This article comes out of a series of discussions among a diverse group of chief executive officers (CEOs) and other leaders of nonprofit hospitals, long-term care facilities, health maintenance organizations, and other insurance providers, including several nonprofit Blue Cross Blue Shield (BCBS) plans. The group has met several times over the past year around a shared concern: the current challenges to nonprofit health care organizations and the future role for nonprofits in the re-visioning and creation of an American health care (...) system that is characterized by universal access, patient-centered quality, and national affordability. Gideon Rosen (2014) has drawn our attention to cases of duress of a particularly interesting sort: the person's ‘mind is not flooded with pain or fear’, she knows exactly what she is doing, and she makes a clear-headed choice to act in, as Rosen says, ‘awful ways’. The explanation of why we excuse such actions cannot be that the action was not voluntary. In addition, although some duress cases could also be viewed as necessity cases and thus as justified, Rosen (...) wisely sets aside that complicating factor by zeroing in on those cases where the action clearly is not justified. So why do we excuse in these cases, where the action is not justified and the agent acted voluntarily?Rosen thinks the key lies in the ‘ill will’ condition, ‘the idea that an act is blameworthy only if it manifests insufficient concern or regard for those affected’. He says this is relatively uncontroversial; much of my paper is taken up with calling the ‘ill will’ condition into question. I also take issue with Rosen on just how justifications and excuses differ. I argue in favour of understanding justifications (in a context where we are asking how justifications and excuses differ) as not requiring truth, but only reasonable belief. (shrink)

A. Koriat distinguishes between feeling-based and inferentially based feeling-of-knowing judgments. The former are attributable to partial information that is activated in implicit memory but not fully articulated. They are not, however, attributable to direct access to the target-an hypothesis that Koriat specifically repudiates. While there is considerable merit in the distinction that Koriat draws, and his emphasis on the possibility that people base at least some of their metacognitive judgments on implicit information seems well founded, it is argued that his (...) rejection of the direct access view is premature. There may be a state-a true noetic state-in which people actually know the answer before they are able to express it. A case is made for further consideration of the scientific merits of the direct-access view of the noetic feelings people experience in imminent tip-of-the-tongue (TOT) states. (shrink)

Substructural fuzzy logics are substructural logics that are complete with respect to algebras whose lattice reduct is the real unit interval [0.1]. In this paper, we introduce Uninorm logic UL as Multiplicative additive intuitionistic linear logic MAILL extended with the prelinearity axiom ((A → B) ∧ t) ∨ ((B → A) ∧ t). Axiomatic extensions of UL include known fuzzy logics such as Monoidal t-norm logic MTL and Gödel logic G, and new weakening-free logics. Algebraic semantics for these logics are (...) provided by subvarieties of (representable) pointed bounded commutative residuated lattices. Gentzen systems admitting cut-elimination are given in the framework of hypersequents. Completeness with respect to algebras with lattice reduct [0, 1] is established for UL and several extensions using a two-part strategy. First, completeness is proved for the logic extended with Takeuti and Titani's density rule. A syntactic elimination of the rule is then given using a hypersequent calculus. As an algebraic corollary, it follows that certain varieties of residuated lattices are generated by their members with lattice reduct [0, 1]. (shrink)

Baron develops and assesses the criticism, which she sees as comprising two objections: that duty plays too large a role, leaving no room for the supererogatory, and that Kant places too much value on acting from duty. Clearly written and cogently argued, Kantian Ethics Almost without Apology takes on the most philosophically intriguing objections to Kant's ethics and subjects them to a rigorous yet (...) sympathetic assessment. Morganeering was written by Professor Alexander Bickerton, in Christchurch, New Zealand, in the late 1800s. Various partial versions have survived with the most complete appearing in 1903. Lyman Tower Sargent searched UK and New Zealand archives, then diligently assimilated the various versions and portions to recreate this book, which he has meticulously edited. His forty-four-page introduction is well worth reading even on its own.Bickerton came from England to New Zealand in 1874 as Foundation Professor at what is now University of (...) Necessary and sufficient conditions are presented for the (first-order) theory of a universal class of algebraic structures (algebras) to have a model completion, extending a characterization provided by Wheeler. For varieties of algebras that have equationally definable principal congruences and the compact intersection property, these conditions yield a more elegant characterization obtained (in a slightly more restricted setting) by Ghilardi and Zawadowski. Moreover, it is shown that under certain further assumptions on congruence lattices, the existence of a model completion implies (...) that the variety has equationally definable principal congruences. This result is then used to provide necessary and sufficient conditions for the existence of a model completion for theories of Hamiltonian varieties of pointed residuated lattices, a broad family of varieties that includes lattice-ordered abelian groups and MV-algebras. Notably, if the theory of a Hamiltonian variety of pointed residuated lattices has a model completion, it must have equationally definable principal congruences. In particular, the theories of lattice-ordered abelian groups and MV-algebras do not have a model completion, as first proved by Glass and Pierce, and Lacava, respectively. Finally, it is shown that certain varieties of pointed residuated lattices generated by their linearly ordered members, including lattice-ordered abelian groups and MV-algebras, can be extended with a binary operation to obtain theories that do have a model completion. I develop a new theodicy in defense of Anselmian theism, one that has several advantages over traditional and recent replies to the Problem of Evil. To make my case, I first explain the value of a positive trajectory: a forward-in-time decrease in ‘first-order-gratuitous’ evil: evil that is not necessary for any equal-or-greater first-order good, but may be necessary for a higher-order good, such as the good of strongly positive axiological trajectory. Positive trajectory arguably contributes goodness to a world in proportion (...) to the magnitude of this trajectory, and worlds that contain first-order-gratuitous evil thereby have the potential to contain a strongly positive trajectory. This would arguably explain why God would permit first-order-gratuitous evils: he may be indifferent between a world with no first-order-gratuitous evil and a world with some first-order-gratuitous evil but a strongly positive trajectory. Next, I answer the most salient objections to this theodicy. Finally, I explain how this theodicy is superior to some common theodicies. (shrink)

Anniversaries and funding crises prompt periodic calls to reevaluate the mission and public perceptions of the U.S. Land-Grant University system. One such call was issued by the Kellogg Commission on the Future of State Colleges and Land Grant Universities in their 1999 report, “Returning to Our Roots: the Engaged Institution.” Written by leaders of state universities and land-grant colleges, this report urges these institutions to engage more authentically and equitably in two-way relationships with their local constituents. Twenty years later, Land-Grant (...) Universities continue to struggle with building widespread public support for their missions and equitable involvement in research, teaching, and extension functions across diverse constituencies. While largely discounted by the Kellogg Commission, a fresh look at the role originally envisioned for the extension arm of the trifold land-grant mandate suggests that we may be conceiving of this system too narrowly. The establishment of statewide extension systems was once seen as a way to ensure that Land-Grant Universities would be accessible and responsive to all of a state’s residents. Extension systems continue to offer a front-door to a major public university in almost every county of the United States, but they tend to be viewed primarily as a way to translate science or distribute information from the university to the public. This discussion uses a historical and modern lens to reimagine the role that Extension could potentially play in catalyzing reciprocal, co-learning relationships between Land-Grant Universities and their diverse local constituencies. American doctors in the 1990s are being asked to serve as "double agents," weighing competing allegiances to patients' medical needs against the monetary costs to society. This situation is a reaction to rapid cost increases for medical services, themselves the result of the haphazard development since the 1920s of an inherently inflationary, open-ended system for funding and delivering health care. The answer to an inefficient system, however, is not to stint on care, but rather to restructure the system to remove (...) the inflationary pressures. As long as we are spending enormous resources on an inherently inefficient and inflationary system we cannot justify asking doctors to withhold beneficial care to save money for third-party payers. Doing so serves a largely political agenda and endangers the patient-centered ethic that is central to medicine. (shrink)

This book is a philosophical reflection on the experience of time from within exile. Its focus on temporality is unique, as most literature on exile focuses on the experience of space, as exile involves dislocation, and moods of nostalgia and utopia. Marcia Sá Cavalcante Schuback proposes that in exile, time is experienced neither as longing back to the lost past nor as wanting a future to come but rather as a present without anchors or supports. She articulates this present (...) as a "gerundive" mode, in which the one who is in exile discovers herself simply being, exposed to the uncanny experience of having lost the past and not having a future. To investigate this, the book establishes a conversation among three authors whose work has exemplified this sense of gerundive time: the German philosopher Martin Heidegger, the French writer and essayist Maurice Blanchot, and the Brazilian writer Clarice Lispector. The book does not aim to discuss how these authors understand the relation between time and exile but enters in conversation with them in relation to this question. Attempting to think and express this difficult sense of time from within exile, the book engages with the relation between thought and language, and between philosophy and literature. Departing from concrete existential questions, it opens new philosophical and theoretical modes through which to understand what it means to be present in times of exile. (shrink)

Hume scholars have been anxious to point out that when Hume calls Justice, chastity and so on artificial virtues, he is in no way denying that they are real virtues. I shall argue that they are mistaken, and that anyone who wants to understand Hume's account of Justice and his category of artificial virtues must take seriously his choice of the word ‘artifice,’ recognizing that it means not only ‘Skill in designing and employing expedients,’ but also ‘address, cunning, trickery.'My suggestion (...) will seem strange given Hume's own repeated plea that we not take the term ‘artifice’ too seriously. Yet while it is generally good policy to take people - at least philosophers - at their word, this is a Justified exception, Justified not only by Hume's known proclivities to irony and subtlety, but also by the implications of hearkening to his plea. Current UK legislation is impacting upon the feasibility and cost-effectiveness of medical record-based research aimed at benefiting the NHS and the public heath. Whereas previous commentators have focused on the Data Protection Act 1998, the Health and Social Care Act 2001 is the key legislation for public health researchers wishing to access medical records without written consent. The Act requires researchers to apply to the Patient Information Advisory Group for permission to access medical records without written permission. We present a (...) case study of the work required to obtain the necessary permissions from PIAG in order to conduct a large scale public health research project. In our experience it took eight months to receive permission to access basic identifying information on individuals registered at general practices, and a decision on whether we could access clinical information in medical records without consent took 18 months. Such delays pose near insurmountable difficulties to grant funded research, and in our case £560 000 of public and charitable money was spent on research staff while a large part of their work was prohibited until the third year of a three year grant. We conclude by arguing that many of the current problems could be avoided by returning PIAG’s responsibilities to research ethics committees, and by allowing “opt-out” consent for many public health research projects. This paper brings about a conversation between Schumpeterian and Polanyian perspectives on markets and their central role in the capitalist economy. For Schumpeter, markets were critical to the process of selftransformation of economic activity, but in his vision, markets as such were largely taken for granted. Markets enabled the introduction of new processes and products equally as well as rendering economic activities obsolete, with the entrepreneur and firm as agents of change, generating new combinations of activities and driven by the (...) creative power of knowledge. Innovation and markets are jointly the engines of endogenous growth. For Karl Polanyi, by contrast, although markets were the central feature of the capitalist economy from the beginning of the nineteenth century, his main interest is the constant impulse for markets as institutions to expand into every aspect of social life and the countermovement of regulation to restrain what he sees as their essentially destructive nature. His focus is therefore on markets as instituted economic processes, driven by the double movement of regulation and de-regulation. He scarcely considers innovation in production or consumption, concentrating on institutions of exchange and distribution. The paper explores the two perspectives in order to ask the question that their confrontation raises: What is the relation between intra-market endogenous change and marketframework institutional change? To test out each perspective, a schematic “long-duration” empirical account of the United Kingdom food distribution markets is subjected to a Schumpeterian and Polanyian reading, and each is exposed for complementary deficits. A broader explanatory framework is sketched that proposes analysis of innovation in market institutions--especially processes exchange and distribution-- in combination with innovation in production and consumption. It is suggested that to explore the constant change of capitalist economies, these four economic domains each involve different orders of innovation and transformation that have complex feedbacks and interactions with each other. Rather than according primacy to one or other order of change, we require a complex causal account embracing multiple instituted economic processes.Cet article discute de la vision des marchés et de leur rôle central dans l’économie capitaliste selon Schumpeter et Polanyi. Eugene Garver. Chicago: University of Chicago Press, 2004. pp. 264. $55.00, hardcover; $22.50, paperback.Professor Garver's book, For the Sake of Argument: Practical Reasoning, Character, and the Ethics of Belief, is a provocative and illuminating study of practical reasoning, and one that develops (...) many of the ideas found in his magisterial study, Aristotle's Rhetoric: An Art of Character (Chicago: University of Chicago Press, 1994). The previous book concluded by arguing that Aristotle's Rhetoric is philosophically more interesting today than it was in Aristotle's time, in part because for us there is no polis to which the argumentative facility of rhetoric would be subordinate (1994, 233ff.). This idea is echoed in the present book when Garver writes: "The more we take disagreement to be a permanent part of the situation of practical reasoning, and not something soon to be overcome by appropriate theory or universal enlightenment, the more rhetorical facility becomes a central part [End Page 95] of practical reason" (2004, 175). It is, indeed, a fascinating feature of For the Sake of Argument that it defends the autonomy and integrity of practical reason through Aristotle's insights on the various connections between argument, persuasion, and ethos (153), and illustrates these through examples such as the South African Truth and Reconciliation Commission, the landmark Brown v. Board of Education, and subsequent Supreme Court decisions.The book is divided into eight chapters, and, as Garver explains, these represent four pairs of essays in which a more concrete or "applied" chapter is followed by a chapter that draws generalizations from the examples of the prior chapter. Among the themes most prominent in the book are the connection between reason and character, on which Garver writes, "Practical reason has its own integrity when who we are and how we think are intimately connected" (2); the compatibility, within practical reason, of truth and one's own interest; the "ampliative" nature of practical reason, such that the implications of one's beliefs can lead to discoveries unanticipated at the beginning; the connection between the ethos of a leader and the ethos of a community; and the underappreciated power of epideictic rhetoric "to affirm values and articulate new vocabularies" (178). In addressing such broad themes, Garver's attention to concrete examples, like Brown v. Board of Education, is thoroughly instructive. The Brown decision, he argues, is "an epideictic declaration that equality and antidiscrimination are fundamental American Constitutional values" (73). Brown clearly demonstrates the ampliative nature of practical reason in that the conclusion it reaches is stronger than the premises from which it begins (i.e., the Fourteenth Amendment); moreover, it generates what Garver calls an "ethical surplus" that allows for unanticipated implications that are stronger still, such as the later Court decision striking down antimiscegenation laws (71–73). This "increase" in strength in proceeding from premises to conclusion is "impossible under a purely deductive conception of rationality," Garver writes (73), yet it is well explained by his Aristotle-inspired account of practical reasoning.Surely some readers will recoil from Garver's more provocative claims, such as that "we decide... to be convinced and choose to find a line of reasoning compelling" (119), offered within a discussion of the responsibility we bear in ethical argumentation. However, the issue that is more problematic, to my mind, concerns Garver's treatment of Plato. This may seem odd, given that Plato only appears as a foil in the book—but the problem is that it is merely a caricature of Plato that Garver allows to act as [End Page 96] a foil. Garver argues against "the Platonic program which will save reason by removing it from human contamination" (3) and "the Platonic hope of replacing ethical reasoning by the certainties of science" (5). He sides with Aristotle's idea that we can aim at effectiveness and at rightness together (48, 200) over against the allegedly Platonic idea that we must choose between truth and our own interest, reason and emotion, and so forth, or else... It is widely agreed that the top three Model Penal Code culpability levels suffice for criminal liability, but the fourth is controversial. And it isn’t just the particular MPC wording; that negligence should be on the list at all is controversial. My question is: What makes negligence so different? What is it about negligence that gives rise to the view that it should not suffice for criminal liability? In addressing it, I draw attention to how we conduct the debate, and (...) how our framing of the issues is shaping it. My hope is to prompt thought and discussion on just what we want the element of mens rea to provide, and to draw attention to background assumptions that shape our views of what it should take for negligence to count as a species of mens rea. A Kripke semantics characterization is given for the structurally complete implication–negation fragments of intermediate logics, and it is shown that the admissible rules of this fragment of form a PSPACE-complete set and have no finite basis.
