Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

In combating the ongoing global health threat of the COVID-19 pandemic, decision-makers have to take actions based on a multitude of relevant health data with severe potential consequences for the affected patients. Because of their presumed advantages in handling and analyzing vast amounts of data, computer systems of algorithmic decision-making are implemented and substitute humans in decision-making processes. In this study, we focus on a specific application of ADM in contrast to human decision-making, namely the allocation of COVID-19 vaccines to (...) the public. In particular, we elaborate on the role of trust and social group preference on the legitimacy of vaccine allocation. We conducted a survey with a 2 × 2 randomized factorial design among n = 1602 German respondents, in which we utilized distinct decision-making agents and prioritization of a specific social group as design factors. Our findings show that general trust in ADM systems and preference for vaccination of a specific social group influence the legitimacy of vaccine allocation. However, contrary to our expectations, trust in the agent making the decision did not moderate the link between social group preference and legitimacy. Moreover, the effect was also not moderated by the type of decision-maker. We conclude that trustworthy ADM systems must not necessarily lead to the legitimacy of ADM systems. (shrink)

It discusses the answers given by Aristotle, Proclus and Kant, through Frege's and Russell's versions of logicism, Hilbert's formalism, Gödel's platonism, up to the the current debate on (...) Benacerraf's dilemma and the indispensability argument. Through the considerations of themes in the philosophy of language, ontology, and the philosophy of science, the book aims at offering an historically-informed introduction to the philosophy of mathematics, approached through the lenses of its most fundamental problem. Social norms have played a key role in the evolution of human cooperation, serving to stabilize prosocial and egalitarian behavior despite the self-serving motives of individuals. Young children’s behavior mostly conforms to social norms, as they follow adult behavioral directives and instructions. But it turns out that even preschool children also actively enforce social norms on others, often using generic normative language to do so. This behavior is not easily explained by individualistic motives; it is more likely a result of (...) children’s growing identification with their cultural group, which leads to prosocial motives for preserving its ways of doing things. Proposition I.1 is, by far, the most popular example used to justify the thesis that many of Euclid’s geometric arguments are diagram-based. Many scholars have recently articulated this thesis in different ways and argued for it. My purpose is to reformulate it in a quite general way, by describing what I take to be the twofold role that diagrams play in Euclid’s plane geometry (EPG). Euclid’s arguments are object-dependent. They are about geometric objects. Hence, they cannot be diagram-based unless diagrams (...) are supposed to have an appropriate relation with these objects. I take this relation to be a quite peculiar sort of representation. Its peculiarity depends on the two following claims that I shall argue for: ( i ) The identity conditions of EPG objects are provided by the identity conditions of the diagrams that represent them; ( ii ) EPG objects inherit some properties and relations from these diagrams. . This paper investigates the mechanisms of knowledge production of twenty-first century robotics-inspired morphology. How robotics influences investigations into the structure, development, and change of organic forms? Which definition of form is presupposed by this new approach to the study of form? I answer these questions by investigating how robots are used to understand and generate new questions about the locomotion of extinct animals in the first case study and in high-performance fishes in the second case study. After having illustrated (...) the landscape of twentieth-century morphology, I will reflect on the definition of form adopted in twenty-first century robotics-inspired morphology as well as on the differences between this approach to the study of form and the so-called nature-inspired disciplines, such as bionics or biomimetics. In the conclusion, I suggest that we are now in a material turn in morphology, characterized by the coexistence of the robotic, the virtual, and the real, which enables an understanding of how the structures and dynamics of shapes change over time. By inserting the dialogue between Einstein, Schlick and Reichenbach into a wider network of debates about the epistemology of geometry, this paper shows that not only did Einstein and Logical Empiricists come to disagree about the role, principled or provisional, played by rods and clocks in General Relativity, but also that in their lifelong interchange, they never clearly identified the problem they were discussing. Einstein’s reflections on geometry can be understood only in the context of his ”measuring rod objection” against (...) Weyl. On the contrary, Logical Empiricists, though carefully analyzing the Einstein–Weyl debate, tried to interpret Einstein’s epistemology of geometry as a continuation of the Helmholtz–Poincaré debate by other means. The origin of the misunderstanding, it is argued, should be found in the failed appreciation of the difference between a “Helmholtzian” and a “Riemannian” tradition. The epistemological problems raised by General Relativity are extraneous to the first tradition and can only be understood in the context of the latter, the philosophical significance of which, however, still needs to be fully explored. The notion of schema has been given a major role by Recanati within his conception of primary pragmatic processes, conceived as a type of associative process. I intend to show that Recanati’s considerations on schemata may challenge the relevance theorist’s argument against associative explanations in pragmatics, and support an argument in favor of associative (versus inferential) explanations. More generally, associative relations can be shown to be schematic, that is, they have enough structure to license inferential effects without any appeal to (...) genuine inferential processes. Associative processes are thus able to explain a number of pragmatic and linguistic phenomena which have instead been thought to require specialized inferential processes. (shrink)

Debates on situated affectivity have mainly focused on tools that exert some positive influence on affective experience. Far less attention has been paid to artifacts that interact with the expression of affect, or to those that exert some negative influence. To shed light on that shadowy corner of our affective social lives, I describe the workings of an atypical socio-affective artifact, namely, sunglasses. Drawing on insights from psychology and other social sciences, I construe sunglasses as a social shield that helps (...) us block spontaneous emotional expressions, as well as affecting other social processes that heavily depend on the eye region: gaze direction detection, identity recognition, and the sense of intimacy afforded by eye contact. Research on organizational epistemic vice alleges that some organizations are epistemically malevolent, i.e. they habitually harm others by deceiving them. Yet, there is a lack of empirical research on epistemic malevolence. We connect the discussion of epistemic malevolence to the empirical literature on organizational deception. The existing empirical literature does not pay sufficient attention to the impact of an organization’s ability to control compromising information on its deception strategy. We address this gap by studying eighty high-penalty corporate misconduct cases between (...) 2000 and 2020 in the United States. We find that organizations use two different strategies to deceive: Organizations ‘sow doubt’ when they contest information about them or their impacts that others have access to. By contrast, organizations ‘exploit trust’ when they deceive others by obfuscating, concealing, or falsifying information that they themselves control. While previous research has focused on cases of ‘sowing doubt’, we find that organizations ‘exploit trust’ in the majority of cases that we studied. This has important policy implications because the strategy of ‘exploiting trust’ calls for a different response from regulators and organizations than the strategy of ‘sowing doubt’. (shrink)

In considering what it means to lead organizations effectively and ethically, the literature comprising spirituality at work and spiritual leadership theory has become highly influential, especially in the USA. It has also attracted significant criticism. While in this paper, we endorse this critique, we argue that the strand of literature which purportedly takes a Christian standpoint within the wider SAW school of thought, largely misconstrues and misapplies the teaching of its founder, Jesus. As a result, in dismissing the claims and (...) application of SAW and SLT, there is a real risk that we lose the vital contribution of Christian thought, not least some of the timeless counter-cultural wisdom of Jesus which, we contend, offers a vital foundation to the practice of ethical leadership and business ethics in organizations. In proposing a way forward, two thorny issues which face all leaders are addressed: dealing with ego and closing the gap between what we say and what we do. The more we understand about the dynamics of human nature, the more we learn about the profundity of Jesus’ teachings. We then propose a number of ways in which Jesus-centred ethical leadership can be practised. Each is radical and each implies risk: both the personal risk of inner renewal arising from repentance as a doorway to personal integrity, as well as the risk of opposing unethical practices and promoting the excellence of core practices in the workplace. This article provides a contribution to the concept of a peace ethics which understands human peacemaking as a churchly practice accepting and joining in God's reconciling works. From a pacifist stance, the author argues that ecclesial ethics allows a forceful reframing of the just war tradition as it is developed in the largely unknown Reformed confessions of the l61 h century. A theological exploration of the peace church's pathos drives the author towards a rediscovery of the church's central worshiping practices, (...) such as eucharist, as distinctively peacemaking practices. Between 1909 and 1913, Berlin’s Museum für Naturkunde (Berlin Museum of Natural History) unearthed more than 225 tons of fossils in former German East Africa and transported them to Berlin. Among them were the bones of Brachiosaurus brancai, which would eventually become the biggest mounted dinosaur in the world. By analyzing the social and communicative strategies that made this expedition possible, this paper aims to reveal several aspects of natural history knowledge production at the end of the long nineteenth century. Using rhetoric, the director of the Geological–Paleontological Museum in Berlin, Wilhelm von Branca, conducted a highly successful campaign to market the dinosaurs in Prussia and to convince public opinion and the Prussian central state of the value of paleontology. He fired the Prussian imagination and took advantage of the competitive urge to emulate American paleontology and industry. This work examines how his public relations strategies shaped the German biological “landscape” of the first decades of the twentieth century. It asks: when and under what conditions did paleontology successfully appeal to the public? How does communication dictate, shape, and constrain the development of a specific epistemic agenda? Nous étudions cette bibliographie comme le témoignage d’un moment charnière du marché du livre de commerce : celui où il renaît après la tourmente révolutionnaire.

Global environmental problems, such as global warming, pollution, or deforestation, are critical issues that require a rapid and common response. In this context, companies play a decisive role in achieving environmental objectives through the ecological knowledge they can store and manage. In this context, the present research focuses its interest on analyzing how the set of green intangibles possessed by organizations, i.e., Green Intellectual Capital, affects their Green Performance. Specifically, the study shows how GP is influenced by GIC through the (...) mediating role of the Green Innovation variable. Therefore, the research questions to be answered by this study are as follows: Does GIC influence environmental performance? Does GI mediate the GIC-GP relationship? What actions can companies take to improve their GP? There are several reasons that have led us to carry out this research. First, there is little empirical evidence of the relationships proposed in this study. Second, to the best of our knowledge, there is no previous research that has contextualized the relationships raised in the wine industry, thus representing an advance in the comprehension of the constructs studied. Third, GIC represents an incipient field of study that needs to be developed and established within the literature linked to Intellectual Capital. In order to achieve the proposed objectives, data from a survey of 202 wineries in Spain were used and a quantitative approach was followed using Structural Equation Modeling. The results of the research indicate that there is a positive and significant relationship between GIC and GP. In addition, GI partially mediates the relationship between these two variables, playing a key role in the environmental management of wineries. The theoretical and practical contributions of the study improve the understanding of the relationships raised, being a pioneering study due to its contextualization in the wine industry, as well as providing a series of guidelines for both environmental managers and winemakers to improve their GP. One of the most important devices in the management and control of our global societies is the scenario-planning. In this regard, this paper analyses the impact that the massive use of these devices implies to our society. Specifically, it is used as an analytical approach the concepts of difference, différance and destituent power. These theoretical proposals, which have been regarded as important dimensions of resistance and liberation, paradoxically are relevant to understanding the operation of the scenario-planning. Therefore, this paper warns (...) of the need to try new forms-of-thought that allow us to overcome the danger of our best philosophy captured by new machines of control. Uno de los dispositivos más utilizados en la gestión y control de nuestras actuales sociedades globales son las técnicas de construcción de escenarios. En este sentido, el presente artículo analiza el impacto que la utilización masiva de estos dispositivos entraña para nuestra sociedad. Específicamente, se utilizará como enfoque analítico el concepto de diferencia de Deleuze, la différance de Derrida y lo destituyente en Agamben. Dichas propuestas teóricas, que permanentemente han sido consideradas como dimensiones de resistencia, subversión y liberación, se muestran paradójicamente pertinentes para comprender el funcionamiento de las técnicas de construcción de escenarios ficcionales. Por ende, el presente art&iacut e la necesidad de ensayar nuevas formas-de-pensamiento que nos permitan sortear el peligro de fagocitación de nuestra mejor filosofía por parte de nuevas maquinarias de control. Starting from a debate which took place at the beginning of the twenty-first century between Jean Clair and Arthur C. Danto, we will focus on the link between art and disgust, because we wish to show what art is now ‘doing’ with disgust. Our hypothesis is that art is part of the general process of self-reshaping that is underway in today’s capitalist societies. Therefore, by commenting Aurel Kolnai’s phenomenological analysis of disgust, we will gain the tools to try to show (...) how disgust could be a crucial factor in the above process. Finally, we will recall the work of artists such as Pasolini, Nebreda, and McCarthy, in order to suggest how art could use disgust and have an actual political effect by orienting that process. We consider algebras on binary relations with two main operators: relational composition and dynamic negation. Relational composition has its standard interpretation, while dynamic negation is an operator familiar to students of Dynamic Predicate Logic (DPL) (Groenendijk and Stokhof, 1991): given a relation R its dynamic negation R is a test that contains precisely those pairs (s,s) for which s is not in the domain of R. These two operators comprise precisely the propositional part of DPL.This paper contains a finite equational (...) axiomatization for these dynamic relation algebras. The completenessresult uses techniques from modal logic. We also lookat the variety generated by the class of dynamic relation algebras and note that there exist nonrepresentable algebras in this variety, ones which cannot be construedas spaces of relations. Abstract The aim of the paper is to reassess the role of British Aristotelianism within the history of early modern logic between the sixteenth and seventeenth centuries, as a crucial moment of cultural transition from the model of humanistic rhetoric and dialectic to that of facultative logic, that is, a logic which concerns the study of the cognitive powers of the mind. The paper shows that there is a special connection between Paduan Aristotelianism and British empiricism, through the mediation of (...) British Aristotelianism. British Aristotelians took the ideas of the Paduan Aristotelian tradition and carried them to an extreme, gradually removing them from the original Aristotelian context in which they were grounded and developing what would later become the fundamental ideas of British empiricism. This perspective paper aims at discussing theoretical principles that could explain how emotion regulation and physical diseases mutually influence each other in the context of borderline personality disorder (BPD). Furthermore, this paper discusses the clinical implications of the functional relationships between emotion regulation, BPD and medical conditions considering dialectical behavior therapy (DBT) as a well-validated therapeutic intervention, which encompasses these issues. The inflexible use of maladaptive emotion regulation strategies (e.g., suppression, experiential avoidance, and rumination) might directly increase the probability of (...) developing physical diseases through a physiological pathway, or indirectly through a behavioral pathway. Some metabolic and chronic medical conditions could significantly impact emotional functioning through biological alterations involved in emotion regulation. Several empirical studies have shown high co-occurrence rates between BPD and several chronic physical diseases, especially ones linked to emotion-based maladaptive behaviors. DBT addresses physical diseases reported by individuals with BPD reducing problematic behaviors functionally associated to emotion dysregulation and identifying physical health as a goal forBuilding a Life Worth Living. In their attempt to connect the workings of the human mind with their neural realizers, cognitive neuroscientists often bracket out individual differences to build a single, abstract model that purportedly represents (almost) every human being’s brain. In this paper I first examine the rationale behind this model, which I call ‘Platonic Brain Model’. Then I argue that it is to be surpassed in favor of multiple models allowing for patterned inter-individual differences. I introduce the debate on legitimate (and illegitimate) ways (...) of mapping neural structures and cognitive functions, endorsing a view according to which function-structure mapping is context-sensitive. Building on the discussion of the ongoing debate on the function(s) of the so-called Fusiform “Face” Area, I show the necessity of indexing function-structure mappings to some populations of subjects, clustered on the basis of factors such as their expertise in a given domain.
