In December 2017, Law 219/2017, ‘Provisions for informed consent and advance directives’, was approved in Italy. The law is the culmination of a year-long process and the subject of heated debate throughout Italian society. Contentious issues are addressed in the law. What emerges clearly are concepts such as quality of life, autonomy, and the right to accept or refuse any medical treatment – concepts that should be part of an optimal relationship between the patient and healthcare professionals. The law maximizes (...) the value of the patient’s time to decide. Every patient is allowed to make choices for the present as well as for the future, conceived as a continuation of the present, and to decide what comes next, based on what he/she already knows. The law identifies three distinct but converging paths towards the affirmation of a care relationship based on reciprocal trust and respect: the possibility to consent to or refuse treatment, the shared care planning, and advance directives. The fundamental point to emerge from the new Italian law is that consensus is an essential connotation of the treatment relationship. Consensus is not limited to the acceptance/rejection of medical treatment but is ongoing. It is projected into the future through shared care planning and advance directives which act as tools for self-determination and the manifestation of the beliefs and preferences of persons unable to express their will. These principles are in line with the idea of appropriate care as evaluated from two different perspectives, one of scientific adequacy and the other commensurate with the individual’s resources, fragility, values, and beliefs. Surely, however, the new law is not the end of the matter on issues such as conscientious objection, which is deeply rooted within the Italian cultural and political debate. In this regard, healthcare institutions and policymakers will be called upon to develop and implement organizational policies aimed at the management of foreseeable conscientious objection in this field. This paper describes the Eunomos software, an advanced legal document and knowledge management system, based on legislative XML and ontologies. We describe the challenges of legal research in an increasingly complex, multi-level and multi-lingual world and how the Eunomos software helps users cut through the information overload to get the legal information they need in an organized and structured way and keep track of the state of the relevant law on any given topic. Using NLP tools to semi-automate the lower-skill (...) tasks makes this ambitious project a realistic commercial prospect as it helps keep costs down while at the same time allowing greater coverage. We describe the core system from workflow and technical perspectives, and discuss applications of the system for various user groups. (shrink)

The essay is dedicated to war considered through the reflections of Roger Caillois and in particular through certain motifs – feast, sacred, vertigo – that allow us to grasp its ‘metaphysical’ intention, i.e. capable of looking at war as the point of chiasmatic reversibility of life and death.

The novel pandemic called “Coronavirus Disease 2019”, as a global public health emergency and global threat, has affected many countries in unpredictable ways and impacted on physical activity behaviors to various extents. Specific populations including refugees, asylum seekers, and prisoners, are vulnerable groups with multiple complex health needs and worse health outcomes with respect to the general population worldwide and at high risk of death from the “Severe Acute Respiratory Syndrome-related Coronavirus type 2”. Governments around the world have been implementing (...) preventive healthcare policies, including physical and social distancing, isolation, and confinement, to mitigate against the burden imposed by the COVID-19 outbreak. This pandemic period is characterized by reduced or lack of movement. During this period of lockdown, PA can represent an immunotherapy and a preventative approach to avoid the harmful effects of inactivity due to the pandemic. Moreover, PA could be prescribed to improve the immune system of specific populations, which particularly experience the condition of being confined. The present narrative review discusses the potential impacts of COVID-19 pandemic on these specific populations’ health status and the importance of performing PA/exercise to reduce the deleterious effects of COVID-19 pandemic. In addition, we aim to provide useful recommendations on PA/exercise for these specific populations to maintain their level of independence, physical, and mental health as well as their wellbeing. Folk-economic beliefs may be regarded as “evidential fictions” that exploit the natural tendency of human cognition to organize itself in narrative form. Narrative counter-arguments are likely more effective than logical debunking. The challenge is to convey sound economic reasoning in narratively conspicuous forms – an opportunity for economics to rethink its role and agency in public discourse, in the spirit of its old classics.

Previously published as special issues of _The European Journal of the History of Economic Thought_ and _The Review of Political Economy_, this volume contains the papers devoted to the life and work of Piero Sraffa. Sraffa was a leading intellectual of the twentieth century. He was brought to Cambridge by John Maynard Keynes and had an important impact on the philosopher Ludwig Wittgenstein. He received the golden medal Söderström of the Swedish Academy of Sciences for his edition of David Ricardo's (...) _Works and Correspondence_ and he is the author of _Production of Commodities by Means of Commodities_, one of the most often cited book in economics. Using hitherto unpublished material from Sraffa's literary heritage kept at Trinity College, Cambridge, the papers throw new light on the intellectual development of the young Sraffa and correct several of the received views on him and his contribution. Themes covered concern his: objectivism rediscovery and reformulation of the classical theory of value and distribution criticism of Alfred Marshall's analysis relationship with his Cambridge colleagues and friends biography around the time when he left Italy for the UK friendship with Wittgenstein and his impact on the latter's thinking. Ulrich Beck characterized the transition from modern to late modern society as a shift from an industrial to a “risk society.” Contemporary society is challenged by negative side effects of modernization, including the increasing and imminent threat of global climate change. This article will test the validity of conceivable prescriptive elements associated with this sociological theory. In doing so, it will focus on the most recent legal developments aimed at tackling climate change within the EU. This paper finds that the (...) precautionary approach is unable to sufficiently shape balanced legal intervention in this day and age. However, the approach adopted by the EU appears to be more successful in this respect. (shrink)

In this paper we document the developmental trajectory of the complementizer system (CP-system) in Italian by looking at the earliest spontaneous production of eleven young children, whose transcriptions are available on CHILDES. We conducted a novel corpus analysis, tracking down a number of constructions in which the clausal left-periphery is activated. First, we considered the appearance of the different complementizer particles in the CP-system, which overtly realize the three distinct functional projections ForceP, IntP, and FinP. The analysis revealed that children (...) acquiring Italian correctly use these complementizer particles already in the third year of life. Second, we looked for the simultaneous activation of different functional projections within the CP-system. We went through our corpus searching for complex sentences in which more than one constituent was moved to the left periphery. This option is allowed by the adult grammar of Italian and, as our search revealed, it is also attested in the grammar of young children. Soon after their second birthday, sequences in which a left-dislocated Topic and a Wh- element co-occur are attested, directly supporting the existence of a (high) Topic position above FocusP. Moreover, movement in general conforms to the constraints of the adult grammar, with no attested violation of obligatory inversion (a consequence of the Q-Criterion). Importantly, “why-questions” did not require inversion, much as in the adult grammar of Italian. Taken together, children's use of complementizer particles and their activation of multiple landing sites for movement show that 2-year-olds already possess a richly articulated functional structure of the CP-system, aligned to the layered adult structure. In concluding the paper, we also discuss some temporal differences between constructions activating high and low portions of the CP-system. In particular, we detect a temporal precedence for wh-questions over why-questions. Since the former activate a lower projection, this is consistent with the recently proposedGrowing Treeshypothesis, according to which the development of the CP-system proceeds stepwise. (shrink)

We introduce a reciprocity criterion for coalition formation among goal-directed agents, which we call the indecomposable do-ut-des property. It refines an older reciprocity property, called the do-ut-des or give-to-get property by considering the fact that agents prefer to form coalitions whose components cannot be formed independently. A formal description of this property is provided as well as an analysis of algorithms and their complexity. We provide an algorithm to decide whether a coalition has the desired property, and we show that (...) the problem to verify whether a single coalition satisfies the property is tractable. Moreover, we provide an algorithm to search all the sub-coalitions of a given coalition satisfying the new property. Even if this problem is not computationally tractable, we show that in several cases, also the complexity of this problem may decrease considerably. (shrink)

Luigi Giussani, a high school religion teacher throughout the 1950s and 1960s, grounded his teachings in the vast body of experience to be found in Christianity's two-thousand-year history. He told his students, “I'm not here to make you adopt the ideas I will give you as your own, but to teach you a method for judging the things I will say.” Throughout his life, education was one of Giussani's primary intellectual interests. He believed that effective education required an adequate (...) background in the Christian tradition, presented within a lived experience that underscored the capacity of the faith to answer universal questions. What he proposed was a process that allowed one to sift through tradition, critically examining it and comparing it against the ultimate criteria for judgment: the desires of the heart. In Giussani's view, the primary concern was to “educate the human heart as God made it.” In The Risk of Education he states that fear leads students to associate this process of criticism with negativity or doubt. Yet, without an education in criticism, students cannot develop conviction. At a time when young people are abandoning the church and questioning the value of faith, Giussani's method of judging and verifying Christianity as an experience seems a necessary intervention. In The Risk of Education he argues that, ultimately, education and the Christian message reveal themselves through human freedom. (shrink)

Nel mio articolo propongo una lettura dei §§ 79-84 della Critica del Giudizio, parte della sezione Metodologia del Giudizio teleologico. Dapprima mi interrogo sul significato di una Methodenlehre del Giudizio teleologico, che rintraccio in un’attività metariflessiva del Giudizio; procedo poi ad una lettura analitica del testo nelle sue varie articolazioni, nella quale passo in rassegna le questioni attinenti alla specificità dello statuto epistemologico della teleologia, alla possibile convivenza tra finalismo e meccanicismo nella scienza della natura, all’origine della vita, allo scopo (...) ultimo della natura e allo scopo finale della creazione; approdo, infine, ad un’interpretazione per cui l’intera teleologia rationis humanae, che si estende dalla teleologia naturale alla teleologia morale passando per l’antropologia e per la filosofia della storia, viene in questa sezione riarticolata intorno ad un nuovo fulcro concettuale di livello trascendentale, che può garantire l’effettivo collegamento tra queste diverse parti della filosofia proprio perché esso non si esercita in forma di dominio legislativo, ma in forma di riflessione sul molteplice empirico e sulla causalità teleologica propria dell’uomo. Many scholars have claimed that satire is a genre. At the same time, however, it is also widely acknowledged that satire has changed over the centuries, that it has taken various forms and that it still appears in a variety of other genres. Far from being a drawback in identifying satire as a genre, I will claim that variability is a natural property of genres if the latter are conceived of as dynamic cognitive categories that emerge out of a complex (...) interplay of heterogeneous factors which cluster differently under the effect of different contextual and cotextual attractors. I will assume that, in satire, these factors include a range of linguistic and rhetorical devices which interact in different ways to dynamically bring about specifically intended effects. I will further claim that understanding satire is a context-sensitive complex process which implies setting up and maintaining multiple mental representations, and drawing pragmatic inferences. Game-based approaches are emerging in many fields, such as education, social sciences, marketing and government. Most studies debate its role in consolidating learning, guided by both internal and external rewards. These approaches are also being applied in rehabilitation, where patients must undergo a re-learning process of motor gestures after an injury to a body structure. In physiotherapy, much importance is given to analytical-functional movement aspects, but less to the recovery of the complete experience, including motivation, perception, and emotional experience of (...) the patient during the process. The aim of this narrative review is to investigate the role of subjective experience in the application of gamification in physiotherapy, considering the added value it provides to recovery by involving neural structures, not just motor functions. By analyzing the most investigated aspects in using gamification in rehabilitation, we will outline the primary methods of investigation into the engagement and emotions involved in the process. Through a selection of scientific articles found on main databases, we identified articles investigating the patient’s experience. The analysis of these articles was based on aspects related to the recovery of movement, the technology used, as well as the methods of investigation and collection of qualitative data regarding the emotions and perceptions of patients during the gamification experience. The results are divided into two primary topics. Overall, this review supports the idea that gamification could represent a rehabilitation approach integrating physiotherapy, more suitable for the final stages of recovery, such as returning to work or sports. In the present paper, the author aims at laying the foundations of a symbolics of technical gesture, according to the thesis that symbolic faculty is another face of the technological one, and that they are both in truth two sides of the same coin. Accordingly, the author suggests to rename the whole dimen-sion as “meta-environmentality”. The analysis is carried out on the basis of a specific comparison between Cassirer’s definition of “animal symbolicum” and its scientific consistence in the light of (...) modern palaeontology. “Animal symbol-icum” is here compared with Leroi-Gourhan’s homo technologicus, and Cassi-rer’s ideas on human identity tested starting from paleoanthropological data. The result of the inquiry lead us to recognize the urgency of integrating Cassi-rer’s argument with the primacy of the technological capacity, but a deep anal-ysis of the characterizing attributes of the latter compels us to uphold the symbolic attitude of the technological dimension. The author then sketches a basic description of the guidelines of a symbolic theory of technology, and tries to show how the basic elements of such an approach were familiar both to Cassirer and Leroi-Gourhan. As a consequence of the whole theory, the author elaborates a chronological analysis of human identity, whose basic result is the determination of the future as main temporal dimen-sion of human acting.
