Se propone un método paradójico para el análisis del Derecho. Este método de conocimiento consiste en una mirada a la complejidad del fenómeno jurídico, presentando sus aspectos complejos en forma de aparentes contradicciones. No son contradicciones reales, sino elementos complejos que, al constatarlos como0 dándose conjuntamente, nos permite dotar de profundidad nuestra reflexión. Hay diferentes maneras de definir la paradoja, pero aquí nos centramos en las cualidades literarias, retóricas y filosóficas que ofrece el tipo o tipos de paradoja utilizados, de (...) forma magistral, por el escritor inglés G.K. Chesterton. De las funciones de las paradojas (desde esta perspectiva, pero no solamente) son especialmente útiles para el análisis jurídico: criticar el sistema de pensamiento y abrir a la realidad. La primera se relaciona con el Derecho porque este siempre está bajo la amenaza del formalismo. La segunda se relaciona con él porque el Derecho es un fenómeno humano, de forma que, cuando hablamos de Derecho, estamos analizando la realidad compleja de la persona humana. Esta nos e puede reducir a una sola de sus dimensiones, y por ello es necesaria la paradoja, para equilibrar los distintos enfoques del análisis. Tras explicar todo esto, se procede en el artículo a sugerir siete paradojas que muestran la complejidad del fenómeno jurídico y pretenden ser retos al pensamiento. (shrink)

Vivimos en una sociedad en la que lo digital lo ha invadido todo. Han se ha ocupado de analizar este cambio desde la perspectiva antropológica y social, con una posición radicalmente crítica. Para Han el medio digital es un medio que nos re-programa. El cambio principal consiste en que desaparece lo que Han llama la “negatividad”. La negatividad aparece como aquello que no es positivo, que no es puesto (positum) por el individuo, sino que le viene dado y se percibe (...) inicialmente como límite. Esa negatividad de lo dado tiene múltiples manifestaciones: es lo no-inmediato, lo extraño, lo otro, lo que produce pesar y resistencia. Esta transformación hacia la transparencia “es una coacción sistémica que se apodera de todos los sucesos sociales y los somete a un profundo cambio”. Esto afecta incluso al hombre mismo, que es convertido también en un elemento funcional del sistema. Han analiza esa coacción violenta de la transparencia digital, y su omnipresencia, desde distintos enfoques a lo largo de sus libros. De ellos hemos seleccionado cinco: las relaciones personales (respeto y confianza), las relaciones comerciales (el mercado), las relaciones políticas y las relaciones con la realidad, mediadas por nuestro entendimiento del espacio y el tiempo. Con la imagen de la locura (loco sería, no el incapacitado para razonar, sino el que vive fuera de la realidad), considera al capitalismo como una locura porque su discurso es coherente pero no ofrece una vida digna para el ser humano: el capitalismo quita la libertad al proletario, le obliga a desvincularse espiritualmente de su propiedad y le desalienta (...) cuando propone alternativas económicas. BALLESTEROS, Jesús: «Domeñar las finanzas, cuidar de la naturaleza».

The ontology behind quantum mechanics has been the subject of endless debate since the theory was formulated some 100 years ago. It has been suggested, at one time or another, that the objects described by the theory may be individual particles, waves, fields, ensembles of particles, observers, and minds, among many other possibilities. I maintain that these disagreements are due in part to a lack of precision in the use of the theory’s various semantic designators. In particular, there is some (...) confusion about the role of representation, reference, and denotation in the theory. In this article, I first analyze the role of the semantic apparatus in physical theories in general and then discuss the corresponding ontological implications for quantum mechanics. Subsequently, I consider the extension of the theory to quantum fields and then analyze the semantic changes of the designators with their ontological consequences. In addition to the classical arguments to rule out a particle ontology in the case of non-relativistic quantum field theory, I show how the existence of black holes makes the proposal of a particle ontology in general spacetimes unfeasible. I conclude by proposing a provisional pluralistic ontology of fields and spacetime and discussing some prospects for possible future ontological economies. (shrink)

. Scientists, for the most part, want to get it right. However, the social structures that govern their work undermine that aim, and this leads to nonreplicable findings in many fields. Because the social structure of science is a decentralized system, it is difficult to intervene. In this article, I discuss how we might do so, focusing on self-corrective-labor schemes. First, I argue that we need to implement a scheme that makes replication work outcome independent, systematic, and sustainable. Second, I (...) use these three criteria to evaluate extant proposals, which place the responsibility for replication on original researchers, consumers of their research, students, or many labs. Third, on the basis of a philosophical analysis of the reward system of science and the benefits of the division of cognitive labor, I propose a scheme that satisfies the criteria better: the professional scheme. This scheme has two main components. First, the scientific community is organized into two groups: discovery researchers, who produce new findings, and confirmation researchers, whose primary function is to do confirmation work. Second, a distinct reward system is established for confirmation researchers so that their career advancement is separated from whether they obtain positive experimental results. (shrink)

We investigate the possibility of inducing the cosmological constant from extra dimensions by embedding our four-dimensional Riemannian space-time into a five-dimensional Weyl integrable space. Following the approach of the space-time-matter theory we show that when we go down from five to four dimensions, the Weyl field may contribute both to the induced energy-tensor as well as to the cosmological constant Λ, or more generally, it may generate a time-dependent cosmological parameter Λ(t). As an application, we construct a simple cosmological model (...) in which Λ(t) has some interesting properties. (shrink)

We argue that the distinction between framework and interaction theories should be taken carefully into consideration when dealing with the philosophical implications of fundamental theories in physics. In particular, conclusions concerning the nature of reality can only be consistently derived from assessing the ontological and epistemic purport of both types of theories. We put forward an epistemic form of realism regarding framework theories, such as Quantum Field Theory. The latter, indeed, informs us about the general properties of quantum fields, laying (...) the groundwork for interaction theories. Yet, concerning interaction theories, we recommend a robust form of ontological realism regarding the entities whose existence is assumed by these theories. As an application, we refer to the case of the Standard Model, so long as it has proved to successfully inform us about the nature of various sorts of fundamental particles making up reality. In short, although we acknowledge that both framework and interaction theories partake in shaping our science-based view of reality, and that neither would do by itself the work we expect them to accomplish together, our proposal for a coherent ontology of fundamental entities advances a compromise between two forms of realism about theories in each case. A fin de dar respuesta a esta brecha, ensayamos una mixtura del enfoque de las capacidades con las teorías de Hartmut Rosa. Argumentamos que la resonancia natural funge de factor personal de conversión necesario, si (...) bien no suficiente, para la capacidad de acción ecosocial; y que una política que promocione la resonancia natural se adecuaría también a los requisitos impuestos al desarrollo humano tanto por el enfoque de las capacidades como por la sostenibilidad. I present a condensed exposé of systemic materialism, a synthesis of materialism and systemism originally proposed by Mario Bunge. Matter is identified with mutability of propertied particulars, and a concrete or material system is defined as an object with composition, structure, mechanism, and environment. I review different aspects of this ontology, and discuss some of its implications for epistemology, ethics, and aesthetics. I also try to identify some problems of this view and offer some ways to overcome the difficulties. ABSTRACT Data from digital technologies are increasingly integrated in public health research. In April of 2020, we interviewed a subset of participants who completed a survey approximately one month earlier. Using the survey, we contacted and interviewed participants who had expressed their willingness or unwillingness to share digital data for use in public health. We followed a directed content analysis approach for the analysis of the interview data. Among participants who had reported being unwilling to share data, concerns about privacy, (...) confidentiality, and the purpose of the research were cited. During the interviews, 76.9% of the participants who had who had previously indicated that they were unwilling to share their data, expressed willingness to share data in order to assist with COVID-19 prevention. Our results contribute to our understanding of people’s perspectives on sharing personal data and of the way their perspectives can vary as a function of potential uses of their personal information. This study employed a technology surveillance process in the beekeeping sector with the objective of identifying emerging technologies that are relevant to small beekeepers in emerging economies. The analysis of patents classified under A01K 47/00 revealed the emergence of pivotal innovations in domains such as hive design, automated honey extraction, and the integration of sensors for hive monitoring. The surveillance process facilitated the collection and analysis of data on the most patented technologies in the sector, thereby addressing key planning questions. (...) The study identified technological trends with the potential to transform beekeeping in low-tech contexts, thereby enhancing the productivity and sustainability of beekeeping operations. The findings of this study indicate that the identified technologies have the potential to significantly contribute to the well-being of small beekeepers, provided that their adoption is facilitated through the provision of governmental and organizational support. It is recommended that future research investigate the implementation of these technologies and the factors that influence their adoption in diverse production contexts. (shrink)

Dicer is a key player in microRNA (miRNA) and RNA interference (RNAi) pathways, processing miRNA precursors and doublestranded RNA into ~21-nt-long products ultimately triggering sequence-dependent gene silencing. Although processing of substrates in vertebrate cells occurs in the cytoplasm, there is growing evidence suggesting Dicer is also present and functional in the nucleus. To address this possibility, we searched for a nuclear localization signal (NLS) in human Dicer and identified its C-terminal double-stranded RNA binding domain (dsRBD) as harboring NLS activity. We (...) show that the dsRBD-NLS can mediate nuclear import of a reporter protein via interaction with importins β, 7, and 8. In the context of full-length Dicer, the dsRBD-NLS is masked. However, duplication of the dsRBD localizes the full-length protein to the nucleus. Furthermore, deletion of the N-terminal helicase domain results in partial accumulation of Dicer in the nucleus upon leptomycin B treatment, indicating that CRM1 contributes to nuclear export of Dicer. Finally, we demonstrate that human Dicer has the ability to shuttle between the nucleus and the cytoplasm. We conclude that Dicer is a shuttling protein whose steady-state localization is cytoplasmic. (shrink)

In the wake of the financial crisis, many developed countries have embarked upon ambitious fiscal consolidation programs. While the success of austerity programs is still unclear, it is also an open question what success would mean for activist government in the long run. This study rejects the progressive belief that successful fiscal consolidation will strengthen fiscal capacity, arguing that consolidations transform the political context in which fiscal policy is made. By analyzing public expenditure in six countries with sustained budget surpluses, (...) we show that surpluses were mostly achieved through expenditure cuts but predominantly used for tax cuts. While fiscal crises abated, their collateral damage to public expenditure remained. This result is further elaborated by a case study of the Swedish budget surplus. We conclude that consolidations can create a new fiscal regime and thus have long-term consequences for the fiscal capacity of the state. (shrink)

Friendship is an important bond in the personal and social growth of an individual and plays a prominent role during youth. Most scales to measure it are aimed at children and adolescents but none measure character friendship, a type of selfless friendship with ethical traits an d Aristotelian roots. Therefore, the aim of the research is to design and validate the youth Character Friendship Scale (CFS) in a sample of 1587 young Spanish people. The final version of the CFS is (...) composed of 35 items distributed over three dimensions: "Selfless love and intimacy" (21), "Trust" (7) and "Respect and forgiveness" (7) with ordinal reliability coefficients of 0.94, 0.79 and 0.7 respectively and good model fits (CFI = 0.986; TLI = 0.986; RMSEA = 0.043; SRMR = 0.054; GFI = 0.997). It is concluded that the CFS is a scale with good psychometric properties for measuring character friendship in young adults. The results obtained from its application will lead to a better understanding of the importance of character friendship for the socioemotional development or happiness of young adults and will enable the development of intervention programmes that enhance aspects of friendship such as trust, respect, forgiveness or mutual knowledge, which can facilitate collaborative relationships and contribute to social cohesion. The Kalam Cosmological Argument is perhaps the most solid and widely discussed argument for a caused creation of the universe. The usual objections to the argument mainly focus on the second premise. In this paper we discuss the dependency of the first premise on the topological structure of the space-time manifold adopted for the underlying cosmological model. It is shown that in chronology-violating space-times the first premise can also be violated. The chronology-violation, in turn, requires a massive violation of the (...) so-called energy conditions which might have observational effects that are briefly discussed here. Hence, astronomical observations could be relevant for the validity of the metaphysical argument. In this sense, it is possible to talk of “observational theology”. (shrink)

Closed time-like curves (CTCs) naturally appear in a variety of chronology-violating space{times. In these space{times, the principle of self-consistency demands a harmony between local and global a airs that excludes grandfather-like paradoxes. However, selfexisting objects trapped in CTCs are not seemingly avoided by the standard interpretation of this principle, usually constrained to a dynamical framework. In this letter we discuss whether we are committed to accept an ontology with self-existing objects if CTCs actually occur in the universe. I discuss the recent claims made by Mario Bunge on the philosophical implications of the discovery of gravitational waves. I think that Bunge is right when he points out that the detection implies the materiality of spacetime, but I reject his identification of spacetime with the gravitational field. I show that Bunge’s analysis of the spacetime inside a hollow sphere is defective, but this in no way affects his main claim.

This article studies the political dimension of friendship in Robert Guédiguian’s cinema, delving into the crucial role that conversation plays in this relationship, and taking Stanley Cavell’s thought as a main reference. Aristotle’s concept of civic friendship, along with its contemporary readings, and Cavell’s notion of conversation provide a theoretical frame for the analysis of three recent feature films directed by Guédiguian that present a strong thematic and narrative unity (and have barely received attention in previous scholarship): Les Neiges du (...) Kilimandjaro/The Snows of Kilimanjaro (2011), La Villa/The House by the Sea (2017) and Gloria Mundi (2019). Based on, but going beyond, Cavell’s moral theorisation of the filmic portrayal of human relationships, the analysis of these films has identified four milestones in the transformative process—both personal and political—that stems from conversation with friends: conformity, confrontation, acknowledgement and renewed community. In all three films, this process of change is not only presented as a progressive discovery of one’s own voice, but also as a progressive unmasking: both are necessary prerequisites for welcoming foreigners in need of acknowledgement and, consequently, for the renewal of community. This article considers friendship as a channel for education and as one of its objectives, as it is a necessary ingredient for a fulfilled life. This requires an initial study of interpersonal relationships in the postmodern context, considering their opportunities and risks. Our aim is to draw a topography of these relationships by analysing texts by major thinkers of the last four decades. The result of this analysis is the core of the article, namely, that there are four categories which (...) seem to give a proper account of the characteristics of interpersonal relationships in postmodernity and are relevant in education: 1) the questioning of the individual; 2) the appearance of the internet; 3) the recoveryof emotions; and, finally; 4) the extension of the feminine space. As a conclusion, they may all be said to have an ambivalent character that requires central issues in education to be reconsidered: the awareness and emotional regulation; the new constitution of identity and intimacy on the internet; education for male-female relationships, which now exist outside the sexual sphere, and preventing violence in these relationships; as well as how to educate for cooperation in an individualistic society. This essay discusses the idea that trust is a pre-rational, other-oriented emotion and it is constitutive of friendship practices regardless of the type of friendship. In particular, what we call ‘social friendship’ refers to a distinctive set of loose but lasting and cohesive bonds both among citizens within society (horizontal dimension) and between them and the state (vertical dimension), triggering solidarity and altruism. The other-oriented emotion of trust underpinning these social bonds–social friendship–in turn, is necessary for social justice to be (...) supported, legitimized, and furthermore demanded by society. El propósito de este estudio es dilucidar algunos de los rasgos distintivos de la concepción del ser humano que mantiene Jürgen Habermas y sus implicaciones en la teoría de la acción comunicativa. De este modo, se trata de mostrar que la antropología habermasiana se singulariza por adoptar una perspectiva naturalista y darwinista. En la primera parte, se analiza el legado epistemológico de Darwin como un programa de investigación y se contrastan los estudios de Habermas sobre antropología biológica con las últimas (...) investigaciones en genética y paleontología. En la segunda parte, se presenta la propuesta de Habermas de afrontar un dualismo epistemológico mediante un naturalismo débil noreduccionista, como crítica de la metafísica moderna y estructurador de un nuevo realismo. Conspecific violence has been pervasive throughout evolutionary history. The current research tested the hypotheses that individuals implicitly categorize combative contexts (i.e., play fighting, status contests, warfare, and anti-exploitative violence) and use the associated contextual information to guide expectations of combative tactics. Using U.S. and non-U.S. samples, Study 1 demonstrated consistent classification of combative contexts from scenarios for which little information was given and predictable shifts in the acceptability of combative tactics across contexts. Whereas severe tactics (e.g., eye-gouging) were acceptable in (...) warfare and anti-exploitative violence, they were unacceptable in status contests and play fights. These results suggest the existence of implicit rules governing the contexts of combat. In Study 2, we explored the reputational consequences of violating these implicit rules. Results suggest that rule violators (e.g., those who use severe tactics in a status contest) are given less respect. These are the first studies to implicate specialized mechanisms for aggression that use contextual cues of violence to guide expectations and behavior. (shrink)

En un primer momento, se analizará la filosofía en tanto que creación de conceptos y la manera de cómo (...) esta creación se vincula cómo se vincula con las líneas de fuga, así como los procesos de subjetivación. I argued against relationalism with four objections. One of those was that, under reasonable assumptions, relationalism's modal relation needs to be what I called an `extra order' relation. I recently came to notice that the objection could have been posed with much less substantive assumptions. In particular, I recently noticed that order-dissonant predications are not required for the objection; therefore, noncumulativism is not relevant for my argument.

En la actualidad hay un renacer del interés académico por la amistad que se aborda desde múltiples disciplinas, tales como la Sociología (Spencer & Pahl, 2006), la Psicología (Hojjat & Moyer, 2017), la educación (Kristjánsson, 2022), la Política (Digeser, 2016) o las Relaciones Internacionales (Koschut & Oelsner, 2014). En filosofía, la amistad es un tema clásico que se ha abordado con interés variable en distintos momentos de la historia: para griegos y romanos fue relevante a nivel personal y político (Aristóteles, (...) 1994); los pre-modernos la concibieron como un vínculo fundamental para la estabilidad política y la administración de la justicia (Smith & Devere, 2010) y en la Ilustración siguió considerándose un vínculo valioso. A partir del siglo XIX se oscurece su papel social (Laín Entralgo, 1986) y solo a finales del XX se retoma su valor en el ámbito social, más allá del personal (Derrida, 1998). A pesar de esa atención renovada a la amistad, las investigaciones desde la antropología filosófica o la metafísica son hoy menos frecuentes que otras como las que se hacen desde la ética o la filosofía política, por lo que es relevante prestarle atención desde esta perspectiva que es la elegida en este capítulo. El objetivo es repensar la amistad en Leonardo Polo desde su antropología trascendental partiendo de una confluencia interesante entre este filósofo y Agamben: la apertura ontológica al plano existencial (trascendental, en terminología poliana). Argumentaré cómo, en continuidad con la antropología trascendental y prosiguiendo el pensamiento de Polo, la amistad puede incluirse de alguna forma en el ámbito trascendental, puede ser un “amor personal” que, como tal, radica en la persona, muestra a la persona y la hace crecer. De acuerdo con eso, la estructura del capítulo es la siguiente: explicaremos la confluencia metafísica entre ambos filósofos y el papel de la amistad en la apertura al ámbito existencial (epígrafe 2); seguiremos con los elementos de la antropología trascendental que permiten proseguir pensando la amistad (epígrafe 3); estudiaremos el amar personal y la posibilidad de los “amores personales” (epígrafe 4) y finalmente abordaremos la amistad como amor personal. La irrupción de la inteligencia artificial, la consecución de los objetivos de inclusión, igualdad o de sostenibilidad económica, plantean en las sociedades occidentales diferentes alternativas de actuación educativa. Este nuevo entorno que habitamos ha provocado también una evolución en los desafíos éticos que se presentan en el mundo de la educación caracterizados por la complejidad de su resolución y por la pluralidad de escenarios y protagonistas involucrados en los mismos. Cuestiones referentes a ¿cómo posicionar al profesor ante la posibilidad del (...) aprendizaje y evaluación automatizada?, ¿cómo implementar el principio de no discriminación educativa en un aula en la que conviven alumnos con diferentes capacidades, habilidades e intereses?, ¿cómo replantear nuevos hábitos de vida en pro de la sostenibilidad planetaria?, ¿cómo integrar la enseñanza de los valores constitucionales del siglo XX con el progreso moral de la sociedad del siglo XXI? constituyen la hipótesis de partida. Se afirma por tanto, que la educación debe abrirse a otras cuestiones, relativamente novedosas y de origen tecnológico, político o económico, que trascienden ese horizonte e impactan directamente en ella, concretamente desde el punto de vista de la ética educativa. Se establece una análisis de los desafíos actuales y su prospectiva en el campo de la ética de la educación y se establecen tres nuevas categorías en el campo de estudio: triaje, digitalización y nuevos actores. Research on cognitive control has sparked increasing interest in recent years, as it is an important prerequisite for goal oriented human behavior. The paced auditory serial addition task has been used to test and train cognitive control functions. This adaptive, challenging task includes continuous performance feedback. Therefore, additional cognitive control capacities are required to process this information along with the already high task-load. The underlying neural mechanisms, however, are still unclear. To explore the neural signatures of the PASAT and particularly (...) the processing of distractive feedback information, feedback locked event-related potentials were derived from 24 healthy participants during an adaptive 2-back version of the PASAT. Larger neural activation after negative feedback was found for feedback related negativity, P300, and late positive potential. In early stages of feedback processing, a larger difference between positive and negative feedback responses was associated with poorer overall performance. This association was inverted in later stages. Together, our findings indicate stage-dependent associations between neural activation after negative information and cognitive functioning. Conceivably, increased early responses to negative feedback signify distraction, whereas higher activity at later stages reflects cognitive control processes to preserve ongoing performance. Se presenta un breve análisis comparativo del lenguaje religioso y el lenguaje científico.

The European Universities Initiative (EUI), created by the European Commission in 2017, is a recent novel phenomenon within the European Union policy toolkit that explicitly targets the development of transnational cooperation in higher education (HE). To date, the EUI counts 44 European university alliances, involving around 340 HE institutions. In this paper, we argue that the EUI can be seen as a case of a transnational institution building process representing a potentially significant structural reform for European higher education. Anchored in (...) new institutionalism, we explore the regulative, normative, and cultural-cognitive dimensions of the EUI. Methodologically, this study analyzes the perspectives of European policy actors (n = 4), a set of policy documents (n = 13) and the mission statements of the EUI’s partnerships funded before 2022 (n = 41). The results show that the EUI emerges as the ‘next level of cooperation’ in European HE since it aims to transform European cooperation (regulative dimension), to create and diffuse a new model for European HE following a challenge-based approach (normative dimension), and to work as a way to reinforce and institutionalize European and global scripts for European HE (cultural-cognitive dimension). We discuss the concepts of Weyl and Riemann frames in the context of metric theories of gravity and state the fact that they are completely equivalent as far as geodesic motion is concerned. We apply this result to conformally flat spacetimes and show that a new picture arises when a Riemannian spacetime is taken by means of geometrical gauge transformations into a Minkowskian flat spacetime. We find out that in the Weyl frame gravity is described by a scalar field. We (...) give some examples of how conformally flat spacetime configurations look when viewed from the standpoint of a Weyl frame. We show that in the non-relativistic and weak field regime the Weyl scalar field may be identified with the Newtonian gravitational potential. We suggest an equation for the scalar field by varying the Einstein-Hilbert action restricted to the class of conformally-flat spacetimes. We revisit Einstein and Fokker’s interpretation of Nordström scalar gravity theory and draw an analogy between this approach and the Weyl gauge formalism. We briefly take a look at two-dimensional gravity as viewed in the Weyl frame and address the question of quantizing a conformally flat spacetime by going to the Weyl frame. (shrink)
