Faith occupies an important place in human lives in both religious and secular contexts: faith may be directed towards God, friends, governments, political systems and football teams. It is said to help people through crises and motivate people to achieve life goals. But what is faith? Philosophers and theologians have for centuries been concerned with questions about the rationality of faith, but more recently, have focussed on what kind of psychological attitude faith is. We bring together, for the first time, (...) the different elements of this recent debate, staking out the different positions and arguments, and defend a novel 'true grit' theory of faith, from which we assess questions about the rationality of faith from a fresh perspective. The book engages with a range of questions about the nature of faith, including: Does faith require belief? How is faith expressed in language? Is faith motivational? What is the relationship between faith and cognate attitudes, such as trust and hope? What is the role of faith in our long-term plans? And, in what sense is faith steadfast, resilient or constant, as is commonly supposed? This last issue leads us to additional literature from the social sciences, and we defend a distinctive conception of faith as resistance to practical, psychological and epistemic challenges, that forms the basis of the true grit theory defended in the book. The aesthetics of nature has over the last few decades become an intense focus of philosophical reflection, as it has been ever more widely recognised that it is not a mere appendage to the aesthetics of art. Arthâpatti is a pervasive form of reasoning investigated by Indian philosophers in order to think about unseen causes and interpret ordinary and religious language. Its nature is a point of controversy among Mimamsa, Nyaya, and Buddhist philosophers, yet, to date, it has received less attention than perception, inference, and testimony. This collection presents a one-of-a-kind reference resource for understanding this form of reasoning studied in Indian philosophy. Assembling translations of central primary texts together with newly-commissioned essays on research topics, it (...) features a significant introductory essay. Readable translations of Sanskrit works are accompanied by critical notes that introduce arthâpatti, offer historical context, and clarify the philosophical debates surrounding it. The Acquaintance Principle maintains that aesthetic knowledge must be acquired through first-hand experience of the object of knowledge and cannot be transmitted from person to person. This implies that aesthetic knowledge of an object cannot be acquired either from an accurate description of the non- aesthetic features of the object or from reliable testimony of its aesthetic character. The question I address is whether there is any sound argument in support of the Principle. I give scant consideration to the possibility (...) of deriving knowledge from a non- aesthetic description. If this were to be a real possibility, it would certainly disprove the Acquaintance Principle, but its impossibility would not establish it. Furthermore, if the way knowledge were to be derived from a non- aesthetic description were through its enabling a person to imagine the object, a defender of the Acquaintance Principle might simply deem imagining to be a form of first-hand experience. I focus on the possibility of acquiring aesthetic knowledge through reliable testimony because here there is a style of argument that, if correct, would rule out the possibility of knowledge of an item's aesthetic properties being transmitted to someone who lacks the requisite first-hand experience, and the manoeuvre of including imagining under the head of first-hand experience is not available. An argument of this kind is, I believe, the only possible way of establishing the Acquaintance Principle. I try to show that this style of argument fails and that the Acquaintance Principle should be rejected. (shrink)

I offer an argument for why torture, as an act of state-sponsored force to gain information crucial to the well-being of the common good, should be considered as a tactic of war, and therefore scrutinized in terms of just war theory. I argue that, for those committed to the justifiability of the use of force, most of the popular arguments against all acts of torture are unpersuasive because the logic behind them would forbid equally any act of mutilating or killing (...) in battle. I will also argue that looking at torture through the perspective of the just war tradition forces us to place strictures on the practice that make it hard to justify, helps us to see why torture should never be legalized, helps us to clarify when circumstances might justify torture, and suggests what sort of character is required to recognize when those circumstances have occurred. This chapter talks about the war between the Formics, a seemingly malevolent species of aliens, and humans in the Ender's Game. The great tragedy of the violence that erupted from the Human/Formic war was the result of two deep misunderstandings. The Formics not only failed to grasp the capabilities of humanity, but humanity also deeply misunderstood the creatures that they would come to nickname “buggers.” These misunderstandings may have resulted from what is sometimes called “cultural incommensurability.” The chapter relates that (...) what is most important about Ender is not merely his ability to understand his “enemy,” but his ability to love them. He is able to harness the sympathies of the humans and change their minds about the buggers. An attempt is made to answer the question why wittgenstein might have found the analogy between speaking and playing games philosophically exciting. It is argued that on the face of it the two are strikingly disanalogous, But that on reflecting further one can find various features of games (9 are distinguished in all) which are also features of some speech episodes, And the awareness of which could be philosophically significant.

For most people a sense of self includes an embodied component: when describing our selves we describe those aspects of our physical bodies which can be easily codified: height, hair colour, sex, eye colour. Even when we consider ourselves we tend not to consider our intellectual cognitive characteristics but our describable anatomy. Wittgenstein's dictum, ‘the human body is the best picture of the human soul’, is relevant here but I would like to go further: the body-part we feel most embodied (...) in is our face, even though it is difficult to describe and so forms little part of how we describe ourselves to others. Recent approaches to causal modelling rely upon the causal Markov condition, which specifies which probability distributions are compatible with a directed acyclic graph. Further principles are required in order to choose among the large number of DAGs compatible with a given probability distribution. Here we present a principle that we call frugality. This principle tells one to choose the DAG with the fewest causal arrows. "These essays advance a reinterpretation of pivotal categories such as self-knowing, moral agency, and altruism.

Here we present the personal perspectives of two authors on the important and unfortunately frequent scenario of ambulance clinicians facing a deceased individual and family members who do not wish them to attempt cardiopulmonary resuscitation. We examine the professional guidance and the protection provided to clinicians, which is not matched by guidance to protect family members. We look at the legal framework in which these scenarios are taking place, and the ethical issues which are presented. We consider the interaction between (...) ethics, clinical practice and the law, and offer suggested changes to policy and guidance which we believe will protect ambulance clinicians, relatives and the patient. The simple question, what is empirical success? turns out to have a surprisingly complicated answer. We need to distinguish between meritorious fit and ‘fudged fit', which is akin to the distinction between prediction and accommodation. The final proposal is that empirical success emerges in a theory dependent way from the agreement of independent measurements of theoretically postulated quantities. This essay explores histories of common salt, sodium chloride, using concepts and methods from media theory. It contributes to research on media and environment and the general ‘material turn’ taken across the Humanities. I conceive of salt as what Peters calls an ‘elemental’ medium so as to show, first, the imbrication of naturally-occurring substances in the operations and supply chains of digital culture. Second, the many lives salt has lived materially, in techniques of survival and exchange, and metaphorically, in cultural (...) expression, complicate conventional understandings of media. In showing how salt performs three functions, processing, storage, and transfer, which Kittler ascribed to technical and symbolic media, I argue for a more expansive use of ‘mediation’ as a bridge concept that speaks to matters of nature and culture, Arts and Science, and to account for deep histories of extraction and economy that shape digital culture and global supply chains. A relatively high incidence of unsatisfactory review decisions is widely recognised and acknowledged as ‘the peer review problem’. Factors contributing to this problem are identified and examined. Specific examples of unreasonable rejection are considered. It is concluded that weaknesses of the ‘peer review’ system are significant and that they are well known or readily recognisable but that necessary counter-measures are not always enforced. Careful management is necessary to discount hollow opinion or error in review comment. Review and referee functions should (...) be quite separate. (shrink)

This essay explores Aristotle’s treatment of imagination. It argues that Aristotle need not be charged with the radical inconsistency in his treatment of phantasia diagnosed by Hamlyn. Although a conceptual link can be made between imagination and a use of ‘appears’, the link is not as close as the connection between phantasia and phainesthai, nor does ‘appears’ provide the natural entree to the study of imagination which phainetai provides to that of phantasia. A little lexicography will show that the syntactic (...) behaviour and semantic range of phantasia are different from those of imagination. (shrink)

For some time, the role of culture in language education within schools, universities and professional communication has received increasing attention. This article identifies two aporias in the discourse of intercultural communication : first, that it contains an unstated movement towards a universal consciousness; second, that its claims to truth are grounded in an implicit appeal to a transcendental moral signified.These features constitute IC discourse as ‘totality’, or as ‘metaphysics of presence’.The article draws on the work of Levinas ; and Derrida (...) to propose more considered ethical grounds for intercultural praxis. Contra a Hegelian impetus towards universal consciousness,we posit an irreducible distance and separation between the self and other. In so doing, not only are we able to supersede the field’s implicit appeal to the transcendental as a source of truth but also to counter perceptibly ‘exorbitant’ claims and actions of the intercultural other. In this vein, the article proposes a discourse ethics of responsibility by which it still becomes possible for a critical intercultural praxis to make value judgements and to take potentially transformative action vis-à-vis cultural acts that challenge the limits of intercultural tolerance and hospitality. Thomas Hobbes's Leviathan is one of the most important philosophical texts in the English language, and one of the most influential works of political philosophy ever written. This is the first critical edition based on a full study of the manuscript and printing history. It is also the first edition to place the English text side by side with Hobbes's later Latin version of it, complete with a set of notes in which the many passages that differ in the Latin (...) are translated into English. So, for the first time, readers of Leviathan will be able to see clearly every stage of the development of the text. Both texts are fully annotated with explanatory notes. The editor's Introduction, which takes up the whole of the first volume, gives a path-breaking account of the work's context, sources, and textual history. ‘Framing the Refugee’ looks at the power of representation of liberal political theory with regard to refugees. In the author’s view, legal and political arbitrariness lies in the representing of refugees as lacking agency. His key point is that liberalism fails to conceive of refugees as politically capable actors, and he is thus complicit in the arbitrary neutralisation of their emancipatory potential and participatory powers. This paper emphasises the moral justifiability of that state of affairs by seeking some answers to (...) the question of why liberal political theory construes a concept of the refugee that does not contain any element of political agency. Most obviously, the author acknowledges that refugees perform a significant social role in contemporary societies and are hence active members in them. Nonetheless, they remain neglected in their political role by most political theory. What does it mean to have political agency for the author? It means to have the power of self-representation, that is, of being allowed and even enabled by a given legal system to bring about change in the political order, or at least to participate in that change. But the author also calls attention to the role of ‘theory’ in addressing this downside of the contemporary liberal democratic order. Theory becomes even more crucial at times of urgency, that is, when theorists have a moral responsibility to deepen their philosophical imagination, as Hannah Arendt so forcefully noted. The theoretical task of ‘re-framing’ the refugee entails reconfiguring political philosophy and its traditional categories of sovereignty, citizenship and nationality. The liberal inability to accommodate the political agency of many members of the political community – especially of non-nationals – is a sign of the historical contingency of the current rules of political membership. This inability makes evident the imperative of rethinking politics in ways that avoid the arbitrariness of treatment and aim instead at equality and justice. If political leaders can re-write the rules of membership to suit their own ideological agendas, the same demand should be addressed by – indeed demanded from – political and legal theorists. However, this is not as easy as it seems, according to the author. In his view, political theory is confronted with fundamental challenges, the most obvious one being that ‘theory’ is usually unequipped to defeat its own ‘topology’. Note that in saying this the author is raising a more pressing concern about arbitrary law-making: it may be that arbitrariness – especially the arbitrary treatment of aliens by the sovereign state and by liberal democracies in particular – is inscribed in the very DNA of liberalism. No matter how odd this may seem, the author advances the view that ideas, however creative of a new order, or transformative of a given status quo, never appear in "free form", and are instead deeply rooted in a structure that constrains our imagination. The challenge is thus to develop a meta-theory that reconceptualises the very way liberal political theory frames marginalised sectors of society – such as the "poor" – as a product of an international economic order that robs those sectors of their agency as the very condition of its internal functioning. We must therefore question how the very idea of the refugee is produced, because it symbolises the construction of an inside and an outside that is complicit with the arbitrary play of legal statuses involved in migration policy. The author’s main point regarding this is that certain groups are sidelined by economic, political and social systems because they are already excluded from theoretical systems to start with. Organizations are faced with the challenge of responding to increasing pressures to promote diversity in various ways. We draw attention to one possible proactive organizational response—the incorporation of diversity in organizational identity. This initial response necessarily evokes subsequent tasks of managing the changed identity. Therefore, this article also addresses the management of diversity identity within organizations, and relevant organizational outcomes. Our theoretical model is grounded in institutional theory, and we propose that the management of diversity identity can impact both perceptions (...) of legitimacy as well as diversity identity. Adequate, inadequate, and optimal management of diversity identity have differential effects on legitimacy and diversity identity. We contribute to the literature by a) unbundling initial and later firm responses to promoting diversity at the organizational level, and b) offering a more nuanced understanding of the complexities of managing diversity identity within organizations. This paper examines the structural features of the U.S. Health Care System that make it particularly vulnerable to fraud, and which help to account for the types of fraud that arise and the difficulties authorities confront in controlling them. These structural features include the predominance of fee-for-service structures, private sector involvement in health care delivery and health insurance, highly automated cl aims processing systems, and a processing culture and audit mentality that emphasize process accuracy over verification. The paper also discusses (...) the underlying pathology of fraud as a white-collar crime problem, and explains how the more general challenges of controlling fraud are exacerbated by particular features of the health system. The central and unsolved problem of False Claims is examined in some detail. A series of recent governmental responses to medically impossible claims of various types is shown to align more closely with a claims-process-improvement mindset than with a crime-control approach. A more mature crime-control orientation is a pre-requisite for any serious progress in reducing the levels of fraud in the U.S. health system. (shrink)

This paper explores similarities and differences between grief over the death of a person and other experiences of loss that are sometimes termed 'grief', focusing on the impact of serious illness and bodily injury. It takes the form of a dialogue between a physician/ neurophysiologist and a philosopher. Adopting a broad conception of grief, we suggest that experiences of lost or unrealized possibilities are central to all forms of grief. However, these unfold in different ways over prolonged periods. Experiences of (...) grief are complex, diverse, difficult to articulate, and frequently under-acknowledged. This diversity, we note, complicates discussions of how to distinguish typical from pathological forms of grief. We raise the concern that thinking of grief through the lens of bereavement eclipses other circumstances in which people are required to comprehend and adapt to loss. With this lack of acknowledgment, the phenomenology of grief is characterized in ways that are overly tidy and people are deprived of important interpretive resources. (shrink)

Over recent decades, developments in network governance have seen governments around the world cede considerable authority and responsibility to commercial migration intermediaries for recruiting and managing temporary migrant labour. Correspondingly, a by-product of network governance has been the emergence of soft employment regulation in which voluntary codes of conduct supplement hard legal employment standards. This paper explores these developments in the context of temporary migrant workers employed in Australian horticulture. First the paper analyses the growing use of temporary migrant labour (...) in this industry. It then describes how different types of intermediaries interact with this workforce. The paper then outlines both hard and soft employment regulations, and contrasts them with actual employment conditions, questioning how a network governance approach has affected this vulnerable workforce. The paper concludes that changes in network governance of migration and employment relations have emasculated formal legal regulation, leaving market forces to operate without effective or ethical constraints at the expense of the public good. This paper critically examines the materialism that Gilles Deleuze espouses in his oeuvre to the benefit of educational theory. In Difference and Repetition, he presented transcendental empiricism by underwriting Kant with realism (Deleuze, 1994). Later, in Capitalism & Schizophrenia I & II that were co-written with Félix Guattari (1984, 1988) and that they named Anti-Oedipus and A Thousand Plateaus, Deleuze's philosophical approach is realigned into what I term here as transcendental materialism, and latterly as immanent materialism; that I claim effectively (...) eliminate phenomenology as perceptual input. This essay takes this transformation seriously as a way of understanding educational data, research and practices. The proposition that is central to this paper is that transcendental and immanent materialism give us a means of dealing with educational phenomena without the interference of perception or a stable category of experience, by connecting data with theory and circumventing subjectification. It is argued that this proposition has important consequences for educational research, and the construction of educational arguments that will be illustrated in this essay. Deleuze's debt to French Marxism and in particular to the work of Louis Althusser are also recognised through this writing. (shrink)
