This paper argues that moral thinking is an essential management capability which strengthens organizations and contributes to theirperformance in the marketplace. The paper explains what moral thinking is, and addresses the most common reasons for considering it inappropriate or irrelevant to managerial practice. The argument provides a compelling rationale for the corporate ethics initiatives undertaken in recent years.

Dealing with situations where parents’ views about treatment for their child are strongly opposed to doctors’ views is one major area of ethical challenge in paediatric health care. The traditional approach focuses on the child’s best interests, but this is problematic for a number of reasons. The Harm Principle test is regarded by many ethicists as more appropriate than the best interests test. Despite this, use of the best interests test for intervening in parental decisions is still very common in (...) clinical settings and can lead to confusion. In this paper, I propose the Zone of Parental Discretion as a means of putting into practice the key ideas of the Harm Principle, in a clear, step-by-step process. The Zone of Parental Discretion provides a tool for ethical deliberation by clinicians and ethicists about all situations in which parents and doctors disagree about treatment of a child, whether parents are refusing medically recommended treatment, or requesting non-recommended treatment. Brentano's philosophy of art, contained primarily in his book, Grundzuge der Ästhetik, is the result of an original theory of intrinsic value that was derived from Brentano's philosophical psychology. In his aesthetics, Brentano endeavored to find an objective ground for the value of aesthetic contemplation through his theory of the intentional objects of emotions and desires. The lack of attention Brentano's aesthetics has received is surprising, given that two of the many students Brentano influenced, Husserl (through the development of the (...) phenomenological movement) and Ehrenfels (through the development of Gestalt psychology) have had an extraordinary influence on twentieth century perceptions of art. In this paper I will attempt to redress some of this neglect by outlining Brentano's analysis of aesthetic intentions and the relationship his aesthetics bears to his overall philosophical system. Although ethical guidelines for doing Internet research are available, most prominently those of the Association of Internet Researchers ( www.aoir.org ), ethical decision-making for research on publicly available, naturally-occurring data remains a major challenge. As researchers might also turn to others to inform their decisions, this article reviews recent research papers on publicly available, online data. Research involving forums such as Facebook pages, Twitter, YouTube, news comments, blogs, etc. is examined to see how authors report ethical considerations and how they (...) quote these data. We included 132 articles published in discourse analysis-oriented journals between January 2017 and February 2020. Roughly one third of the articles (85 out of 132) did not discuss ethical issues, mostly claiming the data were publicly available. Quotations nevertheless tended to be anonymized, although retrievability of posts was generally not taken into account. In those articles in which ethical concerns were reported, related decisions appeared to vary substantially. In most cases it was argued that informed consent was not required. Similarly, approval from research ethics committees was mostly regarded unnecessary. Other ethical issues like consideration of users’ expectations and intentions, freedom of choice, possible harm, sensitive topics, and vulnerable groups were rarely discussed in the articles. We argue for increased attention to ethical issues and legal aspects in discourse analytic articles involving online data beyond mentioning general concerns. Instead, we argue for more involvement of users/participants in ethical decision-making, for consideration of retrievability of posts and for a role for journal editors. (shrink)

This method draws on the pragmatic philosophy of John Dewey and recommends an experimental approach to solving moral problems in clinical practice. Although the method may shed some light on how clinicians and their patients ought to interact when moral problems are at hand, it nonetheless is deficient in a number of respects. Clinical pragmatism fails to explain adequately how moral problems can be solved experimentally, (...) it underestimates the relevance and importance of judgment in clinical ethics, and it presents a questionable account of the role that moral principles should play in moral problem solving. For many years, there has been a gap in our capacity to study the structure and organization of chromosomal DNA molecules. The very small genomes of some viruses and bacteriophages (≤ 50,000 bp or 50 kb) are amenable to analysis by conventional gel electrophoresis, while the extremely large DNA molecules (> 100,000 kb) comprising the chromosomes of higher eukaryotes have been analysed under the light microscope, using a range of banding and in situ hybridization techniques. However, intact DNA molecules with (...) sizes between these two extremes have been largely inaccessible experimentally. This gap has recently been bridged with the development of two‐dimensional electrophoretic procedures that allow the separation and purification of chromosome‐sized DNA molecules ranging from ∼ 50 kb to several thousand kb.1–3 There are currently two variations of the technique in use: pulsed field gradient (PFG) gel electrophoresis1,2 and orthogonal‐field‐alteration gel electrophoresis (OFAGE).3 Both are based on a common principle, differing primarily in the geometry of the electrodes. Already, they have been employed to determine the approximate chromosome sizes and numbers for a variety of lower eukaryotes, including yeast and several protozoa.2–10 These ‘molecular karyotypes’ provide fundamental information about the genomic organization of each organism, and allow very rapid construction of linkage maps. Surprisingly, they have also revealed a remarkable plasticity in the genomes of several lower eukaryotes. (shrink)

Comparisons of Japan with Western countries have long been used to explore the relationship between technology and culture. In the 1950s and 1960s such work sought to determine if technological imperatives were diminishing cultural differences. In the 1970s, 1980s and early 1990s many sought to identify aspects of Japanese culture that might lie at the root of Japan’s technological successes. This article argues that we should now undertake more micro and more systematic comparative studies that are more directly grounded in (...) theory. Studies concentrating on engineers and the practice of engineering would seem to be an especially promising starting point. (shrink)

‘Tympaniser’, Alan Bass tells us, is an ‘archaic verb meaning to ridicule publicly’ or to decry. In the essay fronting Margins of Philosophy called ‘Tympan’ Derrida decries the philosophy that would own its limits, absorbing ‘the margin of its own volume’. While it is Derrida’s late work on the ‘animal question’ that has brought his insistence on the nourishment of the limits between species as limitrophy to wider attention, it is also named as the general condition of the interface of (...) the limits in the much earlier text, ‘Tympan.’ There, in dislocating the tympanum, the margins of philosophy are eaten. Equally, given the rhythmic address of the tympanum, we might say that the margins of philosophy are beaten. Struggling within the strictures of a small town amateur dramatic rehearsal, Selma, the lead protagonist in Dancer in the Dark, makes a plea for more rhythm. But there is no license for tap-dancing in The Sound of Music. This chapter considers Dancer’s persistent play on rhythmic sounds as that which trip Selma’s fantasy song and dance numbers as a ‘tympanising’ of the limits, notably of the limits of the law in both juridical and symbolic senses, as they also work the edges of the film’s two styles. In a provocative analysis of this film, Cary Wolfe suggests that we might understand Selma’s vocal style as a refusal of the phallic imposition of language, and that her virtually suicidal submission to the death sentence construed as a Lacanian ‘feminine’ act, allow for a notion of a ‘posthuman feminine’. ‘Tympan Alley’ redirects Wolfe’s tantalising term ‘posthuman feminine’ through a more consistently Derridean line of thought. It draws on Derrida’s late work on the animal, in which it is polemically clear that deconstruction has never been confined to the signifier nor to the human, and sounds out the implications of his early work on b/eating the limits through Selma’s percussive ear. The author has previously shown that for a certain class of structures $\mathcal {I}$, $\mathcal {I}$-indexed indiscernible sets have the modeling property just in case the age of $\mathcal {I}$ is a Ramsey class. We expand this known class of structures from ordered structures in a finite relational language to ordered, locally finite structures which isolate quantifier-free types by way of quantifier-free formulas. This result is applied to give new proofs that certain classes of trees are Ramsey. To aid this (...) project we develop the logic of EM-types. (shrink)

An implicit goal of many interventions intended to enhance integrity is to minimize peoples' exposure to unethical events. The intent of the present effort was to examine if exposure to unethical practices in the course of one's work is related to ethical decision making. Accordingly, 248 doctoral students in the biological, health, and social sciences were asked to complete a field appropriate measure of ethical decision making. In addition, they were asked to complete measures examining the perceived acceptability of unethical (...) events and a measure examining perceptions of ethical climate. When these criterion measures were correlated with a measure examining the frequency with which they had been exposed to unethical events in their day-to-day work, it was found that event exposure was strongly related to ethical decision making but less strongly related to climate perceptions and perceptions of event acceptability. However, these relationships were moderated by level of experience. The implications of these findings for practices intended to improve ethics are discussed. (shrink)

Theories of spatial cognition are derived from many sources. Psychologists are concerned with determining the features of the mind which, in combination with external inputs, produce our spatialized experience. A review of philosophical and other approaches has convinced us that the brain must come equipped to impose a three-dimensional Euclidean framework on experience – our analysis suggests that object re-identification may require such a framework. We identify this absolute, nonegocentric, spatial framework with a specific neural system centered in the hippocampus.A (...) consideration of the kinds of behaviours in which such a spatial mapping system would be important is followed by an analysis of the anatomy and physiology of this system, with special emphasis on the place-coded neurons recorded in the hippocampus of freely moving rats. A tentative physiological model for the hippocampal cognitive map is proposed. A review of lesion studies, in tasks as diverse as discrimination learning, avoidance, and extinction, shows that the cognitive map notion can adequately explain much of the data.The model is extended to humans by the assumption that spatial maps are built in one hemisphere, semantic maps in the other. The latter provide a semantic deep structure within which discourse comprehension and production can be achieved. Evidence from the study of amnesic patients, briefly reviewed, is consistent with this extension. (shrink)

Ethical decision making measures are widely applied as the principal dependent variable used in studies of research integrity. However, evidence bearing on the internal and external validity of these measures is not available. In this study, ethical decision making measures were administered to 102 graduate students in the biological, health, and social sciences, along with measures examining exposure to ethical breaches and the severity of punishments recommended. The ethical decision making measure was found to be related to exposure to ethical (...) events and the severity of punishments awarded. The implications of these findings for the application of ethical decision making measures are discussed. (shrink)

Embedding Ethics questions why ethics have been divorced from scientific expertise. Invoking different disciplinary practices from biological, archaeological, cultural, and linguistic anthropology, contributors show how ethics should be resituated at the heart of, rather than exterior to, scientific activity. Positioning the researcher as a negotiator of significant truths rather than an adjudicator of a priori precepts enables contributors to relocate ethics in new sets of social and scientific relationships triggered by recent globalization processes--from new forms of intellectual and cultural ownership (...) to accountability in governance, and the very ways in which people are studied. Source credibility has been thought to bean important determinant of peoples‘ reactions toinformation about technology. There has also been muchdebate about the need to communicate effectively withthe public about genetic engineering, particularlywithin the context of food production. Questionnaireswere used to investigate the impact of sourcecredibility, admission of risk uncertainty, andinitial attitude towards genetic engineering onattitudes of respondents after information provision.120 respondents with positive attitudes towardsgenetic engineering in food production were providedwith persuasive information about the technology,where both source attribution and admission (...) of riskuncertainty were systematically varied within theexperimental design. Impact on perceptions of sourcecredibility, informational qualities, and postintervention attitudes were examined, and compared toa second group of respondents who held initiallynegative attitudes towards genetic engineering, andwho had been exposed to similar informationinterventions. As predicted by Social Judgment Theory,initial attitude was found to be an importantdeterminant of post-intervention attitude. However,admission of risk uncertainty was also found to beinfluential in increasing acceptance and reducingrejection of the technology, possibly through thefacilitation of elaborative processing. Contrary toprevious research, prior attitudes had an impact onperceptions of both source credibility andinformational quality. In terms of effectiveinformation provision about genetic engineering, itwas concluded that scientific honesty is the bestpolicy, and that lay understanding of scientificprocess is probably greater than hitherto assumed byexperts. Synaesthesia is an excellent model for understanding perceptual binding in the human brain. Current evidence suggests that if synaesthetic colour is bound, it is through the same attention-dependent integration of feature maps that occurs in other forms of binding. synaesthetic colour arises after the point that separate wavelengths blend in normal colour vision, which creates a perceptual paradox where synaesthetic and print colour can appear bound to a single location without blending. If a letter is printed in a colour that (...) is different from the synaesthetic colour it induces, the two hues will activate different hue-selective maps allowing for dual representation of colour, but if synaesthetic and print colours are the same/similar they will co-activate the same hue-selective map and create an amplified colour signal. Studies suggest that the parietal cortex plays a key role in this binding of synaesthetic and/or print colour to shape. (shrink)

Although we are sympathetic to his central thesis about the illusion of will, having previously advanced a similar proposal, Wegner's account of hypnosis is flawed. Hypnotic behavior derives from specific suggestions that are given, rather than from the induction, of trance, and it can be observed in 90% of the population. Thus, it is very pertinent to the illusion of will. However, Wegner exaggerates the loss of subjective will in hypnosis.

Background Many indigenous people have died or been harmed because of inadequately monitored research. Strong regulations in Human Research Ethics (HRE) are required to address these injustices and to ensure that peoples’ participation in health research is safe. Indigenous peoples advocate that research that respects indigenous principles can contribute to addressing their health inequities. This scoping literature review aims to analyze existing peer reviewed and grey literature to explore how indigenous values and principles from countries of Oceania are incorporated into (...) HRE and the governance of research involving human participants. Methods A scoping literature review framework was used for this study. A search for peer reviewed and grey literature from Google, bibliographies, and electronic databases such as SCOPUS, SPRINGER, Medline (Ovid) and JBI Database of Systematic Reviews was conducted, limited to the years 2002–2020. Sixty (60) documents that focused on indigenous knowledge from Oceania region and HRE were included, from which key findings and themes were synthesized. Results Charting the data showed that more than half the eligible documents were peer-reviewed journal articles (54%). Other sources included: International Declarations on Human Research (8%); book chapters (8%); government documents (8%); HRE Guidelines or protocols (13%); news articles (7%) and PhD thesis (2%). The literature was from Australia, Cook Islands, Guam, New Zealand, Fiji, Samoa, Tonga and Vanuatu, some of which focused specifically on HREs in the Pacific Region. Issues emerging from the literature were grouped into five themes (i) indigenous and cultural principles of HRE; (ii) informed consent in indigenous settings in Oceania; (iii) vulnerability and minority status of indigenous populations exploited for research; (iv) research ethics governance for Oceania indigenous peoples; and (v) research ethics committees in Oceania. Respect, relationship building, and trust were priority indigenous HRE principles that encompass the principles of partnership, capacity building, reciprocity, and equality. Relationship building and trust imply the equal distribution of benefits for indigenous population and researchers. Conclusion Indigenous principles of HRE identified were interconnected and interdependent. Recommendations were to incorporate indigenous principles of research in HRE regulations and processes of all countries with indigenous populations. This is especially pertinent for emerging national research committees in LMIC countries, including Fiji and Tonga. Relationship building among researchers and indigenous populations is key to successful research with indigenous populations. HRE principles important for relationship building include respect that is reciprocal among researchers and indigenous people. Elements of the principle of respect highlighted are empathy, collaboration, sharing of benefits, reciprocity, appreciation, empowerment, protection, safety and awareness of culture and languages. Indigenous ontology from the Oceania region involves spirituality, connectedness to land, religious beliefs and a participatory approach to HRE and should be respected in research. An ethical governance mechanism of HRE is one that incorporates indigenous principles and applications for the purpose of maximizing the protection of the dignity and rights of indigenous peoples of Oceania. Resident microorganisms, known as the microbiota, are essential for many physiological functions including protection against pathogens. Microbiota is indeed required for proper immune system development and function, and can also host-independently protect against infections. Thus, a co-constructed view of host protection involving both host and microbiota, named ’co-immunity,’ has been proposed, and the idea of an ’immunological holobiont’ has been suggested. Yet this view of co-immunity might be too limited, as experimental work has shown that the immune system is involved (...) in functions other than protection, essentially development and repair. Microbiota, through co-immunity, is thereby most likely involved in these functions, although strong evidence is currently lacking. Moreover, as our point of view is mainly host-centered, we may miss the implications of co-immunity at broader scales, including cellular and population levels. Intriguingly, co-immunity effects could be beneficial for one function and/or one level, while being detrimental for others. All these elements should be taken into consideration for microbiota manipulation, in order to avoid potentially harmful side effects. (shrink)

As one of the preeminent philosophers of the twentieth century, W. V. Quine made groundbreaking contributions to the philosophy of science, mathematical logic, and the philosophy of language. This collection of essays examines Quine's views, particularly his holism and naturalism, for their value to feminist theorizing today. Some contributors to this volume see Quine as severely challenging basic tenets of the logico-empiricist tradition in the philosophy of science—the analytic/synthetic distinction, verificationism, foundationalism—and accept various of his positions as potential resources for (...) feminist critique. Other contributors regard Quine as an unrepentant empiricist and, unlike feminists who seek to use or extend his arguments, they interpret his positions as far less radical and more problematic. In particular, critics and advocates of Quine's arguments that the philosophy of science should be "naturalized"—understood and pursued as an enterprise continuous with the sciences proper—disagree deeply about whether such a naturalized philosophy is "philosophy enough." Central issues at stake in these disagreements reflect current questions of special interest to feminists and also bridge the analytic and postmodern traditions. They include questions about whether and how the philosophy of science, as a form of practice, is or can be normative as well as questions concerning the implications of Quine's philosophy of language for the transparency and stability of meaning. In representing feminist philosophy centrally engaged with the analytic tradition, this volume is important not only for what it contributes to the understanding of Quine and naturalized epistemology but also for what it accomplishes in working against restrictive conceptions of the place of feminism within the discipline. In this paper, we discuss and critically evaluate the National Health and Medical Research Council’s recently released document entitled ‘Draft Values and Ethics in Aboriginal and Torres Strait Islander Health Research’. We provide a brief account of its development, philosophy and contents, and then consider how the document could be used by HRECs. We recommend that three specially targeted documents be developed from this one document, to meet the particular needs of HRECs, Indigenous people and researchers. We propose a system (...) of Indigenous ethics advisers as a way to implement the central ideas of the new draft guidelines, without falling into the legalism and rule-following that these guidelines explicitly aim to avoid. Cancer has long been a cultural touchstone: a metaphor of devastation and a spectre of social as well as bodily anomie and loss. Yet recent years have witnessed significant transformations in perceptions of cancer, particularly in perceptions of the cancer patient. This paper is concerned with the ‘struggles of subjectivity’ emergent in this transvalued cancer culture. Explored from the standpoint of the ‘bad patient’, and drawing on media and cultural methodologies, the paper will consider the convergence of medicine, morality and (...) popular iconography as they are embedded in the imageries, imaginaries and representational economies of the cancer culture industry. Of particular concern in this context are the (re)composures of the patient, as liminal figure, caught between clinical imperative and cultural fantasy. (shrink)

Private Lawyers and the Public Interest: The Evolving Role of Pro Bono in the Legal Profession traces the rise and impact of the American Bar Association's campaign to hold lawyers accountable for a commitment to public service and to encourage public service within law schools. Combining empirical legal research with reflections by practitioners and theorists about the (...) meaning and practice of pro bono legal work, this collection of essays interrogates the public service ideals that are inscribed within the legal profession and places these ideals within a broader social, economic, ideological, and normative context. Particular attention is paid to the factors that explain why lawyers engage in pro bono work and the ways in which their views of pro bono are mediated by the institutional context of their legal practice. The book also explores the concept of "public" in public service and compares pro bono as a means of delivering legal services with other mechanisms such as state funding. Collectively, these essays investigate the evolving role of pro bono in the legal profession and in law schools, the relationship between pro bono ideals and pro bono in practice, the way that pro bono is shaped by external forces beyond the individual practitioner, and the multi-faceted nature of legal professionalism as expressed through pro bono practice. : From its founding in 1847, the AMA divided drugs into "ethical" and "unethical" preparations. Those that were ethical had a known composition and were advertised only to the profession. Others, patent medicines (technically proprietary drugs, whose trademarks were protected by copyright), were sold directly to the public. In spite of the AMA's efforts to ban the advertising and sale of these nostrums, proprietary drugs flourished during the nineteenth century. Starting in 1900, however, three major societal trends combined to bolster (...) the AMA's campaign, and by 1920 almost all advertising was directed to physicians, who would then prescribe medications to their patients. This ban on advertising pharmaceuticals directly to the public remained virtually unchanged until approximately 1980. Since then, it has slowly eroded and, as recently as 1997, the FDA created guidelines for pharmaceutical companies to advertise on television. What does this change say about the profession of medicine, the role of the physician in society, and the doctor-patient relationship? Using a comparative historical approach, this paper examines these issues. (shrink)
