estão a Redução de Danos, (...) os CAPS e o Consultório de Rua, marcadas pelo empirismo, obstáculos e desafios em relação à universalidade e equidade. Estratégias intersetoriais, podem ser utilizadas para se obter melhores condições de saúde e bem-estar, saneamento e água, educação, trabalho. A promoção da saúde corrobora na redução das vulnerabilidades e equidade, com maior sensibilização e qualificação dos profissionais das redes de atenção social, para acolher a população com competência e dignidade. Abstract: In this article I argue that the best way to understand the information turn is in terms of a fourth revolution in the long process of reassessing humanity's fundamental nature and role in the universe. We are not immobile, at the centre of the universe (Copernicus); we are not unnaturally distinct and different from the rest of the animal world (Darwin); and we are far from being entirely transparent to ourselves (Freud). We are now slowly accepting the idea that (...) we might be informational organisms among many agents (Turing), inforgs not so dramatically different from clever, engineered artefacts, but sharing with them a global environment that is ultimately made of information, the infosphere.
