This paper analyses whether current explainable AI (XAI) techniques can help to address taxpayer concerns about the use of AI in taxation. As tax authorities around the world increase their use of AI-based techniques, taxpayers are increasingly at a loss about whether and how the ensuing decisions follow the procedures required by law and respect their substantive rights. The use of XAI has been proposed as a response to this issue, but it is still an open question whether current XAI (...) techniques are enough to meet existing legal requirements. The paper approaches this question in the context of a case study: a prototype tax fraud detector trained on an anonymized dataset of real-world cases handled by the Buenos Aires (Argentina) tax authority. The decisions produced by this detector are explained through the use of various classification methods, and the outputs of these explanation models are evaluated on their explanatory power and on their compliance with the legal obligation that tax authorities provide the rationale behind their decision-making. We conclude the paper by suggesting technical and legal approaches for designing explanation mechanisms that meet the needs of legal explanation in the tax domain. (shrink)

The Fairness, Accountability, and Transparency (FAccT) literature tends to focus on bias as a problem that requires ex post solutions (e.g. fairness metrics), rather than addressing the underlying social and technical conditions that (re)produce it. In this article, we propose a complementary strategy that uses genealogy as a constructive, epistemic critique to explain algorithmic bias in terms of the conditions that enable it. We focus on XAI feature attributions (Shapley values) and counterfactual approaches as potential tools to gauge these conditions (...) and offer two main contributions. One is constructive: we develop a theoretical framework to classify these approaches according to their relevance for bias as evidence of social disparities. We draw on Pearl’s ladder of causation (Causality: models, reasoning, and inference. Cambridge University Press, Cambridge, 2000, Causality, 2nd edn. Cambridge University Press, Cambridge, 2009. doi:10.1017/CBO9780511803161) to order these XAI approaches concerning their ability to answer fairness-relevant questions and identify fairness-relevant solutions. The other contribution is critical: we evaluate these approaches in terms of their assumptions about the role of protected characteristics in discriminatory outcomes. We achieve this by building on Kohler-Hausmann’s (Northwest Univ Law Rev 113(5):1163–1227, 2019) constructivist theory of discrimination. We derive three recommendations for XAI practitioners to develop and AI policymakers to regulate tools that address algorithmic bias in its conditions and hence mitigate its future occurrence. As lawmakers produce norms, the underlying normative system is affected showing the intrinsic dynamism of law. Through undertaken actions of legal change, the normative system is continuously modified. In a usual legislative practice, the time for an enacted legal provision to be in force may differ from that of its inclusion to the legal system, or from that in which it produces legal effects. Even more, some provisions can produce effects retroactively in time. In this article we study a simulation (...) of such process through the formalisation of a temporalised logical framework upon which a novel belief revision model tackles the dynamic nature of law. Represented through intervals, the temporalisation of sentences allows differentiating the temporal parameters of norms. In addition, a proposed revision operator allows assessing change to the legal system by including a new temporalised literal while preserving the time-based consistency. This can be achieved either by pushing out conflictive pieces of pre-existing norms or through the modification of intervals in which such norms can be either in force, or produce effects. Finally, the construction of the temporalised revision operator is axiomatically characterised and its rational behavior proved through a corresponding representation theorem. (shrink)

The SARS-CoV-2 (COVID-19) pandemic has caused social and economic devastation. As the milestone of two years of ‘living with the virus’ approaches, governments and businesses are attempting to develop means of reopening society whilst still protecting public health. However, developing interventions – particularly technological interventions – that find a safe, socially acceptable, and ethically justifiable balance between these two seemingly opposing demands is extremely challenging. There is no one right solution, but the current most popular ‘solution’ is the so-called ‘COVID-19 (...) Vaccine Passport’ (also known as COVID-19 passes or certificates), the use of which may be supported by both human rights and international public health law if they are designed and implemented appropriately. (We use the term ‘Vaccine Passport’ because it has been adopted by the popular press. Though it has been used in many ways, here we use it generically to refer to a document that certifies that an individual has been vaccinated against COVID-19 and on that basis grants the bearer more liberties than to those who have not been vaccinated. Later, we will discuss why it is necessary to move beyond considering only vaccinations, which informs our preferred term of ‘COVID-19 Status Pass’.) We set out to answer the following questions: how should governments and businesses assess the risks in light of human rights, public health ethics, and digital ethics concerns which emerge from developing and deploying COVID-19 Vaccine Passports? What design decisions should businesses make when developing COVID-19 Vaccine Passports to help ensure they respect human rights, and both public health and digital ethics? Do the implications for human rights, public health, and digital ethics vary depending on where and when COVID-19 Vaccine Passports are used? What are the rights and powers of the individual to object to or seek remedy for the use of COVID-19 Vaccine Passports? How can the risks of inequalities and social division derived from the deployment of COVID-19 Vaccine Passports be avoided or mitigated? We conducted a literature review and documentary analysis, supplementing our findings with news articles where appropriate. The following pages report our results, concluding with a series of actionable recommendations for businesses, national governments, and supranational organisations. (shrink)

ObjectiveThis study aims to analyze sociohistorically how the normative patterns of hegemonic masculinity produced impacts on men’s health/mental health in the context of the COVID-19 pandemic.MethodsA qualitative study from a socio-historical perspective was conducted with 50 men based on an online survey. A semistructured form was applied. The data were analyzed by the Collective Subject Discourse method, interpreted in the light of the context of epidemic disease and hegemonic masculinity.ResultsThe experience of the pandemic exposed the normative patterns of masculinities from (...) the consummation of acts representative of the pandemic context, which incited men to deny the existence of COVID-19 disease and to delay the understanding and adoption of measures to protect and control COVID-19. As a repercussion, men presented conflicts in the regulation of emotions; presented emotional suppression; were more reactive; felt threatened regarding the loss of the role of family provider, virility; and revealed a sense of invulnerability, added to the weakening of self-care.ConclusionThe discourse revealed that the men’s behaviors are consistent with the characteristics of hegemonic masculinity, but express signs of recognition that this behavior causes harm to themselves and their health. In this article, I summarise the ontological theory of informational privacy (an approach based on information ethics) and then discuss four types of interesting challenges confronting any theory of informational privacy: (1) parochial ontologies and non-Western approaches to informational privacy; (2) individualism and the anthropology of informational privacy; (3) the scope and limits of informational privacy; and (4) public, passive and active informational privacy. In this paper we propose an approach to multi-source belief revision where the trust or credibility assigned to informant agents can be revised. In our proposal, the credibility of each informant represented as a strict partial order among informant agents, will be maintained in a repository called credibility base. Upon arrival of new information concerning the credibility of its peers, an agent will be capable of revising this strict partial order, changing the trust assigned to its peers accordingly. Our goal (...) is to formalize a set of change operators over the credibility base: expansion, contraction, prioritized, and non-prioritized revision. These operators will provide the capability of dynamically modifying the credibility of informants considering the reliability of the information. In previous works (Floridi 2018) I introduced the distinction between hard ethics (which may broadly be described as what is morally right and wrong independently of whether something is legal or illegal), and soft or post-compliance ethics (which focuses on what ought to be done over and above existing legislation). Who are we, and how do we relate to each other? Luciano Floridi, one of the leading figures in contemporary philosophy, argues that the explosive developments in Information and Communication Technologies is changing the answer to these fundamental human questions. As the boundaries between life online and offline break down, and we become seamlessly connected to each other and surrounded by smart, responsive objects, we are all becoming integrated into an "infosphere". Personas we adopt in social media, for example, (...) feed into our 'real' lives so that we begin to live, as Floridi puts in, "onlife". Following those led by Copernicus, Darwin, and Freud, this metaphysical shift represents nothing less than a fourth revolution. "Onlife" defines more and more of our daily activity - the way we shop, work, learn, care for our health, entertain ourselves, conduct our relationships; the way we interact with the worlds of law, finance, and politics; even the way we conduct war. In every department of life, ICTs have become environmental forces which are creating and transforming our realities. How can we ensure that we shall reap their benefits? What are the implicit risks? Are our technologies going to enable and empower us, or constrain us? Floridi argues that we must expand our ecological and ethical approach to cover both natural and man-made realities, putting the 'e' in an environmentalism that can deal successfully with the new challenges posed by our digital technologies and information society. Este artigo busca um diálogo entre a filosofia e a música, esta tratada mais como área do conhecimento do que como fenômeno estético ou social. Procurando uma superação da classificação de Boécio, que colocava o teórico como o terceiro e mais elevado tipo de músico – acima do instrumentista e do poeta –, notamos que a hermenêutica gadameriana impõe uma reunião do aspecto prático e teórico no âmbito da interpretação que acredito oferecer fundamento para uma epistemologia da interpretação musical. O (...) que a classificação boeciana perde de vista é que a música – como toda a proposição artística– é uma forma de pensamento. Gadamer vem aqui em nosso encontro através de seu livro Verdade e Método, um dos mais sólidos trabalhos em epistemologia do século XX, na medida em que determina a obra de arte “ ao lado da experiência da filosofia ”, como “a mais peremptória advertência à consciência científica, no sentido de reconhecer seus limites”. É nesta chave que desenvolvemos um modelo preliminar de constituição interpretativa, partindo do caráter universal da hermenêutica, proposto por Gadamer a partir do fenômeno da compreensão em sua concepção mais geral, Esse modelo precisaria ser, ao mesmo tempo, sistemático e aberto. E tem, ao mesmo tempo, implicações filosóficas sobre a atuação histórico-social do músico pesquisador. Em uma abordagem assim, justifica-se não só a presença da música enquanto disciplina da Universidade, mas também o fato – incômodo para alguns, especialmente ligados à tradição da musikwissenschaft – de essa presença assumir a herança do modelo conservatorial do aprendizado de ofício, não mais como uma tradição antiga e aceita, mas como um ponto de partida para novas proposições artísticas. What is the impact of information and communication technologies (ICTs) on the human condition? In order to address this question, in 2012 the European Commission organized a research project entitled The Onlife Initiative: concept reengineering for rethinking societal concerns in the digital transition. This volume collects the work of the Onlife Initiative. It explores how the development and widespread use of ICTs have a radical impact on the human condition.

This article reports the findings of AI4People, an Atomium—EISMD initiative designed to lay the foundations for a “Good AI Society”. We introduce the core opportunities and risks of AI for society; present a synthesis of five ethical principles that should undergird its development and adoption; and offer 20 concrete recommendations—to assess, to develop, to incentivise, and to support good AI—which in some cases may be undertaken directly by national or supranational policy makers, while in others may be led by other (...) stakeholders. En el presente trabajo sostengo que los argumentos específicos desarrollados por John Rawls para justificar la adopción de un estándar de bienes sociales primarios no logran su cometido. En primer lugar, presento y critico los argumentos rawlsianos relacionados con intuiciones antidiscriminatorias y con el hecho del pluralismo razonable. Asimismo, caracterizo y critico las ideas rawlsianas concernientes al alcance del concepto de equidad, así como el argumento de los gustos caros y de la responsabilidad por los fines. Estimo que ellos no (...) logran justificar el distribuendum recursivista de bienes sociales primarios. En cambio, entiendo que tales consideraciones brindan apoyo a un estándar bienestarista. Ello se debe a que un estándar welfarista enfrenta exitosamente las dificultades que Rawls menciona para favorecer el estándar recursivista de bienes sociales primarios. In the present paper I argue that the specific arguments developed by John Rawls to justify the standard of social primary goods do not succeed. In the first place I develop and criticize the Rawlsian arguments grounded in antidiscriminatory intuitions and the fact of reasonable pluralism. I also characterize and criticize Rawls's ideas concerning the scope of the concept of fairness as well as his argument concerning extensive tastes and responsibility for ends. I believe that they do not justify a resourcist distribuendum. On the contrary, I argue that such considerations support a welfarist standard. The reason is that a welfarist standard successfully deals with the difficulties Rawls mentions in favoring the resourcist standard of social primary goods. (shrink)

In the past months, there has been a lively debate about so-called COVID-19 apps developed to deal with the pandemic (Morley et al. 2020b). Some of the best solutions use the Bluetooth connection of mobile phones to determine contacts between people and therefore the probability of contagion, and then suggested related measures. In theory, it may seem simple. In practice, there are several ethical problems (Morley et al. 2020a), not only legal and technical ones. To understand them, it is useful (...) to distinguish between the validation and the verification of a system, remembering that these words are used here only in the design/engineering sense, and certainly not philosophically. Information and Communication Technologies have profoundly changed many aspects of life, including the nature of entertainment, work, communication, education, healthcare, industrial production and business, social relations and conflicts. They have had a radical and widespread impact on our moral lives and hence on contemporary ethical debates. The Cambridge Handbook of Information and Computer Ethics, first published in 2010, provides an ambitious and authoritative introduction to the field, with discussions of a range of topics including privacy, ownership, freedom of speech, responsibility, (...) technological determinism, the digital divide, cyber warfare, and online pornography. On 21 April 2021, the European Commission published the proposal of the new EU Artificial Intelligence Act (AIA) — one of the most influential steps taken so far to regulate AI internationally. This article highlights some foundational aspects of the Act and analyses the philosophy behind its proposal.

The goal of the book is to present the latest research on the new challenges of data technologies. It will offer an overview of the social, ethical and legal problems posed by group profiling, big data and predictive analysis and of the different approaches and methods that can be used to address them. In doing so, it will help the reader to gain a better grasp of the ethical and legal conundrums posed by group profiling. The volume first maps the (...) current and emerging uses of new data technologies and clarifies the promises and dangers of group profiling in real life situations. It then balances this with an analysis of how far the current legal paradigm grants group rights to privacy and data protection, and discusses possible routes to addressing these problems. This paper stems from previous works of the authors in which a new measure of the simplicity of an explanation based on its degree of arbitrariness is proposed: The more the explanation is arbitray, the less appealing it is, with explanations having no arbitrariness – called constrained – being the preferred ones. In previous works, as commonly done in the literature of abductive logic programming, a set of hypotheses is not an explanation, unless it is definite, i.e. it explains all (...) the data belonging to the observation. In this paper, we follow a different perspective and define the concept of indefinite constrained explanations, i.e. constrained explanations that are not definite, but admit some indefiniteness. An indefinite constrained explanation captures the intuition of the existence of an explanation (indefinite explanation) that would best explain the given evidence, while not making arbitrary choices (constrained explanation). The main contribution of the paper is the study of abduction in indefinite deductive theories: specifically, the paper studies the framework of abductive logic programming extended with integrity constraints in the setting in which both the initial knowledge base and the abductive explanations are indefinite (may contain occurrences of null values) and the domain is possibly infinite. Furthermore, the paper discusses the complexity of problems concerning indefinite (constrained) explanations. (shrink)

En el presente artículo, mi objetivo es ofrecer un análisis de la posible comparación entre la filosofía de Fichte y la pragmática trascendental de Apel. A pesar de algunas coincidencias importantes, la comparación no resulta completamente satisfactoria. En realidad, el pensamiento de Fichte corresponde al paradigma moderno de una filosofía de la conciencia. Por consiguiente, su reflexión trascendental no pretende descubrir las condiciones intersubjetivas del discurso, sino las condiciones subjetivas del pensamiento. Según Fichte, el fundamento último de la filosofía no (...) se encuentra en la dimensión pragmática del lenguaje o en una comunidad ideal de comunicación, sino más bien en la unidad de la autoconciencia subjetiva en el pensamiento, el conocimiento y la acción. In this paper, my aim is to offer an approach to the possible comparison between Fichte's idealism and Apel's transcendental pragmatics. Despite some relevant similarities, the comparison of these philosophical theories is not completely satisfactory. Indeed, Fichte's thought corresponds to the modern paradigm of a philosophy of consciousness. Therefore, his transcendental reflection does not intend to discover the intersubjective conditions of discourse, but the subjective conditions of thought. According to Fichte, the ultimate foundation of philosophy cannot be found in the pragmatic dimension of language or ideal community of communication, but in the unity of subjective self-awareness in thinking, knowledge and action. Es muy importante reflexionar sobre algunas claves de su pensamiento: a) no hay isomorfismo entre ser y pensar (o naturaleza y razón); b) la indeterminación del Dios-Naturaleza es deliberada y es imposible atribuir ningún sentido y significado al absoluto; c) los cimientos de la razón son las «nociones comunes», que pertenecen a un modelo físico de pensamiento.

Inducement prizes have been long used to stimulate individuals and groups to accomplish diverse goals. Lately, governments have become more and more interested in these prizes and sought to include this kind of incentives within the set of policy tools available to promote science, technology, and innovation. To date, however, there has been little empirically-based scientific knowledge on how to design, manage, and evaluate innovation prizes. This note discusses aspects of the prize phenomenon and the opportunities and challenges related with (...) the use of innovation prizes as a government policy instrument. Compared to other incentive mechanisms, prizes are likely to present advantages to, for example, accelerate the development and commercialization of technologies that are held back for diverse reasons and help to leverage public money with external ideas, collaborative efforts, and the participation of diverse individuals and organizations. Still, despite these advantages and other interesting features of prizes, there are key questions that policy-makers and scholars must address to better understand this kind of incentives and further improve prize designs and implementations before governments move forward to a more widespread use of innovation prizes in science and technology policies.
