Riker (1982) famously argued that Arrow’s impossibility theorem undermined the logical foundations of “populism”, the view that in a democracy, laws and policies ought to express “the will of the people”. In response, his critics have questioned the use of Arrow’s theorem on the grounds that not all configurations of preferences are likely to occur in practice; the critics allege, in particular, that majority preference cycles, whose possibility the theorem exploits, rarely happen. In this essay, I argue that the critics’ (...) rejoinder to Riker misses the mark even if its factual claim about preferences is correct: Arrow’s theorem and related results threaten the populist’s principle of democratic legitimacy even if majority preference cycles never occur. In this particular context, the assumption of an unrestricted domain is justified irrespective of the preferences citizens are likely to have. (shrink)

What makes up reality, and how? What kinds of entity are fundamental to reality, and how do dependent entities depend on the fundamental ones? How does one entity metaphysically ground another? These questions are central to contemporary metaphysics. The papers in this collection, written by a new generation of metaphysicians, address these and related questions. Critics of reliability theories of epistemic justificationoften claim that the `generality problem' is an insurmountabledifficulty for such theories. The generality problem is theproblem of specifying the level of generality at which abelief-forming process is to be described for the purposeof assessing its reliability. This problem is not asintractable as it seems. There are illuminating solutionsto analogous problems in the ethics literature. Reliabilistsought to attend to utilitarian approaches to choices betweeninfinite utility streams; they also ought to attend towelfarist approaches to social (...) choice situations that donot demand full aggregation of individual welfares.These analogies suggest that the traditional `single number'approach to reliability is misguided. I argue that a newapproach – the `vector reliability' approach – is preferable.Vector reliability theories associate target beliefs withreliability vectors – that is, structured collections ofreliability numbers – and construct criteria of epistemicjustification that appeal to these vectors. The bulk of thetheoretical labor involved in a reliability account of epistemicjustification is thus transferred from picking a uniquereliability number to constructing a plausible criterionof epistemic justification. The periodic table may be seen as the most successful example of inquiry in the history of science, both in terms of practical application and theoretic understanding. As such, it serves as a model for truth as it emerges from inquiry. This paper offers a sketch of a central moment in the history of chemistry that illustrates an intuitive metamathematical construction, a model of emerging truth. The MET, reflecting the structure the surrounds the periodic table, attempts to capture the salient (...) epistemological elements that warrant truth claims based on sets of models that are progressive in light of both empirical and theoretical advance seen over time. In this paper we shall introduce a simple temporal logic suitable for reasoning about the temporal aspects of parallel universes, parallel processes, distributed systems, or multiple agents. We will use a variant of the mosaic method to prove decidability of this logic. We also show that the logic does not have the finite model property. This shows that the mosaic method is sometimes a stronger way of establishing decidability.

Self-representational theories of consciousness hold that a mental phenomenon is conscious if, and only if, it presents, among other things, itself. But in conscious perception one may lose oneself in the object perceived and not be aware of one’s perceiving. The paper develops a Brentano-inspired response to this objection. He follows Aristotle in holding that one is aware of one’s perceiving only ‘on the side’: when one perceives something one’s perception neither is nor can become observation of itself. I argue (...) that the arguments Brentano gave for this claim in Psychology from an Empirical Standpoint are wanting. However, a promising argument emerges if one takes Brentano’s conception of noticing into account. (shrink)

:Academic Medical Centers offer patient care and perform research. Increasingly, AMCs advertise to the public in order to garner income that can support these dual missions. In what follows, we raise concerns about the ways that advertising blurs important distinctions between them. Such blurring is detrimental to AMC efforts to fulfill critically important ethical responsibilities pertaining both to science communication and clinical research, because marketing campaigns can employ hype that weakens research integrity and contributes to therapeutic misconception and misestimation, undermining (...) the informed consent process that is essential to the ethical conduct of research. We offer ethical analysis of common advertising practices that justify these concerns. We also suggest the need for a deliberative body convened by the Association of American Medical Colleges and others to develop a set of voluntary guidelines that AMCs can use to avoid in the future, the problems found in many current AMC advertising practices. Merging the information from different senses is essential for successful interaction with real-life situations. Indeed, sensory integration can reduce perceptual ambiguity, speed reactions, or change the qualitative sensory experience. It is widely held that integration occurs at later processing stages and mostly in higher association cortices; however, recent studies suggest that sensory convergence can occur in primary sensory cortex. A good model for early convergence proved to be the auditory cortex, which can be modulated by visual and tactile stimulation; however, (...) given the large number and small size of auditory fields, neither human imaging nor microelectrode recordings have systematically identified which fields are susceptible to multisensory influences. To reconcile findings from human imaging with anatomical knowledge from nonhuman primates, we exploited high-resolution imaging (functional magnetic resonance imaging) of the macaque monkey to study the modulation of auditory processing by visual stimulation. Using a functional parcellation of auditory cortex, we localized modulations to individual fields. Our results demonstrate that both primary (core) and nonprimary (belt) auditory fields can be activated by the mere presentation of visual scenes. Audiovisual convergence was restricted to caudal fields [prominently the core field (primary auditory cortex) and belt fields (caudomedial field, caudolateral field, and mediomedial field)] and continued in the auditory parabelt and the superior temporal sulcus. The same fields exhibited enhancement of auditory activation by visual stimulation and showed stronger enhancement for less effective stimuli, two characteristics of sensory integration. Together, these findings reveal multisensory modulation of auditory processing prominently in caudal fields but also at the lowest stages of auditory cortical processing. (shrink)

In a recent paper, I launch an attack on a fundamental doctrine of legal positivism. I argue that nonnormative facts cannot themselves constitutively determine the content of the law. In a response published in this journal, Ram Neta defends the view that nonnormative social facts are sufficient to determine normative facts, including both moral and legal facts. Neta's paper provides a useful opportunity to address a spelled-out version of this view, which in various forms is widely held in philosophy of (...) law and other areas of philosophy. I begin by addressing Neta's attempts to show that descriptive facts can alone determine moral and legal facts. First, Neta's account of why it is wrong to break promises fails. In addition to other problems, it begs the question by taking for granted that a person's desires or other motivational states necessarily justify the actions that they motivate. Next, I turn to Neta's attempt to provide a counterexample to my view about law. In my original paper, I claim that the nature of the constitutive determination relation in the legal domain is what I call rationaldetermination. Roughly speaking, a full constitutive account of the legal facts must include reasons that explain the relation between the determining facts and the legal facts. The facts on which Neta's putative counterexample depends cannot be reasons of the required sort because they take for granted what they are supposed to explain—the way in which nonnormative social facts contribute to the content of the law. Finally, I address the larger issue of how far my argument applies to other domains. I consider and reject Neta's argument that purports to show that all normative domains have the relevant features of the legal domain. I then sketch a competing picture of some normative domains. This dissertation is concerned with normativity both as an explanatory device in the philosophy of language, logic and epistemology and as a philosophical issue in its own right. Following later Wittgenstein and Sellars, it is argued that language is normative, in the first instance because of the fact that speech acts take place within a structure of social norms and institutions. This fact is then utilized to show that important features of semantic content can be explained in terms of such (...) norms. ;This Sellarsian conception of linguistic usage as the performance of acts within a linguistic game of giving and asking for reasons, leads us to focus on inferential proprieties as central to semantic content. It is, then, natural to look at logical vocabulary, paradigmatically 'entails', as expressing the very normative relations definitive of this content. An idea of Brandom's is developed in providing a formal theory of the inferential content of logical vocabulary. Such normative-inferentialist semantic analyses are developed for a wide range of logical systems. ;A certain conception of justification also falls naturally out of this general theory of language. If asserting is an act performed within a linguistic game, then justification can be thought of as a matter of winning such a game, a successfully defending one's assertion in the face of licensed challenges to it. This account is developed, drawing consequences for the theory of rationality and knowledge. ;The second major issue of the dissertation is the theory of the normative itself and much of the constructive work in the philosophy of language, philosophy of logic and epistemology forms a case study for a particular theory of the normative. On the basis of Wittgensteinian considerations, it is argued that normativity must be understood as resting ultimately on social practice. ;We solve problems of earlier accounts of norms by introducing a novel normative relation between assertions of normative propriety and social practices. Normative assertions do not describe existing social standards, but do nonetheless derive their semantic content from those standards. This argument carried through in detail for cases of logical and epistemic vocabulary in the dissertation. (shrink)

In a recent article Richard Rorty has attempted to juxtapose Heidegger and Dewey. While finding significant points of agreement between the two, and by implication praising much of Heidegger’s work, Rorty also suggests a series of criticisms of Heidegger. The problems which Rorty finds with Heidegger can, I think, all be reduced to one basic criticism, which has two main sides. In Rorty’s view Heidegger can not really differentiate between Being and beings in the way that he wants, and thus (...) can give no sense to the word ‘Being’ other than the old metaphysical one. That is, Being and the ontological difference are metaphysical remnants, the last evaporating presence of the Platonic distinction of the real world and the apparent world. This is indicated in two ways. First, Rorty feels that Heidegger can make no real distinction between philosophy, which they both agree has ended, and ‘thinking’ in the specifically Heideggerian sense. Second, Rorty claims that it is impossible to distinguish ontic from ontological becoming. That is, the various epochs of Being which Heidegger distinguishes are, for Rorty, parasitic upon and reducible to the ordinary history of man’s activity in relation to things, material and social. As such, Heidegger’s account of ontological epochs is a species of idealistic reflection upon the history of man’s activity upon things. (shrink)

The authors examine Habermas's contribution to pedagogy, learning and classroom interaction; the relation between education, civil society and the state; forms of democracy, reason and critical thinking; and performativity, audit cultures and accountability.

In “Disentangling Conscience Protections,” in this issue of the Hastings Center Report, Nadia Sawicki offers a taxonomy of conscience protection laws (conscience clauses) that highlights the expansive protections they can offer to health professionals who refuse to provide a medical service for reasons of conscience. Conscience clauses can protect health professionals from adverse actions by public actors (such as administrative agencies, prosecutors, and government funders) or private actors (such as employers, private professional associations, and injured patients), and they can also (...) protect health professionals from being subject to adverse actions for their beliefs, their conduct, or harm that results from their conduct. This taxonomy provides an accurate description of the broad range of protections conscience clauses can offer and thereby is a valuable contribution to the scholarly literature on conscientious objection in health care. But it remains to consider whether the distinctions Sawicki identifies disentangle conscience protections beyond merely providing a taxonomy. In particular, does the taxonomy identify relevant distinctions in relation to determining whether a conscience clause is justified? (shrink)

Robert Roberts’s fourth secular and eleventh total monograph, Emotions in the Moral Life, exemplifies his characteristic insight, depth, earnestness, humanity, and religious commitment. Poised midway between Emotions: An Essay in Aid of Moral Psychology (Cambridge: Cambridge University Press, 2003) and Attention to Virtues (in progress), Emotions in the Moral Life draws on the resources Roberts has already developed for analysing emotions as concerned-based construals in order to show how such construals contribute in diverse ways to moral (and immoral) cognition, action, (...) relationships, and character. The concepts of placebos and placebo effects refer to extremely diverse phenomena. I recommend dissolving the concepts of placebos and placebo effects into loosely related groups of specific mechanisms, including (potentially among others) expectation-fulfillment, classical conditioning, and attentional-somatic feedback loops. If this approach is on the right track, it has three main implications for the ethics of informed consent. First, because of the expectation-fulfillment mechanism, the process of informing cannot be considered independently from the potential effects of treatment. Obtaining informed (...) consent influences the effects of treatment. This provides support for the authorized concealment and authorized deception paradigms, and perhaps even for outright deceptive placebo use. Second, doctors may easily fail to consider the potential benefits of conditioning, leading them to misjudge the trade-off between beneficence and autonomy. Third, how attentional-somatic feedback loops play out depends not only on the content of the informing process but also on its framing. This suggests a role for libertarian paternalism in clinical practice. (shrink)

This paper sets out an agenda for the study of the history of analytic and post-analytic political philosophy. It builds on a growing literature on the history of analytic philosophy to make three main suggestions. First, analytic philosophy arose as part of a wider shift from the developmental historicism of the nineteenth century to more modernist modes of knowledge. Second, analytic philosophy included a wide range of approaches to moral and political issues, many of which reflected distinctive concepts of analysis, (...) logic, and science. Third, analytic philosophy only became widespread when the work of Quine and Wittgenstein moved it in a more post-analytic direction. Crucially, the move toward post-analytic philosophy inspired people to rediscover and reinvent other traditions, including liberal humanism, democratic republicanism, virtue ethics, and historicism. The resulting history provides a fluid and diverse understanding of arguably the most powerful philosophical movement of the twentieth century. (shrink)

Expertise is a topic that is beginning to receive more attention in the Philosophy of Education and discussions are closely related to the epistemological debate concerning the nature of know-how which has also burgeoned in recent years within ‘mainstream’ epistemology. More specifically, this volume focuses on the relevance of expertise to professional education and practice, with the aim on shedding light on what is involved (...) in professional expertise and the implications of a sound understanding of professional expertise for professional education. Although all contributions have roots in philosophical discussion, there is an element of cross-disciplinarity among them, reflecting the advances that have been made to our understanding of expertise from psychology in particular. The rise of quantum information theory has lent new relevance to experimental tests for non-classicality, particularly in controversial cases such as adiabatic quantum computing superconducting circuits. The Leggett-Garg inequality is a “Bell inequality in time” designed to indicate whether a single quantum system behaves in a macrorealistic fashion. Unfortunately, a violation of the inequality can only show that the system is either (i) non-macrorealistic or (ii) macrorealistic but subjected to a measurement technique that happens to disturb the system. The “clumsiness” (...) loophole (ii) provides reliable refuge for the stubborn macrorealist, who can invoke it to brand recent experimental and theoretical work on the Leggett-Garg test inconclusive. Here, we present a revised Leggett-Garg protocol that permits one to conclude that a system is either (i) non-macrorealistic or (ii) macrorealistic but with the property that two seemingly non-invasive measurements can somehow collude and strongly disturb the system. By providing an explicit check of the invasiveness of the measurements, the protocol replaces the clumsiness loophole with a significantly smaller “collusion” loophole. (shrink)
