This article presents the recent literature about the church Nossa Senhora da Consolação, considered through the prism of the study of sacred art. After a historical overview about the neighborhood and the ancient temple of Consolation, will be highlighted some most relevant artistic aspects of architecture and works of art gathered in the sacred building, designed by German engineer Maximilian Emil Hehl, whose inspiration reports to the formal and stylistic features of Romanesque architecture as well as the influences of eclecticism (...) with a predominance of Romanesque Revival architecture and Gothic Revival in São Paulo in the early twentieth century. We investigate the major mathematical theories of space from a modal standpoint: topology, affine geometry, metric geometry, and vector algebra. This allows us to see new fine-structure in spatial patterns which suggests analogies across these mathematical theories in terms of modal, temporal, and conditional logics. Throughout the modal walk through space, expressive power is analyzed in terms of language design, bisimulations, and correspondence phenomena. The result is both unification across the areas visited, and the uncovering of interesting new questions.

Terms of service of on-line platforms too often contain clauses that are potentially unfair to the consumer. We present an experimental study where machine learning is employed to automatically detect such potentially unfair clauses. Results show that the proposed system could provide a valuable tool for lawyers and consumers alike.

In combating the ongoing global health threat of the COVID-19 pandemic, decision-makers have to take actions based on a multitude of relevant health data with severe potential consequences for the affected patients. Because of their presumed advantages in handling and analyzing vast amounts of data, computer systems of algorithmic decision-making are implemented and substitute humans in decision-making processes. In this study, we focus on a specific application of ADM in contrast to human decision-making, namely the allocation of COVID-19 vaccines to (...) the public. In particular, we elaborate on the role of trust and social group preference on the legitimacy of vaccine allocation. We conducted a survey with a 2 × 2 randomized factorial design among n = 1602 German respondents, in which we utilized distinct decision-making agents and prioritization of a specific social group as design factors. Our findings show that general trust in ADM systems and preference for vaccination of a specific social group influence the legitimacy of vaccine allocation. However, contrary to our expectations, trust in the agent making the decision did not moderate the link between social group preference and legitimacy. Moreover, the effect was also not moderated by the type of decision-maker. We conclude that trustworthy ADM systems must not necessarily lead to the legitimacy of ADM systems. (shrink)

Embodiment and embeddedness define an attractive framework to the study of cognition. I discuss whether theory of mind, i.e. the ability to attribute mental states to others to predict and explain their behaviour, fits these two principles. In agreement with available evidence, embodied cognitive processes may underlie the earliest manifestations of social cognitive abilities such as infants’ selective behaviour in spontaneous-response false belief tasks. Instead, late theory-of-mind abilities, such as the capacity to pass the (elicited-response) false belief test at age (...) four, depend on children’s ability to explain people’s reasons to act in conversation with adults. Accordingly, rather than embodied, late theory-of-mind abilities are embedded in an external linguistic practice. (shrink)

. This paper investigates the mechanisms of knowledge production of twenty-first century robotics-inspired morphology. How robotics influences investigations into the structure, development, and change of organic forms? Which definition of form is presupposed by this new approach to the study of form? I answer these questions by investigating how robots are used to understand and generate new questions about the locomotion of extinct animals in the first case study and in high-performance fishes in the second case study. After having illustrated (...) the landscape of twentieth-century morphology, I will reflect on the definition of form adopted in twenty-first century robotics-inspired morphology as well as on the differences between this approach to the study of form and the so-called nature-inspired disciplines, such as bionics or biomimetics. In the conclusion, I suggest that we are now in a material turn in morphology, characterized by the coexistence of the robotic, the virtual, and the real, which enables an understanding of how the structures and dynamics of shapes change over time. In Unfit for the Future, Ingmar Persson and Julian Savulescu present a sophisticated argument in defense of the imperative of moral enhancement. They claim that without moral enhancement, the future of humanity is seriously compromised. The possibility of ultimate harm, caused by a dreadful terrorist attack or by a final unpreventable escalation of the present environmental crisis aggravated by the availability of cognitive enhancement, makes moral enhancement a top priority. It may be considered optimistic to think that our present moral (...) capabilities can be successfully improved by means of moral education, moral persuasion, and fear of punishment. So, without moral enhancement, drastic restrictions on human freedom would become the only alternative to prevent those dramatic potential outcomes. In this article, I will try to show that we still have reason to be less pessimistic and that Persson & Savulescu’s arguments are fortunately unconvincing. (shrink)

The present paper attempts to show that a 1915 article by Erich Kretschmann must be credited not only for being the source of Einstein’s point-coincidence remark, but also for having anticipated the main lines of the logical-empiricist interpretation of general relativity. Whereas Kretschmann was inspired by the work of Mach and Poincaré, Einstein inserted Kretschmann’s point-coincidence parlance into the context of Ricci and Levi-Civita’s absolute differential calculus. Kretschmann himself realized this and turned the point-coincidence argument against Einstein in his second (...) and more famous 1918 paper. While Einstein had taken nothing from Kretschmann but the expression “point-coincidences”, the logical empiricists, however, instinctively dragged along with it the entire apparatus of Kretschmann’s conventionalism. Disappointingly, in their interpretation of general relativity, the logical empiricists unwittingly replicated some epistemological remarks Kretschmann had written before General Relativity even existed. Anthony Kenny e Orlando Todisco, in due diversi contesti, hanno proposto un originale accostamento tra Wittgenstein e alcuni filosofi francescani. Alla luce di questi studi è possibile chiedersi quale valore possa avere la nozione di francescanesimo wittgensteiniano e quale utilità essa ricopra nell’identificare i caratteri di una filosofia francescana. Nella prima parte considererò l’atteggiamento di Kenny nei confronti di Duns Scoto, le cui tesi, dapprima frettolosamente associate a quelle del neopositivismo, vengono poi adeguatamente contestualizzate all’interno della contrapposizione tra la tradizione (...) neoplatonica-agostiniana e l’aristotelismo radicale nell’Università di Parigi. Nella seconda parte, analizzerò il parallelo suggerito da Todisco tra Wittgenstein e Occam, con particolare attenzione alla filosofia del linguaggio, alla critica alla metafisica e alla nozione di ineffabilità. Dopo aver evidenziato i limiti storiografici di entrambe queste proposte, concluderò sostenendo che il francescanesimo wittgensteiniano non può essere considerato un progetto di ricerca autonomo capace di stabilire delle tesi comuni. Esso comunque non è una mera provocazione, in quanto offre interessanti considerazioni circa una affine modalità di porsi gli interrogativi filosofici da parte di Wittgenstein e dei filosofi francescani. Questo esito permette di identificare alcune condizioni necessarie perché si possa parlare di una filosofia francescana all’interno della storia della filosofia. In two very different contexts, Anthony Kenny and Orlando Todisco have proposed an original combination between Wittgenstein and some Franciscan thinkers. Thanks to their studies it is possible to question the value and the usability of the expression Wittgensteinian Franciscanism in order to identify the features of a Franciscan philosophy. In the first paragraph, I will take the approach of Kenny about Duns Scotus into consideration. At the beginning of his career, Kenny hastily associates Scotus’ theses to the Neo-Positivistic ones, but in his mature works, Kenny adequately contextualizes them within the contrast between, on the one hand, the Neoplatonic-Augustinian tradition and, on the other, the radical Aristotelism held at the Paris University. In the second paragraph, I will study in depth the parallelism suggested by Todisco between Wittgenstein and Occam, paying particular attention to the philosophy of language, to the criticism toward some types of metaphysics, and to the notion of ineffability. After having underlined the historiographic limits of both of these proposals, I will conclude arguing that Wittgensteinian Franciscanism cannot be appreciated as an autonomous research project able to establish common theses. All the same, it is not a mere provocation, in fact it presents interesting considerations about analogous modalities to submit philosophical questions shared between Wittgenstein and Franciscan thinkers. This outcome allows to distinguish some necessary conditions in order to identify a Franciscan philosophy in the history of Western thought. (shrink)

The main target of this paper is to provide a basis for the thesis that the core of Aristotle’s theory of human agency lies in the fact that the agent is in a relevant sense able to do otherwise. To this effect, a distinction is drawn between Aristotelian theory of action, and his moral psychology. The former is taken to be governed by the notion of a power to choose between contraries when the agent is about to do something, whereas (...) the latter is focused on the notion of character, which imposes fixity and regularity to the agent’s actions. The distinction proposed is reached at by means of a reappraisal of NE 1112a31-33, passage in which Aristotle declares that (practical) intellect is a cause alongside nature, chance, and necessity. In lieu of an abstract, here is a brief excerpt of the content:Many scholars have contended that Clare of Assisi’s original intention upon leaving her family home to take up religious life sometime around 1211 was to lead a life essentially like that of the mendicant friars.1 She and the women who soon joined her would be not only poor and penitential, but also itinerant and apostolic. Like the friars their life would be marked by both insertion into the world (...) and seclusion from it as they alternated between active service and recollected contemplation. The important proof text for this claim is a passage in a letter composed by Jacques de Vitry in 1216, just five years after Clare’s conversion. Many scholars, including Paul Sabatier, Luigi Pellegrini, Roberto Rusconi, Marco Bartoli, Ingrid Peterson, Chiara Frugoni, Giovanni Boccali, and Chiara Augusta Lainati believe the text to be the earliest witness to the manner of life led by Clare and her followers during their initial years.2 The letter has been used to argue further that the women were explicitly grouped together with the Lesser Brothers, were known by the parallel title of “Lesser Sisters,” and had the freedom to come and go as they wished during their early years in San Damiano.Since claims about the women’s early likeness to the friars’ mendicant way of life are often made as brief assertions resting on Jacques’s letter, I think it important to consider in a more detained fashion the provocative passage thought to support them. Closer scrutiny of Jacques’s text shows that while none of these claims can be entirely ruled out, importantly, none can be supported with any solid evidence. I agree essentially with scholars such as Lilly Zarncke, Ernest McDonnell, Maria Pia Alberzoni, Jacques Dalarun, and Lezlie Knox who consider the letter’s language too general to know if it refers specifically to Clare and her sisters.3 I suggest, furthermore, that there are reasons to conclude that this is certainly unlikely if the passage is interpreted to mean, specifically, that Clare and her sisters carried on an active apostolate outside of San Damiano.Jacques de Vitry is generally recognized as one of the most astute and forward-thinking observers of his time in terms of recognizing the importance of new religious groups. A Parisian master, canon regular, and bishop, Jacques had the opportunity to live in a variety of settings, including his native France, the Low Countries, Italy, and the holy land.4 In 1216, he traveled from Liège in the Low Countries to Perugia to be consecrated bishop by Honorius III, who himself had just been elevated to the papacy.5 Along with observations about other matters, Jacques shared the following comment about religious men and women in a letter that he sent almost certainly to a group of his friends back in Liège. He was writing in the early days of October 1216 as he was leaving Italy on a boat that would carry him to his new episcopal see in Acre. The letter, the first of six that survive, is prized not only for its reference to the Lesser Sisters, but also as the very first written testimony regarding the Franciscan movement in general. The great nineteenth-century historian Paul Sabatier thought it provided a more vivid and precise description of Francis’s ministry than any single passage contained in his early biographies.6 The passage, which represents less than seven percent of the entire letter, is rendered thus in a widely available English translation:I found one consolation in those parts, nevertheless: many men and women [multi enim utriusque sexus], rich and worldly, after renouncing everything for Christ, fled the world. They are called Lesser Brothers and Lesser Sisters [fratres minores et sorores minores]. They are held in great esteem by the Lord Pope and the cardinals. In his 1916 review paper on general relativity, Einstein made the often-quoted oracular remark that all physical measurements amount to a determination of coincidences, like the coincidence of a pointer with a mark on a scale. This argument, which was meant to express the requirement of general covariance, immediately gained great resonance. Philosophers such as Schlick found that it expressed the novelty of general relativity, but the mathematician Kretschmann deemed it as trivial and valid in all spacetime theories. With the (...) relevant exception of the physicists of Leiden (Ehrenfest, Lorentz, de Sitter, and Nordström), who were in epistolary contact with Einstein, the motivations behind the point-coincidence remark were not fully understood. Only at the turn of the 1960s did Bergmann (Einstein’s former assistant in Princeton) start to use the term ‘coincidence’ in a way that was much closer to Einstein’s intentions. In the 1980s, Stachel, projecting Bergmann’s analysis onto his historical work on Einstein’s correspondence, was able to show that what he started to call ‘the point-coincidence argument’ was nothing but Einstein’s answer to the infamous ‘hole argument’. The latter has enjoyed enormous popularity in the following decades, reshaping the philosophical debate on spacetime theories. The point-coincidence argument did not receive comparable attention. By reconstructing the history of the argument and its reception, this paper argues that this disparity of treatment is not justified. This paper will also show that the notion that only coincidences are observable in physics marks every critical step of Einstein’s struggle with the meaning of coordinates in physics. (shrink)

The growing cultural complexity in the face of new immigration waves influences the public understanding of religious diversity. The two central questions of this article are as follows: first, ‘how much religious difference and of what kind is compatible within Europe?’ and second, ‘to what extent can Muslim diversity be integrated into Europe?’. This article undertakes an investigation of these questions and explores the extent to which discourses on religious diversity imply boundary making and aim at limiting the religious freedom (...) of Muslims. Empirically, I scrutinize press coverage between 2009 and 2010, the years in which the minarets ban entered the sociopolitical arena of European public debate. The methodology adopts a social network analysis to uncover semantic macro-structures and elicit common discourses in the press of France, Germany, Italy and the United Kingdom. Subsequently, discourse analysis of relevant samples is applied to examine textual strategies used to legitimate inclusion or exclusion of religious difference. (shrink)

Although somewhat neglected in the scholarly debate, Vṛṣabhadeva’s commentary (known as Sphuṭākṣarā or Paddhati, possibly 8th c. CE) on Vākyapadīya’s first chapter, offers a remarkable analysis of Bhartṛhari’s views on metaphysics and philosophy of language. Vākyapadīya’s first four kārikās deal with ontological issues, defining the key elements of Bhartṛhari’s non-dualistic edifice such as the properties of the unitary principle, its powers, the role of time and the ontological status of worldly objects. Vṛṣabhadeva’s interpretation of the kārikās in question is intriguing (...) and seems to be guided by the urgency to find a solution to the riddle which every non-dualistic theory has to face: how is it possible to postulate a unitary principle of reality when reality is cognized as multiple? In accomplishing the task Vṛṣabhadeva proposes various solutions (some of them based on concepts which are hardly detectable in Vākyapadīya and appear close to the ones propounded in certain trends of Advaita Vedānta), finally suggesting an explanation which, focusing on the pragmatic aspect of language, is altogether consistent with Bhartṛhari’s theoretical picture. The age at which children acquire the concept of belief is a subject of debate. Many scholars claim that children master beliefs when they are able to pass the false belief test, around their fourth year of life. However, recent experiments show that children implicitly attribute beliefs even earlier. The dispute does not only concern the empirical issue of discovering children’s early cognitive abilities. It also depends on the kind of capacities that we associate to the very concept. I claim (...) that concept possession must be understood in terms of the gradual development of the abilities that underlie the concept in question. I also claim that the last step to possess the concept of belief requires children to understand how beliefs and desires are used in everyday explanations of people’s actions. Thus, I suggest that understanding folk psychology as an explanatory theory is what children lack when they fail the false belief test. (shrink)

Debates on the moral status of human embryos have been highly and continuously controversial. For many, these controversies have turned into a fruitless scholastical endeavor. However, recent developments and insights in cellular biology have cast further doubt on one of the core points of dissent: the argument from potentiality. In this article we want to show in a nonscholastical way why this argument cannot possibly survive. Getting once more into the intricacies of status debates is a must in our eyes. (...) Research on organizational epistemic vice alleges that some organizations are epistemically malevolent, i.e. they habitually harm others by deceiving them. Yet, there is a lack of empirical research on epistemic malevolence. We connect the discussion of epistemic malevolence to the empirical literature on organizational deception. The existing empirical literature does not pay sufficient attention to the impact of an organization’s ability to control compromising information on its deception strategy. We address this gap by studying eighty high-penalty corporate misconduct cases between (...) 2000 and 2020 in the United States. We find that organizations use two different strategies to deceive: Organizations ‘sow doubt’ when they contest information about them or their impacts that others have access to. By contrast, organizations ‘exploit trust’ when they deceive others by obfuscating, concealing, or falsifying information that they themselves control. While previous research has focused on cases of ‘sowing doubt’, we find that organizations ‘exploit trust’ in the majority of cases that we studied. This has important policy implications because the strategy of ‘exploiting trust’ calls for a different response from regulators and organizations than the strategy of ‘sowing doubt’. (shrink)

In 1912, Ernst Cassirer contributed to the special issue of the Kant-Studien that honored Hermann Cohen's retirement—his mentor and teacher, and the recognized founding father of the so-called 'Marburg school' of Neo-Kantianism. In the context of an otherwise rather conventional presentation of Cohen's interpretation of Kant, Cassirer made a remark that is initially surprising. It is “anything but accurate,” he wrote, to regard Cohen's philosophy as focused “exclusively on the mathematical theory of nature,” as is usually done. This research examines the necessary condition of emotions in predicting consumer ethical decision-making, using a new multiplicative method for identifying and measuring the necessary condition in data sets—Necessary Condition Analysis (NCA). Based on a sample of over four hundred individuals, and combining three different consumption scenarios involving ethical issues, our findings demonstrate that emotions are a necessary condition for consumer ethical decisions and behaviours. In addition, the results show that higher levels of consumer ethical decisions can only be achieved if (...) happiness, gladness and satisfaction increase towards a minimum level of necessity. The findings provide empirical support for the essential role of emotions in predicting consumer ethical decision-making. Furthermore, this research identifies the emotional thresholds without which ethical choices cannot occur and then explains why individuals sometimes behave ethically but other times do not. In addition, this is a first contribution applying NCA to consumer ethics. (shrink)

Between 1909 and 1913, Berlin’s Museum für Naturkunde (Berlin Museum of Natural History) unearthed more than 225 tons of fossils in former German East Africa and transported them to Berlin. Among them were the bones of Brachiosaurus brancai, which would eventually become the biggest mounted dinosaur in the world. By analyzing the social and communicative strategies that made this expedition possible, this paper aims to reveal several aspects of natural history knowledge production at the end of the long nineteenth century. Using rhetoric, the director of the Geological–Paleontological Museum in Berlin, Wilhelm von Branca, conducted a highly successful campaign to market the dinosaurs in Prussia and to convince public opinion and the Prussian central state of the value of paleontology. He fired the Prussian imagination and took advantage of the competitive urge to emulate American paleontology and industry. This work examines how his public relations strategies shaped the German biological “landscape” of the first decades of the twentieth century. It asks: when and under what conditions did paleontology successfully appeal to the public? How does communication dictate, shape, and constrain the development of a specific epistemic agenda? While there is convincing evidence that preverbal human infants and non-human primates can spontaneously represent number, considerable debate surrounds the possibility that such capacity is also present in other animals. Fish show a remarkable ability to discriminate between different numbers of social companions. Previous work has demonstrated that in fish the same set of signature limits that characterize non-verbal numerical systems in primates is present but yet to provide any demonstration that fish can really represent number rather than basing their (...) discrimination on continuous attributes that co-vary with number. In the present work, using the method of 'item by item' presentation, we provide the first evidence that fish are capable of selecting the larger group of social companions relying exclusively on numerical information. In our tests subjects could choose between one large and one small group of companions when permitted to see only one fish at a time. Fish were successful when both small (3 vs. 2) and large numbers (8 vs. 4) were involved and their performance was not affected by the density of the fish or by the overall space occupied by the group. This paper argues that the path integral formulation of quantum mechanics suggests a form of holism for which the whole (total ensemble of paths) has properties that are not strongly reducible to the properties of the parts (the single trajectories). Feynman’s sum over histories calculates the probability amplitude of a particle moving within a boundary by summing over all the possible trajectories that the particle can undertake. These trajectories and their individual probability amplitudes are thus necessary in calculating the total (...) amplitude. However, not all possible trajectories are differentiable, thus suggesting that they are not physical possibilities, but only mathematical entities. It follows that if the possible differentiable trajectories are taken to be part of the physical system, they are not sufficient to calculate the total probability amplitude. The conclusion is that the total ensemble is weakly non-supervenient upon the physically possible trajectories. (shrink)

This book fills a major gap in the ever-increasing secondary literature on Hannah Arendt's political thought by providing a dedicated and coherent treatment of the many, various and interesting things which Arendt had to say about law. Often obscured by more pressing or more controversial aspects of her work, Arendt nonetheless had interesting insights into Greek and Roman concepts of law, human rights, constitutional design, legislation, sovereignty, international tribunals, judicial review and much more. This book retrieves these aspects of her (...) legal philosophy for the attention of both Arendt scholars and lawyers alike. The book brings together lawyers as well as Arendt scholars drawn from a range of disciplines (philosophy, political science, international relations), who have engaged in an internal debate the dynamism of which is captured in print. Following the editors' introduction, the book is split into four Parts: Part I explores the concept of law in Arendt's thought; Part II explores legal aspects of Arendt's constitutional thought: first locating Arendt in the wider tradition of republican constitutionalism, before turning attention to the role of courts and the role of parliament in her constitutional design. In Part III Arendt's thought on international law is explored from a variety of perspectives, covering international institutions and international criminal law, as well as the theoretical foundations of international law. Part IV debates the foundations, content and meaning of Arendt's famous and influential claim that the 'right to have rights' is the one true human right. (shrink)

Une liste publiée sous le Consulat dormait dans un annuaire destiné aux négociants d’exportation. Établie par un libraire reconnu, elle a trouvé sa place en tête de l’ouvrage signé par un spécialiste du commerce européen. Nous étudions cette bibliographie comme le témoignage d’un moment charnière du marché du livre de commerce : celui où il renaît après la tourmente révolutionnaire.

Starting from a debate which took place at the beginning of the twenty-first century between Jean Clair and Arthur C. Danto, we will focus on the link between art and disgust, because we wish to show what art is now ‘doing’ with disgust. Our hypothesis is that art is part of the general process of self-reshaping that is underway in today’s capitalist societies. Therefore, by commenting Aurel Kolnai’s phenomenological analysis of disgust, we will gain the tools to try to show (...) how disgust could be a crucial factor in the above process. Finally, we will recall the work of artists such as Pasolini, Nebreda, and McCarthy, in order to suggest how art could use disgust and have an actual political effect by orienting that process. All this is possible, because disgust has to do with the good life. (shrink)
