Legal norms are an invention. This paper advances a proposal about what kind of invention they are. The proposal is that legal norms derive from rules which specify role functions in a legal system. Legal rules attach to agents in virtue of their status within the system in which the rules operate. The point of legal rules or a legal system is to solve to large scale coordination problems, specifically the problem of organizing social and economic life among a group (...) of people and their successors, though not every legal rule pertains to a coordination problem. The framework for thinking about legal norms that I describe is a framework for thinking about institutions and policies more generally. The idea is to show that legal norms are a species of institutional norm. There are two central ideas. The first is the idea of a role in an institution. The second is the idea of proxy agency. Proxy agency involves one agent or group acting under the authorization of another agent or group (perhaps subsuming it) in a way that makes the actions of the proxy count as actions (under a description) of the individual or group for which it is a proxy. We get the characteristic structure of a legal system by conceiving of an institutional group, itself conceived of as a set of interlocking roles realized in individuals, as having one or more roles for proxy agents who are authorized by the group to make policy for the group. The set of rules governing the basic constitution of the group and spelling out the powers of the policy proxies determine fundamental norms for the group with specific role responsibilities attaching to particular positions in institutional arrangements. The policies determine further norms whose force derives from the fundamental norms. We must then say some further things to distinguish institutions and policies which we wish to designate as legal. This article responds to a case-based argument by Mark Richard that rule of reference is not essential to meaning. It objects that the argument requires shifting between understanding the relevant term in the case, ‘marriage,’ as a determinable, in order to support one premise, and a determinate, in order to support another. On no univocal interpretation can both premises be made true.

Even after yet another grand conjecture has been proved or refuted, any omniscience principle that had trivially settled this question is just as little acceptable as before. The significance of the constructive enterprise is therefore not affected by any gain of knowledge. In particular, there is no need to adapt weak counterexamples to mathematical progress.

This article addresses ontological negotiations in the Global South through three case studies of community-based research in Brazil and Ghana. We argue that ontological perspectives of Indigenous and other subjugated communities require an ontological pluralism that recognizes the plurality of both representational tools and ways of being in the world. Locating these two readings of ontological pluralism in the politics of the Global South, the article highlights a wider dynamic from ontological paternalism to ontological diversity to ontological decolonization. With reference to Mead, Peirce, speech act theory, conversation analysis, and Luhmann's phenomenological grounded version of systems theory, the paper tries to reconstruct actions as products of communication. A triadic sequence is identified as the elementary unit for the intersubjective constitution of an act. This unit combines three achievements: (a) the constitution of meaning by sequential attribution, (b) the intersubjective coordination of attributed meanings, and (c) the reproduction of rules, guiding the process of constitution and coordination of attributed meanings. Then, (...) using the tools of systems theory and applying them to empirical results of ethnomethodology and conversation analysis, it is shown how the rule scheme is integrated in a triadic sequence, functioning on three different levels of communication. Finally, a specific form of repair after next turn is discussed, relating it to the function of preserving the structure of conversational types. The analysis of such conversational types opens a possible realm of cooperation between conversation analysis and Luhmann's version of systems theory. (shrink)

Die Beiträge behandeln in systematischer und historischer Sicht epistemologisch orientierte Fragen nach dem gesellschaftlichen und kulturellen Standort von Theorie zwischen Wissenschaftskultur und Kulturwissenschaft. Sie gehen dem Eindruck nach, demzufolge die Ambivalenz theoretischer 'Passion' entweder eher zu ereignisträchtigen kulturellen Formen oder aber ins Abseits theoretisch-organisatorischer Betriebsamkeit führt. Nicht nur in den Geisteswissenschaften lässt sich beobachten, dass Theoriebildungsprozesse innerhalb einer vielfach unterschätzten Bandbreite von Denkstilen vonstatten gehen - zwischen Intuition und Konstruktion. Diese Vor- und Nachrationalisierungen theoretischen Denkens hat die bisherige Theoriegeschichte weitgehend (...) unbeachtet gelassen; auch für diese Denkstil-Bandbreite steht der Platzhalter 'kulturell'. Es sind mithin sowohl die gesellschaftlich-institutionellen Einbindungsformen als auch die möglichen kulturellen Ressourcen von Theorie, denen die einzelnen Beiträge des Bandes paradigmatisch (u.a. BackgroundThe transplantation of porcine islet cells provides a new potential therapy to treat patients with type 1 diabetes mellitus (T1DM). Compared to other biomedical technologies, xenotransplantation stands out in terms of its involvement of animals as graft sources, as well as the possible transmission of infectious diseases. As these aspects are especially relevant for potential xenotransplantation recipients, it is important to assess their opinion regarding this technology, in particular in terms of the requirements that should be met in the informed (...) consent process for xenotransplantation.MethodsWe conducted qualitative interviews with seven T1DM patients to assess their information needs prior to xenotransplantation. Before the interview, the participants received a model informed consent form for a clinical trial with porcine islet cells transplantation. The interviews were transcribed and analysed using qualitative content analysis.ResultsIn the interviews, we identified several requirements that are crucial for patients with T1DM in order to consider xenotransplantation as a potential treatment option: therapy-related requirements, professional care and supervision, successful behaviour and attitude management, improving quality of life, and managing control/self-determination challenges. Regarding the informed consent form, several of the participants’ questions remained open and should be addressed in more detail. The interviewees stressed the importance of personal consultations.ConclusionsTo become a sustainable therapeutic option, patients especially expected an improved diabetes control and a reduction of diabetes-related burdens. Health-related aspects prove to be pivotal for diabetic patients when considering porcine islet cell transplantation. The use of pigs as source for organ retrievals was not considered as problematic. Anhand der Erinnerungskultur der NS-Psychiatrieverbrechen in den ersten Nachkriegsjahrzehnten wird der Frage nachgegangen, wie sich Erinnern und Gedenken gestalten lassen. Erinnern, Gedenken und Bewusstsein stehen in dynamischer Beziehung zueinander: Je nach Perspektive, ob der des Opfers oder des Täters, war das, was erinnert, wessen gedacht und was bewusst wurde bzw. unbewusst bleiben musste, sehr unterschiedlich. Durchgesetzt hat sich das Täter-Opfer-Narrativ der deutschen Nachkriegs-Psychiater, das die verstörende Realität, als Wissenschaft, als Institution und als Individuen so willfährig für ein verbrecherisches Regime gewesen (...) zu sein, verleugnen wollte. An dieser spezifischen »Erinnerungskultur« wird gezeigt, dass Erinnern und Gedenken Konstruktionen aus der Jetztzeit über die Vergangenheit sind und von der jeweiligen Gegenwart des Erzählenden geformt werden. Eine Aufführung der »Antigone« in der Erlanger psychiatrischen Anstalt 1946 wird als Rahmen gewählt, um die sich aus der Erinnerungskultur der NS-Psychiatrieverbrechen ergebenden ethischen Fragestellungen auf einer anderen Ebene zu betrachten.
