Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. BALLESTEROS, Jesús: «Domeñar las finanzas, cuidar de la naturaleza».

Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

Vivimos en una sociedad en la que lo digital lo ha invadido todo. Han se ha ocupado de analizar este cambio desde la perspectiva antropológica y social, con una posición radicalmente crítica. Para Han el medio digital es un medio que nos re-programa. El cambio principal consiste en que desaparece lo que Han llama la “negatividad”. La negatividad aparece como aquello que no es positivo, que no es puesto (positum) por el individuo, sino que le viene dado y se percibe (...) inicialmente como límite. Esa negatividad de lo dado tiene múltiples manifestaciones: es lo no-inmediato, lo extraño, lo otro, lo que produce pesar y resistencia. Esta transformación hacia la transparencia “es una coacción sistémica que se apodera de todos los sucesos sociales y los somete a un profundo cambio”. Esto afecta incluso al hombre mismo, que es convertido también en un elemento funcional del sistema. Han analiza esa coacción violenta de la transparencia digital, y su omnipresencia, desde distintos enfoques a lo largo de sus libros. De ellos hemos seleccionado cinco: las relaciones personales (respeto y confianza), las relaciones comerciales (el mercado), las relaciones políticas y las relaciones con la realidad, mediadas por nuestro entendimiento del espacio y el tiempo. Is it fair to leave the next generation a public debt? Is it defensible to impose legal rules on them through constitutional constraints? From combating climate change to ensuring proper funding for future pensions, concerns about ethics between generations are everywhere. In this volume sixteen philosophers explore intergenerational justice. Part One examines the ways in which various theories of justice look at the matter. These include libertarian, Rawlsian, sufficientarian, contractarian, communitarian, Marxian and reciprocity-based approaches. The experimental interventions that provide evidence of causal relations are notably similar to those that provide evidence of constitutive relevance relations. In the first two sections, I show that this similarity creates a tension: there is an inconsistent triad between Woodward’s popular interventionist theory of causation, Craver’s mutual manipulability account of constitutive relevance in mechanisms, and a variety of arguments for the incoherence of inter-level causation. I argue for an interpretation of the views in which the tension is merely apparent. (...) I propose to explain inter-level relations without inter-level causation by appealing to the notion of fat-handed interventions, and an argument against inter-level causation which dissolves the problem. Fowers et al. (2017)recently made a general argument for virtues as the characteristics necessary for individuals to flourish, given inherent human limitations. For example, people can flourish by developing the virtue of friendship as they navigate the inherent (healthy) human dependency on others. This general argument also illuminates a pathway to flourishing during the COVID-19 pandemic, the risks of which have induced powerful fears, exacerbated injustices, and rendered life and death decisions far more common. Contexts of risk and fear call (...) for the virtue of courage. Courage has emerged more powerfully as a central virtue among medical personnel, first responders, and essential workers. Longstanding inequalities have been highlighted during the pandemic, calling for the virtue of justice. When important personal and public health decisions must be made, the central virtue of practical wisdom comes to the fore. Wise decisions and actions incorporate the recognition of relevant moral concerns and aims, as well as responding in fitting and practical ways to the specifics of the situation. Practicing courage, justice, and practical wisdom illuminates a path to flourishing, even in a pandemic. (shrink)

ABSTRACT There has been extensive debate among various disciplines about the nature and value of play. From these discussions it seems clear that play is a phenomenon with more than just one dimension: as a specific type of activity, as a form or structure, as an ontologically distinctive phenomenon, as a type of experience, or as a stance or an attitude towards a particular activity. This article focuses on the importance of the playful attitude in sport. It begins by attempting (...) to describe the underpinning features of a playful attitude, and its relation to Suits’ lusory attitude and the concept of gamification. Finally, it considers and critically evaluates the relationship between play and sport and the importance of the playful attitude in sporting activities. The purpose of this paper is a far deeper analysis of the playful attitude and its relationship to sport than has been previously provided, and a more precise definition as to what the playful attitude is. This will ultimately help to answer questions about the value of sport and how sport ought to be played. (shrink)

A distorted representation of one's own body is a diagnostic criterion and core psychopathology of both anorexia nervosa (AN) and bulimia nervosa (BN). Despite recent technical advances in research, it is still unknown whether this body image disturbance is characterized by body dissatisfaction and a low ideal weight and/or includes a distorted perception or processing of body size. In this article, we provide an update and meta-analysis of 42 articles summarizing measures and results for body size estimation (BSE) from 926 (...) individuals with AN, 536 individuals with BN and 1920 controls. We replicate findings that individuals with AN and BN overestimate their body size as compared to controls (ES= 0.63). Our meta-regression shows that metric methods (BSE by direct or indirect spatial measures) yield larger effect sizes than depictive methods (BSE by evaluating distorted pictures), and that effect sizes are larger for patients with BN than for patients with AN. To interpret these results, we suggest a revised theoretical framework for BSE that accounts for differences between depictive and metric BSE methods regarding the underlying body representations (conceptual vs. perceptual, implicit vs. explicit). We also discuss clinical implications and argue for the importance of multimethod approaches to investigate body image disturbance. (shrink)

This paper addresses a theory of intergenerational justice that we refer to as “needs-based sufficientarianism”. According to needs-based sufficientarianism, the present generation ought to enable future generations to meet their basic needs — for example, their needs for drinkable water, food and health care. Our aim is to explain and defend this theory in a programmatic way. First, we introduce what we regard as the most plausible variant of needs-based sufficientarianism. Then we argue that this variant is superior to several (...) alternative ways of thinking about intergenerational justice. In particular, we defend basic needs as the currency of intergenerational justice and sufficiency as its principle. Our arguments for these claims are neither fully comprehensive nor fully conclusive. Yet, we hope that they suffice to show that needs-based sufficientarianism is a major contender, with significant pro tanto advantages over other views. (shrink)

We investigate the possibility of inducing the cosmological constant from extra dimensions by embedding our four-dimensional Riemannian space-time into a five-dimensional Weyl integrable space. Following the approach of the space-time-matter theory we show that when we go down from five to four dimensions, the Weyl field may contribute both to the induced energy-tensor as well as to the cosmological constant Λ, or more generally, it may generate a time-dependent cosmological parameter Λ(t). In (1b), for the most part induces a so-called Quantificational Variability Effect (QVE) on the NP the linguists from the East Coast, yielding roughly the interpretation ‘most of the linguists from the East Coast came to NELS’. We claim that the two constructions above differ in the domain where they apply, producing similar but not identical quantificational interpretations over the NP. In particular, we argue that most of the NPs applies to the nominal domain, while for the most part applies (...) to the verbal domain. Our claim is based on two sets of novel semantic data. First, we show that the distribution of most of the NPs is parallel to that of all the NPs in terms of its selective compatibility with collective predicates. To account for this data, we extend Brisson’s (1998, 2003) analysis of all the NPs to most of the NPs, concluding that most is an ∃-quantifier introducing a group of a certain proportion. Second, we show that, when for the most part gives rise to a QVE on a definite NP, the collective interpretation is not available. We develop a semantic analysis of for the most part as a verbal modifier that explains the lack of collective readings and that extends to interpretations other than QVE. The structure of the paper is as follows: in section 2, we introduce some general background on events and distributivity that are relevant to the current paper. In section 3, we propose the analysis of most of the NPs, followed by the analysis of for the most part in section 4. Section 5 concludes the paper and discusses further issues. (shrink)

We argue that the distinction between framework and interaction theories should be taken carefully into consideration when dealing with the philosophical implications of fundamental theories in physics. In particular, conclusions concerning the nature of reality can only be consistently derived from assessing the ontological and epistemic purport of both types of theories. We put forward an epistemic form of realism regarding framework theories, such as Quantum Field Theory. The latter, indeed, informs us about the general properties of quantum fields, laying (...) the groundwork for interaction theories. Yet, concerning interaction theories, we recommend a robust form of ontological realism regarding the entities whose existence is assumed by these theories. As an application, we refer to the case of the Standard Model, so long as it has proved to successfully inform us about the nature of various sorts of fundamental particles making up reality. In short, although we acknowledge that both framework and interaction theories partake in shaping our science-based view of reality, and that neither would do by itself the work we expect them to accomplish together, our proposal for a coherent ontology of fundamental entities advances a compromise between two forms of realism about theories in each case. This study employed a technology surveillance process in the beekeeping sector with the objective of identifying emerging technologies that are relevant to small beekeepers in emerging economies. The analysis of patents classified under A01K 47/00 revealed the emergence of pivotal innovations in domains such as hive design, automated honey extraction, and the integration of sensors for hive monitoring. The surveillance process facilitated the collection and analysis of data on the most patented technologies in the sector, thereby addressing key planning questions. (...) The study identified technological trends with the potential to transform beekeeping in low-tech contexts, thereby enhancing the productivity and sustainability of beekeeping operations. The findings of this study indicate that the identified technologies have the potential to significantly contribute to the well-being of small beekeepers, provided that their adoption is facilitated through the provision of governmental and organizational support. It is recommended that future research investigate the implementation of these technologies and the factors that influence their adoption in diverse production contexts. (shrink)

This essay traces the influence of Carl Schmitt on an interpretative tendency found in a number of contemporary readings of Kant’s political philosophy. This influence can be traced back to two basic commitments: the idea that Kant’s philosophy seeks to defend a pacifist and humanitarian ideal of history and progress, and that political conflict must, for this reason, be somehow pacified or eradicated. I argue that these ‘anti-conflict’ readings of Kant go astray in ignoring the systemic role conflict plays in (...) Kant’s understanding of agency and freedom on the one hand, and in overlooking that this conflict is not empirical but normative, and thereby, unavoidable. In light of this ‘agential conflict’, Schmitt’s critique to Kant begins to lose all its force. (shrink)

When does a human being cease to exist? For millennia, the answer to this question had remained largely unchanged: death had been diagnosed when heartbeat and breathing were permanently absent. Only comparatively recently, in the 1950s, rapid developments in intensive-care medicine called into question this widely accepted criterion. What had previously been deemed a permanent cessation of vital functions suddenly became reversible. -/- A new criterion of death was needed. It was suggested that the destruction of the brain could indicate (...) the death of the organism in the presence of external life support. Soon the so-called brain death became the new worldwide standard. In recent years, however, doubts about this neurological criterion have been growing. Is brain death really our death? -/- This is the question that this thesis seeks to answer. To this end, we shall connect the medical debate about the definition of death to the philosophical debate about personal identity. While we will find that the destruction of its brain does in fact not correspond to an organism’s death, we shall also ask whether the assumption that we are essentially organisms is correct. May brain death be the ceasing to exist of a different entity? -/- Substituting clinical case reports and considerations about human physiology for the use of thought experiments, the thesis takes a novel and philosophically unconventional approach to the problem of what we essentially are. We shall analyse various pathological conditions and their respective effects on the bodily and mental characteristics of our existence. We will conclude that brain death is indeed our death – but for reasons entirely different from those cited in the original justification of this criterion. (shrink)

A realistic axiomatic formulation of nonrelativistic quantum mechanics for a single microsystem with spin is presented, from which the most important theorems of the theory can be deduced. In comparison with previous formulations, the formal aspect has been improved by the use of certain mathematical theories, such as the theory of equipped spaces, and group theory. The standard formalism is naturally obtained from the latter, starting from a central primitive concept: the Galilei group.

Certain information-seeking yes/no (yn)-questions –e.g. Did Jorge really bring a present? and Doesn’t John drink?– convey an epistemic bias of the speaker. Two main approaches to biased yn-questions are compared: the VERUM approach and the Decision Theory approach. It is argued that, while Decision Theory can formally characterize the notion of “intent” of a question, VERUM is needed to derive the data.

Academic entrepreneurship and the formation of spin-offs from educational institutions have been consolidated as essential elements to promote innovation and stimulate economic growth worldwide. However, the evolution of these initiatives shows marked differences between developed countries and emerging economies, such as Colombia. This study focuses on analyzing how research in this area has progressed, identifying the key factors that determine the success of spin-offs and suggesting a framework for action for Colombia in comparison with international dynamics. The findings reveal a (...) shift in research attention from prioritizing the creation of spin-offs to a greater focus on their long-term performance and sustainability. At the international level, the relevance of technology transfer, strategic alliances between universities and industry and the efficient management of technological resources are highlighted. On the other hand, in the Colombian context, research tends to focus on institutional aspects, cultural factors and support regulations, underestimating the analysis of the performance of spin-offs after their creation. This paper aims to contribute to the formulation of policies and strategies that promote not only the emergence but also the sustainability of academic spin-offs in Colombia, seeking to align their practices with international standards in order to maximize their impact on the economic and social development of the country. In the wake of the financial crisis, many developed countries have embarked upon ambitious fiscal consolidation programs. While the success of austerity programs is still unclear, it is also an open question what success would mean for activist government in the long run. This study rejects the progressive belief that successful fiscal consolidation will strengthen fiscal capacity, arguing that consolidations transform the political context in which fiscal policy is made. By analyzing public expenditure in six countries with sustained budget surpluses, (...) we show that surpluses were mostly achieved through expenditure cuts but predominantly used for tax cuts. While fiscal crises abated, their collateral damage to public expenditure remained. This result is further elaborated by a case study of the Swedish budget surplus. We conclude that consolidations can create a new fiscal regime and thus have long-term consequences for the fiscal capacity of the state. (shrink)

The paper delves into manuscript sources connected with various disputations held at Prague University from around 1390 to 1420 and singles out a set of hitherto unknown quaestiones dealing with the nature of the human intellect and its relation to the body. Prague disputations from around 1400 arguably offer a unique vantage point on late medieval anthropological issues, since they encompass an entanglement of numerous doctrinal influences from Buridanian De anima commentaries to John Wyclif’s theories. The paper delineates several conceptual (...) tensions regarding the nature of the intellect, e.g., between materialism (entailed by the emphasis on the intellect’s inherence in the body) and personal immortality. It presents several strategies Prague masters employed to overcome these tensions. For example, an anonymous participant of the 1409 quodlibet develops the Buridanian distinction between the rationally demonstrable materialist tendency and the indemonstrable “catholic truth” about the intellect both inhering in and separable from the body. On the other hand, Wyclif’s adherents (Jacob of Mies and another anonymous master) postulate an immortal spirit hypostatically united to each human being beside the human soul educed from the potency of the matter. Yet, the boundaries between the doctrinal standpoints in question seem permeable, whereby a rigid definition of antagonistic groups in late medieval Prague intellectual milieu (e.g., Buridanians vs Wycliffites) is rendered ineffective. Montague’s analysis of the well-known temperature paradox poses a problem for Gupta’s syllogism, whose surface syntax differs from the temperature syllogism in the addition of the intensional adverb necessarily. Lasersohn (2005) argues that the puzzle arising from these syllogisms can be solved if one adopts the Fregean presuppositional treatment of definite descriptions, and concludes that the temperature-Gupta puzzle provides an argument in favor of such treatment. This paper shows that the analysis of definite descriptions is in fact orthogonal to the (...) puzzle. Instead, it will be shown that the differences between the two syllogisms stem from the temporal interpretation of their premises. (shrink)

El propósito de este estudio es dilucidar algunos de los rasgos distintivos de la concepción del ser humano que mantiene Jürgen Habermas y sus implicaciones en la teoría de la acción comunicativa. De este modo, se trata de mostrar que la antropología habermasiana se singulariza por adoptar una perspectiva naturalista y darwinista. En la primera parte, se analiza el legado epistemológico de Darwin como un programa de investigación y se contrastan los estudios de Habermas sobre antropología biológica con las últimas (...) investigaciones en genética y paleontología. En la segunda parte, se presenta la propuesta de Habermas de afrontar un dualismo epistemológico mediante un naturalismo débil noreduccionista, como crítica de la metafísica moderna y estructurador de un nuevo realismo. This article examines the discursive construction of Scottish and British- English national identities in the printed press within the context of the planned Scottish independence referendum. Using Critical Discourse Analysis and informed by sociological and anthropological research, the study uses a Corpus Linguistics approach to analyse newspaper texts from the Scottish and British printed media to define the strategies used in the construction and disarticulation of these identities and the ideologies behind them. The results of the analysis will show that (...) the Scottish broadsheets use a staunchly Scottish rhetoric with frequent examples of nation flagging, showing the palpable struggle for power and a certain sense of inferiority. Inadvertently or otherwise, these newspapers engender a sense of separateness by employing techniques of positive in-group identification. The Scottish editions of UK broadsheets, on the contrary, hold a more Anglocentric perspective and their treatment of the referendum is more political than ideological, frequently attributing negative evaluations to the independence issue and engaging in the practice of “tartanisation”. To conclude, the UK broadsheets tend to provide a more balanced and objective point of view, thus being at the political centre of the social debate enacted by the referendum and the subsequent possible independence of Scotland. Dicer is a key player in microRNA (miRNA) and RNA interference (RNAi) pathways, processing miRNA precursors and doublestranded RNA into ~21-nt-long products ultimately triggering sequence-dependent gene silencing. Although processing of substrates in vertebrate cells occurs in the cytoplasm, there is growing evidence suggesting Dicer is also present and functional in the nucleus. To address this possibility, we searched for a nuclear localization signal (NLS) in human Dicer and identified its C-terminal double-stranded RNA binding domain (dsRBD) as harboring NLS activity. We (...) show that the dsRBD-NLS can mediate nuclear import of a reporter protein via interaction with importins β, 7, and 8. In the context of full-length Dicer, the dsRBD-NLS is masked. However, duplication of the dsRBD localizes the full-length protein to the nucleus. Furthermore, deletion of the N-terminal helicase domain results in partial accumulation of Dicer in the nucleus upon leptomycin B treatment, indicating that CRM1 contributes to nuclear export of Dicer. Finally, we demonstrate that human Dicer has the ability to shuttle between the nucleus and the cytoplasm. We conclude that Dicer is a shuttling protein whose steady-state localization is cytoplasmic. (shrink)

Anerkennung soll die Leerstelle ausfüllen, die mit dem Zusammenbruch metaphysischer Systeme aufgetreten ist. Die Ethik sozialer Anerkennung wird damit aber mit Erwartungen überfrachtet. Durch technologische Veränderungen verändern sich permanent die Statusbestimmungen: Die Autonomie des Menschen konkurriert mit künstlich-intelligenten Maschinen, die Leidensfähigkeit mit der des Tieres, die Individualität mit der digitalen Selbstinszenierung und die Geschöpflichkeit mit der technologischen Selbstvergöttlichung. Die Beiträge suchen nach Bedingungen sozialer Anerkennung, die nicht zirkulär ausgehandelt werden können, sondern Kategorien einbringen, die auch von Menschen verwendet werden, wenn (...) sie von Gott sprechen. Damit soll die Basis einer theologischen Anerkennungstheorie gelegt werden. (shrink)
