Unlike most theologians of his age, Martin Bucer proved to be farsighted with respect to European affairs: In addition to his contacts within Alsace and Germany he established relations with almost every European country. It was his ecumenical attitude that always led him to mediate between the parties in the religious battles of his time. His deep commitment to the goal of reaching agreement can be traced in all his activities, works and letters. Since the first editor, Jean Rott, died (...) in 1998, Bucer's correspondence has been edited in Erlangen. This academic edition of source material provides future research with a broad basis for significant aspects of Reformation history about which very little is known. In this short paper we analyse some paradoxical aspects of France’s Foucauldian heritage: while several French scholars claim the COVID-19 pandemic is a perfect example of what Foucault called biopolitics, popular reaction instead suggests a biopolitical failure on the part of the government; One of these failures concerns the government’s inability to produce reliable biostatistical data, especially regarding health inequalities in relation to COVID-19. We interrogate whether Foucaldianism contributed, in the past as well today, towards a certain myopia in France (...) regarding biostatistics and its relation to social inequalities in health. One might ask whether this very data could provide an appropriate response to the Foucauldian question: What kind of governance of life is the pandemic revealing to us? (shrink)

Essays on a wide range of areas and topics in Asian studies for scholars looking to incorporate Asia into their worldview and teaching. The scope of issues of justice extends globally on many issues. Governance of global society therefore needs transformed institutions. A vision of global democracy assumes a relational model of self‐determination as non‐domination in the context of inclusive and stronger global institutions.

: The essay theorizes the logic of masculinist protection as an apparently benign form of male domination. It then argues that authoritarian government is often justified through a logic of masculinist protection, and that this is the form of justification for the security regime that has emerged in the United States since September 11, 2001. I argue that those who live under a security regime live within an oppressive protection racket. Most hospitals are considered charities under common law because they were established for the benefit of the public. The law granted them benefits, but also imposed duties. Under the cy-pres doctrine, if a charitable purpose becomes obsolete or incapable of being carried out, the court could modify those purposes to meet current needs of the organization and the community. Modern laws attempt to find a purpose as near as possible to original purposes set up by donors. In the case of (...) hospital conversion, some regulators say assets must be used to support hospital health care, while others say they can be used in the broad sense of health care. That has been a continuing conflict between communities and regulators.Since 1996, 30 conversion statutes have been enacted, covering hospitals, HMOs, and insurers. (shrink)

We analyze combinatorial properties of open covers of sets of real numbers by using filters on the natural numbers. In fact, the goal of this paper is to characterize known properties related to ω-covers of the space in terms of combinatorial properties of filters associated with these ω-covers. As an example, we show that all finite powers of a set R of real numbers have the covering property of Menger if, and only if, each filter on ω associated with its (...) countable ω-cover is a P + filter. Scientific endeavor is the pursuit of knowledge with the aim of advancing the welfare of all human beings. This endeavor is built on the ideology of science; thus, society relies on the integrity of the practice of science and of scientists themselves. The responsible conduct of research is the essence of good science; however, many of the pedagogical approaches used to instill integrity in science accentuate the negative rather than exemplify ideal professionalism. This paper makes an argument for the inculcation (...) of the appropriate conduct of research via a positive approach. We address the acclimation to the culture of science that supersedes diverse cultural backgrounds of students. We suggest techniques for the implementation of positive strategies and reinforce the benefit of approaching the teaching of ethical behavior as a competitive advantage. We highlight ways in which this approach can empower the individual scientist and the scientific community as a whole. Transmission of the culture of scientific professionalism formalizes the aims of an ideal scientific professional and encourages assimilation and identification as a member of the scientific profession. We purport that instilling scientific professionalism will spur responsible conduct of research. (shrink)

We argue that the proper context for understanding Collingwood’s The Principles of Art is his claim that it has bearing “upon the condition of art in England in 1937”. We thus argue that he formulated a philosophical argument that underpins avant-garde dramatic poetry and theatrical practices (Eliot, Auden and the Group Theatre), taking his interpretation of Spinoza’s Ethics 5 prop. 3 to be the book’s central thesis: it is through art that one knows, against the ‘corruption of consciousness’, what emotions (...) one feels and recognizes them as one’s own. Collingwood further believed that this could only be achieved through collaboration between the artist and the community, validating new theatrical practices involving interaction with the audience. We analyse these views in the context of England in 1937: in an era marked by the rise of Fascism and Nazism, Collingwood believed that art thus conceived could help restoring emotional support for the defense of liberal democracies. We conclude with an exploration of parallels with and divergences from the Spinozist idea of ‘mobilizing affects’ in contemporary ‘left populism’ (Mouffe). (shrink)

Theories of deliberative democracy presume too narrow an understanding of political communication. Several forms of communication additional to argument are important for political debate, especially between members of more dominant and more marginalized groups. Greeting, rhetoric, and narrative each have important functions for public acknowledgement of interlocutors and communication when premises are not shared.

After the UN Guiding Principles on Business and Human Rights were adopted in 2011, an international treaty has been being negotiated since 2014. The two instruments reveal similarities and also conflicts regarding the adequate organization of the global economy based on human rights. The focus in this article will be on the processes leading to these instruments, because they themselves mirror different understandings of governance in the field of business and human rights as well as the struggle over the power (...) of definition and legitimacy. The UNGPs were developed on the basis of global multi-stakeholder consultations, underlining legitimacy through broad inclusion. There are varying judgements as to the success of this approach. The process towards the treaty follows the traditional path of negotiations at UN level. These negotiations reveal a struggle for recognition of the legitimacy of the process itself. Both procedures have shortcomings with regard to legitimacy and show the need for a revision concerning the inclusion of stakeholders. The complementarity of a soft and hard law instrument may enhance the creation of a level playing field in the global economy, thereby strengthening human rights. (shrink)

One of the main theses defended in the Critique of Judgment – the specific aesthetic nature of an object solely consists of what is “merely subjective” – offers a wide range of points to be clarified in Kant´s third critical chief work. These includes above all the crucial question of justification of a special type of judgment based, on one hand, on a purely aesthetic satisfaction and claiming, on the other, a general approval and hence some kind of intersubjective validity: (...) a question which according to Kant only can be solved in a transcendental way, what means: on the basis of a principle a priori, universally valid for all aesthetic judgments. One of the most important structural components of this doctrine is undoubtedly Kant´s key concept of a “free play of the faculties of cognition” and the further issue of a “sensus communis aestheticus”. My purpose is to show that in these sections is stated that we have to consider, besides the particular structure of an aesthetic judgment, its specific feasibility conditions, and that in this respect Kant´s concept of an “aesthetic common sense” represents an important systematic complement addition to his transcendental argumentation strategy as a whole. Both law and medicine rely on self-regulation and codes of professionalism to ensure duties are performed in a competent, ethical manner. Unlike physicians, however, judges are lawyers themselves, so judicial oversight is also self-regulation. As previous literature has highlighted, the hesitation to report a cognitively-compromised judge has resulted in an “opensecret” amongst lawyers who face numerous conflicts of interest.Through a case study involving a senior judge with severe cognitive impairment, this article considers the unique ethical dilemmas that cognitive specialists may (...) encounter when navigating duties to patient, society, and the medical profession, without clear legal guidance.Systemic self-regulatory inadequacies in the legal profession are addressed, as well as challenges that arise when trying to preserve the trust and dignity of an incapacitated patient who must fulfill special duties to society.Ultimately, because of their unique neurological expertise and impartial assessments, we submit that allowing cognitive specialists to submit their assessments to an internal judiciary board may act as an additional check and balance to ensure the fair and competent administration of justice. A recent study showed physicians' reasoning about a realistic case to be ignorant of base rate. It also showed physicians interpreting information pertinent to base rate differently, depending on whether it was presented early or late in the case. Although these adult reasoners might do better if given hints through talk of relative frequencies, this would not prove that they had no problem of base rate neglect.

Despite becoming one of the most active research areas in organizational behavior, the field of organizational justice has stayed at a safe distance from moral questions of values, as well as from critical questions regarding the implications of fairness considerations on the status quo of power relations in today’s organizations. We argue that both organizational justice research and the managerial practices it informs lack reflexivity. This manifests itself in two possible hypocrisies of fairness. Managers may apply organizational justice knowledge but (...) fail to increase the actual levels of fairness in employment relations. Researchers, on the other hand, may claim to promote fairness through their work while actually providing managers with tools that enable or even encourage them to feed the hypocrisy of fairness identified above. As␣part of our argument, we identify three types of mechanisms managers may use to influence and manage the formation of fairness perceptions. We consider how the exercise of power is related to the potential application of organizational justice knowledge across individual, interpersonal and social levels. Our approach makes power dynamics and moral implications salient, and questions the purely subjectivist view of justice researchers that deliberately discards normative aspects. The questions opened up by considering alternative mechanisms for creating fairness perceptions have led us to formulate a research agenda for organizational justice research that takes multiple stakeholder interests, power dynamics and ethical implications into account. We believe that the fields of organizational justice and normative justice can benefit from combined research. (shrink)

Environmental Narratives in the Huainanzi and the Anthropocene analyzes the Anthropocene periodization using the Huainanzi, an eastern Eurasian text from the second century BCE. This book argues that the Anthropocene concept inhibits the transformative change needed to address global crises such as climate change and mass extinction.

São muitas e, até hoje, muito controvertidas as opiniões referentes à função e ao lugar sistemático da filosofia da história de Kant no todo do seu projeto crítico-transcendental; nem há consenso quanto à importância ou relevância filosófica dos diversos escritos em que Kant aborda e defende os seus teoremas histórico- políticos. – No presente trabalho, pretende-se interpretar a “doutrina” histórico-filosófica kantiana – não obstante o seu caráter fragmentário e até aparentemente nem sempre coerente – na perspectiva da sua possível homogeneidade (...) e compatibilidade com os elementos centrais da própria teoria-base transcendental. Isso significa, antes de mais nada, ler os respectivos teoremas não como resultados de um raciocínio dogmático baseado num saber do processo histórico, mas como um conjunto de teses e postulados baseados no mero suposto subjetivo-racional de um progresso, ou seja, na idéia não só da possibilidade mas da necessidade (subjetiva) da razão de implantar princípios racionais na história. ABSTRACT There are many different and controversial opinions about the function and the systematic place of Kant’s philosophy of history in the context of his critical-transcendental project on the whole, as well as about the philosophic relevance of his historical-political writings. – This paper aims to interpret Kant’s historical-philosophical “doctrine” – in despite of its fragmentary character and of some apparent incoherences – in the horizon of its possible homogeneity and compatibility with the central elements of the basic transcendental theory. That means, above all: read the theorems in question not as results of a dogmatic thought based on the knowledge of historical processes, but as a set of thesis and postulates based on the mere subjective- rational supposition of progress, that is, on the idea that it is not only possible, but a (subjective) need of reason to implant rational principles in history. The problems of racism and racially motivated violence in predominantly African American communities in the United States are complex, multifactorial, and historically rooted. While these problems are also deeply morally troubling, bioethicists have not contributed substantially to addressing them. Concern for justice has been one of the core commitments of bioethics. For this and other reasons, bioethicists should contribute to addressing these problems. We consider how bioethicists can offer meaningful contributions to the public discourse, research, teaching, training, policy development, and (...) academic scholarship in response to the alarming and persistent patterns of racism and implicit biases associated with it. To make any useful contribution, bioethicists will require preparation and should expect to play a significant role through collaborative action with others. (shrink)
